Govt urged to seek civil lawyer for Habib

The Law Council of Australia has called for the Federal Government to ensure Guantanamo Bay inmate, [prisoner], Mamdouh Habib has access to a civil lawyer.

The call comes after the US Supreme Court ruled American courts do have the jurisdiction to consider challenges to the legality of the detention of foreign nationals in Cuba.

The council's Bob Gotterson says the other Australian detainee, [prisoner], David Hicks, does have access to a civil lawyer, and Mr Habib should have the same help to challenge his detention, [imprisonment.]

"Mr Habib I believe does not have assistance from the Australian Government for that but there can be no reason we can see for discriminating between the two of them," he said.

How detox and self-help brought suicide jail back from the brink

UK: Six suicides in 12 months made Styal prison notorious and the Prisons Ombudsman criticised the prison and its staff for serious failures. But things are changing.

The Observer was allowed rare access to Styal and found it striving to change, with a scheme to help newly arrived drug users, and inmates, [prisoners], trained by the Samaritans to help women in despair. Report by Jane Mulkerrins.

At first sight, Styal prison is unrecognisable as the grim institution described in a report last January by the Prisons Ombudsman, Stephen Shaw. In the Cheshire countryside near Wilmslow, the official blue sign at the entrance to the drive spells out its purpose.

Yet instead of the vast Victorian corridors one might expect, most inmates, [prisoners], share individual two-storey red-brick houses in the complex, built as an orphanage. The houses have sitting-rooms with comfortable chairs, stereos, TV sets and pot plants, and are reached along small paths separated by grass.

Each inmate, [prisoner], has her own keys to her room, though the front doors of the houses are locked by staff at night. From a distance, it all seems very progressive.

Yet Styal has another side: beyond the neat houses on the other side of an ugly 20 metre-high fence is Waite wing, home to 160 of the most vulnerable women. Shaw called it 'isolating and forbidding'.

It was here that five of the six women who killed themselves at Styal in the year before last August died. All five were in their first month of custody, and four were in their first week.

Julie Walsh, 39, a mother of two, overdosed on drugs stolen from a medical trolley. Hayley Williams, 41, Jolene Willis, 24, Anna Baker, 31, and Nissa Ann Smith, 20, all hanged themselves with home-made 'ligs', nooses fashioned from material and fastened to furniture.

Sarah Campbell, 18, died of an overdose within 24 hours of starting a three-year sentence for the manslaughter of a man who collapsed after she hassled him for money in the street.

Five of the inquests have yet to take place, but Shaw's report identified drugs, mental health issues, administration of medicines and communications failures between staff as factors in the deaths. Four staff members, one a nurse, face disciplinary action.

The governor, Steve Hall, admits there are major problems, but vows: 'We are trying to address them.'

The number of women in prison in England and Wales has risen by 173 per cent in 10 years to more than 4,400. Between 1990 and 1995, seven women inmates, [prisoners], killed themselves, an average of 1.2 a year. In 2002, that increased to nine and last year it was 14. Women prisoners are three times more likely to commit suicide than their male counterparts.

More than 100 female inmates, [prisoners], were resuscitated after a suicide bid last year. There were a further 5,142 reported incidents of serious self-harm or attempted suicide not involving resuscitation.

Despite being only six per cent of the prison population, women account for half of all self-harm - one reason for the high pressure on staff in women's prisons where it is not unusual for 15 per cent of inmates, [prisoners], to be on the F2052 procedures for monitoring those deemed at risk.

Six deaths at Styal in a year was extreme, but there have been no suicides since last August mainly, say inmates, [prisoners], because women who use drugs in the outside world are now given methadone.

Styal is the second largest women's prison in England and Wales, housing 440 prisoners of all categories, from those on remand to murderers. Eighty per cent arrive with a drug problem. Most are heroin addicts but many are taking a combination of drugs, including amphetamines, cocaine and crack.

Until last September, newcomers had to go 'cold turkey', given only painkillers to ease the cramps, insomnia, vomiting, shaking and sweating of withdrawal - a system compared to giving an aspirin to an amputee.

Prisoner Sarah McKeever found this tough. 'I couldn't cope with the pain, so I stole my cellmate's painkillers and took 86 paracetamol tablets. All I wanted to do was end it,' she said.

McKeever has been in and out of prison three times since 1999 and been homeless after each release. This time she stole a purse to get money for accommodation. Although painfully thin, she is bright-eyed and chatty. 'Last time I came in,' she says, 'I had a straight rattle [cold turkey] and got really depressed. You've just been locked up and taken away from your family. Coming straight off heroin as well is just too hard - you can't cope and you just want to die.'

Methadone eases the pain of withdrawal. Daily doses are reduced over 15 days. The programme had been planned at Styal for three years, but money for it became available only six months ago. In March, three-quarters of the 230 new inmates, [prisoners], were on the drug.

'It's a different place here now,' says Sarah. 'Last time, there were three suicides in the nine months I was here. It was very edgy. Everyone wondered who would kill themselves next.'

Niall Clifford, who oversees women's prisons, said: 'Women have confidence in the detox programme, so they are not terrified of the process like they were before. That has made for a far calmer atmosphere.'

Waite wing itself is changing. The fence between it and the rest of the prison is coming down and what one inmate, [prisoner], saw as a battleship-grey, 'concentration camp' look has been transformed into a cheerfully painted environment with communal areas and cell furniture with fewer points for ligatures.

Suicide attempts may never be completely eliminated, however. 'Women will cut themselves with the tops from margarine tubs and bits of Biros, if that's all they can find,' said deputy governor Susan Howard.

Governor Hall believes this is why women's prisons should work to a different charter from the one that regulates men's jails. 'We are probably closer to being a hospital than a prison in many ways,' he said.

Statistics back this up. A Prison Reform Trust report showed that two-thirds of women prisoners suffer from a mental disorder, and 40 per cent have attempted suicide at some time.

'Detox is just a start and it only treats the symptoms of a much deeper problem,' says Hall. 'Drug use often masks serious mental health issues and depression. For many women coming off drugs, it is the first time they have had to face up to the realities of their lives. Once we treat the drug dependency, we often uncover sexual and physical abuse, issues with men and families, reasons for criminal activities and so on.

'Women would come in, detox over two weeks, then settle into a period of self-harm where they would think, "What have I done? Where are my kids?" Hall says. 'There is a sense of hopelessness they have avoided up to that point through drug use.'

In The Observer last month, Cherie Booth QC argued for reducing the number of women in prison. 'Everyone has a choice not to commit crime,' she wrote. 'But that choice is harder when, after years of being the victim of domestic violence or sexual abuse, you have lost all respect for yourself and others. It is harder still when you are addicted to drugs, or have stopped caring whether you live or die.'

Hall believes women feel the effects of prison more deeply than men. 'Men offend at a rate 16 times that of women, but the intensity of what women need is much higher,' he says.

'The expressions on their faces when they queue up to collect their methadone are very different from that of men. There is a different look in their eyes - more desperate.' Huge quantities of tranquillisers are dispensed in women's jails. In Styal fewer than 10 per cent of the inmates, [prisoners], are free of medication.

Dr Louisa Snow, a prison suicide prevention adviser, said: 'Women tend to be primary carers for their children, so the impact of leaving them behind is enormous. There are only 19 women's prisons, so they are usually much further from their families and have fewer visits.'

Hall believes women inmates, [prisoners], differ from men in positive ways too. 'You can harness peer support and responsibility more naturally - it is a natural thing for them to share emotions,' he said.

Peer support is evident in Styal's Listeners scheme, where a group of inmates, [prisoners], trained by the Samaritans is on call around the clock to listen to women who need support. Styal is also pushing art, sport, dance and education courses.

The Government too has a new approach. Prisons Minister Paul Goggins launched a Women's Offending Reduction Programme last month to tackle mental health and drugs problems.

Most Styal inmates, [prisoners], feel that on release they are replanted in environments that caused them problems before, with little or no support. In some cases, they feel even worse off. 'It's ridiculous that I stole a purse to get by last time I was released. This prison has really improved, but there is still no one to help keep us straight when we get out,' says McKeever.

ED: Actually some men are biologically women in that they are more women than men, that means men suffer the same if not similar problems and some are also primary carers for children and suffer from detox problems. The real answer is that we are all people and to solve any problem holistically one must go to the root and the root is a human being and not a women or a man. Therefore there is really not much difference with the way people suffer, prisoners' suffer, and prisons are barbaric in relation to punishment especially in the 21 century and they should be abolished.

On 27 May 2004 Izhar Haque will be applying for bail to the NSW Supreme Court. Izhar is a third year medical student who is presently languishing in isolation, with no access to legal or medical support, at Goulburn High Risk Maximum Security jail.

Izhar is one of the new victims of Australia's draconian civil liberties deprivation laws. He has been accused of visiting a group that was not proscribed until ten months after Izhar's alleged visit.


Izhar's friends describe him as a placid, loving, caring person who was studying medicine to save lives. Izhar's life has come to a halt. Your loved ones could be next on the government's hit list.

Pakistani militant group Lashkar-e-Tayiba has been branded a terrorist organisation by Australia, the US and Pakistan. It's been accused of being part of the al-Qa'ida network and of planning attacks in Australia.

These are some of the few pictures the world has seen of Lashkar-e-Tayiba, a shadowy military group in Pakistan and Kashmir. A number of Australians have journeyed to Pakistan to train with Lashkar-e-Tayiba. Several are now in jail, accused of terrorist affiliations. Last week Yahya Mujihad former Lashkar-e-Tayiba spokesman and currently with the offshoot organisation Jamat-u-Dawah, gave this rare interview to Dateline.

YAHYA MUJIHAD, FORMER LASHKAR-E-TAYIBA SPOKESMAN (Translation): Even when I was the spokesperson for Lashkar-e-Tayiba I stressed that the organisation was not involved in activities, including international activities we are limited to Pakistan only in legal activities.

That's in stark contrast with Australian Government accusations that Lashkar-e-Tayiba sponsors terrorism here. Yahya Mujihad denies it sends its members overseas.

YAHYA MUJIHAD, (Translation): I want to clearly tell you we do not have our network in the Western world including Europe and America. It is just propaganda of India. Instead of listening to the Western propaganda we need to listen to the facts, we are quite confident that if you go to any court of justice we can prove that we do not have any sort of involvement.

That court of justice could be in Australia. Under our new terrorism laws member ship of Lashkar-e-Tayiba can land you in jail. Young medical student Izhar ul-Haque, currently in Goulburn Supermax prison faces charges for training with the group for 20 days. David Hicks, now imprisoned in Guantanamo Bay is also alleged to have trained with Lashkar-e-Tayiba. French terror suspect Willie Brigitte was accused of planning attacks in Australia under instructions of Lashkar-e-Tayiba handler Faheem Lodhi. Faheem Lodhi is awaiting trial in Goulburn's high security prison.

YAHYA MUJIHAD, (Translation): Let me tell you we have no reason to send people to Australia and to fight there, why should we do that? We do not believe in terrorism and we do not act on that principle. We consider ourselves Muslims and Muslims do not approve of the killing of innocent people. I told you that we focus on Pakistan and we focus on issues of Pakistan, there is no room for people who come from outside and it's not possible to go outside and provide training to people.

Lashkar-e-Tayiba was founded in 1990 to wage an Islamic war in the Himalayan province of Kashmir. It has been accused of scores of atrocities against India, including the bombing of the Indian parliament in 2001.

YAHYA MUJIHAD, (Translation): It's purely a Kashmiri organisation and that is their fundamental human right to fight for freedom and achieve their objectives. It is belief that Kashmir should have sovereignty and independence and we extend our support for their struggle.

Many of the world's Islamic terror groups were born here in Afghanistan during the jihad against the Soviet occupation. From here fighters went on to form terrorist cells in South and South-east Asia. US intelligence agencies argue that Lashkar-e-Tayiba has strong links with al-Qa'ida, but former spaitionperson, Yahya Mujihad is equally adamant that this is not the case.

YAHYA MUJIHAD, (Translation): Let me tell you during the Afghan Jihad there used to be Arab individuals and people from all walks of like, but we were not represented there as an organisation. So far as the allegations of our connection with al-Qa'ida are concerned, it is the propaganda of India. You should look at the abuses in Kashmir. I think the world has to look into reality.

The battle for Kashmir is fundamental to how Pakistanis see themselves. Even when President Pervez Musharraf band Lashkar-e-Tayiba and a number of other Pakistani militant groups he pledged to continue the struggle for Kashmir.

PERVEZ MUSHARRAF, PAKISTANI PRESIDENT (Translation): Kashmir runs in our blood. No Pakistan can break links with Kashmir. The whole world knows this, all Pakistanis know this.

The issue is so much in the blood of Pakistanis that in an interview with Dateline last month the president, himself, forgot the group was banned.

PERVEZ MUSHARRAF: Lashkar-e-Tayiba has not been banned. Lashkar-e-Tayiba is not threatening anybody. Who has told you that they are threatening anybody? It is Jaish-e-Muhammed that has threatened, and Jaish-e-Muhammed is banned.

MARK DAVIS: I might clarify that, it might be a pronunciation problem of mine, Lashkar-e-Tayiba this is not a banned...

PERVEZ MUSHARRAF: No, no, no. Certainly this is not a banned organisation.

MARK DAVIS: You put them on a watched list, have you?

PERVEZ MUSHARRAF: Yes, yes.

Despite being outlawed, official leniency has allowed Lashkar-e-Tayiba to continue under new names. Mayiya, a Lashkar-e-Tayiba commando and MBA graduate claims he is just one of hundreds of thousands of registered members. He has recently returned from Jihad in Kashmir.

MAYIYA, LASHKAR-E-TAYIBA COMMANDO (Translation): If the Pakistan government is putting pressure on us that is because of the pressure they are subjected to by America.

To become a commando fighting on the Kashmir border he under went three stages of training.

MAYIYA, (Translation): The basic training goes for one month, for the special training you undergo two months of exercises and for the commando stage it's an additional six months training.

Despite allegations that Lashkar-e-Tayiba continues to act as a training organisation for al-Qa'ida, spokesman Yahya Mujihad claims the training camps have now been shut down.

YAHYA MUJIHAD, (Translation): It's alleged that there is training centre 38km from Lahore, but how is that? It is ridiculous to have it right under their noses when Pakistan has gone as far as the mountains to apprehend people. And even in the mountains Pakistan has dismantled the training centres so how is this possible?

Despite his protestations of innocence, Lashkar-e-Tayiba is reportedly still recruiting, but it remains to be seen whether it's just for Kashmir or beyond.

The only time you are guaranteed time out of your cell is on the weekend.

6 months to see a doctor, you have nothing in your cell and you have nothing until you submit.

Faheem Khalid Lodhi, 34, was arrested yesterday allegedly as part of investigations into the activities of deported French tourist Willie Brigitte, because he breached his visa.

The Government issued the confidential report on Wednesday night by Colonel Richard Tracey QC into a military inquiry that found the Defence Intelligence Organisation (DIO) reports what the Government wants to hear.

Faheem Khalid Lodhi was refused bail in Sydney's Central Local Court after appearing on allegedly seven terrorism-related charges. [Used as a scapegoat for the Coalition of the Killing to bolster support and quell dissent for their illegal and degrading resource war's in the Middle East.]

The prosecution is alleging Mr Lodhi possessed plans for a major infrastructure facility in Australia and had enquired about the price of chemicals while using a false company name. He is also accused of recruiting for a terrorism organisation. [Using draconion laws to prosecute him.]

Outside the court, his lawyer Stephen Hopper says authorities have not conducted their investigations properly.

"They botched it in the first instance, they should have kept my client and a number of others involved in this under a lengthy period of surveillance," he said.

"They failed to do that so they don't really know what's gone on, and they've made a reconstruction on certain facts that could have many other interpretations."

Mr Hopper says Lodhi was an acquaintance of Willie Brigitte's, but denies ever being involved in a terrorist organisation.

Conditions in the HRMU

Justice Action is trying to obtain documents on behalf of prisoners held in the Goulburn High Risk Management Unit (HRMU) from the Federal Attorney General's Department, Corrective Services Minister's Conference regarding the process described below, in which the Standard Guidelines for Corrections in Australia were adopted.

This documentation will help explain the justification for the conditions in the HRMU.

After receiving complaints from several prisoners regarding the air and light conditions inside the cells, we compiled some research into the Standard Guidelines for Corrections in Australia (SGCA). It is clear from our research that, in the adoption of the UN Standard Minimum Rules for the Treatment of Prisoners (UN SMR's) to the Australian context, the "Rules" changed to "Guidelines" and the substance of the material changed significantly. These changes relate directly to the conditions in the HRMU which appear to breach the UN SMR's and partially the SGCA.

Terrorism suspect faces possible life sentence

A young unemployed man accused of planning a terrorist act faces a possible life sentence after becoming the first person charged under the nation's new [draconian], counter-terrorism laws. [Scapegoat laws.]

There are also remand prisoners at HARM-U one Prisoner "S" sent to prison for malicious damage to a motor vehicle a minor charge but after he was put in a cell with a child molester at the Remand Prison Long Bay was charged with the murder of his cell mate and has remained at the HARM-U ever since on remand. "S" was diagnosed with Schizophrenia.

When I complained that the prisoners housed at the HRMU were being denied their mail since October 2003, which included authorities Justice Action sent them for us to deal with their medical complaints because the prisoners hands were tied no-one including the Corrections Health Service, the Ombudsman or Human Rights and Equal Opportunity Commission would help. Even though the prisoners medical complaints fell on deaf ears because the prisoners were self-harming due to the conditions.

The Ombudsman as follows, Mr Vince Blatch Letter dated 8 January 2004,

" Corrections Health staff provide medical care. However, its staff's authority is essentially limited to making recommendations to corrective services on treatment. Corrective Services staff can then decide what treatment can be given."

Now corrective services we are told can agree to medical treatment or not over and above trained medical staff?

So we sent our Authorities into the prison with the Prisoners Legal Service as follows,

Will Hutchins Senior Solicitor PLS dated 16 March 2004,

"I returned from leave yesterday. Prior to going on leave I sent the authorities to Manfred Dougall & Company, solicitors who do visit for us at Goulburn Correctional Centre. For your information, I enclose copy of their reply dated 26/2/04 advising of their unsuccessful attempt."

The Human Rights and Equal Opportunities Commission's Ms Rocky Clifford sent Justice Action a letter dated 16 April 2004 after we made a complaint to them as follows,

"I also note that your concerns fall into the second category. Under the Act "human rights" is strictly defined and relates to those rights and freedoms recognised in the provisions of the international human rights instruments scheduled to or declared under the Act, such as the International Covenant on Civil and Political Rights. The provisions that relate to human rights require that the subject matter of complaint arises from an act or practice of the Commonwealth government. These provisions are therefore not applicable to an act or practice of the NSW Department of Corrective Services.

I note that it is not apparent that any of the individual prisoners that you mention are being held by the NSW Department of Corrective Services on behalf of the Commonwealth. Therefore, the conduct about which you complain does not constitute a breach of human rights as defined by the HREOC.

If Justice Action is not an organisation that would be providing legal representation and assistance to the prisoners, then it does not appear to be the case that the Department is denying these prisoners legal assistance by any refusal to allow Justice Action to access them."

If the idea that now we have alleged *terrorists* housed at the HRMU and now collectively all the prisoners housed there including the alleged terrorists will not receive or send mail at all then how do the prisoners including the alleged terrorists tell people who care what difficulties they are faced with? Especially when the prisoners are self-harming and no one not even a Legal Aid Lawyer can get in to represent them.

These prisoners are being denied their right to legal assistance; their right to give instructions, their right to waive their privacy in order to get and receive community support. These are extremely urgent matters that involve fundamental human rights of communication, which we complain about for ourselves and for all those concerned.

Prisoners at the HRMU are the most vulnerable in the State and need continuous access to assistance without any blockage or even perception of blockage.

High Risk Management causes mental illness and self-harm and you should be very alert and alarmed and if you see Alexander Downer approach him and tell him he is armed and very very dangerous. Sending people especially young people to the HRMU is very dangerous to their mental health screw the politics of fear.
