"TIME TO MOVE ON" - NO JUSTICE FOR TJ

In reply to written requests to out new Premier, Morris Iemma and out new Minister for Aboriginal Affairs, Milton Oskopoulos, sent on 15 August 2005, ISJA was contacted by the Chief of Staff of the Minister's office, Nathan Rees, to arrange a meeting to 'discuss matters'.

On 28 September 2005, Rees met with this Association, accompanied by Warwick Neilley of the Premier's Office, at my Waterloo residence.

They first made it quiet clear that neither they, nor any other member of their respective offices, would be making themselves available for the Public Meeting to be held at The Settlement, 17 Edward Street, Chippendale on Saturday 8 October 2005, beginning at 5:30 pm to further plan actions to obtain Justice for TJ.

The new Premier and Minister were invited in the hope that, with the retirement of Bob Carr, perhaps some real Justice may now occur. The Minister especially had publicly stated that he wanted to meet Aboriginal people within the NSW Communities, but according to Rees, this Community was not one of them. Maybe he chooses his meetings so that he only meets with those whom he sees as being 'suitable or preferred' members of the Communities that he will visit?

The next question put to them was on seeking their opinion on the call to have the Hickey Inquest either re-opened or a new one called. The answer was, to quote Neilley:- 'it's time to move on. It's not going to happen. Far better to work with the Government on important issues.' The advice to 'get a life' was also gratuitously given.

They then moved to their agenda that involved their wishes to find an organisation that would remove Mick Mundine from the Aboriginal Housing Company and for that organisation to then work with the Government on solving the Block issues.

Whilst not surprised - it is well known that the NSW Government has 'problems' with Mick - their offer was totally rejected as being neither viable nor useful. This Association believes it is up to the Block residents - past and present - and the current AHC Management to decide what is in the best interests of the Block.

A further request to Rees that the Minister meet with Gail Hickey and her Family was agreed to on the condition that the death/murder of her son not be raised! The meeting finished.

No Justice for TJ. No Justice for the Hickey Family. No Justice for the Redfern, Waterloo, Walgett Communities.

Come to the meeting on Saturday to help us plan our next steps in our ongoing struggle for Justice for TJ, Gail, her Family and supporters.

ONE YEAR ON - JUSTICE FOR TJ - RE-OPEN THE INQUEST

AUSTRALIA: NSW: The Indigenous Social Justice Association Inc has organised a Rally and March on Wednesday 17th August 2005 on behalf of Gail Hickey, her Family and supporters.

We will rally at the Block, Redfern, at 11:30 am and then march to the Glebe State Coroners Court before returning to the Block for a community BBQ.

On the 17th August 2004 the NSW State Coroner, John Abernethy, handed down his Finding arising from the T.J. Hickey's Death in Custody Inquest.

The Finding was fatally flawed as it was based on the acceptance of a corrupt NSW Police Brief of investigation.

The Inquest itself was also flawed as legitimate evidence and witnesses were blocked by the legal team purportedly representing the Hickey Family and by the Counsel assisting the Coroner. The Coroner had also set strict parameters for what could be discussed in open Court.

This and related concerns have been subject to a complaint to the NSW Judicial Commission for their consideration. We have submitted that they should find fault with the original Inquest process and to recommend that a new Inquest be held or that the original Inquest be re-opened.

We have also asked the new NSW Premier Morris Iemma and his new Aboriginal Affairs Minister, Milton Orkopoulos, to meet with ISJA and the Hickey Family to discuss our concerns with the original Inquest. With the moving on of Bob Carr we expect that any intransigence such as that shown by him will no longer be present.

The NSW State Coroner must be advised that the Inquest is to be reopened or a new inquest be held in the interests of justice in order to allow True Justice to finally occur.

We strongly believe that (now Senior) Constable Michael Hollingsworth had far greater involvement in the tragic death of TJ and he must now take the stand and give his evidence despite the comments of the State Coroner that he cannot be trusted to tell the true facts of his part in the tragedy of that day.

Australia: Cop Watch

The roundup this week - dodgy riot gear, shooting French photographers, senior coppers being 4 times over the legal limit, dodgy promotions in NSW, more terrorism powers in WA and drug-dealing coppers in Melbourne (it is alleged).

The August 7 Sunday Telegraph reports that NSW police is facing an $800,000 fine for not providing proper riot gear for police during the riot last year in Redfern. The riot took place after the death of a local Koori boy, TJ Hickey, while being followed by police.

Workcover has recommended NSW Police be charged with negligence on the basis that helmets, shields and other riot equipment held at Redfern police station were old, broken or worn and that nothing was done to replace them.

The helmets were too big, the visors were so badly scratched that officers could not see through them, and the shields were too small to stop leg injuries.

The man responsible for ensuring that police had the right gear was assistant commissioner Dick Adams. Dick Adams has meanwhile left the force on what are called medical grounds.

The August 7 Sun-Herald continues the grand tradition of the media peddling human interest stories to put police in a good light. The paper did a sympathetic piece on a former copper, Anthony Dilorenzo, who shot a man dead at Bondi Beach.

The victim was a French photographer called Roni Levi. Levi waded fully clothed into the Bondi surf carrying a kitchen knife - no one knows why. When he returned to land, however, the police surrounded him and shot him dead using four bullets.

Differing versions of the events occurred, but at least some witnesses on the promenande say that the man posed no threat to the officers, let alone enough of a threat to shoot him four times.

All fairly straight-forward it seems - officers doing a difficult job under difficult circumstances and so on, till it was alleged that both officers were coked off their little heads. Both coppers had spent the previous night at a party with alcohol and cocaine till just before their 6.00am shift.

What a shame, then, that neither copper was tested for alcohol or drugs, to show whether or not they were under the influence of alcohol or coked off their little piggy faces. However, Mr Dilorenzo did confess to being a regular cocaine user and was discharged from the force.

Mr Podesta, the other copper who pumped bullets into the French photographer at point blank range, was later convicted on drugs charges and also left the police service.

The August 4 Herald Sun reports that famous Aboriginal actor David Gulpilil has had his license removed for 12 months after an alcohol-related driving offence.

The star of Walkabout and The Tracker was caught with a blood-alcohol reading of .093 on July 17. This will no doubt come of some comfort to a police inspector who was caught driving with .236, according to the July 25 Sydney Morning Herald.

The drink-driving copper, Inspector Lee Philip Renshaw, had his day in Hobart Magistrates Court where he will return in the future. Till the small matter of being four times over the legal limit is sorted out, the Tasmanin Police Comimssioner has told Renshaw that he is not able to exercise any of his powers as a police officer pending the outcome of this matter.

That will teach him a lesson.

NSW police meanwhile want to promote more grunting gorillas by emphasising the importance of practical experience.

An August 9 report says that NSW police officers who want to be promoted to the dizzying heights of sergeant will go through an application process that will take more consideration of their operational experience.

Although a backward step for those people still silly enough to hope for any sort of reform in the police force, it is at least better than the system at the time of the Wood Royal Commission into the NSW Police Service in 1997. This system was described as being one where, in order to be promoted, an officer had to be quote warm but vertical unquote.

The warm but vertical comment (above) was made by none other than the Police Commissioner in NSW, Mr Moroney, who also said that until the early 1990s you could almost pinpoint to a day on which those before you were retiring ... and determine when your next promotion was going to be.

The NSW Minister for Police, Mr Anderson, said the changes to the policing system were quote tailored towards the police officer who has an understanding of what's happening out there... rather than one who simply wants to sit down and study a book. unquote

You couldn't make it up.

But there are police complaints systems such as the Police Integrity Commission in NSW. The August 9 Sydney Morning Herald reports that the outgoing inspector of the Police Integrity Commission has called for an extension of power to be made to his successor so that he can investigate a broader number of officers.

Morris Ireland, QC, whose term in office expires at the end of August, has called on the state government to allow his successor to be able to investigate more officers than he can at present. Mr Ireland, in his annual inspector's report, called for the powers to be widened to include agencies such as the NSW Crime Commission.

An example of where this would have been more useful, says Mr Ireland, would have been Operation Florida, where it seems that most police north of Manly were involved in cocaine trafficking. The Operation was a three-year undercover investigation into links between police and known criminals in the distribution of cocaine across Sydney and targeted 300 members of the NSW Police Service.

The new Police Integrity Commission's head will be Justice James Wood. Justice Wood has been a NSW Supreme Court judge since 1984 and will retire at the end of this month. He is the same Justice Wood that headed the royal commission into police corruption in NSW from 1994 to 1997. Although the report makes sensational reading, very few coppers have actually served any time as a result of the report's revelations.

By now, you may be thinking that coppers are the last people you want to give more powers to, but this is not to be the case. The Western Australian Government will introduce new counter-terrorism laws to satisfy police demands. The new powers will grant police special powers to search, apprehend and detain people suspected of terrorist activities. The legislation has not yet been introduced into Parliament, but Dr Dr Gallop says the powers will need to be used 'responsibly'.

WA Police Commissioner, Karl O'Callaghan, has welcomed the proposed package which the WA Police put forward to the state government in the first place.

From terrorism to drugs... The Australian reports on August 10 that one of the crack cops in Victoria made thousands of dollars from supplying drugs to the Bandidos motorcycle gang and members of the Moran crime family - allegedly.

The jury in the trial of (Detective Senior Sergeant) Wayne Geoffrey Strawhorn was told that the copper made a mint from his connections, ending in a threat to kill against an internal affairs detective who was investigating the state's now disbanded drugs squad.

On March 15, 2003, Mr Strawhorn was taped making threats to kill Inspector Peter De Santo - allegedly. He said quote the bottom line is my life at Vicpol is over ... I will not rest until De Santo is dead ... I have to (kill him). It is the only way to get satisfaction. unquote

The former copper known as Strawhorn has pleaded not guilty to five counts of trafficking in pseudoephedrine. He also denies a sixth charge of making a threat to kill the ethical standards department detective.

The trial, as they say, continues.

Media invites to dawn drug raids, people evicted from homes?

NSW: When the NSW police burst into five Sydney homes in Redfern in the early hours of Thursday morning they took with them an entourage of media stooges and public housing authorities eager to find more vacant public housing for the 80,000 people on the DOH waiting list.

But if the police go into any home they could find something illegal, no doubt!

I saw police holding up a plastic bag on CH/10 news with what looked like a small marijuana bud about as big as a five cent piece saying words to the affect, "small green leaf matter."

Therefore the chances of the police and media sustaining some charge or conviction or making those people look guilty as sin is always there for the taking. In short you can be severely exploited by the powers that be!

Surely there are legal and privacy issues involved when police are going to arrest people. I call on civil liberty lawyers to look into those legal and privacy issues.

The fact that now, when people who reside in public housing who are arrested can be publicly evicted, that is another worry.

Joe Tripodi the Housing Minister was proud to announce in the NSW Parliament that those who were arrested would be evicted from their public housing. Even though they were not yet found guilty of any crime. And even worse than that made to look guilty by the media.

Were these people guilty of anything? Or simply drug users and not dealers? Yet to be determined by a court of law, but they were dealers according to the police and the media stooges at 6.am in the morning, all working together to sustain a public image that could have been so wrong and that could have severely misrepresented those people they arrested.

Police could go to any drug users housing commission home and seize drugs and the housing minister could throw any drug user out onto the street? This must concern the community because it is wrong that people who take drugs should merely be accused of dealing, charged for being a user and then dumped onto the street.

State Opposition Leader John Brogden just recently backed a plan by Bob Carr to overhaul public housing.

"We support a good plan like this," Mr Brogden said.

"For the hundreds of thousands of people across the state who are on the waiting list for public housing, this (plan) will make it easier for them to get into public housing."

Or just raid their homes and kick them out, 14 at a time?

Now PUBLIC housing tenants will no longer be entitled to government housing for life, and some tenants will face higher rents, the New South Wales Government has announced.

So there is a major public housing shortage at the present time. NSW Premier Bob Carr recently announced the biggest shake-up of public housing in 50 years, with tenants on moderate income to be encouraged to move into the private rental market.

New tenants will be given limited leases including short-term leases of up to two years and medium-term leases of between two and 10 years. Elderly and disabled people will be entitled to 10-year leases.

But the NSW Council of Social Service (NCOSS) warned the reforms would only marginally cut the waiting list for public housing, which stood at 80,000 people.

"There's an element of that in it (cutting the waiting list) but it's only going to affect 2500 people at the most," council director Gary Moore said.

NCOSS doubted whether people forced into the private rental market would find affordable housing in Sydney.

"We're concerned about the group of so-called modest-income earners for whom the private rental market is seen as the salvation," Mr Moore said.

"It's very unlikely they'll find a way into affordable private rentals in Sydney."

Despite the reforms announced, fixed-term leases were not new and had been in place for all new public housing tenants since November 2002, he said.

Warnings went up when police and DOH decided to work together as a force now people are being accused and thrown out of their homes onto the streets of Sydney.

Department of Housing units in Morehead Street and Young Lane were raided. The raid was to be connected with the supply of drugs, predominantly heroin?

The police raid was to be connected? Is connected? Looks like it's connected, to drug dealing? So the dealers are not users? Drug users not yet found guilty of dealing should be kicked out of their homes?

The raids began at 6am (AEST) and police were still at the scene gathering evidence at 9.30am (AEST). The spokesman said those arrested had been taken away in paddy wagons and were 'expected' to be charged with drug supply and expected to be kicked out of their public housing because of a public housing shortage and anyone will do!

The higher your income gets the less rent subsidy you receive, so in effect the middle incomers subsidise the maintenance of the whole estate.

Also, if you drive out everyone who can afford to beautify and properly maintain their place you eventually get to the point where all tenants with any sense of community pride abandon the estate. Then you get the sort of unsolvable problems we saw at the Villawood Housing Estate and the government sends in the bulldozers - followed by developers and their McMansions.

Tripodi is also being disingenous in suggesting that the police raids were the result of tenant complaints about drug dealing. Housing tenants are now required to keep 'incident diaries' about possible law-breaking on the estates. Those who refuse to be part of this DoH Stasi network are themselves liable to be evicted. So when the Department of Housing wants to evict tenants they can requisition the diaries, claim that they show tenants are worried about crime in the estate, send in the cops, then evict those arrested whether or not there is any evidence against them.

So its the government policies which lead to the destruction of trust and social capital in housing estates. Then the very community breakdown the government has caused is used as an excuse to shut down public housing and turn the real estate over to Carr's developer mates.

Rally to seek fresh Hickey hearings

Thomas Hickey.....rally to push for reopening of inquest

A community rally calling for the reopening of the inquest into the death of Aboriginal teenager Thomas 'TJ' Hickey will be held at Walgett in northern New South Wales today.

Today would have been the 19th birthday of the teenager, who died in Redfern last year.

Two busloads of people from Sydney have travelled to Walgett to take part in the rally and about 100 people have been gathering at the Hickey family home.

Rumours that TJ Hickey was being chased by police when he lost control of his bike and became impaled on a fence sparked a nine-hour riot in Redfern.

A coronial inquiry cleared police of chasing the teenager.

But the Hickey family and their supporters will today march down the main street of Walgett to call for the inquest to be reopened.

Ray Jackson from the Indigenous Social Justice Association says there is evidence to show the teenager was being chased by police.

"We know that there is evidence out there that has not yet been presented to the coroner," he said.

"We have witnesses who have not been called, we most certainly want Michael Hollingsworth, the police office exempted from giving evidence, to give evidence."

Riot not planned: Palm Is leaders

Community leaders on Palm Island off north Queensland have rejected suggestions that Friday's riot was premeditated.

The community remains calm but tense, with police reinforcements sent to the island today.

The police station and courthouse were destroyed when residents went on a rampage, angered over the death of 36-year-old Cameron Doomadgee in police custody.

Nine people have now been charged with various offences in relation to the riot.

Police say he died after a scuffle, during which he and an officer fell onto concrete steps. [?]

Palm Island community councillor, Rosina Norman, says the riot was not planned.

"If it were, it would have happened from Monday because this started Monday," she said.

"We had a community meeting then the people went up to the police station and asked for the police to come out."

Premier Peter Beattie says the Crime and Misconduct Commission is investigating Mr Doomadgee's death.

Palm Island crisis easing

North Queensland police say the crisis on Palm Island has now eased in the aftermath of yesterday's riot.

Indigenous community residents took to the streets after the release of an autopsy conducted on a man who died in police custody.

The autopsy showed that Cameron Doomadgee had broken ribs and died from a punctured lung in the watch-house last Friday.

Up to 300 islanders stormed the police station, setting fire to it with a petrol bomb. They also destroyed the police residence.

Fire officials trying to control the blaze were reportedly threatened by locals, some of whom were carrying knives and other weapons.

A fire truck was also destroyed.

Mr Doomadgee's cousin, Murrandoo Doomadgee, says he understands the anger in the local community.

"What we look upon with shame is the continued violence of police against young Aboriginal men and women," he said.

Queensland Premier Peter Beattie has sought to reassure Palm Islanders the death will be properly investigated and Police Commissioner Bob Atkinson, who has flown to Townsville, says his officers will fully co-operate.

It is believed 60 police officers are on Palm Island trying to restore law and order.

Meanwhile, Queensland's coroner released a statement last night, promising an "open and thorough" inquest into Mr Doomadgee's death.

Michael Barnes says an initial report indicates there is no evidence to suggest that his injuries were caused by the "direct use of force." [?]

He says the pathologist believes they were consistent with Mr Doomadgee and another person falling onto a hard surface - such as the watch-house steps - during a struggle. [?]

Up to 50 armed police reinforcements were today being flown to the Aboriginal settlement after hundreds of angry residents stormed the police station and adjoining courthouse early this afternoon, setting fire to the buildings with a petrol bomb.

Residents "were believed" to have blocked the airstrip with cars to stop police reinforcements being flown from nearby Townsville.

Palm Island resident Nicky Bull said the situation was worse than during this year's Redfern riots in Sydney.

"There's smoke everywhere, the police station's just about burnt to the ground as it is, as well as the residence where the police live," she said.

The riot follows the release of a post-mortem examination of Cameron Doomadgee, 36, who died in custody last Friday.

The autopsy found the man had four broken ribs and died from a punctured lung.

Another resident, Nicky Willis, said, "The atmosphere over here at the moment is one that's full of anger because of what's come out of the coroner's report .

"It's one that's full of fear as well because there are a lot of good people that live on this land.

"There's a lot of elders that live here . . . and they are living in fear."

The Palm Island hospital has been locked down.

Whitewash over Hickey's death

The New South Wales coroner has cleared police of any responsibility for the death of Aboriginal teenager Thomas 'TJ' Hickey.

The 17-year-old's death sparked a riot in the inner-Sydney suburb of Redfern in February.

State coroner John Abernethy has dismissed claims that police were chasing or pursuing TJ Hickey when he crashed his bike and became impaled on a fence.

Those claims led to the riot in Redfern.

The coroner has found the 17-year-old died during a police operation and was being followed by one paddy wagon shortly before he crashed.

What do you call that? Running away from the crime scene?

But he said there was no evidence to find police caused TJ Hickey's death, nor that the teenager was aware that police were behind him.

He was terrified so much so that he impaled himself on a fence and a paddy wagon was following him and another was seen going around the opposite direction.

Common sense would clearly tell any reasonable person that he thought he was being chased.

He even went through a gate separating one wagon from the pathway 'typical tactical move by Thomas to avoid the pursuit'.

One policeman chose not to give evidence to the inquest, while another officer was described by the coroner as a "poor witness".

Here we go again!

How can you dismiss the claim when the copper involved refuses to give evidence on oath and his witness is described as poor? Better description 'vague', 'forgetful' and 'untruthful'.

The Hickey family in Glebe Coroners Court was visibly upset at the finding.

Outside the court, TJ Hickey's great-aunt, Gail Cargill, said the family was extremely disappointed with the coroner's finding.

"TJ was a good kid, he was always kind to his sisters, he was only 17 and we all love him and we miss him very much," she said.

"We're so disappointed with what's happened today."

New South Wales Police Commissioner Ken Moroney has backed his officers, saying no disciplinary action will be taken against them.

"I supported each and everyone of my officers on the morning after the incident involving Thomas Hickey," he said.

"I supported each and everyone of my officers after the riot and my support remains for those police officers."

Redfern police need education not weapons

NSW police want new offensive equipment including long-range capsicum spray guns and modified armoured vehicles capable of spraying tear gas following a damning report on the Redfern riots in Sydney earlier this year.

An internal review of the February riots, leaked to the state Opposition, calls for a range of "less than lethal" equipment to be considered to boost police capabilities in the event of future unrest.

The options include equipment that can shoot capsicum spray up to 20 metres, rubber bullets and modified armoured rescue vehicles, known as "bear cats", fitted with external fire extinguishers, water cannons and devices to pump gas, capsicum spray or other irritants.

But what is needed is supervision by senior police who are not racist and not pissed. Drug and alcohol classes and self help books on racism would perhaps be better, so police can learn equality and respect and get off the piss, opposed to the racist bullies who pursued a young aboriginal boy to his death.

Even the name suggests police action to date. 'FORCE' and not 'Service' in other words disrespect and no respect and it shows doesn't it?

Who's serving who? Well who do the taxpayers pay!

The NSW police service has obtained legal advice on the use of such equipment that says police may employ 'reasonable force' to ensure public order.

Which also means civilians will obtain advice on the use of such equipment that says civilians may employ 'reasonable defence' to ensure public safety.

Lets see, they could start using boomerangs, spears and nulla nulla. Vicious circle?

One wonders whether police are trying to keep up with the Jones's in the 'terror games', trying to cover up for their bad behaviour or both? Surely using more weapons will only cause more bad behaviour.

The internal police review of the Redfern riots, following the death of Aboriginal teenager Thomas "TJ" Hickey, has concluded the overall police management was "poor".

"It was not our best night," Deputy Commissioner Dave Madden admitted in Sydney yesterday.

But in reality overall police management in NSW has been 'sad' for some time with the likes of noble cause corruption, corruption generally, booze on the job, bulling, racism and the list goes on.....

The violence in the 'racist' inner-city area resulted in 35 arrests and allegedly injuries to 45 officers and two police dogs? But that hasn't been proved and most people say it was a cover-up for the sham.

Pursuing innocent people to death is a bad trait and if police think they're above the law themselves even if they're racist then that's another good reason to educate them considering they swore their allegiants to the Crown.

The police report on the riots, following an investigation by strike force Coburn, raises concerns about poor communications and inadequate equipment, including ill-fitting riot helmets that fell off.

But in reality they were just too pissed to work it all out and too racist for it to end up any better than what it did.

The report says there was a breakdown in communications between police and Aboriginal Community Liaison Officers, of which three are attached to the Redfern Local Area Command to liaise with the Aboriginal community.

From what I heard the Aboriginal Community Liaison Officer got his arse kicked if he wasn't racist even though he was an Aboriginal himself. That shows you how strong the boys club in the Force is about racism.

According to the description of one senior police officer, the ACLO called out on the afternoon before the Redfern violence escalated was "hopeless, intoxicated and had no driver's licence."

There you go even the senior supervisor was pissed in breaking the law!

One damning police eyewitness report of the riot said the only reason police were able to move into the main street of The Block, the area at the centre of the trouble, "was because the offenders went to bed, not because of any tactical movement or result of any management decisions".

Another police witness said: "On several occasions rioters were allowed to walk past police lines and attend local shops. One of these persons seemed to be one of the main agitators."

Excuse me, I just need a packet of cigarettes and a drink then it's back to the riot and off to bed, ZZZZZZZZZZ.

Police finished their shift with a feeling of "disgust and embarrassment", another officer said.

The report found the issues raised as a result of the Redfern riots had statewide implications, particularly the inability of police to respond to "unplanned acts of violence".

"Redfern aside, one cannot overlook the possibility of an international incident sparking a large-scale violent response threatening public order within NSW," the report says.

Police Commissioner Ken Moroney had refused to publicly release the report until the coroner hands down his findings on TJ Hickey's death which are expected next week.

Carr defends Redfern riot fallout


An Upper House inquiry has recommended that an internal police report into the Redfern riot should be released as soon as possible. [?]

A spokeswoman for Police Minister John Watkins says the committee's report is being considered by the state coroner as part of the inquest into the Thomas Hickey's death.

Advice was being sought about the release of the document.

The report has been written by "Strike Force Coburn", [police investigating themselves], which was set up to investigate the police response to the riot.

[When police investigate themselves they did nothing wrong so we wonder what benefit to the community this report would be other than to protect the police again. It certainly won't add or subtract anything the committee should be investigating in relation to the death in custody, which caused the riot. So it is being used as some sort of leverage by a corrupt cop who wouldn't give evidence on oath at the inquest into TJ's death because he might incriminate himself.]

New South Wales Premier Bob Carr has defended the effectiveness of an Upper House inquiry into the Redfern riots in Sydney. He says the Opposition has criticised the inquiry because the findings did not support their prejudices.

The riot erupted after the death of 17-year-old Aborigine Thomas Hickey, who was impaled through the neck on a fence in Redfern in February.

[Allegedly], more than 50 police were injured during the riot.

Time and time again we hear that after police pursued a boy to his death it caused a riot and 50 police were injured, is that so we can feel more sorry for the police? Or the bricks?

Of course these are honest cops ? who can do no wrong ? especially after a riot caused by a death in custody where police claimed they were just innocent bystanders minding their own business. [?]

Opposition Leader John Brogden said yesterday the report's recommendations would not prevent another riot and would do nothing to address social problems in the area.

[Actually we agree! Unless we get to the bottom of police race hate and corruption and the fact that police in this State don't take responsibility for pursuits that kill people especially when authorities continue to covering up for them then this will go on indefinitely.

Things only change when wrongdoing is admitted but if there was no wrong then nothing happened and no one need to be responsible and nothing will change the police culture, no doubt! Accept for the fact that police will do it again. Is that not what the inquiry was about?]

But Mr Carr says the Opposition needs to focus on implementing measures that will help improve the situation?

[Sounds like the pot calling the kettle black? Accept Bob Carr is responsible alongside his minister for police and both of them refuse to acknowledge police corruption.]

Carr: "I think we should set aside the political argument here and simply get on with the hard job of building a community, of dealing with the problems of broken families," he said.

[But surely he means dealing with the problem of dead families because that is the problem. When you pursue a person to their death and they die then the problem the families face is how come they raised up this lad only to be pursued to his death for no good reason other than race hate.]

Carr: "Seeing these strategic goals advanced and backing the police in the day-to-day task of maintaining order and chasing the drug dealers."

THE DOG: This is why the police culture will not change in NSW because at all material times there is no admission of wrongdoing by police, or the Carr government who investigate themselves. They are simply an infallible and protected class that can do no wrong - but that goes against the grain of humanity. When mistakes are made there has to be admissions for things to be corrected.


Just like our public hospitals and prisons no one is prepared to make admissions so things will change until many people die because the Carr Government is the problem.


In addition police will always have a legitimate reason for being at any location at anytime whether they are acting corruptly or not. Therefore it is not an easy thing to do to prove police corruption and the authorities know it.


So when police are caught out and the government don't do anything about it - because it seems easier to cover it up then police culture won't change and they'll do it again no doubt.


In order to challenge inappropriate behaviour towards others - the very same respect police seek to challenge in others - then they need to do it by setting an example for the whole community.


At the moment police get "bricks" because the community don't get any respect either and instead the cop is promoted for inappropriate behaviour and the same corrupt cop has more power to act corruptly.


The question is why do we need cops like this? Just ask Bob Carr.

The Fight for the Truth Continues

On Monday, 5 July 2004, the Hickey Family and their supporters will come together in the Glebe Coroners Court with the Redfern Police, the same police, specifically unknown at this time, who pursued the Young Man to his death by impalement.

Since that tragic February day the Redfern Police have been honing and polishing up their statements, the better to allow for a more complete dove-tailing of 'their' facts.

They have found witnesses to support their sanitised view of the events and it has been stated that of the 10 days set aside for the Coronial Enquiry, the first five days will be dedicated to the police and their own witnesses.

For the Family, the times have been one of stress and frustration. At the behest of the Family, legal assistance was found by the Association on their behalf. The Aboriginal Legal Service at Redfern was not considered by Mrs Hickey to be a viable option.

After a couple of strange months, the Family now have a Legal Aid solicitor and two Public Defender Barristers, a junior and a senior.

It is my belief that we, the Family 'team', have wasted too much time in sorting out whether Legal Aid was going to pay the original Barrister and Solicitor or whether the Family would only be funded for the Legal Aid/Public Defender Team.

A further problem is in keeping our Forensic Consultant on the job, so to speak. A lot of evidence in this particular case is relative to matters forensic.

We believe we have good solid arguments that the police wagon did indeed pursue the Young Man to the Renwick Street fence line. We also believe that we have credible witnesses who will truthfully state that the police wagon was seen at the fence-line with lights flashing and sirens on.

>In all Death in Custody cases, but especially with police deaths in Custody, the Family and their supporters are up against the experts in honing and polishing the facts. The police have total control over what is treated as evidence and the arguments that are put to the Coroner. The police have all access to the media to allow for their spin to become a public issue; they have access to all witnesses and in choosing those witnesses that they believe best support their particular line of 'facts'; they also have seemingly endless resources to allow for the honing and polishing of their statements.

Death in Custody Families have none of these. Death In Custody Families only have the trauma of the loss, generally, a most questionable loss. Then there is the Sorry Business that consumes the Family and their supporters. For some Families that continues every day even though the Death occurred some twenty years ago. Whatever the particular Coroner may do, or find, there are always unanswered questions.

I, and many others, have been strongly critical of the police investigating the police, especially in police Deaths in Custody. Everyone, from Premier Bob Carr down knows full well that police investigation only have one end in mind - and that is the total exoneration of the suspect police officers. We all know of the Police Culture that makes the good honest cops accept the corrupt practices of their less professional Brother and Sister officers.

The truth for the Hickey Family can be found by the Coroner, in this instance State Coroner, John Abernathy.

It is up to Gail's legal team and her supporters to argue that truth to the satisfaction of the Coroner. Not always a done thing if we look to History.
