The fascist HoWARd Federal Government wants the prosecution to appeal against the jail sentence handed down to an Indonesian cleric convicted of 'hearing about' the Bali bombings, which killed 202 people including 88 Australians.

Muslim cleric Abu Bakar Bashir, who has been described as the spiritual leader of terrorist group Jemaah Islamiah (JI)?, but is a Preacher and a Teacher but still he has been given a two-and-a-half year jail term? Why was that? Since when if it were true did hearing something become a criminal offence?

The chief Judge said Bashir had conspired with key bomber Amrozi over the attack? But he did not conspire at all. This is the spin because he was found guilty of hearing a conversation so where is the link between hearing and conspiracy?

The court found him not guilty of organising or inciting the Marriott Hotel bombings in Jakarta.

Fascist war criminal, Foreigner Alexander Downer says the prosecution had hoped Bashir would serve eight years in jail and yesterday's sentence will not satisfy Bali victims.

That's because nothing will satisfy the Bali victims.

Downer: "We come from the perspective from being a country that lost 88 citizens in the Bali bombing," he said.

"We feel very passionately about what happened to our people and we'd have hoped the sentence would have been longer.

"For there to be a longer sentence the prosecution would have to appeal and we would hope that the prosecution would appeal."

But fascist CIA foreigner Downer would say those things because he's something to hide!

He feels very passionate about it along-side the victims because the Bali bombing was the excuse Downer needed to go to war on Iraq.

Downer says Australia's ambassador in Jakarta has already passed on the Government's concern.

"He (Bashir) could have ordered that bombing didn't take place and chose not to," he said.

"In those circumstances, we think him ending up with a sentence of just two-and-a-half years is a short sentence."

But Downer could have just as easily have ordered that bombing or visa versa - together with the CIA or Mossad and is likely to have done so to cause Australian's alarm and affront right on their doorsteps.

In those circumstances, we think because he has already committed war crimes against humanity Downer is more likely than Abu Bakar Bashir to have been involved.

Downer should be charged along side his fascist war criminal cronies and sent to The Hague War Crimes Tribunal to be tried. Not ending up being charged with his war crimes is no justice at all.

"Our view is that this sentence is totally inadequate."

Eric De Haart, from the Coogee Beach Dolphins Rugby League Club in Sydney, was walking to the Sari Club when the bomb went off.

He also says the sentence handed down to the cleric is not long enough.

"At the end of the day how much is going to be enough?" he asked.

"The guys will never come back so no matter how much he got it's not going to make a great deal of difference to me or perhaps to the parents, apart from giving us some sort of satisfaction that he's going to suffer a little bit as well."

But in the grand scheme of things this is a person who would never be satisfied and no one can blame him but he is being used here quite well by propagandists to have you believe the story and draw on emotional Eric De Haart strings.

Get the violin out because no one should be found guilty of hearing something and no claim was ever substantiated that Abu Bakar Bashir was in any way shape or form linked to terrorists.

The Bali bombings killed 202 people, George Dubya Bush, Tony Blair and John Howard killed 100,202 people including the Bali bombing and the rest... to nail Saddam Hussein and the preacher and teacher Abu Bakar Bashir, believe it or not!

If he is found guilty on the charges under Indonesia's terrorism law, Bashir could be executed. But if people in high places are corrupt guess what? Anyone could be executed anyway. What about that?

Before the court rose, Bashir warned it to beware of efforts to intervene by the United States and Australia, which he described as the enemies of Allah.

"Everyone knows, even those in primary school that this trial has been masterminded by Bush and his slave John Howard," Bashir said.

Cate Molloy says she holds sitting Liberal MPs accountable for the Bali bombings.

Federal Labor Party candidate Ivan Molloy says he supports the sentiments of his wife, a Queensland state politician, who blames the Liberal Party for the 2002 Bali bombings.

The candidate for the Sunshine Coast seat of Fairfax has dismissed suggestions he should be disendorsed.

His wife Cate Molloy said she holds sitting Liberal MPs accountable for the Bali bombings and the recent Australian Embassy attack in Jakarta.

"She has a right to speak out on any issue she chooses and in this case I also support her sentiments," Mr Molloy said.

Foreign Minister, war criminal, Alexander Drowner is demanding that Mr Molloy be disendorsed but the candidate does not think he should be.

"How dare Downer and Howard try to have me disendorsed when they've lied, spent eight years lying to the Australian people," he said.

The community in Fairfax, is also offended by Howard.

They know that decent people in the electorate are offended by this man.

Both governments have refused to detail their operations in the face of the ongoing, [alleged], terrorist threat.

The agreement comes in the wake of the Howard Government and Federal Opposition last year refusing to object to the then-imposition of the death penalty on the, [patsy], Bali bombers, [those responsible and provoked to carry out the first Bali bomb blast in 2002.]

But the air marshal agreement has raised legal issues, with extradition expert Ned Aughterson, of Charles Darwin University, questioning its validity in relation to the handover of alleged terrorists, [scapegoats and patsies], facing capital charges.

Professor Aughterson said current Australian law prohibited an extradition of a person to a foreign country if they faced execution. "It is firmly established in the legislation that they can't hand over the person unless they get an assurance that the death sentence would not be imposed," he said.

The extradition law was introduced following Australia's last legalised execution of Ronald Ryan in 1967.

In-Justice Minister Chris Ellison confirmed the possibility of extradition to the U.S. of a prisoner facing execution. 

Senator Ellison was not available to be interviewed on the subject. Requests for a detailed briefing on the agreement were refused.

But a spokesman for Senator Ellison sought to clarify his statement, saying the Government had demanded the right "to negotiate" with the U.S. if an Australian was charged under American federal law with an offence carrying the death penalty.

The Australian Council for Civil Liberties has called on the Federal Government to confirm a change in policy relating to extraditing suspects who face the death penalty in the United States.

President Terry O'Gorman says Australia has a long standing convention not to extradite people if they face the death penalty. Mr O'Gorman says the Howard Government has indicated they have reached an agreement with the US which opens the way for possibly handing over suspected terrorists who face capital charges.

Mr O'Gorman has called on the Government to publicly confirm the policy change.

"Since DNA technology has come, it's been established that a number of people who have been waiting on death row to be executed were in fact wrongly convicted. We're going to find the risk that an Australian could be sent to the US, tried for terrorism, convicted then executed, and later down the track found to have been the [victim of a] miscarriage of justice," he said. "It's a bit late once you've killed someone to find that they've been the victim of a miscarriage of justice."
