Plea to release Biggs rejected by ruling-class

UK: Home Secretary Charles Clarke has rejected a plea by Great Train Robber Ronnie Biggs to be released from prison on compassionate grounds.

The ailing 76-year-old has been informed his bid to leave HMP Belmarsh high security jail in south east London on the grounds of his persistent poor health has been turned down because his illness is not deemed terminal. [?]

In a letter to the former fugitive, the National Offender Management Service said Mr Clarke had decided Mr Biggs is not "severely incapacitated so as to satisfy the criteria for compassionate release". [Un-Satisfied Ruling Class?]

The prisoner was told that: "Whilst noting your frailty and the slow deterioration in your condition, (Mr Clarke) is not persuaded that your condition merits the truly exceptional step of releasing you early on compassionate grounds." [Looking at the above photo?]

Biggs, who has recently suffered minor strokes and heart attacks and contracted MRSA, was originally jailed for 30 years for his part in the infamous raid on a Glasgow to London mail train on August 8 1963, when a 15-strong gang made off with £2.6 million in used bank notes.

He escaped from Wandsworth prison in a furniture van after just 15 months and later lived a life of exile in Brazil.

Biggs was detained when he voluntarily returned to the UK in 2001.

Medical reports prepared for the appeal said Biggs often needs a tube to assist in his feeding and has difficulties speaking.

However, doctors said he can walk short distances and is being adequately cared for within the prison system. [Rubbish! In other words, the ruling-class don't have any mercy!]

The 75-year-old, who has suffered several strokes and minor heart attacks and can no longer speak, is currently held at Belmarsh, a category A prison, where he receives 24-hour nursing care.

Legal advisor Giovanni Di Stefano said that London-born Biggs "did not belong in prison and in any other European Country would be on home detention".

Solicitors have written to Home Secretary Charles Clarke to ask for Biggs's release on compassionate grounds "in view of our client's age and infirmity".

Biggs, who was born in Lambeth, was sentenced to 30 years for his part in the raid on the Glasgow to London mail train on August 8, 1963, when the 15-strong gang made off with £2.6 million in used bank notes.

He fled Britain after escaping from Wandsworth prison in a furniture van after just 15 months in jail.

After using plastic surgery to change his appearance he fled to Spain, Australia, and then Brazil.

He then spent 36 years on the run but surrendered himself back into custody in 2001.

His solicitors have made a series of attempts to transfer him to a lower security prison or have him released.

Control order flaws exposed

UK: First interview with ex-detainee reveals a regime that leaves him in despair : Ex-detainee exposes flaws in terror control orders

The bizarre world of the government's controversial anti-terrorist control orders [scapegoats for resource wars in the Middle East] was revealed when one of the 10 men who had been detained in high-security institutions for more than three years walked into the Guardian offices without any security escort.

Highlighting the stark contradictions in the control orders, Mahmoud Abu Rideh, who had been detained without charge and trial in Belmarsh prison and Broadmoor psychiatric hospital, is kept under house arrest at night, but is able to roam freely under tagging during the day.

The Palestinian refugee, who was held for three-and-a-half years, says he cannot understand the double standards of the order, and said it was further exacerbating his psychiatric difficulties. He has been diagnosed as mentally ill.

In the first interview from any of the 10 detainees placed under control orders, he said: "I go everywhere now - on the underground, buses, the mosque. But I must be home by 7pm. People think I am dangerous, but I am not dangerous. The government is playing games. If I am a risk to security, why are they letting me out to be with people? I wouldn't do anything silly. I am not a dangerous man."

Mr Abu Rideh's control order says he is a key UK-based contact and provider of financial and logistical support to extreme Islamists with connections to al-Qaida. It says: "You belonged to and have provided support for a network of north African extremists directly involved in terrorist planning in the UK, including the use of toxic chemicals."

Mr Abu Rideh denies this is the case.

The control orders were rushed through parliament earlier this month in the face of widespread opposition. The contradictions inherent in them are clear from Mr Abu Rideh's experiences since being released on bail almost two weeks ago:

- He is not allowed to make arrangements to meet anybody, but he can drop in to see anyone if he does so unannounced;

- He cannot attend any pre-arranged meetings or gatherings, but was present at the anti-war demonstration at Hyde Park last Saturday. He says he stumbled across it while playing football in the park with his children;

- He is banned from having visitors to his home unless they are vetted in advance, but he is allowed to arrange to attend group prayers at a mosque;

- He thinks he is being followed on the tube, but if he calls a taxi, no one tails him.

Mr Abu Rideh told the Guardian that his confusion over how the control orders work, and his lack of support, led him to take a drug overdose last week. He was taken to Charing Cross hospital after he swallowed 35 tablets and was not released until the Monday evening. He says he cannot bear to live under the conditions imposed by the home secretary.

He said: "I only want to kill myself. I don't want to kill anybody else. I am not a danger to anybody else, but this government has made me a danger to myself. It is just as bad to be free with a control order as it is in Belmarsh prison or Broadmoor hospital."

The control orders authorised by the home secretary, Charles Clarke, caused a parliamentary crisis two weeks ago and were only shunted through after 30 hours of ferocious tussling between the two houses and a compromise on the part of the government.

The 10 men include Abu Qatada, the Islamist preacher who has been described by a judge as a truly dangerous individual who was "at the centre of UK terrorist activities associated with al-Qaida".

At the time of the parliamentary debate, the Home Office said that the 10 released men were still a risk to national security. Lawyers for Mr Abu Rideh and the other men began a legal challenge to the control orders. They told a high court judge that the orders were confused and difficult to work with, saying: "It has been continuous crisis management for the past 10 days."

Mr Abu Rideh explained some of these problems. "The conditions are too complicated and they don't work. The Home Office emergency number doesn't work. I phoned Fulham police station and they said it's not their problem," he said.

He claims that the voice recognition system operated by the tagging company, Premier Monitoring Services, does not work and the Guardian found that the Home Office control order hotline was an answering machine.

Mr Abu Rideh is so frustrated that he has threatened to take direct action similar to Fathers4Justice. He said: "I will go to Big Ben and make a demonstration, I will chain myself to the railings of the high court or the House of Commons. My lawyer has told me not to, but if I don't get justice I will."

The transition from being in Belmarsh and then in a hospital with the criminal mentally ill to being at home with his wife and five children is prov-ing to be fraught. "I think they will arrest me again. My kids worry that when they get back from school I will be gone and they might not find me again. My wife can't sleep. She is asking me not to go out."

Surprise searches by Scotland Yard officers leave his family on edge, he said, and his wife sleeps fully clothed in case of any eventuality. He complained that officers rifled through his wife's underwear drawer. "That's wrong in anybody's culture," he said. "I asked them, What are you searching there, do you think I have a bomb in my house, do you think I would kill my kids?"

But the most frustrating thing of all is that, despite being called an international terrorist by the government, he has never been told where he crossed the line.

He said: "I want to talk to whoever locked me up. Talk to me. Tell me, why? See my face, see my body. But I can't find anybody to talk to me."

A spokesperson for Premier said the company could not discuss individual cases.

Belmarsh prisoners consider suicide, says freed man

UK: The first of the Muslim prisoners released from Belmarsh high security prison after being held on suspicion of terrorism, [scapegoats for the Coalition of the Killing's resource war's in the Middle East], has [said], his fellow prisoners are suffering such 'severe mental problems' that they constantly consider suicide.

In his first interview since being released from the jail, after judges said there was no evidence that he was a terrorist, prisoner M said being held without charge and without limit of time has made his fellow prisoners "crazy".

"Their situation has become very, very difficult for them," he said. "Three or four of them have become mad, exactly mad. They can't control themselves, they are not thinking in a good way."

His claims came on the day that another detainee, G - neither can be named for legal reasons - was released from Belmarsh to become the first prisoner in Britain to be held under house arrest because he is too mentally ill to stay in prison.

The decision marks another embarrassing defeat for David Blunkett, the home secretary, who had fought to prevent both G and M from being released.

The Special Immigration Appeals Commission ruled that G had become mentally deranged in Belmarsh and that his detention meant he was in danger of self-harm. He will now reside at his home under strict bail conditions and will be cared for by mental health workers.

According to M, G explained to him that he knew suicide was against Islam but he took consolation in an interpretation of the Koran which allows a Muslim to do something which is forbidden in the most extreme circumstances.

"If you are lost in the desert and you don't have any food and drink but you have a bottle of wine, which is forbidden, then it is allowed for us to stay alive," he said. "I am in prison, I am thinking of taking my own life because I would do less harm than what prison is doing to me."

M [said], last night: "One of them understands that he is crazy, because his situation is worse than the others, he thinks that everybody wants to kill him, that maybe he will lose his wife.

"It is unlawful to detain people inside prison indefinitely and the situation is made worse because of the situation in the prison, where you are inside four walls for most of the time."

The 38-year-old Libyan claims that two of the detaineees have become full-time carers for their fellow prisoners because they are now so obviously sick. He recalled how he was once woken at 3am and asked by a prison officer to look after G. "Sometimes he is crying, sometimes he said: 'I would like to kill myself, I can't stay alone in my cell.' He is just thinking: 'When am I going to die?'"

M claims Belmarsh cannot cope with mental health issues but the Home Office argues that each prisoner has the same healthcare provision inside as they would receive outside.

"They say they have healthcare in Belmarsh but it doesn't make a difference. They will take you from your single cell, they will put you with other people and maybe they are more mad than you. They will give you tablets to make you sleep and that's it. They are not coping with the situation. I have seen people become worse. It is absolutely appaling conditions."

M said he had not contemplated suicide but it has been reported that at least one of the other men attempted it.

"I don't know if they have tried [suicide] but they are thinking about it," M said. "The reason is because they do not know if they will ever be released."

Last night the Home Office said: "Anyone held in a high-security establishment has access to 24-hour healthcare. They are regularly seen by healthcare professionals and anyone can request a psychiatric assessment at any time, as can their legal representatives, and they will be seen."
