A community rally calling for the reopening of the inquest into the death of Aboriginal teenager Thomas 'TJ' Hickey will be held at Walgett in northern New South Wales today.

Today would have been the 19th birthday of the teenager, who died in Redfern last year.

Two busloads of people from Sydney have travelled to Walgett to take part in the rally and about 100 people have been gathering at the Hickey family home.

Rumours that TJ Hickey was being chased by police when he lost control of his bike and became impaled on a fence sparked a nine-hour riot in Redfern.

A coronial inquiry cleared police of chasing the teenager.

But the Hickey family and their supporters will today march down the main street of Walgett to call for the inquest to be reopened.

Ray Jackson from the Indigenous Social Justice Association says there is evidence to show the teenager was being chased by police.

"We know that there is evidence out there that has not yet been presented to the coroner," he said.

"We have witnesses who have not been called, we most certainly want Michael Hollingsworth, the police office exempted from giving evidence, to give evidence."

POLICE have no right to demand increased support to patrol Redfern in the wake of one of the worst death in custody cover-ups by police in Australian history.

The community are outraged and say they are sick and tired of it. Some police should be wearing the blame for the intimidation and harassment of TJ Hickey.

[Allegedly], Police will be on alert today as TJ's friends and family attend his funeral in the northern NSW town of Walgett. Redfern residents plan a march in his honour.

Carol Ada Green, 46, appeared in Central Local Court charged with, [allegedly], riot, affray, throwing a bottle in a public place and using violence causing fear.

Ms Green, who said she would plead not guilty, was ordered to leave Sydney for her home in Coonabarabran in western NSW. Speaking outside the court, Ms Green said she had planned to attend TJ's funeral and described the police involved in the boy's death as "a pack of bastards".

Another, [alleged], riot suspect a 25-year-old man from Arncliffe in Sydney's inner southwest will appear in Central Local Court today on several charges.

LIST OF DEMANDS

Demand the officers involved in the incident resulting in the death of TJ Hickey be stood down from active duty pending the outcome of all enquires, given that witnesses have now come forward to say that TJ was being chased by Redfern Police at the time of the incident;

Demand that an independent forensic examination of the site of the incident be undertaken, and that all four vehicles involved in the police search for bag snatcher also be examined forensically by independent experts;

Demand to know why Redfern Police did not follow normal procedure in relation to impaling victims with serious injuries, for example: why did officers move TJ from fence without calling the appropriate Emergency Rescue Services or Ambulance to allow for the fence to be removed from TJ under medical supervision;

Demand to know why police officers involved made their first radio call for back-up, rather than to the Emergency Rescue Services or Ambulance;

Demand all log book, radio transcripts and staffing of the four vehicles involved in the incident be made available to all enquires regarding the death of TJ so that the whereabouts of each vehicle can be corroborated by an independent witnesses;

Demand the engagement of an independent Coroner to monitor and assist the State Coroner during its Coronial enquiry;

Demand the Ambulance reports of incident be made available to all enquires;

Demand that all enquires have an independent Aboriginal observer/participant;

Demand that the State of NSW pay for the legal representatives of the Hickey family in all enquires;

Demand that the evidence collected for all the enquires, whether in draft or progress reports be made available to legal representatives of the Hickey family;

Demand an independent forensic examination of TJ's bike;

Demand the examination by the enquires of all Redfern Police vehicles log books and radio transcripts at the time of the incident;

Sentencing innovation breaks vicious circle of jail terms

"Three months' jail for one punch in a pub fight is too much," said the victim. The victim's comment counted because he and the offender, Robert Bolt, a Nowra Aborigine, were making history in the first case of circle sentencing, a new way of deciding punishment for indigenous offenders.

The "circle" of four Aboriginal elders, a magistrate, a police prosecutor and a defence solicitor, listened. Mr Bolt got six months' home detention.

Sixteen months later, despite at least eight previous jail stints, he has not re-offended. Only one of 28 who have faced circle sentencing have re-offended.

Mr Bolt, 29, a budding artist, said his elders had asked how jail would feel. "My crime to me was a pub fight, but for the victim it was terrifying and I felt remorse for what I had done," he told a circle sentencing forum in Nowra yesterday.

An Aboriginal Legal Service solicitor, Mark Douglass, told the forum: "There is the victim adding flesh and bones to police facts which in an ordinary court are bare bones."

The pilot, which has dealt with offences ranging from driving infringements to family violence, has been so successful that the NSW Attorney-General, Bob Debus, has said circle sentencing will start in Dubbo next month. Walgett, Brewarrina and as many centres as possible will follow.

The Government has changed the law to create a formal legal basis for circle sentencing.

It was not an easy way out for offenders, said Doug Dick, a Nowra magistrate. "Punishments meted out fall in the middle-to-heavy end of penalties," he said.

Criminals were now being held accountable by elders from their own culture, said a police prosecutor, Craig Veness.

Sentences have included drink-driving programs, anger management courses, weekend detentions and random drug and alcohol tests, the forum was told.

A Nowra elder, Nora Roberts, who has participated in a circle, said it was "one of the best things that had happened to Aboriginal people today". Under the regular court system, her brother had once got six months' jail for stealing a sausage, she said.

Mr Bolt's mother, Desley, thanked Judge Dick and all those connected with circle sentencing.

"Without you, my boy would have ended up in jail . . . The elders in this community gave him the chance," she said.

When I got to Junee I was given nothing except bed linen. That's it! No clothing. I had to put my name down for clothing, which they said I could get on Saturday.
