Drug rehabilitation: Threats, threats and more threats!

If you don't I will! The Australian dictator John Howard's drugs adviser calls for compulsory treatment.

Prime Minister John Howard's head adviser on drugs has called for the introduction of laws forcing users into treatment.

Major Brian Watters says it is often the case that drug users do not know what is best for them.

But a spokesperson for Citizens Against Being Forced Mr Ihave Amind Ofmyown said, "Major Watters is John Howard's adviser because he's a bully. Citizens make their own decisions about what is best for them and if you don't like that step down."

Major Watters heads the National Council on Drugs, established by the Government as part of its Tough on Drugs strategy in 1998.

He says drug users should not be given a choice as to whether they enter rehabilitation programs.

"It's a misunderstanding that people say quite often that somebody has got to want to stop before you can help them," he said.

Major Watters says he has not raised the idea with Mr Howard but hopes compulsory treatment will be a thing of the future.

However, the Federal Opposition's Justice spokesman, Daryl Melham, says the idea is a step back in time.

"It's the sort of thinking that will wipe out all the public health gains of the last 15 years," he said.

Justice Minister Chris Ellison says he does not believe drug users can be forced to seek treatment.

Howard says he wants to investigate the merits of Australia joining the United States' anti-missile program because of the potential threat of a missile attack by North Korea.

Howard says the defence system would not involve nuclear weapons."The whole system is built upon the interception of offensive material heading towards a particular country through the use of missiles or lasers or a combination, but what we're talking about is finding out if it could be of assistance to Australia," he said.

Mr Dia Logue said, "Usually offensive material heading towards a particular country comes at the expense of offensive material being thrown towards a particular country by a particular country who has lost the plot.

LUKE: Wake up John Howard this is not a movie yet. If you want to see Star Wars go to the PowerHouse Museum. You're just a bully. The only friend you got is George Bush and Tony Blair. NSW Election 2003: The Sale of Justice

The Sale of Justice - Law & Order Reforms & the NSW Election

Despite the NSW State election being less than 4 weeks away, the war on Iraq has all but drowned out the policy announcements of the major parties.

NSW Young Lawyers' Criminal Law & Human Rights Committees, however, have been concerned about the civil rights trade-offs that both major parties have been proposing (or, in the case of the Government, implementing) prior to the election.

Given the fundamental implications for the legal system of the Liberal & Labor policies in the areas of Sentencing, Bail Reform & Double Jeopardy, NSW Young Lawyers has sought to educate the community with a number of press releases on these issues over recent weeks.

Luke Brasch, representing the Criminal Law Committee, and I have spoken on radio about the concerns NSW Young Lawyers has about recent proposals (see press releases below).

So I trust that some people who, with the photos and guns guessed that a jury would quickly establish a case against a profiled person whom, you just had a picture and a history of. Common knowledge? The government knew their victims would take the blame. Not just chess in court, 'moving around the pieces', but 'putting false evidence, or not enough evidence before the jury."

Australia: Human Rights 'Framed'

Here is a quick report on our Human Rights Commission approach on Framed (the quarterly magazine of Justice Action) being banned from all NSW prisons. After 42 issues went in.

Following our successful approach to HREOC in March 2001 on the Queensland government's rejection of Framed, we went back to HREOC. It had previously resulted in almost full access to all prisons in Australia, except the NT.

This time however, Corrective Services Commissioner Ron Woodham has decided to fight back. He was sent a letter by the HREOC asking him to respond to several questions regarding the past and present distribution of Framed in NSW prisons. Instead of responding to the questions, he responded to the HREOC epilogue, "I am also happy to consider anything you may wish to put to me as to whether I should continue with this inquiry."

To this, Woodham replied 10/2/03 that:

1) "Human Rights" only exist because the Commission says so.

2) The concepts of "act" and "practice" are defined differently in different situations. (The spin begins.)

3) In this situation, they are defined by Section 3 ("an act done by or on behalf of the Commonwealth or an authority of the Commonwealth")

4) NSW jails are run under State laws, even if prisoners are inside for Federal offences, therefore the Act doesn't apply to us.

5) Even if the Act applied to us, you don't have the power to do anything about it anyway. ("In any event, the ICCPR does not found justiciable rights.")

It was Woodham's opinion that the HREOC should not continue with the inquiry.

The matter hinges on the phrase "act done by or on behalf of the Commonwealth". In order to prove that Federal prisoners are under the jurisdiction of the HREOC, they have requested statements from Federal prisoners who have been denied access to Framed because of the actions of the Department.

We sent an urgent request out to our friends in NSW prisons. Unfortunately, many of the letters were intercepted, opened, and returned.

We received independent verification that these prisoners are in the jails. Woodham may think he's headed off the requests, but some got through as evidenced by this heartwarming letter:

"I received your request this morning and I personally know 6 federal long term inmates who are all happy to help. They have signed the letter. Its our pleasure to assist JA in any way we can."

Ron Woodham, Commissioner Corrective Services stated "[this Department] does not recognise Justice Action as an advocate on correctional centre issues." He has ordered a ban on all Justice Action material inside the NSW prison system. This resulted from a request for the approval of the latest edition of Framed (the Magazine of Justice Action) to be distributed throughout NSW prisons as has occurred for the past ten years.

Academic devises scheme for low income earners to pay back fines:

I contacted Junee Correctional Centre at 10:25 AM on 26 February 03.

I asked if Mr W P was in the Jail because I received a return to sender after I mailed our client.The person I spoke to said that Mr W P was in the Jail but would not give me his location ie wing.

I asked if Mr C K was in the Jail because I received a return to sender after I mailed our client. The same person said that Mr C K was in the jail but would not give me his location ie wing.

I asked for the identification of the person I was speaking to and was told that I was not entitled to that information. I needed to verify the call and asked for a name or number to register my call because I was asked to get those details by my coordinator.

The person refused to identify themselves either by name or number. I asked to be transferred to a senior person and was refused.

The person I spoke to then hung up the phone.

I contacted Liz from your office (Ombudsman) shortly thereafter and was told by her that firstly she was unsure if the person at Junee Correctional Centre had to give me any name or number so I could verify the call I had made to them. I am dissatisfied with the result of not being able to identify the person I spoke to in relation to being able to verify the call I made.

Liz asked me to write to you in relation to what I should expect when I contact a private prison in terms of verification and identity of the person I am speaking to. The person I spoke to insisted that she was not a public servant and did not have to comply with my request, as she is an employee of a private corporation.

I am dissatisfied with the result. Can you please confirm my expectations as soon as possible? Are there these obligations as public servants, and whether these are continued obligations for a private prison?

MPs told of police corruption

Corruption and mismanagement are still entrenched in the NSW Police, and problems at the highest levels are "whitewashed", according to evidence given yesterday to a federal parliamentary committee.

In a wide-ranging attack, the former head of human resources, Edd Chadbourne, also criticised the Police Integrity Commission, saying it had a "deep-seated reluctance" to tackle either corruption or poor management.The committee also heard from a former NSW police officer that some investigators on the Wood royal commission were corrupt.

The committee is ostensibly inquiring into crime in the community, but Labor members have described the process as a "joke", saying it is aimed at damaging the NSW Government before the March election.

Dr Chadbourne also:

Attacked the legal team that represented him when he appeared before a PIC inquiry.Accused the former head of Internal Affairs, Mal Brammer, of conspiring with the legal team to set him up. Said a sensitive internal inquiry in 2001 into a police employee, who had a "close personal relationship" with the then commissioner, Peter Ryan, had been a "whitewash".

Described the Commissioner, Ken Moroney, as gutless and implied he was duplicitous.

He told the Standing Committee on Legal and Constitutional Affairs, chaired by a Liberal MP, Bronwyn Bishop, [another seriously flawed politician] that he had lost Mr Ryan's confidence in September 2001 after he gave evidence in the PIC's Operation Malta, "which embarrassed him". The legal team which had represented him at the PIC included a leading barrister, Barry Toomey, QC, and another barrister, Alison Stenmark.

But Dr Chadbourne said that at a meeting five months earlier, Mr Toomey, Ms Stenmark and Mr Brammer had discussed how they should target him. Dr Chadbourne told the committee: "Mal Brammer conspired with the police legal team to set me up as a sacrificial lamb in Operation Malta." The committee also heard allegations that a Wood royal commission investigator acted more corruptly than the subjects of its inquiry, including putting lethal heroin on to Kings Cross streets.

A former detective, Mick McGann, said he had evidence of a royal commission operation - Caesar - which targeted corrupt police at Kings Cross but led to lethal heroin flooding the streets.

He said a former NSW detective, Ray Lambie, had played him a tape last year, in which a royal commission investigator, Keiran Miller, was talking to an unnamed informant on July 21, 1996.

Mr McGann said Mr Miller told the informant that heroin had to be returned to a dealer so it could be cut down. "We can't have this as a one-to-one [purity]," Mr Miller allegedly said.

"Miller was also heard to say that [the royal commission] does not have the authority to sell drugs where people are OD'ing," Mr McGann told the committee.

"The informant ... appears worried and was told by Miller at one stage that for people to die in this fashion, that is overdosing on heroin, is manslaughter. "In listening to this side of the tape there is no reference by Miller to stopping the heroin, just cutting it down."

2,500 crooked detectives? Or a corrupt Government?
Evan Whitton: Either two things occurred. If you said you didn't join the police force to extort money from working girls, your papers were marked 'not suitable for plain clothes' and you were sent back to uniform.

How to become corruption resistant in NSW
Don't trust those who cannot prove themselves with the little amounts of trust you give them. Just because they have a letter of perceived trust doesn't mean they can be trusted.

This is not how you eat 'antisocial behaviour'
Process corruption, perjury, planting of evidence, verbals, fabricated confessions, denial of suspects rights, a solicitor to induce confessions, tampering with electronic recording equipment, framing. Generally green lighting crime, and I say Murder, including the kids who overdosed on heroin. No doubt.

Deeds
I am disturbed by Governments 'actions' in relation to shuffling the police service. Clive Small seconded into Parliament like a cocky in a perch. A breach of the fundamental Separation of Powers Doctrine does not in my view allow the thought of intervening, planning, or shuffling to stack the deck of our police service. The one that suppose to be autonomous according to Lord Denning. Where the Parliamentary Secretary can ask the commissioner of police to 'report' then sack him if he is not satisfied with such report.

Australia's Political Underworld...& their enforcers
The promotion of law and order means money to big business. Profits from insurance, security fixtures, patrol services and the like can only continue to grow if the perceived threat of uncontrollable crime wave escalates. In the past few months there have been many examples of the true nature of our blood thirsty politicians and their sinister attempts to spoon-feed a not so gullible public with their repetitious rhetoric.

Truth
Who is telling the truth? Well I guess Dr. Ed. Chadbourne or Mr. Peter Ryan may have the answer to that. Dr. Chadbourne sacked by Peter Ryan and more specifically in my view because he elected deputy commissioners Dave Madden and Andrew Scipione as the best men in the service in relation to his qualifications to make a recommendation in his capacity as human resources.That is if you believe that a Dr. can be corrupted.

Honesty
What is happening between the Police Service and politics is quite extraordinary at the moment. If stand over tactics don't work tell half the truth honestly and follow the example of sheep. Another word for it is sleaze, yeah. Another word for it is workplace harassment. Another word for it is bribing a Police Officer. Another word for it is misleading Parliament.

Most people I know don't buy the Daily Telegraph. Why? Because of the lies and propaganda purported by them.

Lord Denning
Interesting how a member of the Police Board Mr. Tim Priest would hold grave fears for his safety from dangerous senior police but fails to name them or have them sacked. Rather Priest resigns as if he had no powers. Could that mean what he was saying is that the Governments are also corrupt?

Corrosive
Clive Small is Bob Carr's choice for the new Police Commissioner. It could only be the case considering his, Small's special appointment into Parliament House. Small who suffers from the little person syndrome is the ideal bend over boy who gets shuffled through his corrupt actions. Rolling the legal system for him after the fact, just like his predecessor Roger the dodger Rogerson.

Roger Rogerson, the old hero, who never faced a result in the Warren Lanfranchi, or Sally-Anne Huckstepp murders, was let off in my opinion when the New South Wales Government rolled the legal system (deciding what evidence to give the police prosecutor) to have the jury believe the illusion they (the Government wanted to create).
