Four Corners [Walls] 'CASE AGAINST DAVID HICKS'

The real story of David Hicks...? what is the evidence against the accused Australian citizen as he prepares for a US Kangaroo Caught. And what has happened to him while in an American/Cuban gulag?

Four Corners [Walls]: The Australians, the Americans, they all know this is a facade, this is a farce"... David Hicks US lawyer Josh Dratel.

Four Corners [Walls]: He knowingly joined the Taliban and Al Qaeda. [Rubbish! He may have associated with the Taliban.] I don't have any sympathy for anyone who's done that"... Prime Minister John Howard? [Does he have any sympathy for liars?]

Four Corners [Walls]: David Hicks came cheap. [nothing] As US-backed Northern Alliance fighters routed Afghanistan's Taliban in late 2001, they seized the fleeing young Australian at a taxi station. Then they sold him to the Americans for $1000.

Four Corners [Walls]: Next month, when Hicks is due to front a US military commission on terror charges.[Scapegoat Charges!]

Four Corners [Walls]: While Hicks has co-operated with interrogators, his case has irritated Washington and Canberra, stirring persistent allegations about American treatment of detainees and Australian acquiescence.

Four Corners [Walls]: "What did David Hicks do to become one of the first Guantanamo detainees to face military trial - and the prospect of spending the rest of his life behind bars? There is no doubt he spent time in training camps. But did he, as charged by the Americans, conspire with Osama bin Laden to commit terrorism, aid enemy forces and try to kill coalition soldiers?" [Well he had nothing to do with the George Bush demon Osama and no one can find him to find out?]

Common Sense: David Hicks is pro-government propaganda fodder for Four Walls and a scapegoat for the illegal and degrading wars in Afghanistan and Iraq. And there is doubt about everything, until he can tell his side of story which incidentally, doesn't even need to be told because people already know the real truth. So what are they trying to say just one month before his Star Chamber? That he's guilty?

Four Corners [Walls]: Four Walls unravels the story of David Hicks from his early days doing drugs and menial jobs boning chickens and filleting kangaroos, through his restless years of yearning for inspiration and adventure, to his conversion to Islam and his fateful journey to Afghanistan."

Common Sense: Low life Four Walls is just getting in on the sensationalism and adding irrelevant material like, doing drugs, and boning chickens so the inference is that he is no good anyway for little johnny hoWARd the coward before David is tried and convicted.

Common Sense: But who didn't do drugs and who didn't eat or work and what's that got to do with the price of eggs?

Four Corners [Walls]: "This investigation throws new light on Hicks' role as a trainee fighter in Pakistan and Afghanistan - and on his starring role as the only Caucasian scheduled for military trial."

Ed: She also brings up David Hicks's past to make him look worse or at least somehow worthy of his current treatment? And by carefully using words rubs his face right up John Howard's arsehole, to boot. Four Corners is okay when they're doing the community a service by exposing corruption but when they act for John Howard's war agenda propaganda machine they should be culled as any sort of human rights advocates. Shame!

News on David Hicks:

David Hicks will be tried on scapegoat-related charges before a controversial US military rendition on November 18.

The US announced Hicks's first scheduled motions hearing at the US military base at Guantanamo Bay, Cuba, would take place on that date, a month later than expected.

The 30-year-old Australian citizen, formerly of Adelaide, would be the first Guantanamo prisoner to be tried by a military 'caught' at Guantanamo Bay.

Hicks is being used as a 'pawn' for prime Meanster john hoWARD's war crimes against humanity. HoWARd has also been linked to his co-offenders, tony bliar, and george w bushit's, US Military Industrial regime.

David is being used as one of hoWARD's terrorist scapegoats to legitimise his illegal and degrading wars in Afghanistan and Iraq but now David has been charged with conspiracy to commit war crimes? Attempted murder? By an unprivileged belligerent? And aiding the enemy, even though he's been locked up throughout nearly the entire war on Iraq and Afghanistan since 9-11 and the US led pre-emptive war on the sovereign nations.

But in the meantime the Coalition of the Killing who have not been charged with any crimes against humanity have gone on to kill hundreds of thousands of innocent men, women and children, a contradiction in terms.

Last week, the US pointed to the initial motions hearing beginning mid-October for the accused Australian citizen.

The date gives David some more breathing space as he attempts to become a British citizen and avoid the trial. Because then, he can't be used by hoWARd as an arse-wipe for the dictators crimes against humanity.

Scheduling conflicts were named as the reason for the delay in the date.

"The reason for the change is that after taking into consideration the schedules of counsel, the presiding officer set the initial session for 18 November," a US war criminal said.

The motions hearing, which won't tackle the illegal issues, is expected to take about a week.

A kangaroo caught session will follow where Hicks's defence lawyers and the dictators will have the opportunity to challenge the appointment of the three 'panel members' who will 'act' as jurors but won't 'be' jurors in a true sense at Hicks's commission trial.

The fully flawed star-chamber will commence following these two hearings, although no date has been set.

Hicks was caught in Afghanistan while 'allegedly' fighting alongside the Taliban Islamic-indigenous people against the US-led terrorists, who invaded their sovereign nation after the September 11 attacks.

Hicks, is attempting to avoid the military rendition 'caught' by becoming a British citizen. His mother was a British citizen, making him eligible to apply for British citizenship.

The British government refused to allow any of its nine inmates held at Guantanamo Bay to be tried because of concerns the US military tribunals did not meet international justice standards.

The delay until November could also give Hicks valuable extra time with his US District Court challenge of the legality of the military commission process.

A key ruling by US District Court judge Colleen Kollar-Kotelly has been pending since July. The judge is deciding whether to lift stay and allow Hicks to challenge the military rendition in her court.

If the judge lifts the stay, his military rendition dictatorship could be halted and indeed should be halted.

Government must ensure justice for Hicks

The Australian Catholic Social Justice Council is calling on the Australian Government to secure real justice for Australian citizen David Hicks. The call follows a Pentagon announcement of a resumption of military commission hearings at Guantanamo Bay.

Bishop Christopher Saunders, Chairman of the ACSJC said, "For more than three-and-a-half years David Hicks has been held by the U.S. authorities - for most of this time without being charged.

"Only recently David Hicks was charged by US authorities with conspiracy, attempted murder and aiding the enemy. And it is unlikely that subsequent changes to the military commissions that would make them function more like a traditional judge and jury will ensure a fair trial.

"Legal experts in Australia and overseas have criticised the military commission process. The Law Council of Australia has said the proposed changes to the military commissions amount to 'tinkering around the edges' and that the standard of justice remains inferior to that afforded before a non-military court.

"Australians believe that all citizens are entitled to their day in court and the protection of the rule of law should they be accused of an offence. We believe this right must be guaranteed, regardless of the nature of the charges against an individual. David Hicks should have access to the ordinary processes of justice if he has done anything wrong.

"The detention of David has gone on for too long. I call on the Australian Government to use its best endeavours to end the detention of David Hicks. It should do this by either seeking a proper trial before a non-military court or returning him to Australia", Bishop Saunders concluded.

It is quite encouraging to see other organisations, especially religious and in particular Christian groups, voicing their concerns on the military trial of David Hicks and at the his treatment by the Australian Government.

David Hicks would have been freed long time ago if it wasn't for the Australian Government's total disregard for David's human rights. In June 2004, after almost 3 years of imprisonment and the visit of John Howard to the US, David was charged with charges that could not withstand a legitimate court or civil trial.

However, David is not the only Australian to have become the sacrificial lamb of this arrogant government. Other Australians include: Ahmad Aziz Rafiq, held initially at Abu Grahib and then transferred to another prison camp (?), Talaal Adree in Kuwait, Ahmed Jamal, and Mohamad Abbass in Egypt.

According to Amnesty there are in the vicinity of 70,000 prisoners held by or at the behest of the US administration around the world.

Remember David has been imprisoned and tortured since December 2001. It is time for David Hicks to be freed.

I have written countless letters to MPs, Kim Beazley's office responded to one of them 2 and half months after receipt. This is the importance the Opposition gives to this human rights issue.

a cowardly disgrace .....

Whilst US lawyers continue their fight to secure the legal and human rights of Australian citizen, David Hicks, his government has quietly reaffirmed its decision to abandon him to his fate.

On the 4th anniversary of the [US false flag operation on] September 11, more than 200 detainees at the US concentration camp at Guantanamo Bay are continuing a hunger strike to protest their ongoing illegal detention & treatment.

Among the Guantanamo Bay inmates [prisoners] is Australian, David Hicks, who has been held by the US for nearly 4 years: tortured; denied his legal & human rights and abandoned by his own government.

In the face of strenuous opposition from Bush administration lawyers, 3 federal appellate court judges yesterday expressed doubts about the US government's assertion that hundreds of foreign nationals imprisoned indefinitely in Cuba have no right to challenge their detention in US courts.

The remarks from all 3 judges on a panel of the US Court of Appeals for the District of Columbia Circuit came during oral arguments in the high-stakes dispute over whether the Bush administration is properly detaining prisoners at the military prison at Guantanamo Bay and whether special tribunals it established are sufficient to determine the detainee's guilt or innocence ( Judges Question Lack of Prisoner Rights -

At home, a small group of Australian politicians continued their efforts to secure justice for David Hicks.

Their efforts last week were recounted by Alan Ramsey in yesterday's Sydney Morning Herald.

'At 3:37PM on Wednesday afternoon, the Democrats' Lyn Allison, her party's latest federal leader, formally asked the Senate to adopt a cross-party proposal sponsored by the Democrats' Natasha Stott-Despoja ( South Australia ), Labor's Linda Kirk ( South Australia ) and the Greens' Bob Brown ( Tasmania ). The wording, though lengthy, should be read in full.

It said: 'That the Senate -

(a) notes (1) the right of all Australians, regardless of their alleged crime, to a fair and reasonable trial;

(2) the number of serious doubts raised by legal and military experts, including retired High Court justices Mary Gaudron and Sir Ninian Stephen, the presidents of the Law Council of Australia and the 14 Law Societies and bar associations of the states and territories of Australia, independent Law Council of Australia observer, Lex Lasry, QC, head of the Australian Military bar, Captain Paul Willee, QC, Mr Geoffrey Robertson, QC, the American Bar Association, 3 United States military commission prosecutors and sitting High Court of Australia justice Michael Kirby, who regard the US military commissions as unust;

(3) that Spain, France and the United Kingdom have all refused to allowhttp://www.blogger.com/img/blank.gif their citizens to be tried before US military commissions and (4) the comments by the UK Attorney-General, Lord Goldsmith, that 'the United Kingdom have been unable to accept that US military tribunals offer sufficient guarantees of a fair trial in accordance with international standards'; and

(b) calls on the Government to advocate for Mr David Hicks's trial to be conducted in a properly constituted court with rules of procedure and evidence that meet Australian and international standards of fairness.'

The Government's Senate majority threw it out without debate. Not a word. The reading of the motion and its defeat, on the voices, lasted one minute. That is the only right the Howard Government accords Hicks - the right of his country's national legislature to spend 60 seconds in trashing, without argument, a request he get a fair trial.

Hicks, a convert to the Islamic faith, was 'captured' with Taliban 'fighters' in Afghanistan on December 9, 2001, by 'forces' of the so-called Northern Alliance, who handed him over to 'US authorities', according to Amnesty International. He was incarcerated at the US military's camp at Guantanamo Bay, Cuba, in January 2002. He has been there ever since, mostly in isolation. Total: three years and nine months. Whatever he has done - and there is no detail - he is an Australian citizen whom his Government denies all rights under Australian law. It has abandoned him to the US military to do as it wishes.

Such is Howard's Australia.

It happened in your Parliament this week without, as far as I am aware, a flicker of either media interest or general knowledge.

However, although the Howard Government cares nothing for Hicks's rights, overnight Thursday Australian time, a panel of 3 judges of the US Court of Appeals, for the District Court of Columbia, again began hearing argument in the continuing legal battle over whether 505 Guantanamo 'detainees', including Hicks, have a legal right to 'due process'. It is an unresolved battle, going on since June last year.'

How pathetic is it that US lawyers are doing more to secure the human and legal rights of an Australian citizen than his own government?

There are 76 Senators in our Parliament and 'on the voices', more than half don't give a tinker's cuss that David Hicks will shortly confront a US Military Commission, especially created to ensure a guilty finding.
