Prison boom will prove a social bust

Hardened criminals are not filling NSW's prisons - the mentally ill and socially disadvantaged are, writes Eileen Baldry.

The NSW Premier, Bob Carr, proudly announced last Thursday that this state has more than 9000 of its citizens in prison, a record number and one equal to almost half of all prisoners in Australia. Far from being proud of this, Carr should be deeply ashamed. The 50 per cent increase in prisoners over the past decade is a clear indication of failure on the part of government to deal effectively with serious social problems.

More than 50 per cent of prisoners have an intellectual or psychiatric disability. Most of these people cycle in and out on short sentences or on remand because there are few community services to help them stay out of trouble.

Prison, the most unhelpful place to send a person with these problems, is being used as surrogate therapeutic housing. But of course prison is not organised to provide a healing environment and many are released in a worse situation than before they entered.

Parole officers and courts despair that many sent to psychiatric services, because they are clearly mentally unwell, return to court within days or even hours. Eventually they are sentenced to prison terms because there is no alternative.

The chairman of the NSW parliamentary committee on mental health in 2002, Dr Brian Pezzutti, noted: "Deinstitutionalisation, without adequate community care, has resulted in a new form of institutionalisation: homelessness and imprisonment."

The Productivity Commission says NSW spends the least per person of all the state governments on mental health. NSW is also below the average in supporting people with an intellectual disability, particularly those who have been caught in the criminal justice system.

Affordable housing in NSW, especially for those with disabilities, has slipped further out of reach. Fifty per cent of prisoners are homeless within nine months of their release. When this is combined with poor mental or intellectual functioning, most are unable to manage and end up back in prison. NSW has one of the highest rates of recidivism in Australia, with more than 7 per cent of people in prison having been incarcerated before.

NSW is also well below the average in providing supported housing and employment for people with a disability. Most prisoners come from, and go back to, a small number of disadvantaged localities where poor education, unemployment and poor access to services have been generational. These communities already have a heavy load of social problems to deal with without increasing the number of people returning from prison in need of unavailable housing, health and employment.

The fastest-growing group in NSW prisons is Aboriginal women. These women are not the dangerous, violent criminals Carr claims account for the rise in prisoner numbers. Most are on short sentences and have been in and out of detention since their youth, putting a lie to the argument that prison rehabilitates.

Women in general are the next fastest-growing group. Seventy per cent of the flow-through prison population - that is, numbers flowing in and out over a year - are on six-month sentences or less. Most have suffered physical or sexual abuse as a child and domestic violence as adults, and 90 per cent have alcohol or other drug problems. If the women are not supported to overcome these problems they will stay locked in the revolving door of the criminal justice system.

Tougher bail laws were touted as helping us all sleep more comfortably at night. But the remand prisons are not full of serious offenders, although of course there are some. A great many remandees are those who cannot meet bail requirements and are petty crime recidivists. Fifty per cent of people on remand are released in less than a month either because the court assesses they have served their sentence or they are found not guilty; hardly the hardline criminals the bail laws are said to be keeping off the streets.

The people of NSW have been sold a financially and socially expensive lemon. The Government continues to fuel fear of crime at the same time it allows social services to run down. More prisons are presented as the solution. NSW will reap a nasty harvest of greater social problems out of this shameful approach.

Bill toughens Tasmania's family violence laws

Tasmania is set to have some of Australia's toughest family violence laws following the passing of a controversial bill.

The Family Violence Bill has passed the Legislative Council with only a minor amendment.

Attorney-General Judy Jackson has made no apology for proposing pro-arrest family violence laws.

But Nelson MLC Jim Wilkinson says the presumption against bail went too far, wrongly restricting the judiciary's discretion.

Under amendments accepted by both Houses of Parliament, police and magistrates will only be allowed to refuse bail to a person charged with a family violence offence if it is likely that release would affect the safety, well being and interests of another person.

Ms Jackson says the Bill's passing is terrific.

"We do have some of the best legislation in the world for protecting women and children," she said.

The legislation introduces new offences of economic and emotional abuse and comes into effect in March.

Report slams 'unjust' jailing of women on remand

UK: Six out of 10 women sent to jail while they await trial are acquitted or given a non-custodial sentence, a report published today reveals. Introducing the report, Lady Kennedy QC calls for a complete review of the use of remand and bail for women saying it is "inhumane and unjust".

According to the Prison Reform Trust, the number of women in England and Wales remanded into custody has more than trebled over the last 10 years - even though more than 75% of their offences are non-violent or minor. It is now almost four times the comparable rate for men.

In 2002, more than 1,200 women were received in prisons in England and Wales and two-thirds were on remand. The majority are vulnerable women, many have mental health or drug problems and 71% have never received a prison sentence before.

Detention results in many being separated from their children, often when they are the sole carer. Frequently they find themselves with financial problems and increased psychological stress as a result of their prison experience. Many harm themselves while inside and 11 have killed themselves this year.

Lady Kennedy said the system lacked safeguards.


She said: "Something has gone very wrong with our criminal justice system when almost two-thirds of the women who entered prison in 2002 were held on remand."

"Fewer than one in 10 of these women were facing charges for violent offences. More women were sent to prison for shoplifting than any other crime. When their cases were heard, under half of the women remanded in custody received a prison sentence. One in five was acquitted altogether. They were, however, in jail long enough to disrupt lives often already marred by chaos and distress."

The report, Lacking Conviction: The rise of the women's remand population, says that four out of 10 women had received help or treatment for mental health in the year before being sent to prison and a quarter had injected drugs in the month before they were placed in custody. It claims that once in prison women do not get the drug treatment or mental health care that they require, they are confined to their cells for long hours and have limited opportunities to stay in touch with family. It suggests that the provision of bail information has broken down in many prisons.

The report's author, Kimmett Edgar, said: "There is consensus among government, the courts and prisons that the best way to reduce women's offending is ... by improving mental health services, tackling drug abuse, improving family ties and supporting young women."

Holly Dustin, the Fawcett Society's criminal justice policy officer, said: "The use of prison for damaged and vulnerable women awaiting trial for non-violent crimes is unjust. The government needs to act now to improve services for women in the community."

Rachel Lipscomb, chair of the Magistrates' Association, said: "The change in mental health provision over the past decade cannot be ignored. Magistrates are very aware of the need for an increase in provision and improvement in the quality of court-based diversion schemes for women with mental health problems."

Labor to back new draconian scapegoat laws?

The [alleged], federal opposition will support changes to the nation's terrorism, [? draconian scapegoat], laws, which the Government is expected to introduce to Parliament today.

Under the proposals, terrorism suspects, [scapegoats for the Coalition of the Killing's resource war's in the Middle East], would only be granted bail in exceptional circumstances, and if convicted they would be required to serve at least three-quarters of their sentence.

Labor politicians yesterday agreed to support the measures. [?]

The [alleged], opposition's homeland security spokesman Robert McClelland says Labor will ensure the speedy passage of the legislation through Parliament. [?]

"The community doesn't want people accused of serious terrorist offences, [? scapegoats], being at large in the community, that's the first point, and I think the community also wants judges, when they're sentencing people in respect to terrorist offences, [scapegoats], to properly reflect the community's condemnation," he said.

The Community? Who? [The Coalition of the Killing community you mean?]

New laws to make it difficult for people charged with terrorism offences, [scapegoats for the Coalition of the Killing's resource war's in the Middle East], to get bail have been whisked through the New South Wales Parliament after only being introduced earlier today.

The new laws were flagged last month, but New South Wales Attorney-General Bob Debus concedes the laws were rushed through the Parliament in response to a Sydney court's decision on Wednesday to grant bail to a Sydney man charged on terrorism-related matters, [scapegoat matters.]

Former Qantas baggage handler Belal Khazaal, 34, was allowed out on bail after appearing in a Sydney court, charged with collecting or making documents likely to incite terrorism.

Introducing the new laws today, Bob Debus said the new laws created a presumption against bail for people charged with such offences. "The Act will commence upon assent and the presumption against bail will relate not only to any person charged with a terrorist offence, [scapegoats], after commencement but also to any review of bail under part six of the Bail Act," he said.

The Federal Government will also legislate to introduce a presumption against bail for people charged with terrorist offences.

He says he will urgently introduce legislation to ensure that there is a presumption against granting bail to those charged with serious terrorist-related offences. [Scapegoats.]

Duddock: "That would mean that a court would not presume to grant bail unless there were very cogent countervailing circumstances for a grant," he said.
