Prison visits in crisis in NSW

The reason I am writing today is to address a difficult situation that my husband and my family are going through. My husband is currently serving a sentence at Lithgow Correctional Centre in NSW.

On the 20th of November 2004, an incident took place at Lithgow Correctional Centre due to my poor level of concentration during the visit.

On that day I was taking my husband a pair of pajamas and mistakenly left my own cell phone in the same bag as his pajamas when I passed them to the prison officer at the entrance of the prison.

The pajamas were meant to be taken though the jail's reception room and on to my husband from that point. Not my personal phone and because I accidentally left my phone in the same bag when it was located by the officers I was accused of trying to pass off my own mobile phone with the pajamas to my husband and now I have been banned from visiting my partner for 3 years.

In March 1999, after finding out he was in one of the NSW prisons I was finally able to locate him, at Lithgow Correctional Centre. Then I proceeded to pay a personal visit not only in disbelief but also in great fear because the prison would be a new environment to me.

Soon after my first visit I had to make a decision as to whether I wanted to continue to place my family and myself in this institution. I eventually decided to keep visiting the prison on a weekly basis considering that my husband and I had a long history together and after seeing where he was I thought that I couldn't let him go through this process alone.

Unfortunately little did I really know at the time what I was about to experience in my life. During my visit to the prison I have personally encountered and witnessed so many terrifying scenes.

For several years when visiting the prison I have made different attempts to find a way of understanding the system. Not only by making verbal complains but also writing letters of complaint about several issues that my family and I have been exposed to. But instead I have now became a target, and set up to fail on different occasions and have constantly been tormented by officers for speaking up for it. I have requested legal explanation for the officer's abuse to me and my family directly.

I found it extremely impossible to be able to concentrate and focus 100 per cent of the time due to my human nature when visiting Lithgow Correctional Centre. I have been forced not to make a single human error when dealing with them or look out.

Today I am facing a similar incident again like that which had occurred on 19 September 2002, when I was banned for 2 years due to prison officer's making claims against me. On that particular occasion I was forced to seek Legal representation due to my lack of knowledge and understanding about how to address the horrible issues I was experiencing with the Department of Corrective Service (DCS).

Back then a summons was served on DCS by the solicitors representing me at the time and the case was dropped before the court hearing at the NSW Supreme Court. Subsequently after the hearing I was granted access to visit my partner.

Since then however, the personal issues I have faced, in a very cruel manner, exposed me to be humiliated and diminish as a woman once again by the DCS in every way possible. And to the extend to that I was forced to abandon my job due to the high level of stress that I have been exposed to by officers when attending Lithgow Correctional Centre.

DCS are violating and abusing our human rights in every way possible. This behavior would never be tolerated in our social environment. Yet no rules are applied to those abusing visitors' human rights and standards. Therefore causing single mothers, families, and friends to lose their privacy, dignity and respect as human beings. In a majority of cases visitors are then forced to leave their loved ones abandoned and forgotten because of the emotional pressure and environment of the prison regime. DCS are making it hard for families and friends to be able to know each other.

I am so disappointed not finding a solution to my personal situation. Unfortunately after having to mention my personal matters with a few public authorities I haven't been able to get any reasonable assistance either.

On 17 December 2004, I contacted the NSW Ombudsman's office by telephone and had a conversation with Ms Samantha Guillard, Complaints Officer, Corrections she stated that there wasn't much she could do in regards to our family situation due to the Department of Corrective Services discretionary powers. Then she added I was not the only person suffering as a visitor when visiting the prisons and also stated that I could take it further by using my own legal representation.

I then phoned the Prisoners Aid Association, and I explained that my partner and myself were encouraged instead to remain silent because it was obvious that my complaining was not only jeopardising my privilege as a visitor but my partner as well being within the prison due to officers retributions.

There are hundreds of families suffering the consequences of the prison system. A prison system out of control in my view that is emotionally and psychologically affecting those families when they are constantly being set up and exposed to mind games by officers within the prison system.

I have personally been going through so many difficulties with the DCS due to officers over using their power of authority and while performing their duties.

It's unspeakable and humiliating what they have put my family through lately The Prison has a fancy name for their misbehavior and it's called Maintaining Security and Order of the Prison, but I can assure you there is no such thing. The majority of groups affected by this cultural style of management are only inmates, families and their friends who are visiting them.

During the years I have attended those centers for visits while waiting to have access to the visitors reception office I have been a victim myself. My family has witnessed the officers work culture and work performances since 1999 on a weekly basis. There have been some cases where the officer's allegations could be valid against visitors but 95% of the time every single visitor is treated as a criminal for visiting the correctional centre.

I have been embarrassed, brought to tears in front of officers and visitors alike because of this constant harassment by prison staff each time I have attempted to visit my husband.

On the 1 August 2004, while attending Lithgow Correctional Centre visiting my partner, one officer related to him so badly that he humiliated my children and I in front of everyone. Then the prison officer terminated my visit for asking why! Why was my family and I constantly exposed to such horrible humiliation in front of everyone? I was told by the same officer and some senior officers that I was going to be reported to the governor, like I was the prisoner.

The following week I waited to see if the governor would have something to say in regards to the altercation with the officers concerned but nothing was mentioned. I did not want to make my life impossible and personally kept quite to avoid more issues but it has been very near impossible to live in silence because it has started to affect my health.

Another issue was that when booking my visit at Lithgow it had to be done twice a week instead of once a week. After several times I had called early in the week and booked it no problem but when I showed up at Lithgow to visit, my booking wasn't listed Due to their inconsistency I was forced to call early in the week and later on Friday. I must call again to double-check to avoid and minimise horrible dramas and financial hardship on our family by taking the time and cost to visit only to be denied when we arrived after many hours journey to get to the prison.

My visit on numerous occasions has been denied due to the officers discretion and in one of the latest incidents when making a verbal complaint to a high seniority officers about an officers horrific manners toward our family I was told that it's only a perceive harassment and everything they were doing was their jobs?

The majority of the people paying the consequences are single mothers, and in most cases with little babies who happened to travel by public transport for hours and hours in order visit their love ones in prisons. Not forgetting that the same long journey will be a lot longer to get back home as they have to wait for hours outside prison for the only bus that came back again to the prison hours later when their visit are cancelled for one reason or other. Woman in particular are constantly targeted, and abused beyond comprehension.

During these past years all I could hear was that it's about crime in the prison system but there was nothing said about the horrific emotional abuse that families are exposed to. We all hear about drug dealing, smuggling, and contraband but: is the real truth been said? For I have a real story how I was set up to fail and set up as a criminal and when I think of the cruelty and dishonesty that was done to me I'm overwhelmed by what could happen to my husband and other visitors.

I have been set up as perfect prey to cover up the officers corrupted ways in running the prison system, It's proven reality that there has been prison officers caught up in corruption while performing their duties and working for the Department of Corrective Services. They have done the same to visitors in my situation by anylising the inmate visitors intellectual levels and setting them up to fail in every possible way imaginable in order to establish their own domain and rules that only benefit the department. Inmates and families are disadvantaged and in a vulnerable situation.

Maggots in the meat!

I am also very concerned regarding the meals provided by the Lithgow Correctional Centre to inmates. My husband tells me how bad they are. I get extremely worried when I discover that there is nothing being done to stop him and other inmates from eating those meal portions. On so many occasions they get very sick due to food poisoning.

Since the last time David got very sick I have begged him not to eat anything given out by the prison and it was better to place an extra food order from the buy ups to avoid eating the rotten meals from the prison.

Their meals on so many occasions have gone off, not cooked properly or rotten after sitting outside their wings parked in trolleys and exposed to the sun for long periods, even hours. When I asked David all he said was, "Look that's how it is for us! But, don't worry."

I asked my local member of parliament Mr Allan Shearan MP , Member for Londonderry about what would be the best thing for me to do in regards to this matter effectively.

He writes: "You will recall I made representations on you behalf to the Minister for Justice concerning your request for a review of the 3-year ban on your visits to all correctional centres in NSW.

Following a review of your request, the minister has advised me that the ban has been upheld in view of the serious nature of the incident.

The minister further advises that the Department is prepared to consider revocation of the prohibition after 23 November 2007, upon formal application in writing from you at the time.

I trust this explains the position on this matter and I thank you for allowing me to assist you with this matter.

The following is from Mr John Hatzistergos Minister of Justice to Allan Shearan MP.

"I refer to you representations on behalf of you constituent, Mrs Mercedes xxxxx of xxxxx who has requested a review of the three year ban on her visits to all correctional centres in NSW.

Mrs xxxxx also sent a similar letter to my office, addressed to one of my staff.

The Commissioner of Corrective Services has advised me that as a result of your representations, Mrs xxxxx visiting privileges were reviewed by the Executive Director, Office of the Commissioner.

However, I am advised that this current prohibition has been upheld in view of the serious nature of the incident, which involved the attempt by Mrs xxxxxx to introduce a contraband item into Lithgow Correctional Centre.

I am further advised that this is the second occasion in which Mrs xxxxx has been involved in an incident whereby contraband was secreted in property being deposited for an inmate.

The Commissioner has further advised that the Department is prepared to consider revocation of the prohibition after 23 November 2007, upon formal application in writing from Mrs xxxxx at the time.

Yours faithfully
(John Hatzistergos)

After having to deal on my own with this disgusting and dishonest response from the Minister and the corrupted prison system I cannot believe that I am expected to just let them do this to me.

I have not done what those officers at Lithgow have accused me of doing and my husband is being treated like an animal in a cage and not like he's a human being in a state prison.

David only has me to support him whilst in custody. What I want to know is where is the integrity from the staff of the correctional center for the visitors who have given up so much time and effort to be there with their loved ones?

The triviality of the phones is only half the story - the Department could not factually verify that Georgiou ever had phones in his cell, had never investigated the matter, and had never charged Georgiou for such an offence.

Further, when examined by James J, John Salway for the Department conceded that he was " not sure" whether the Commissioner had designated Georgiou because he constituted an extreme danger to other people (cl 25 (2)(a)), or because he constituted an extreme threat to good order and security (cl 25 (2)(b)), or both.

However, the Department and the prosecution were not finished - there was another reason for the designation: "Yes your Honour. On the basis of risk, perceived risk of escape, for the good order of the institution."18 Unfortunately for the Department, or rather unfortunately for Konstantinos Georgiou who has now spent more than 16 months in the HRMU, the Department has never classified Georgiou as an escape risk.

Of course, for an E1 or E2 classification to be made pursuant to cl 24 Crimes (Administration of Sentence) Regulation, evidence would need to be tendered - an
unnecessary obstacle to Commissioner Woodham when designating "high risk" prisoners.

However, as it became obvious to the court that Georgiou's placement was baseless, Mark Phillip Wilson tendered in affidavit:

PM Cold Hard Criminal

IT'S the crimes he's committed but the community is not coming to terms with his unofficial role as "Prime Minister of War Crimes".

Mr HoWARd should have reflected yesterday on how nine years in office has been shaped dramatically by a series of crimes against humanity, which started with Afghanistan and has been followed by Iraq with the torture of Australian citizens at Guantanamo Bay Cuba.

Reviewed by the Australian public, the man frequently criticised as lacking the human touch shows no compassion by reaching out to kill tens of thousands of innocent men, women and children in the name of democracy. People whose lives have been shattered by the illegal and degrading war and subsequent torture of both Iraqi and Australian citizens.

Community: "It's very important that people who commit war crimes making people suffer great tragedy should not maintain any integrity in the role as Prime Minister of Australia. Why should the Australian people have to deal with a leader who doesn't understand that and is ambiguous in his expression of feeling compassion?" The community said.

"HoWARd has literally grabbed hold of people and said, "I am not sorry" and half the country feels that he should be tried at the Hague for his war crimes against humanity and tried in Australia for his complicity to torture and condemn Australian citizens. People who you have locked up in isolation that are innocent yet treated like the worst of the worst criminals."

The community was speaking after his flying visit to the stricken Indonesian province of Aceh, which brought him face-to-face with an Indonesian woman whose leg had been amputated and whose husband and children died when the tsunami struck.

"We know HoWARd is sucking up to the wounded and sick in Aceh but to try and gain some political points as some sort of soft touch because of the tsunami is HoWARd's way of exploiting disasters which he's done time and time again. As with 911 and the Bali bombings and this is played up by his ABC and the corporate media, regardless of his recklessness and contempt for the Australian people."

Howard: "They have so little and we can really help in so many ways. In these sorts of situations I have just responded, I hope, as a compassionate human being. You just have to be your natural self and reach out to people."

Community: "Like you reached out to the people of Afghanistan and Iraq? And like you reached out to the alleged suspected terrorists, [scapegoats] innocent people held in isolation in Australia's prisons at your political leisure."

During his visit to Iraq, HoWARd didn't find himself in the unthinkable situation of walking down a main street of Baghdad and taking a telephone call of gratitude from President George W Bushit while Australian militants attacked and maimed Iraqi citizens.

Community: "We know it was a crime against humanity," they said.

"There were lies and pre-emption in it but there was also reality. They are genuinely critical for what HoWARd has done," the community said.

The Federal Government seized Mr Habib's passport when he returned to Australia last week, after spending more than three years in US custody.

The US released Mr Habib without charged but the Australian Government maintains he is a security threat.

Mr Habib's lawyer, Stephen Hopper, says he is prepared to challenge the Government's case against his client before the tribunal.

"This matter will probably be ventilated before the tribunal," he said.

"We don't want to start a public debate on the reasons until we put our position in the proper forum."

Australian held in Baxter detention centre

It has been revealed an Australian resident has been locked up in Baxter Detention Centre in South Australia for the past four months. Authorities had been unable to establish her identity since she was found wandering in far north Queensland last September.

The young woman, who refugee advocates claim suffers from a mental illness, has been released.

It is understood she is being flown to Adelaide.

Immigration Department spokesman Andrew Gavin says the woman's identity has now been confirmed.

"A woman who had been in immigration detention at Baxter has been identified as a permanent resident of Australia and arrangements are being made to reunite her with her family here," he said.

"She's no longer in immigration detention and she's being cared for at the moment by state authorities."

Mr Gavin says the department made extensive efforts to establish the woman's identity.

"She was located by police in another state and presented to us as being a possible unlawful non-citizen," he said.

"She had no identifying documents and spoke both another language and English and also provided conflicting personal details.

"The department went to great lengths in Australia and overseas to identify her."

'Reprehensible' treatment

Labor's immigration spokesman, Laurie Ferguson, says the treatment of the woman is reprehensible.

"You would wonder whether every person that for some reason wanders around with difficulties and doesn't have identification on them, whether the Government just all of a sudden assumes that they're an illegal or an over-stayer," he said.

"I don't know why that's prima facie the case."

Community links Ellison to corporate greed, organised crime, politics

Ellison buys into WA's home-grown debate.

The Federal fascist Government has accused Western Australian Premier Geoff Gallop of fostering organised crime under laws allowing people to grow small amounts of cannabis?

Injustice Minister Chris Ellison has spoken in support of plans by Liberal leader Colin Barnett to toughen cannabis laws?

What, so we can all go to the doctor to get prescription drugs that doesn't include cannabis? The bottle-shop to get alcohol that doesn't include cannabis? And if we do want cannabis we'd have to buy it from a drug dealer and go down into the criminal underworld or get locked up?

Makes sense to me if you wanted to criminalise the community for smoking herbs, provide fodder for the victim industry and maximise corporate profit! As well as winning the state election for the neo-Liberal fascist party at the cost of the community for a political term.

Senator Ellison says WA Labor's policy on cannabis is too relaxed and undermines cross-border controls.

"One plant harvested four times a year can produce up to eight kilograms of cannabis a year," he said.

"That has a street value of around about $84,000.

"You can see that the potential for the development of organised crime is extremely dangerous."

Actually I can see that in reverse and say, 'that the cost to the community which includes judges, police, lawyers, prison guards, psychiatrists, doctors, nurses, more prisons and wrecked families, outweighs any concerns and in fact makes Ellison's concerns irrelevant'.

The truth is more likely that one plant can only be harvested twice a year at the most and produces up to about two kilograms of cannabis herbs before the plant dies.

And cannabis herbs have a home value of 'pure medicine', including relief from 'depression', drug dealers, corporations and police.

Ellison can see the real potential for the development of 'winning the state election' and corporate greed?

People can also see that the potential for the development of 'legal medicine' which is extremely healthy, and the development 'away from organised crime' which is extremely safe.

Senator Ellison says "grow-your-own cannabis policy" plays into the hands of criminals dealing in drugs interstate.

"In this state, it's well known we have a problem with bikie gangs," he said.

"They're notorious for the distribution of cannabis."

But if everyone who wanted the herbs could grow their own then the 'bikies' would not be notorious for distributing cannabis for the police force or some politician, would they now Mr Ellison?

So that's why the whole country needs to legalise this herb so the politicians, victim industry, drug dealers and corporations don't reek havoc over the community. And so judges, police, lawyers, prison guards, psychiatrists, doctors, and nurses have to find a new way of living.

Peter Hakala: Miscarriage of Justice

THIS IS WHAT IT SOUNDS LIKE WHEN DOVES CRY...

UK: The year was 1986, and on direct instructions from Mr Michael Saunders an Australian police informer who got his wife Mary Saunders to make rape allegations against me. I was subsequently arrested and taken to the police station where I made a written statement on 6 January 1986.

Shortly thereafter Mrs Mary Saunders withdrew her allegation and I was released.

A few days later a Mrs Avigdor contacted the very same police station in London and spoke with the same police officer and had me charge with her rape prompted by Michael Saunders the police informer.

I was subsequently rearrested and have remained in prison ever since.

Mary Saunders then reinstated her original allegation and Michael Saunders made a statement against me and became a listed police witness in my case.

I did not make anymore statements but strangely two other statements turned up on January 10 & 11 1986, unsigned? I was not even in the same location when those two fabricated statements were made and I only made the January 6 statement.

Mary Saunders made her statement January 6 86, she was from an 'outer suburb' of London called Richmond Hill and I was taken and charged at Richmond Hill police station.

Mrs, Avigdor made her statement on January 8, 86, she was from Earls Court an 'inner' suburb of London

In a three-day interim period 19 items were seized for forensic evidence as detailed in a statement from Detective Inspector Shepperdson and other police including DC Hollingsworth.

Police detailed in DI Shepperdson's statement made on 29 January 86, stating the items have been destroyed by the authority?

The trial commenced on 24, July 86, for count 1 Rape - count 2 Assault (occasioning actual bodily harm) - count 3 Rape - count 4 Rape - count 5 threatening to kill, (pleaded not guilty to all charges).

Michael Saunders was made subject of a 'Full Bound Witness Order', which required his attendance at the trial for the prosecution.

Mary Saunders also brought charges against Michael Saunders for violence towards her and a deportation order was issued against him. Subsequently he was deported back to Australia on 25, July 86, one day into my trial and I was not informed about this deportation by the prosecution.

The deportation was raised and addressed in the Court of Appeal, which refused leave on 25 March 88. I gave oral evidence under oath before the jury as advised by my barrister and evidence given by the two interviewing officers was left unchallenged.

The Jury of 12 members retired to consider their verdicts on 30 July 86, and the jury were directed by the judge to issue a unanimous verdict but were unable to and the judge therefore ordered that he would accept a majority verdict.

They found me guilty on count 5 and count 2. However after some 8 hours because they could not agree on the rape charges, the judge discharged the jury and ordered a retrial.

The senior barrister throughout both trials changed around twice. My solicitors originally instructed J Wadsworth QC who prepared for the first trial.

The case was transferred to Arthur Davidson QC who had never seen me or the papers.

Mr Davidson completed the first trial and was logically expected to act in the second trial. Mr Davidson chose to retire from the bar in between the first and second trial. The case was then transferred to Mr Wadsworth who took over until the completion of the second trial.

The second trial commenced on 3 December 86, at Central Criminal Court in London. Three days into the trial on 6 December 86, the judge who normally sat in Southwark Crown Court took the trial with him. I faced charges in relation to counts 1 & 3, & 4 and after five hours of deliberation and a direction by the judge to find a majority verdict, the jury found me guilty unanimously on all three counts.

I sought leave to appeal on 5 May 87. The grounds of the appeal were based principally on Michael Saunders deportation. Leave was refused when the application was heard in the full court on 25 March 88.

On 8 June 98, with a new solicitor an application was made to the Criminal Case Review Commission (CCRC), the application was based on fresh evidence, which cast doubt over the authenticity of the two police interviews. The CCRC, investigated the claim and took the decision on 5 June 2000, that the evidence raised sufficient doubts and referred the case back to the Court of Appeal.

The Court of Appeal refused the application on 19 March 2002. Steps were taken to appeal to the House of Lords however proceedings were abandoned on 14, October 2003.

So 30, July 86 - Central Criminal Court - convicted of assault, found not guilty of threat to kill, jury unable to decide on three rape charges, judge ordered a retrial.

9, December 86 - Southwark Crown Court - convicted of rape 3 counts.

5, May 87, - Court of Appeal (Criminal Division) - leave to appeal refused by a single judge.

25, March 88, - Full Court of Appeal (Criminal Division) - leave to appeal refused.

5, June 2000 - CCRC - granted referral back to the Court of Appeal.

19, March 2002 - Court of Appeal (Criminal Division) -leave to appeal refused.

Forensic Handwriting Document Examiners: Robert W Radley, who completed an ESDA test on 10 & 11 January on the (fabricated statements) stated that the outcome was, that the starting time seemed to be the same as the completion time. That numerous pages have been rewritten. And some further pages had been rewritten from the rewritten pages.

Linguistic Professor, Nixon completed numerous tests on 6 January 86, on the statement which I made and the consecutive statements produced by the police on 10 & 11 January 86. His findings were, if Mr Hakala made the statement on 6 January 86, then he can't be the same person who made the statements on 10 & 11 January 86.

Mr J Wadsworth QC who today is a Judge of the Crown Court sent me a letter dated 6 August 2002, where he stated not to challenge the honesty of the police.

Mr Dave Parry, Chief Scientist Group the Forensic Science Service, on a letter dated 31 October 2003, indicated they have found tapings now of my case which has been stored away and are of the complainants pants (No Semen Stains) and they could not find my DNA on the complainants items.

The police took almost 30 different items to the Forensic Science Service for forensic testing but FSS could not find any criminating evidence against me.

As soon as the two detectives DC Robert Hollingsworth and DI Peter Shepperdson were informed about the ESDA test their story again changed. Also note the record page was written before the front page. Hollingsworth stated, "It was common practice to pre-head the front page".

This is nonsense it is against all instructions and would not be common practice. Hollingsworth stated, "Notes were passed as an aid memoire". But where are these original notes? Police are instructed that all notes must be retained.

Shepperdson stated that all notes were offered to Hakala for examination and signature. He stated that he did not read the notes to Hakala who had declined to sign. By stating "I handed the notes to Hakala" it must be the case that I took hold of the notes according to the police otherwise he would state Hakala refused to accept or read the notes. Therefore my fingerprints and DNA will be present on the documents. The original documents i.e. all three interviews should be provided for testing for the following reasons.

I accept that I was handed the first interview and read it. Therefore common sense dictates they will contain my DNA and fingerprints, but I will state that interview 2 and 3 were fabricated and that I had never been present or had ever been handed the notes to read as stated by Shepperdson.

Therefore if I am telling the truth no DNA or fingerprints of mine will be present by carrying out their tests and it will confirm once and for all whether the two police officers are telling the truth or if in fact they committed perjury and conspired together to pervert the course of justice.

There have been numerous wrongful convictions in the past and this is not the first and will not be the last miscarriage of justice. In response to public concern about wrongful conviction the Government has stated they have an absolute determination to acquit the innocent, yet this is a promise that they cannot fulfil.

Public awareness should be raised of wrongful convictions. Also experienced groups with representation from academic campaign oranisations and criminal appeal lawyers should undertake research that identify the causes of wrongful convictions that effects legal reform of the criminal justice system.

Its contribution to the resolution of wrongful convictions as this case will primarily be its work to undertake and deploy evidence based research into both the causes of and the provisions that exist to remedy wrongful convictions.

This could also educate future lawyers in how wrongful convictions like mine occur and how to overturn them, by developing their skills of investigation and fostering an in dept understanding of appellate procedure. This wrongful conviction should also inject some scepticism into future lawyers. Open their eyes to the realities of criminal procedures.

US judge orders CIA release Guantanamo records

Guantanamo Prison Flight

A US federal judge has ordered the CIA to release records regarding the treatment of prisoners detained in Guantanamo Bay and other facilities in the "war on terror" to a civil rights groups.

District Judge Alvin Hellerstein's ruling rejected a CIA request that he suspend a similar order made in September for the documents to be handed over to the American Civil Liberties Union (ACLU).

The CIA had challenged the original ruling by citing a provision in the Freedom of Information Act, allowing the spy agency to hold on to files still considered "operational".

Judge Hellerstein ruled that the CIA did not meet the statute's requirement that its director must explicitly claim an exemption for specifically categorised files.

"To date, defendant CIA has submitted no evidence that the director declared such an exemption. I decline to find that its operational files warrant any protection from the requirements of FOIA," Judge Hellerstein said.

The ACLU had requested the records in October 2003 but was turned down by the intelligence agency.

Subsequent requests were also denied, and the ACLU eventually decided to sue for the documents' release in court. The ACLU argued that the records would shed light on the interrogation policies that authorised or allowed abuse or torture of prisoners in Iraq, Guantanamo Bay, Abu Ghraib and elsewhere.

There was no immediate word from government lawyers on whether the CIA would appeal.

WE WANT DENNIS FERGUSON

Mob Mentality?

No one here is afraid of Dennis Ferguson. We and our children welcome him...

Governments have been trying to get rid of their problems by making people into outcasts for over 200 years. Transportation, execution and imprisonment didn't work and we should know that by now.

The image of Dennis running from the fearful town of Murgon shows the failure of our criminal justice system.

Dennis has paid his penalty as decided by the courts. He is legally entitled to move on with his life and resettle into a happy accepting community, with a home and income like the rest of us. It is in our interest that he does so as soon as possible.

Instead the justice system has isolated him for 14 years costing well over a million of our dollars, and created a climate of fear that he will attack our most vulnerable children. It hasn't prepared him for safe resettlement, and has given him no chance of survival. Several communities are understandably in uproar due to his proximity.

The solution is not difficult. The Dennis Fergusons are all around us, doing this and other offensive acts. Most sex offending happens in the family. We can't exclude the problem as they are community problems.

Mentoring and restorative justice in the community is the only way forward. And there is a million dollars for every Dennis to spend on it.

We speak for the prisoner community and have been accepting people from the courts on community service orders for over twenty years . We look after our own community. Dennis is welcome.
