NSW prisons over-crowded. Gov't orders investigation into death in custody

Two public servants may be sacked over a bungle affecting an Aboriginal inmate who died in custody in a New South Wales jail.

In January this year, a 23-year-old Aboriginal prisoner was found hanging in his cell in a Sydney jail 18 days after he was due to be released.

The State Government ordered an investigation into how the parole board had miscalculated the inmate's release date.

A report tabled in Parliament blames the error on an inexperienced officer whose work should have been checked.

It describes the parole board as complacent and says its error rates are unacceptable. Justice Minister John Hatzistergos concedes the report is damning and has pledged a major shake-up.

"It's frankly unacceptable. To be frankly blunt about it, I regard it as a disgrace," he said.

A separate report will recommend whether two staff who have been stood aside over the incident, should be sacked.

THE PRISONERS: Prison over-crowding due to the Carr Governments policies have caused the Department of Corrective Services to cut corners in all areas. Watchdogs have been silenced and custodial staff told what to say and not what to say and that's why answers are not forthcoming from DCS about complaints forwarded to them from prisoners who are suffering.

The independence of welfare has diminished and that means the messenger is too late in order to save any life that nears death. There is mounting trauma and frustration of today's prisoners who are trying to survive in barbaric conditions.

Resources and facilities including health, programs, education and even exercise for prisoners out of their cells has been limited and spread so wide that conditions in the jail are causing neglect, self-harm and death.

When I got to Junee I was given nothing except bed linen. That's it! No clothing. I had to put my name down for clothing, which they said I could get on Saturday. PRIME Minister John Howard who is responsible for Australia's army killing innocent families including children in Iraq has spent an hour with the Queen at Buckingham Palace, while the furore over Governor-General Peter Hollingworth continues to grow back home.


The meeting, the PM's first with the Queen this year, was expected to include discussion about the pressure on Dr Hollingworth to step down.

In this instants if Howard were to be discussing Dr Hollingworth in relation to his ethics, as Governor General then it would have to be said in my respectful view that this is the pot calling the kettle black.

But details of the meeting are not expected to be revealed by the prime minister who has grown increasingly testy with questions about the issue.

Howard has been out of the country since a report by the Anglican church found Dr Hollingworth failed to properly deal with sexual abuse claims while he was Brisbane archbishop.

But most learned Australians would argue that killing innocent families including children in Iraq to fix the problem also had no valid principals, values, morals or ethics. And indeed with the greatest respect a contradiction within itself for Howard in terms of Dr Hollinworth's handling of child sexual abuse.

In his only public comment on the report, Mr Howard said he could see no reason for him to recommend to the Queen that Dr Hollingworth be sacked. In short Howard's behaviour since sending our militants to Iraq leaves his own ethics questionable in the eyes of the innocent victims families and friends and Howard knows it.

Today, when questioned again about the issue and polls showing strong support for Dr Hollingworth's removal, Howard refused to answer. But the polls apparently approved the war in Iraq and the killing and maiming of innocent families in Iraq so why should news polls dubbed news propaganda pill's by GKCNN have any issue with the PM indeed? Polls don't tell you how much your worth as a human being who is blown to bits because you're in the wrong place at the wrong time. Polls tell you about your political career correct me if I am wrong.

Howard "I don't have anything to add to what I've previously said on that issue," he replied.

The Hollingworth issue is clouding efforts by Howard to focus on the post-war Iraq reconstruction [?] talks he has had with the United States and will take up with British Prime Minister Tony Blair. The two leaders will have something to celebrate when they meet, with Howard to present Mr Blair with half a dozen Australian red wines to mark the British PM's 50th birthday this week.

Once his British engagements are concluded, Howard will head to Doha in Qatar to meet some of the 2000 Australian militants who were involved in the resource war in Iraq.

The pressure on Peter Hollingworth to resign as Governor-General intensified last night as three Anglican bishops said it was time for their former colleague to step down. "Australians deserve unequivocal ethical behaviour and best practice in all aspects of community leadership," said the Bishop of Bathurst, Richard Hurford. Divisions within the Howard Government over the Governor-General's future became more obvious yesterday when some ministers appeared to urge Dr Hollingworth to ride out the storm.

But he had little support from his church, which is reeling from an inquiry's finding that Dr Hollingworth failed to deal with child sex offenders among the clergy when he was Archbishop of Brisbane.

The Bishop of Armidale, Peter Brain, was forthright. "He hasn't got much choice. I feel for him and his wife and their personal circumstances. But the more I've thought about it the more I think he should resign, for the sake [of the office] and for the sake of the church."

Last night, a Government House spokesman said the Governor-General was hanging on and had "no current plans" to attempt to explain himself further to the public - a day after a Herald, ACNielsen poll revealed 76 per cent of Australians want him to quit.

The Anglican Primate, Peter Carnley, has already admitted the church has been seriously damaged by the scandal - but Bishop Hurford said there was more at stake than the church's reputation. "Public perception has become the reality and it would appear that Dr Hollingworth's position has become untenable. While the Governor-General alone must make the decision whether to remain or to relinquish the office, it is now imperative that the moral authority of the office of the Governor-General is not squandered."

The Bishop of Newcastle, Roger Herft, said that if he was in Dr Hollingworth's shoes, his course of action would be clear. "With such a significant proportion of people saying the position [of Governor-General] is being diminished - and even given concerns that my successor could face similar mauling - for the good of the nation I would say it is time for me to move on."

An advocate for a Wagga Wagga woman says the office of Governor-General has been sullied by the report into Dr Peter Hollingworth's handling of child sexual abuse cases.

An Anglican Church report has found Dr Hollingworth should have been more compassionate in recognising the wrong suffered by the Wagga woman who, when she was 15, had a sexual relationship with a priest who later became a bishop. Since the report's release last week, calls for the Governor-General to stand down have continued, but the Prime Minister is sticking by Dr Hollingworth.

The woman's advocate, Wendy McCarthy, says the former Archbishop of Brisbane failed to respond at a proper level. She says while Dr Hollingworth apologised to her friend, it was only after the Australian Story television program. "If you damage the role of the bishopric, you damage the role of the priesthood and you're now damaging the role of governor-general. I mean...I don't care one thing about the individual concerned, but I do care about the institution that person has represented," she said. Ms McCarthy says the Wagga woman has not sought compensation, but she believes she should. "She hasn't had emotional support, psychological compensation, nobody's paid for her to have a counsellor, nobody's given her a chance to go back and be retrained and re-educated," she said. "She's had no opportunities offered to her by the church except a rather mealy-mouthed apology after Australian Story."

PM man of steel? Or killer and a thief ?

Is JOHN Howard a killer and a thief or a man of steel after he dropped bombs on innocent civilians in order to fix the problem in Iraq for trade agreements with the US? Thousands of children are now dieing of disease.

Is Howard Having trouble accepting his failure to see all people as equal? Dubbed "the Man of Steel", by George W Ya and back for another trade agreement Howard prefers to pretend he hadn't been given the name.

Man of Steel came from President George W. Bush at his ranch in Texas two days ago. But the Man who stole himself isn't wearing the tag.

Howard: "I've long since eschewed personal introspection. I've long since eschewed trying to put descriptions or whatever on myself," he said.

"I will leave that to others. I've seen others wander into that sort of area and get into awful trouble."

John Howard suffers from his conscience as metal with no heart. Howard was the pin-up boy at Yankee Stadium in New York yesterday, getting almost as much attention as the $24 million-a-year baseballers on the field below his official box.

All I can say is Yankee stay in the US.

Everyone loses his or her champion Chris Puplick

THE resignation of NSW anti-discrimination chief Chris Puplick has dashed the bid by everyone who has ever suffered over a privacy breach or who has been discriminated against.

Mr Puplick took up everyone's complaints with integrity, impartiality and independently of the government.

In response, the Carr Government nailed him to the wall for doing his job. The Carr government offended by Mr Puplick's ability not to discriminate and treat people equally, which was obviously in direct contravention of the Carr government's policy.

Mr Puplick had continued to write to the Premier demanding action on the Milat case.

But Mr Puplick's resignation on Friday over the alleged conflict of interest revealed by The Daily Terror means we have lost a decent watchdog that defended our rights.

Shame on you Terror you loser newspaper. There are calls today to sack Campbell Reid the editor.

Mr Puplick was forced to resign over revelations he had helped a friend win thousands of dollars in compensation for a workplace complaint over gay victimisation.

The conflict and other matters are under investigation by NSW Ombudsman Bruce Barbour who is slack to say the least and another pro Carr government lackey who needs to investigate himself. A preliminary report is close to completion.

Mr Puplick will be given a chance to respond to that report before it is handed to Attorney-General Bob Debus for consideration. What a joke, Bob Debus and the boys club.

While Mr Puplick's resignation means Debus no longer has to decide whether he should stay on as Anti-Discrimination Board president and Privacy Commissioner, it may not be the end of the matter, with sources saying some of the matters being investigated by the Ombudsman could be taken further.

In the interim, Mr Puplick's position is being filled by the director-general of the Attorney-General's Department, Laurie Glanfield, ahead of the appointment of a new ADB president and Privacy Commissioner. Definitely not to be trusted.

No need for new terrorism laws: DPP

The New South Wales Director of Public Prosecutions (DPP) has rejected the idea of new laws against terrorism in Australia. [Draconian laws for the Coalition of the Killing to quell dissent and bolster support for their illegal and degrading resource wars in the Middle East.]

Australian Federal Police commissioner Mick Keelty [Guilty] has suggested new terrorism measures including courts for terrorist crimes, prolonged detentions and special accreditation for lawyers representing alleged terrorists. [Scapegoats and patsies.]

But DPP Nicholas Cowdery says this would go against many basic rights Australians are lucky to have.

Mr Cowdery says there is no need to rush about depriving ordinary people of rights that have been taken for granted for so long.

Mr Cowdery: "The laws that we have in place, 'if they are applied properly' and with discretion, are quite capable of meeting a [CIA false flag, call to arms] Bali situation or any other terrorist situation that might erupt here," he said.

State may adopt tough ACT law

FOR the past four years police have wanted the NSW Government to tighten the bail laws for repeat offenders to give them more control over the population and to silence critics or agitators. Police have lobbied for more power in light of Noble Cause Corruption and corruption within the Force generally.

The Government said last night it was working on a proposal. But the government is seeking more control over the population by introducing draconian legislation constantly.

The Attorney General's Department is corrupt. It's working party, in operation since January, appears likely to adopt a position of near-automatic refusal of bail for repeat offenders opposed to community solutions for social problems.

GKCNN understands that the working party's recommendations are due by the end of June and most likely will recommend adopting the ACT's bail laws, which are draconian.

ACT law says, "a court or authorised officer must not grant bail to the accused unless satisfied that special or exceptional circumstances exist justifying the granting of bail". While this clause is tough allowing a repeat offender to get bail, it is considered far tougher than the current NSW law. Since June last year, NSW bail laws have stated there is no presumption in favour of bail for [alleged] repeat criminal offenders. [?]

The Opposition's legal affairs spokesman Andrew Tink will be working today to get an immediate toughening of bail laws. He will present a bill to Parliament today, which is proposing to tighten this situation so there is a presumption against bail for [alleged] repeat offenders. [?] Tink said weak existing bail laws allowed repeat offenders to continually walk free from court after being 'accused' of another crime.

GKCNN has consistently highlighted draconian bail laws. Earlier this year, The Daily Terror exploited another case. Adam Speyer, 22, who was continually, granted bail, despite being born 22 years ago. Apparently they forgot to mention his first mistake when he dropped his babies bottle off his high chair and was granted bail.

Why blame existing laws? The magistrate whoever that was? Granted bail in the Bardakos domestic violence case? Why wasn't the magistrate named? It granted bail in the domestic violence case when he/she had Bardakos's previous history and the current alleged offences in front of him/her. Instead of admissions that the magistrate should have used common sense and made a mistake, by not holding him in custody and offering him some social support, the ruling class argue for tighter restrictions on bail laws, for the whole community.Why is that?

Killer freed without support?

It was alleged she was abducted, raped and tortured by her estranged husband. When he was freed on bail.

The question is did he have any support or counselling? In a crisis situation in relation to domestic violence most people need support. Trish van Koeverden knew he was going to kill her. It was only a matter of time before Trish van Koeverden was going to die.

Her estranged husband Tony Bardakos, who had been charged with her abduction, rape and torture, had been freed on bail [by whom?] "She just hoped she didn't see it coming," her mother Dawn van Koeverden said yesterday. "She told the police that she did a stupid thing letting him into her life but didn't want to die because of it."

It took 14 days for Bardakos to find her and gun her down on Tuesday afternoon. Bardakos, 48, had a lengthy record for violence dating back to 1974, including a previous conviction for the abduction of an ex-wife.

But he was granted conditional bail, [by whom?] despite strong concerns being raised for Trish van Koeverden's safety.

The evidence was [allegedly] clear. Bardakos had repeatedly threatened Ms van Koeverden and her family after their relationship soured in early March.

As part of his conditional bail, he was prohibited from approaching his wife or going within 30km of her parents' home in Lake Macquarie [by whom?]

On Tuesday, 41-year-old Ms van Koeverden, a midwife, was en route to her solicitor's office when Bardakos pulled in front of her in Cameron St in the Newcastle suburb of Hamilton, at 3.40pm.

In the minutes that followed, Bardakos dragged her from her car and knocked her to the ground with the butt of a rifle.

The mother-of-two begged for her life but Bardakos had no intention of sparing her. He shot her twice at point-blank range with a bolt-action shotgun and a rifle. About an hour later, police found Bardakos dead from self-inflicted gunshot wounds in his car in the nearby suburb of Mayfield.

"Trish knew he was going to kill her," Mrs van Koeverden said. "We can't understand why they let him out.

"We knew he was a violent man. There was no way we could protect Trish." Ms van Koeverden's family, friends, police and prosecutors are outraged that Bardakos was given bail [by whom?]

A senior prosecutor involved in one of the bail applications is believed to have become physically sick when told of Ms van Koeverden's death yesterday. The Crown had argued that Bardakos would harm or threaten to harm Ms van Koeverden if he were released. Mrs van Koeverden said Trish knew her life was in danger the moment she learned Bardakos has been released on bail [by whom?]

Shadow Attorney-General Andrew Tink yesterday said the case highlighted the pressing on-going need to reform the bail system for repeat offenders. "I will be introducing a private members Bill today to tighten the laws and take away the presumption of bail for repeat offenders," Mr Tink said.

A spokesperson for Justice Action Mr Brett Collins said, "Tink's proposal to lock more people up will cause more murder and make society more dangerous."

"Crime including murder is the result of many factors all due to being human and wider pressures on individuals to increase the pressure on some people by barbaric conditions can only make them more anti-social and dangerous." He said.

Why blame existing laws? The magistrate whoever that was? Why wasn't the magistrate named? Granted bail in the domestic violence case when he/she had Bardakos's previous history and the current alleged offences in front of him/her. Instead of admissions that the magistrate should have used common sense and made a mistake by not holding him in custody and offering him some social support, the ruling class argue for tighter restrictions on bail laws, for the whole community.Why is that?

Carr's Castle the real story H.R.M.U.The High Risk Management Unit Goulburn Correctional Centre

The Australian Institute of Criminology's Standard Guidelines for Corrections in Australia - 1996 just don't cover the Goulburn HRMU according to Mr Ron Woodham Commissioner of Corrective Services. The High Risk Management Unit (HRMU) is the centrepiece of a major $22M redevelopment of Goulburn Correctional Centre.

You can't see a doctor for six months is one of the complaints.

A prisoner writes, " I was unsuccessful in my letters to Dr Matthews CEO of the Corrections Health Service on my problem regarding air - claustrophobic effect the cells have on me. Just recently the management decided my injuries are not seriously affecting me so no further discussions are necessary.

They are fairly confident in their own assessment as they know every attempt I had previously made to Matthews and other relevant authorities about the matter were dismissed and that is that. In the meantime I still quite often have great moments of anxiety and feel no air and choke-up and get quite bewildered in my attempts to overcome the problem.

This place is purposely built as a basic box in a box. Once our back door is closed there is no natural ventilation and no natural light. The guidelines I read of are not included in 'Carr's Castle' design, and in reality this place is poorly designed and difficult for everyone, prisoners and management.

Management bought it up themselves as each new rule generally cuts across an old rule. I am not concerned about the purpose of the place, but I am about the panic attacks I get in here because it is a straight out box. As I have other issues going on as well I feel some people will confuse those issues and my actions. The lack of air in cells or claustrophobia are both related to it's a box and once I feel the walls closing in and I realise there is no air, no openings- yet I can see air and know its out-side the door and that is what causes me to panic as I know I can't get to it."

"In other units the ASU or MPU I could always get to the grille and breathe in fresh air and after a few minutes I would feel better, in here one cannot do this."

The wife of a prisoner who is now on a hunger strike writes to Justice Action, "I would like to state that I believe that the degree of punishment "D" has received is very severe. Whilst being housed in the H.M.R.U. "D" has been threatened bashed and told by an officer "how would you like to be found hanging in your cell." "D" has made a statements regarding these incidents but has never been informed of any action taken regarding these events."

"I myself have tried five times to speak to the governor at Goulburn in relation to these events and have been unable to speak to him and I am still waiting for him to return my calls. "D" went into custody as a young offender and whilst in the departments custody has never been treated in such a manner despite the sentencing judges recommendations for the department to do so. I fear for "D" health and safety whilst housed at H.M.R.U. as "D" has expressed his concerns to me."

THE PRISONER: Standard Guidelines for Corrections in Australian were. That is, before 'Carr's Castle' (were) as follows:

SECTION 1 - Guiding Principles
1.2 Correctional programs are by the deprivation of liberty to varying degrees, a punishment in themselves. Therefore correctional programs must not, except as incidental to the maintenance of discipline or justifiable segregation, aggravate the suffering inherent in such a situation.

Inspection and Community Involvement
3.1 Each Administering Department must establish a set of clear guidelines for the operation of prisons and community corrections centres, and the management of prisoners and offenders. An inspectorial or review system must be established by each Administering Department to ensure these guidelines are administered in each prison and community correction centre.

Requests and Complaints
3.21 Every offender and prisoner must have the opportunity of making requests or complaints to the designated authorities, including Official Visitors and members of any Aboriginal Visitors Scheme or similar body.
3.22 Every offender and prisoner must have the right to make complaints under confidential cover to persons authorised either under legislation or by the Administering Department.
3.23 All officers must promptly reply to and deal with every request or complaint addressed or referred to them.

Use of Force
5.40 A prison officer may, where necessary, use reasonable force to compel a prisoner to obey a lawful order given by the prison officer. Where such force is used the prison officer must report the fact to the Manager of the prison.

Health Services
5.66 For every prison, the services of at least one qualified medical officer must be available twenty-four hours a day. This service may be on an on-call or standby basis. Medical services should be organised in close relationship with the general health administration in the community and must include access to a psychiatric service for the diagnosis and treatment of mental disorder.

Accommodation
5.23 In new prisons, accommodation should generally be provided in single cells or rooms. Provision may be made however, for multiple cell accommodation for the management of particular prisoners.
5.24 Existing dormitories should only be occupied by prisoners who are suited to them.
5.25 All accommodation provided for the use of prisoners should meet all requirements of health. Due regard must be paid to climatic conditions and particularly to cubic content of air, floor space, lighting, heating and ventilation.
5.26 In all places where prisoners are required to live or work:
* the windows should be large enough to enable the prisoners to read or work by natural light, and should be constructed in such a way that they allow entrance of fresh air except where there is artificial ventilation;
* artificial light should be provided to enable prisoners to read or work without injury to eyesight.
5.27 Toilet and sanitary facilities must be provided for prisoners to use as required, and these must be kept in a clean condition.
5.28 Adequate bathing and shower installations must be provided to enable every prisoner to maintain general hygiene by bathing or showering at a temperature suitable for the climate.
5.29 All parts of a prison should be properly maintained and kept clean at all times.

Australia: Private Prisons, Junee NSW
When I got to Junee I was given nothing except bed linen. That's it! No clothing. I had to put my name down for clothing, which they said I could get on Saturday. When I went down to get my clothing on Saturday I was told they had nothing but I was told that I could buy what I wanted on their monthly buy-up.
