No reason for Habib to sell story: Beazley?

Kim Beazley a well paid loser!

Federal Agreement Leader Kim Beazley is a well-paid loser. A loser who supposed to be defending our democratic rights by standing up to the HoWARd Government's fascism.


But instead Beazley is making adverse comments about this mans right to earn a living wage after he was detained and tortured by the USA in Guantanamo Bay.

He says he does not think former Guantanamo Bay detainee Mamdouh Habib should be paid by a media company for an interview.

Why? Because Beazley is a well-paid loser who thinks Australian citizens should get locked up and tortured by the US government.

Meanwhile Beazley's getting paid as a well-paid loser who incidentally, never lifted a finger in Opposition to the HoWARd Government's complicity in this crime?

Perhaps the police would give Mr Habib and Mr HoWARd an interview for free?

The hide of Beazley to even think of denying a citizen the right to earn a living wage for his family and children while he was being tortured by the USA in Cuba!

Perhaps Kim Beazley would like to donate his last three years pay to Mr Habib instead?

Seems, while Beazley was putting on the pounds stuffing his face and keeping his big mouth shut about Mr Habib. Mr Habib had been taunted and profiled in Australia, then kidnapped by the US and isolated and tortured in Guantanamo Bay? Right under his nose!

What did Beazley do for Mr Habib in Opposition?

Agree that he should continue to be hounded and then try and make him feel uncomfortable about getting paid for his loss and suffering by telling his story.

Like I said a well-paid loser!

Mr Beazley says he does not agree with cheque-book journalism.

"If you've got something to say to the Australian public, if you've got something to say to your fellow Australians, you walk out there and say it," he said.

"You don't sit around waiting for a cheque to fall on your lap."

But surely a true leader of the Opposition doesn't sit on his fat arse in denial, as our innocent citizens are being tortured in Guantanamo Bay and then taunted by the fascist government who were complicit in that torture.

PLANNING TO TRAVEL OVERSEAS? BEFORE YOU GO, READ THIS!


We're all going on a summer holiday, no more working for a week or two. Fun and laughter on our summer holiday, no more worries for me or you, for a week or two?

Each year, a number of Australian citizens are arrested overseas, the majority for alleged drug-related offences.

Currently, 214 Australian citizens are languishing in prisons around the world. The majority of these having been convicted of drug-related crimes.

In many countries drug-traffickers are presented with the death penalty. If you are caught with 15 grams heroin, or more, it is a mandatory death sentence.

These countries make no legal distinction between 'soft' and 'hard' drugs. Penalties for carrying illegal drugs can be severe, even for offences involving marijuana and alcohol.

Penalties include, the death penalty, life in prison without parole, limb amputation, flogging and even torture.

Being an Australian citizen will not save you from such penalties.

IF YOU ARE UNLUCKY ENOUGH TO FIND YOURSELF ON THE WRONG SIDE OF THE LAW IN A FOREIGN COUNTRY --- HERE IS A SAMPLE OF WHAT TO EXPECT

Be prepared to share your cell with a bucket, at least a dozen cockroaches, some lice and a few rats. You will need to become accustomed to the aroma from the bucket (your toilet).

If you conform, prison officials will reward you with a lid for your bucket. If you refuse to conform, you may be legally flogged.

We're going where the sun shines brightly. We're going where the sea is blue. We've seen it in the movies, now let's see if it's true?

Dormitory cells can contain up to 20 prisoners with one large bucket for everyone to share. Contagious diseases, including Hepatitis and HIV are plentiful. The local drinking water contains a natural potent laxative. You are allowed one shower (2-3 minutes max) and clean underpants once a week.

The bed is usually a thin mat on the floor, but do not assume you will get much sleep - those annoying mosquitoes keep buzzing in your ears, and the rats have a bad habit of running over your face throughout the night.

As for the food - you wouldn't feed it to a dog - the cockroaches look more appetizing!

IF YOU ARE ARRESTED OR IMPRISONED OVERSEAS ----WHAT YOU SHOULD DO

If you find yourself arrested or imprisoned, you should IMMEDIATELY ask to be put in touch with the Australian Consul. The Consul will VISIT you as soon as possible after notification of your arrest.

Under the 'Vienna Convention on Consular Relations' which is the generally accepted standard for all countries, a person who has been arrested outside their own country MUST have access to their consular representative. This is international law, and you have the RIGHT to communicate with your Consul, before answering any questions.

In the meantime ....you have the right to refuse to answer questions in all circumstances (except your name and address). Say in answer to all questions --- "At this time I have nothing to say". Do NOT admit guilt. Do NOT sign anything. Do NOT believe anything authorities tell you before your Consul visits you.

In many countries, torture is often used by authorities to extract a confession. If you are assaulted by authorities, it is important that you tell your Consul as soon as they arrive to visit you. Ensure that they record your injuries, the date and the time of the incident. Try to remember the names and contact details of any witnesses to the assault, and the people who saw you immediately before, and immediately after the assault.

Your Consul and consular staff are there to assist you and to help you - they are genuinely interested in your welfare. They are NOT judgmental. They are on YOUR side and you can trust them.

If you wish, you should ask for meetings with your Consul to be in PRIVATE, out of the hearing of prison or police officials.

Your Consul will provide you with general information about the legal system of the country you are being held in. Your Consul will also give you a list of lawyers. Information includes, details on legal aid, prosecution, remand, bail and appeal procedures. This will help you to understand what is happening and you will be made aware of your RIGHTS.

Your Consul will approach local authorities to request that your basic needs are met, and that international humanitarian standards of treatment are respected. They will OBJECT if you are treated less favourably than local citizens arrested for similar offences, or if you are subjected to cruel or degrading treatment.

Your Consul will take up any justified and serious complaint about ill-treatment or discrimination with the police or prison authorities and advise your lawyer on this aspect. You should discuss any problems you may have with your Consul, such as; your financial situation, any health, medical, psychiatric, dental or other problems.

It is the job of the local courts of the country where you have been arrested, to decide on your innocence or guilt.

Your Consul WILL attend your trial in court as an observer. If you are found guilty, your Consul will continue to visit you and to help you, and you should not feel embarrassed in your dealings with your Consul. Arrangements can also be made to help members of your family, to the extent that is possible.

Remember.....If you are arrested in a foreign country, the laws of that country also apply to you. Hence, your Consul cannot get bail for you, cannot get you out of prison, and cannot pay your fines.

Consular officers are located in Australian diplomatic and consular posts abroad. These overseas posts are usually located in capital cities, but there are also some in regional centres.

Everybody has a summer holiday, doing things they always wanted to. So we're going on a summer holiday, to make our dreams come true?

Govt's Hicks concerns an 'election stunt', says Brown

IT'S OFF TO CAUGHT DAVID?

Greens Senator Bob Brown has accused the Federal Government of an election stunt with its questions to the United States authorities about the trial of "Australian Citizen" David Hicks.

The Government says it is worried about some procedural and operational aspects of the military Commission process.

Like the law!

Senator Brown says the Government is simply "pussy footing" around in a humiliating fashion. He says he is pleased to see public opinion has finally had an influence.

"They're obviously heeding Australian opinion and it's not the only case in this election," he said.

"Usually in elections, politicians are trying to get the public to change thinking but here we've got the public changing the politicians thinking, thank goodness."

Governance a misfortune to experience

ADVERSARIES?

As an employee with the Australian government agency Centrelink my job was to interpret Australian law to determine entitlements for Australian citizens.

In the year 2000 a Regional Manager came to my office promoting Machiavellian political propaganda warning of "adversaries who have the laws in their favour".

He declined to remove a display of the propaganda when I indicated to him that I felt uncomfortable treating Australian citizens as adversaries.

The Area Manager refused to intervene in poignant contempt of an unlawfully imposed Centrelink staff agreement then conspired with the Regional Manager to intentionally injure me with anxiety neurosis against explicit medical advice.

I approached the Federal member for the region, Ms Tanya Plibersek, whose office advised me to join the Commonwealth Public Sector Union. A few days later the Regional Manager warned me in the presence of his deputy that I would be charged with harassment if I approached the CPSU delegate who provided me with a union membership application form to complete.

My health deteriorated and I was sacked in my absence on sick leave over spurious allegations of misconduct I was given no opportunity to refute.

A Commissioner for the Australian Industrial Relations Commission reviewed a pre-hearing submission alleging dozens of atrocities committed against me by Centrelink staff, including the prohibition of CPSU membership, and refused to allow the admission of any evidence whatsoever in my failed application for unfair dismissal, confirming the pervasive nature of the corruption of natural justice in the Howard regime.

The Howard legacy is a Public Service drowning in deceit, dishonesty and corruption. At the very least Howard and his Cabinet cronies should be deprived by a properly constituted Parliament of all profits accrued in government prior to facing charges of fraud, dishonesty, deception and corruption before similarly constituted criminal courts.

The Howard regime is unilaterally the most dishonest and downright criminal governance the Australian nation has ever had the misfortune to experience.

How much better life would be if we weren't governed by cowards, cheats and corrupt officials. Change Australia, change.

Prisoners as citizens and duty of care

For a long time now most learned people have been aware of the book Prisoners as Citizens. The Victorian Opposition is outraged at a confidential payout won by a prisoner injured while playing table tennis at the Melbourne Remand Centre because they can't afford the book?

Ayhan Gur sued the Victorian Government for up to $40,000 after he slipped on a wet floor at the centre in 1996. Opposition Corrections spokesman Richard Della Riva says a prisoner should not have the same rights as law abiding citizens.

So why is the Victorian Opposition slow to learn? Is it because law and order gets more votes? No! Because "a landmark collection on prisoners' citizenship rights in Australia is disturbing reading for citizens not concerned about the decency and social justice of our democracy?" No!

One wonders why? Is it because he never went to school like the rest of us and cannot read? Or is it because he can't afford a book? Or perhaps he is hell bent on locking people away and taking no responsibility or Duty of Care towards those who are in Custody?

Or the more likely scenario he wants Votes from the Populist Majority who are so busy getting on with their lives that they didn't read the book either?

Who knows perhaps someone in the Corporate Media can ask him the real reason for his outrages comments?

Della Riva said, Victorians should be told how their money is being spent.

Well Richard the money is being spent on compensation for damages because Ayhan Gur slipped over on a wet floor whilst in custody, because the Department of Corrections had a duty of care.

Della Riva said "There have been recent incidents in other states where prisoners have received massive payouts, and most of the community were very much outraged by that situation," he said.

Well there have been Incidents in other states where prisoners have not received massive payouts, and most of the community were very much unaware by that situation, and in fact told lies about it publicly.

Getting Justice Wrong DPP make full admissions

Della Riva went on to say, "I think what Victoria needs is some rigorous debate about whether prisoners are entitled to receive compensation payouts whilst they are in our jails."

Corrections Commissioner Kelvin Anderson says prisoners have the right to seek compensation through the courts. "Our decision was a balanced decision on how much compensation to provide and we thought it was the best we could do for the state," he said.

A spokesman for the Victorian Government says the state has a duty of care to all prisoners, however it will not accept frivolous claims.

The State government has logged objections to Patrick Horan a NSW prisoner's planned release, convicted of the manslaughter of a police officer and seriously wounding another. Justice Minister John Hatzistergos says the NSW Parole Board intends to grant parole to Patrick Francis Horan, who committed the crimes near Bathurst in NSW's central west in 1986.

Some new issues have arisen today. A senior officer called me to the office, as they usually do to inform me of all new local orders etc concerning prisoners. I'm a prisoner in south Australia (Adelaide), Yatala Labour Prison, I'm 39 years old with only two and a half years spent in the community since the age of 13. I came into the adult prison system in 1985; I was released in 1998 only to re-offend. The Criminal Law (Rehabilitation of Offenders) Act 1986 Qld
The Criminal Law (Rehabilitation of Offenders) Act 1986 (Qld), requires that any person who has committed an offence which is less than 10 years old or which resulted in a prison sentence of more than 30 months, must disclose that offence if requested eg. for employment purposes. If a criminal record is disclosed in a job application, it is unlikely that person will be given the job.

NSW Serious Offenders Review Council
In response to a letter we have received from Mr K C who has said that he is serving 24 years and 10 months commencing on 29/8/1991 with his earliest release date being 28/6/2016 with 4 years parole and full time 28/6/2020. He said that he contacted the Serious Offenders Review Council in writing but received no response.

He is in the Supermax and deprived of any privileges not even legal Aid will fund a solicitor to see him in Goulburn.

Australia: Private Prisons, Junee NSW
When I got to Junee I was given nothing except bed linen. That's it! No clothing. I had to put my name down for clothing, which they said I could get on Saturday. When I went down to get my clothing on Saturday I was told they had nothing but I was told that I could buy what I wanted on their monthly buy-up. In the mean time I got rashes between my legs from the dirty clothes I had on.

He has ordered a ban on all Justice Action material inside the NSW prison system. Corrective Services Minister Richard Amery has a problem attacking prisoners right to privacy.It seems to us that a civil society is best served when social justice laws are applied to all people regardless of their circumstances. Prisoners and those concerned about prisoner issues have very few sources of information.

Sisters Inside Inc. is an independent community organisation, which exists to advocate for the human rights of women in the criminal justice system, and to address gaps in the services available to them. We work alongside women in prison in determining the best way to fulfil these roles.

Smart Justice
Smart Justice does not support any party but calls for investment in prevention, alternatives to custody and initiatives that tackle the causes of crime. It is important to dispel the myths about 'law and order' and promote real solutions to crime and violence.

What happens for a young person who has a parent in prison?
There are a lot of consequences for children or young people who have a parent in prison. During Groupwork the kids themselves have identified as being:

Children of Prisoner's welcomes Ann Symonds as our first Patron at this years AGM and screening of "The Space in Between" video , and will have a visual display to demonstrate the invisible population of children effected by parental incarceration.
