Irene Snow is a social trainer, working with people with intellectual disabilities at Active Foundation, which she has done for over 15 years.

Now in her 60s, she will soon be retiring. "Obviously I worry about what work conditions will be like for my children and grandchildren.

" Some people will be able to bargain and look after themselves, but a lot of people won't. And what about the pension? That's linked to the average weekly wage, so all of this could affect me even after I stop working."

Anne Anderson is an experienced Child Care director and was employed to set up the Curtin Technology Park Child Care Centre.

She set up the centre, successfully seeing it through its licensing and launch. Despite her long hours, hard work and commitment, six months later Anne was sacked.

The company claimed they couldn't afford to pay her, so they employed someone with less experience for less money.

Anne's claim for unfair dismissal was successful and she was awarded 3 months pay and compensation for using her own vehicle and time to ensure the success of the Centre.

" Under this legislation, I would have nowhere to go to clear my name.

" Everything is stacked to the employer. That's wrong. That's why I will be going to the rally."

Thank you for your most welcomed correspondence and the attachments of 06 July 2005, which I received this afternoon. I must also thank you for your previous correspondence of 31 May 2005.

The Prison Resource Kit contains a variety of information I am sure will be well read, thank you. I was quietly amused and agreeing with the poster illustrating imprisonment with the title,' Obedience To The Law is Freedom'. I think it is very apt, in my opinion, what constitutes 'The Law' is open to debate when it comes to 'Freedom'.

I am delighted to see that my previous letters have been accepted as material of interest and relevance by your organisation, and that this material has been put out there for inquisitive and interested eyes to see.

I was very much heartened by your kind comments and uplifting enthusiasm for issues that I am enthusiastic about also. I have various times throughout my continuing, indefinite incarceration, felt as though I were a 'lone voice' in the middle of a screaming AFL Grand Final crowd when it comes to issues of fairness and accountability in the justice system. I am pleased to understand that I am not alone in this regard.

I find it ironic and mildly sad in a way that I am under the control and care of a 'Department' that has the word 'Justice' in its title. Have I missed something? For the most part I understand that a multi faceted system beats to its own drum, and that 'Justice' is an objective most of the time, but I do feel sometimes that the drum isn't sounding out the right type of music.

Issues such as the decision by the Department Of Justice in Western Australia not to distribute the 'Just Us' periodic newspaper astound and concern me. To my knowledge, there is no equivalent publication that is already provided to prisoners in Western Australia.

On that note, at present I have received no further responses to my enquiries with the Department Of Justice relating to this matter, but I will keep you informed as I do.

I am also discussing the periodical Newsletter with people and suggesting that if they wish to be informed and to have their political voice heard, they may choose to write to Justice ACTION and have their details added to the Justice ACTION mailing list.

I have recently commenced civil proceedings in the Supreme Court of Western Australia, in Perth. My case may be cited as [Prisoner] V Director General, Department Of Justice and Anor. XXX. XXX of 2005.

I have lodged a Writ of Habeas Corpus against the First Respondent, Director General, Department of Justice, and a Writ of Certiorari against the Second Respondent, the former Minister for Justice.

My first court appearance regarding these matters was on Thursday, 02 June 2005. This was an 'ex parte' hearing in Chambers before His honour Judge Blaxell. The matter has been adjourned to Wednesday, 15 June 2005. I hope to present oral submissions and argument on this day.

I have prepared the legal documents myself, and I am representing myself in these proceedings. It has been suggested to me that due to the highly political nature of my case in the past, and the foreseeable future, finding legal representation in Perth is very difficult. But I take this difficulty in my stride, and I am only too aware that I am the only person who knows my case and my contentions clearly.

I have enclosed three documents for your perusal and information, which have been filed with the Court already. These documents are:

* Outline Of Submissions For A Writ Of Habeas Corpus And A Writ Of Certiorari And Order Nisi [17 pages]

I am confident that you with be able to understand the directions I will be leading to in argument. The ad hominem contention is of particular interest. As this is a civil action, the case citing, which includes my surname, has been printed in The West Australian newspaper's Court listing. As I noted previously, the case has been adjourned to Wednesday, 15 June 2005, and on this date I will ask the Court for a suppression order relating to my name (my identity), and future Court Listings. I will be seeking to invoke ss 35 and 36 of the Children's Court Of Western Australia Act 1988, for the order.

I am not sure if your organisation is aware of this, but there is presently an inquiry investigating the activities of the Department Of Justice, in connection with the placement and management of prisoners in Western Australian Prisons, and in the community.

There have been a number of incidents of late involving the Department Of Justice, and few high profile inmates, which have received a barrage of media and public interest. The Liberal Party in Opposition has also taken the opportunity to berate the Labor Government concerning these incidents.

As a result of these incidents 14 prisoners, including life sentenced prisoners and Governor's pleasure sentenced prisoners, having done nothing to warrant punishment, were removed from minimum-security prison farms to medium and maximum security facilities. These 14 prisoners had been participating in a program of graduated release into the community. This program is colloquially known as the 'Pre Release Program'.

In response to these incidents, on 05 April 2005, Western Australia's Premier, Dr Geoff Gallop, signed a document that outlines the terms of reference of an 'independent' inquiry. The named inquiry is defined as: "INQUIRY INTO THE PERFORMANCE OF THE DEPARTMENT OF JUSTICE WITH REGARD TO THE MANAGEMENT OF OFFENDERS IN CUSTODY AND IN THE COMMUNITY"

The Honourable Dennis Mahoney, a former New South Wales Supreme Court Judge, has been named as the Inquirer for this Inquiry.

All of this has occurred after the Labor Government was returned to office in February of this year.

The new Minister for Justice, Honourable John D'Orazio, who has relieved Honourable Michelle Roberts, former Minister for Justice, has been appointed the new 'overseer' of the 'troublesome' Justice Portfolio. Mr D'Orazio, a multiple victim of crime himself, in response to the incidents involving the Department Of Justice, has stated in various media reports words to the effect that his priorities are:

(a) Community safety
(b) Staff safety within the justice system
(c) And then we will look at the rehabilitation of prisoners

Life sentenced prisoners and Governor's pleasure sentenced prisoners, who were participating in approved Pre Release Programs, and prisoners who hoped to be commencing Pre Release Programs, have been told that there will be no Pre Release Programs until further notice (indefinite suspension), pending the outcome of the 'independent inquiry.

It has been suggested that this action, or inaction of behalf of the Department Of Justice, and the Labor Government, is a form of group punishment perpetrated towards life sentenced prisoners and Governor's pleasure sentence prisoners, in my opinion this is correct.

The concept of group punishment is from days of old. What is going on in Western Australia? On that note, I shall sign off for now, and turn to my extensive authorities list for my up and coming legal action. I hope that my efforts continue to be of assistance to Justice ACTION and I look forward to hearing from you again.

Ed. Likewise my friend how you have grown in your knowledge and your wisdom from a 16-year-old boy into a fine scholar, from juvenile detention into adult prison, with a lot of knowledge to share with the community. God willing, people who make their first mistake in my opinion always deserve a second chance. A second chance to prove to the community and themselves that they can make it, so the community in turn will not diminish the standards of a human being so easily, after they have made their first mistake. Why? Because a human being is not infallible in the land of trial and error and people only learn by making a mistake. Some people make big mistakes and some people make small mistakes. Nevertheless it is a mistake when it's recognised but once that has occurred and a person has learned and has some insight into their offending behaviour that mistake is unlikely to occur ever again if 'treated properly' the first time.

But making your first mistake as a 'child' in our Wonderful Universe and then being incarcerated for it by the State 'indefinitely' is wrong and I think your case deserves special attention.

Surely there is an obligation by the Australian Constitution to grant you a second chance on the basis that you were a child when you committed your first offence and obviously did not have time to grow up before you tripped over and stubbed your toe on that rock that has been indefinitely tied around your neck ever since. Keep up the good work and let us know how you get on!

It is estimated that 200 of those homeless people are children. For them, the alternative is a night sleeping rough in parks and laneways, under bridges or in doorways.

Homeless Perth man Clinton Burton, 33, said: "I think that a majority of places, they don't have a lot of money to help out the homeless people."

Today, state and federal community service and housing ministers will gather in Melbourne in a bid to reach agreement on a new Supported Accommodation Assistance Program.

While the existing agreement is due to expire at the end of June, the Commonwealth still appears to be a long way short of its contribution.

Agencies working with the homeless fear that current services will be cut if the states do not match the Commonwealth dollar for dollar.

But it says even if the states do come up with extra funds, it does not appear that the Commonwealth is willing to provide any real increase.

Judge blasts security firm over shackled defendants

ONE of WA's most senior judges has severely criticised the company that guards prisoners at the state's courts, after two prisoners were brought to the dock in shackles against her wishes.

WA District Court Chief Judge Antoinette Kennedy took the extraordinary step of summoning a security supervisor for the AIMS Corporation on a contempt of court charge, after two high-risk prisoners appeared before her in leg irons and handcuffs.

In court, last week James Andrew Sweeney, 28 - one of the nine men who last year escaped from the custody cells in Perth's Supreme Court - appeared before Judge Kennedy in chains, after she had earlier warned AIMS guards she did not want to see him handcuffed.

After having ordered the custody supervisor, Chris Blottin, to appear before her for contempt, white supremacist lead Jack Van Tongeren was then also brought to court in shackles, prompting Judge Kennedy to say she would not tolerate the apparent disregard of her orders.

"The service that AIMS is providing, if you can call it that, cannot continue," Judge Kennedy said.

Despite the censure, at a later hearing for Van Tongeren in Perth Magistrate's Court, he again appeared in shackles. His lawyer Michael Clarke expressed his displeasure to magistrate Pamela Hogan.

"It appears someone is not getting the message," Mr Clarke said.

Representing Mr Blottin at his contempt hearing this afternoon, lawyer Basil Georgiou said the AIMS officer profusely apologised for his actions, claiming he had not acted in deliberate defiance of the judge but out of a concern of possible escape.

In reply, the judge said she accepted Mr Blottin's apology but the problems with AIMS had been going on for years.

"If this was just a one-off incident then I would not have taken such drastic action. But this is not a one-off; it has been going on for three years," Judge Kennedy said.

"It is unthinkable that a judge's order would not be obeyed, and unthinkable a supervisor would countermand a judge's order."

The judge's comments are the latest in a series of setbacks for AIMS, widely criticised after the mass breakout from the Supreme Court last year.

That led to AIMS being dumped from guarding prisoners at WA's Supreme Court, and being fined more than $420,000 by the state government.

Slaves who had been sold were also shackled while being moved to another location. Arm and leg shackles were the most common type of restraints, but stocks, neck collars, and the ball and chain were also used. Man jailed for infecting teen with HIV

The District Court in Perth has jailed a 37-year-old man for four years and eight months for infecting a teenage girl with HIV.

For the second time, a jury found Ronald Houghton guilty of infecting the girl by having unprotected sex with her five years ago.

His original conviction had been overturned.

Judge Paul Healy said Houghton had blighted the woman's life by what he had done.

Houghton will have to serve 32 months before he can be considered for parole.

Outside the court, his victim, who is now 23, said she had no option but to take the matter to court.

"I've never heard an apology from him at all which is all what I really wanted," she said.

"I just wanted to have someone say 'look, I'm really sorry, I did a bad thing' and just be able to get on with my life, close that door and move on."

One in six youth deaths caused by alcohol: report

ALMOST one in six deaths amongst young Australians can be attributed to the irresponsible consumption of alcohol, research by the National Drug Research Institute (NDRI) has revealed.

In figures released today, the study shows that 2,643 people aged between 15 and 24 died from alcohol-attributable injury and disease between 1993 and 2002 around 15 per cent of all deaths in the age group.

Young people most at risk live in rural areas, and by region in either the Northern Territory or Western Australia.

The latest National Alcohol Indicators Bulletin, compiled by the Perth-based NDRI, also showed 22 per cent of injuries which lead to young people being hospitalised could also be traced back to risky drinking.

More than 100,000 youngsters were hospitalised for an alcohol related illness or injury between 1993 and 2002, the research found.

Tanya Chickarees, NDRI research fellow and alcohol policy team leader said a number of states and territories had shown an increase in alcohol-attributable deaths, following a period of national decline in the 1990s.

"There was a really encouraging decline in deaths and hospitalisations up until about 2000, but now we are just starting to see a reverse," Ms Chickarees said.

"A great amount of tax is generated from alcohol, but we are starting to think now that the costs are so high, attributable to alcohol, that what is made, the profit, is becoming less (important)."

Dr Chickarees said one of the most marked changes in recent years was the increase in drinking deaths and injury amongst young Australian women.

The institute believed this could be attributed to changes to tax on pre-mixed drinks in 2000.

"Pre-mixed drinks essentially became cheaper for young women than what used to be their preferred beverage, straight spirits or bottled wine," Ms Chickarees said.

"These pre-mixed beverages in my opinion are targeted at young people, and when this tax change happened, there was a massive increase in sales.

"Surveys around the country have been saying that young women are drinking more than they ever have, and we are now bearing our more evidence to support that."

Amongst other findings in the research were that a man was four times more likely to die from an alcohol-attributable death than a women, while the most common causes of alcohol-attributable death for young people were road injury, suicide and violence.

Young indigenous Australians are more than twice as likely as their non-indigenous counterparts to die from alcohol-attributable causes.

Death rates among indigenous youth have not improved in the last eight years, the study concluded.

The rate of alcohol-attributable death among young people who live in non-metropolitan areas is about 1.7 times greater than for their city dwelling counterparts.

The study showed the Northern Territory has the highest number of alcohol-attributable deaths among 15-24 year olds, with 4.0 deaths per 10,000, while WA had the second highest rate, 1.3 per 10,000.

The ACT, with 0.6 deaths per 10,000 had the lowest national rate.

The National Alcohol Indicators Bulletin was released ahead of next week's APSAD "Beyond the Drug" 2004 National Conference, being held in Fremantle, where national and international speakers will present research on drug and alcohol issues.

A leading education expert says state schools need to introduce religious studies, [religious bondage], in their curriculum's to help address the current lack of values in education.

But is it the current lack of values in education or the current lack of values in the Prime Minister that's the problem?

Emeritus Professor Brian Hill from Perth's Murdoch University is delivering a keynote address to the Australian Council for Educational Research conference today in Adelaide.

Professor Hill says religious studies in state schools would be a step toward acknowledging the main source of value traditions that have shaped Australian culture.

"We need to appreciate that no one religion can be privileged in the state school today, but children need the opportunity to study the religious traditions that have had major influence on the society they're living in," he said.

What religious traditions have had a major influence on the society we live in? How many religions is that? How many children were raped and molested by the church?

How about real values, social skills, ethics, morality? What religion is that?

How about John Howard what religion is that? Lies and war crimes against humanity. So who is leading by the worst example?

Now you want to give children some other form of belief opposed to John Howard? Then why is that "rodent type" leading the country? And what has religion got to do with it?

Professor Hill has also attacked church schools for failing to update their religious subjects to keep them relevant to newer generations of students.

He says teachers; students and parents in both the public and private sectors must work together to prioritise educational values in their schools.

"There are gaps in the present curriculum in the study of values and ethics, certainly a gap in the study of religious education which is very chancy and patchy across the nation," he said.

"Some do it well, most don't do it well and these are things which should be regarded as part of the process of curriculum development."

But Western Australia's Education Minister, Alan Carpenter, has dismissed the concerns.

Mr Carpenter says he finds the comments offensive.

"It's a ridiculous beat-up by someone I've never heard of and I wonder how long it's been since the person has been inside a state school," he said.

"Morals, ethics, values are embedded in everything that's taught at schools and if Professor Hill doesn't know that then it amazes me that he describes himself as a professor of education."
