Accused Australian Citizen 'denied passport in 2002'?

Reporter No! He was an undercover agent for the blues!

AN AUSTRALIAN CITIZEN who was refused a passport by DFAT in mid-2002 became frustrated at the government for treating him differently.

According to the prosecution Zeky "Zak" Malah, 21 then planned a suicide attack on buildings accommodating either intelligence officers or foreign affairs personnel; a Sydney court was told yesterday.

The New South Wales District Court yesterday began hearing the trial of Mallah who has pleaded not guilty to charges under Australia's counter-terror laws.

Ruddock's tongue hanging out again like a dog

Malah is accused of plotting to carry out a suicide attack on the Sydney offices of the Department of Foreign Affairs and Trade (DFAT) or the Australian Security and Intelligence Organisation (ASIO), in late 2003, after he was apparently harassed by ASIO agents.

But the Crown claims he planned to kill ASIO or DFAT officers in the attack but fell short of telling the court that after the government denied him his passport they wound him up?

He also pleaded not guilty to offering to sell a video tape, typed statement and photograph of himself to an undercover police officer (who posed as a journalist), between November 2003 and December 2003.

Crown Prosecutor Desmond Fagan SC today told the court the tape and statement related to the planned attacks, and Mallah also told the undercover officer (disguised as a reporter) he wanted to kill commonwealth officers most likely trying to draw some attention to the decision made in his case?

Mr Fagan said Mallah planned the attack after DFAT refused him a passport in mid-2002.

"As a result of that refusal he developed a hostility to that department and ASIO", Fagan said.

I thought he was an Australian citizen so why did DFAT refuse him a passport in mid-2002? Seems likely that if that had not been the case then Zak would not be on trial because he was treated differently.

The trial continues.

JOHN LYONS, REPORTER:
Meet Zak Mallah. He's 18, he's an orphan, he stacks shelves in a supermarket in Sydney and he's near the top of the list of suspected terrorists in Australia?

ZAK MALLAH: Australia is my country. I'm an Australian before I say I'm a Lebanese because I was raised here all my life, I was born here, I'm an Australian. So if someone wants to ask me, "Zak, what are you?" I say "I'm an Australian brother".

REPORTER: If you believe his colleagues and some in the intelligence world in Canberra who have been watching Zak Mallah for months, he's an exuberant teenager who talks tough but has never harmed anybody and is unlikely to.

ZAK MALLAH: I've got family here and I'm looking for a job as well. I currently work at Franklins as a casual position and I was at TAFE as well and I did management and leadership. That shows that I've got education behind me backing me up.

Arrest of Zak Mallah: test case for Australia's anti-terror laws

In a joint state and federal police operation, Zak Mallah, a 20-year-old unemployed youth, was arrested in southwestern Sydney on December 3 under the Howard government's new anti-terror laws. Mallah, a Muslim, is accused of preparing to commit a terrorist act. He could be jailed for life if found guilty.

By all accounts Mallah is an unstable young man who has been disoriented by 18 months of secret police scrutiny and harassment. It appears that the Howard government has singled him out to test its blatantly anti-democratic legislation.

Suicide bomb plot: 'My target is ASIO'
By Ellen Connolly July 21, 2004

A Sydney man who was allegedly planning a suicide attack on an Australian Government building became the first person yesterday to be committed to stand trial under new federal terrorism laws.

Zeky "Zak" Mallah, 21, allegedly made a video of how he would take hostages and kill people - a tape to be played after he had died a martyr.

"This is Zak Mallah, Australian-born, Australian-bred," he said on his final recorded message, Central Local Court was told yesterday. "My target is ASIO because I strongly believe that they have mistreated many Australian citizens?

Another person who wanted attention

A stitch in time saves nine?

Jack Roach may have been found not guilty if he wasn't such an attention seeker. Imagine that this guy rang up ASIO to help them? Shame about the quick nine years he'll spend in solitary confinement and rough Ruddock want's to give Roach another quick 16 years just for good will. Lawyers know all to well that the mud sticks better when you're in the slammer especially when the public are misinformed. Obviously Roach was a couch potato who couldn't get out of his lounge chair let alone bomb an Embassy.

Top police push for court of terrorism?
By Martin Chulov March 21, 2005

Top police want a new court for terror charges?

AUSTRALIA'S top police anti-terrorism experts are lobbying for the establishment of a new court to deal exclusively with terrorist trials.

Senior police figures believe a partial switch to a civil law system like the one used in France, where cases are decided through judicial interrogation, would be more effective than trials.

Attorney-General Philip Ruddock confirmed yesterday that the Government was aware of the pitch by senior officers, but said he wanted more details before deciding whether to act.

Lawyers condemn Vic police confession tactic..

Old Melbourne gaol

Safe From Harm?

Midnight ronkers, city slickers, gunmen and maniacs, all will feature on the freakshow and I can't do nothing 'bout that, no. But if you hurt what's mine, I'll sure as hell retaliate.

Victoria's legal fraternity has condemned covert tactics employed by police to extract confessions from, [alleged], criminals.

The practice involves recruiting suspects to mock crime gangs and forcing them to reveal their, [alleged], role in past crimes. Undercover police tell them to divulge their, [alleged], criminal history because it could attract unwanted police attention.

[So they might say anything just to big note themselves in front of the gang?]

You can free the world, you can free my mind, just as long as my baby's safe from harm, tonight.

The technique, which was pioneered in Canada, has [allegedly] been successful in cracking several unsolved crimes.

I was lookin' back to see, if you were lookin' back at me, to see me lookin' back at you!

[This also reminds me of the secret, we all make mistakes and we all fall down. But usually these mistakes are made when we are getting our wisdom together.]

Victorian Law Institute president Chris Dale says it strikes at the very heart of the judicial system.

"It completely short-circuits the safeguards that operate within our system to protect people charged with crimes," he said.

Lucky dippers, crazy chancers, seems to be moving fast. What happened to the niceties of my childhood days? Well, i can't do nothing 'bout that, no. But if you hurt what's mine, I'll sure as hell retaliate.

[One way I found not to lose a secret is never to tell a secret that you want to keep. And to trust no one with it, unless you want to give yourself up. Not your mother, not your father, not your auntie, not your grandmother, not even your wife or girlfriend. Then if there is a secret you are the only one with the key.]

I was lookin' back to see, if you were? I was lookin? I was. I was lookin' back to see, if you were lookin' back at me, to see me lookin' back at you!

Victoria Police lost an appeal to suppress details of the technique.

Opposition police spokesman Kim Wells says it is a legitimate investigative practise.

"Victoria police need to use the tactics it takes to bring criminals to justice," he said.

You can free the world, you can free my mind, just as long as my baby's safe from harm tonight.

[When or if people turn on you, and you've told them about past mistakes, then you're done, if you have been spilling your guts to them, regardless of how they treat you now. Tomorrow is another day and another mood.]

Victorian police have defended the use of a covert tactic designed to trick confessions out of, [alleged], criminals.

Tell us what it is, dangerous. Friends and enemies, i find it's contagerous, and they're spreading through your system like a virus. Yes the trouble in the end it makes you anxious.

Police Association secretary Paul Mullet says it is a vital policing tactic.

"The vast majority of Victorians won't have a problem because the vast majority are innocent people going about their daily business," he said.

"It's only criminals and particularly the underworld that would have problems with this approach."

[Sorry but if you did that to anyone including politicians and the like you would most likely get a hook into some mistake they made growing up in the past. This is something everyone should be alarmed about.

Let people have their wisdom and their mistakes. Those that don't get caught and who have changed already need not be ashamed of learning because, [alleged], 'criminals' are learners.

The only secret you can ever keep is the secret you kept to yourself!]

But if you hurt what's mine. I'll sure as hell retaliate. You can free the world, you can free my mind. Just as long as my baby's safe from harm tonight.

Massive Attack: Safe From Harm (marshall, vowles, del naja, cobham, nelson).

Ed: People big note themselves too, all the time, but that doesn't mean they did it either. And that could mean a wild goose chase for police and a huge waste of taxpayers money.

Black Knight - Long way to go home
In line with the current climate of police corruption and the demise of the reform unit set up by Wood, these facts ought to have been a good reason to leave Moroney out of the package as Commissioner.

Bob down and sniff my arse
These are serious invasions of privacy and draconian laws? Where are our democratic soldiers, the lawyers and the barristers who need to take on the government in the courts? Are they plastic? Or to busy feathering their nests? Or have they been cleverly purchased by this black government. Drug test police and politicians, and have the tests independently accessed.

Come in spinner? Or Come in sinner?
"You don't have, in my view very vigilant processes. I suppose it's akin to the problem of corruption within the police," he told the ABC radio. " People say there's corruption with the police (but) do you get the police to investigate problems within their own ranks?

Deeds
I am disturbed by Governments 'actions' in relation to shuffling the police service. Clive Small seconded into Parliament like a cocky in a perch. A breach of the fundamental Separation of Powers Doctrine does not in my view allow the thought of intervening, planning, or shuffling to stack the deck of our police service. The one that suppose to be autonomous according to Lord Denning. Where the Parliamentary Secretary can ask the commissioner of police to 'report' then sack him if he is not satisfied with such report.

Truth
Who is telling the truth? Well I guess Dr. Ed. Chadbourne or Mr. Peter Ryan may have the answer to that. Dr. Chadbourne sacked by Peter Ryan and more specifically in my view because he elected deputy commissioners Dave Madden and Andrew Scipione as the best men in the service in relation to his qualifications to make a recommendation in his capacity as human resources. That is if you believe that a Dr. can be corrupted.

Honesty
What is happening between the Police Service and politics is quite extraordinary at the moment. If stand over tactics don't work tell half the truth honestly and follow the example of sheep. Another word for it is sleaze, yeah. Another word for it is workplace harassment. Another word for it is bribing a Police Officer. Another word for it is misleading Parliament.

Tele Tales
Most people I know don't buy the Daily Telegraph. Why? Because of the lies and propaganda purported by them.

Lord Denning
Interesting how a member of the Police Board Mr. Tim Priest would hold grave fears for his safety from dangerous senior police but fails to name them or have them sacked. Rather Priest resigns as if he had no powers. Could that mean what he was saying is that the Governments are also corrupt?

Corrosive
Clive Small is Bob Carr's choice for the new Police Commissioner. It could only be the case considering his, Small's special appointment into Parliament House. Small who suffers from the little person syndrome is the ideal bend over boy who gets shuffled through his corrupt actions. Rolling the legal system for him after the fact, just like his predecessor Roger the dodger Rogerson.

Black Nexus
The Separation of Powers Doctrine is nowcontaminated witharangeofcolours, now leaving us with a black shirt on a once blue bridge that crossed that thin blue line. The 'Amery and Woodham show'.

Same boat
The Premier, Bob Carr, relies on a militia. A gang of bikies and our Police Service, to show all of us he is no murderer. He should be taken to the task along with his partners in crime like Clive Small to account for those people who like my self have been maliciously assaulted and who have complained, without any service and those who cannot speak for themselves who were murdered, like Terry Falconer. Terry murdered in custody.

Good Cop
Why have our democratic institutions broken down? It's not just the criminal justice system. The Anti-Corruption Network webmaster@anti-corruption-network.org exposes the same issues. A group of white-collar workers who say they have suffered as follows:

Dangerous

Roger Rogerson, the old hero, who never faced a result in the Lanfranchi, or Huckstepp murders, was let off in my opinion when the New South Wales Government rolled the legal system (deciding what evidence to give the police prosecutor) to have the jury believe the illusion they (the Government wanted to create).Similarly, Peter Ryan facing the Police Integrity Commission for questions about his involvement in the demise of the dysfunctional reform unit. Chess in the court (rolling the legal system).

Howard rejects spy agency overhaul

War Criminal PM Morally Bankrupt So Be alert and alarmed..

[War criminal], Prime Minister John Howard has played down the need for a major overhaul of Australia's spy agencies as a result of an inquiry by former intelligence officer Phillip Flood.

Because the major overhaul has to be the "Howard Government" who "sexed up" or "made up" anything meant to be intelligent forwarded to him by Australia's spy agencies.

Federal Cabinet will today consider the findings of the inquiry into Australia's intelligence agencies?

"I don't think there is a case for any big changes, any "fundamental rearrangement"," Howard said.

So if you believed that it was your entire fault that you put too much soap powder in the washing machine, or simply overloaded it, then it would be plausible not to want to have the machine fixed?

Court hears agent posed as journalist to expose terror plot?

A Sydney court has heard that an undercover agent posed as a freelance journalist to expose a terrorist plot against Australian targets.

Tell me all you know and I will print your story so ASIO, [an Australian terrorist organisation], can come and get you? The committal hearing is now underway? The man who wanted to tell his story to a journalist?

He was blinded by the blackness of my long list of hits. He would rock me with an optical illusion, and this ain't how I thought it'd be. He just kept on keeping me in a state of total confusion..

Prosecutor Desmond Fagan told Sydney Central Court that Zak Mallah was accused of planning a terrorist attack after an undercover operative posed as a freelance journalist and offered to publish his story.

He took me for a ride, and rattled me down to my shoes, but I found out he was an undercover agent for the blues.

It is alleged Mallah told the agent he planned to buy a gun to attack officers of either the Australian Security Intelligence Organisation (ASIO), [? an Australian terrorist oraganisation], or the Department of Foreign Affairs and Trade in Sydney.

He never really needed love from any direction no, I was just an innocent bystander. He just kept getting kinkier, hook, line and sinker, just too hot to handle.

It is alleged he also planned to kill and operative and take hostages. The prosecution said Mallah sold the agent a video of himself giving reasons for the attack, and showing that he expected to be killed as a result of his actions.

He took me by storm. It must have been a season for the fools, so bad, he was an undercover agent for the blues.
