ACT Police sly avoidance of complaints accountability a bad precedent?

Address: Canberra, Local Assembly

'the [ACT] Minister for Police refused to answer questions about complaints against police at the Annual Report public hearing today'

ACT Greens MLA Deb Foskey Media Release

complaints against police

ACT Greens MLA Deb Foskey expressed concern about the transparency of ACT Policing, after the Minister for Police refused to answer questions about complaints against police at the Annual Report public hearing today.

"At a time when police are to be given more powers, including the use of force against people who may be entirely innocent, we need to be utterly convinced our police force remains accountable and holds up to robust examination" Dr Foskey said today.

"However, the ACT Policing Annual Report provided little information about complaints made against it last year, and the Minister refused to allow questions on the matter in the Committee hearing today."

"The ACT Policing Annual Report failed to cite the number of complaints made against it, the number investigated, and consequent actions taken against AFP employees. The report merely states (p 27) that there were only four substantiated complaints in 2004-05."

"By contrast, the ACT Ombudsman's Annual Report (p 20) reveals that 460 issues arising from complaints were managed through a workplace resolution process, and 246 were successfully conciliated. The Ombudsman has also foreshadowed own motion investigations on areas 'where police interaction with the public remains problematic'."

"The Minister for Police would not tell the Committee why the ACT Policing report did not address these or other matters raised by the Ombudsman. It is no slur on the integrity of the police for me to expect and ask for a full and frank disclosure of its handling of complaints in its annual report" Dr Foskey said.

Guilty until proven innocent - justice in the `war on terror'

In the week in which PM John Howard's support as preferred prime minister dropped to a three-year low, the arrest of 17 people in Sydney and Melbourne on November 7-8, allegedly for planning a terrorist attack [scapegoats to bolster support and quell dissent for the Coalition of the Killing's resource wars in the Middle East], was exceedingly fortunate timing for the federal government.

Victorian cops the most corrupt in Australia

A weekly round up of news on the cops. Former Australian Crime Commission Chair says Victorian cops are the most corrupt in Australia -- so they are given extra powers -- and so Melburnians can be patrolled by the army -- and have business deals with McDonalds. Top cops in NSW cleared after investigation -- but another one charged with child slavery. Western Australian police officer leaves the force under secrecy -- and Canberra hospital nurse tells the Federal Police to bugger off.

Victorian Police have won the prize of being the most corrupt police in Australia, in the opinion of the former chairman of the Australian Crime Commission, Peter Faris QC, according to the Sept 19 Australian.

Mr Faris further said that the Victorian Police Commissioner, Christine Nixon, was weak and a 'slave' to the Bracks Government, as he spoke to a parliamentary committee.

Corruption had been 'swept under the carpet' and allowed to fester, he said.

'I think there's a huge amount of corruption in the Victoria Police that's never been addressed,' Mr Faris said.

'When the balloon went up about the drug squad, that was only a small part of the corruption, and all the rest has never been looked at, it's all been swept under the carpet.'

The QC added 'I think we have dire problems here. I think we have a weak commissioner. I think the commissioner is a slave to the Government.'

The coppers in Victoria have been under sustained fire since the disgraced drug squad was disbanded in 2001.

Victoria: even more powers for the 'most corrupt police in Australia'

But your average copper these days is not so much the filth that we know of old, but a top notch counter-terrorism fighter. How appropriate, then, that they will be given police state powers.

Numerous media outlets reported on Sept. 21 that Victorian police will be given stop and search powers by the Bracks Labor government.

Police will also be able to search cars, demand identification, seize property, seize closed-circuit TV footage without a warrant and conduct secret property searches.

Some of these powers will be extended to officials and security guards at airports, power stations and reservoirs.

On the terrorism front, Premier Bracks has kissed the bottom of the Prime Minister, John Howard, saying that he approved of Federal Government plans to allow terrorist suspects to be detained for up to two weeks.

The Prime Minister, John Howard, has reciprocated by kissing the bottom of Premier Bracks, while at the same time indulging in a little bit of tongue action.

The Prime Minister said 'I think [the plans of Premier Bracks] are very sensible in the context of the preparations in this city for the Commonwealth Games' according to ABC's The World Today program on Sept. 21.

The President of Liberty Victoria, barrister Brian Walters, commented 'We've spent more than $5 billion on security since [the US false flag operations on] September the 11th, 2001 and it's hard to see that that reaction is proportionate to the threat that's posed,' said Brian Walters.

Walters continued 'Well I think there is some hysteria about the threat of terrorism and there is often the belief that getting rid of human rights will somehow make us safer, but our greatest security lies in our human rights.'

Further guranteeing our human rights will be the jackboots of the military, drafted in to occupy Melbourne during the Commonwealth Games, according to ABC news online.

Victorian Police Commissioner Christine Nixon, described as weak and a 'slave' by a witness to a parliamentary committee (see above), will be the head of security for the games.

A total of 1,200 Australian Defence Force personnel will be in Melbourne in addition to the 13,000 police who will be deployed.

Melburnians have been warned to expect Defence Force personnel and equipment in and around the city in the lead-up to the Games. ADF tactical assault teams will be deployed.

Equipment to be used include Black Hawk helicopters and fighter jets, according to a Sept. 20 AAP report.

Melburnians have also been warned to expect personal searches, cars in the city to be subject to spot checks and residents could expect to see military aircraft overhead in the lead-up to, and during, the Games.

Meanwhile, doughnuts are being replaced by Big Macs as the favourite food of coppers in Victoria.

In a scene guaranteed to make any right-thinking person shudder with dread, Victorian Police have linked up with McDonalds to produce 'blue ribbons' for coppers killed on duty, according to the Sept 20 Ararat newspaper.

Blue Ribbon Foundation CEO Neil Soullier, in support of the Victoria Police Blue Ribbon Foundation, has raised more than $4 million for community projects since 1993 which perpetuate the memory of police officers who have died in the line of duty.

No mention has been made in the various press releases about fundraising for the families of victims shot dead by police.

In New South Wales, Deputy Police Commissioner, Dave Madden, who is otherwise leaving the police service, will not be charged with any offence under the Telecommunications (Interception) Act in relation to phone tap leaking allegations, according to the Sept 20 Sydney Morning Herald.

The Assistant Commissioner, Peter Parsons, has also been told he is in the clear.

Mr Madden has applied for medical discharge because of stress.

The leaks related to allegations that some Bulldogs players had raped a woman at Coffs Harbour on February 22.

They haven't escaped yet though. The Department of Public Prosecutions has referred the matter back to the Police Integrity Commission (PIC) to consider disciplinary action, according to a Sept 20 AAP report.

Although these two coppers might get off, that is not the case with former copper, Christopher White, who has been granted bail of 300,000 Thai baht ($A15,000) while facing child molestation charges, according to a Sept 20 AAP report.

White was arrested at his home in Bangkok on August 24 and denies charges that he sexually abused a teenage girl from Chiang Mai for four years. He is accused of forcing her to perform sexual acts on video with him and his friends.

In Western Australia, one of the state's most senior police officers has quit after making an 'error of judgment.'

Deputy commissioner Tim Atherton resigned, but we don't quite know why. The Sept 21 Advertiser reports that State Police Commissioner Karl O'Callaghan refused to provide details of the inappropriate conduct that led to his deputy's surprise resignation

He would not reveal when the conduct occurred and refused to say whether the behaviour involved sexual harassment.

But this week's round up has a happy ending. Australian Federal Police were put in their place by Canberra Hospital staff when they attempted to bully their way in past the emergency reception desk, according to the Sept. 16 Australian.

When the cops, with Deputy Prime Minister Mark Vaile in tow, tried to break the relatives-only visitor rule to see Senator Barnaby Joyce, the badge-flashing cops were told by the desk nurse 'That means nothing here, sonny.'

It was reported that Senator Joyce had arrived at the hospital at 8.45pm complaining of a migraine.

Australia: Counter-liberty plans unveiled

AUSTRALIA: VIC: BLACK Hawk helicopters and fighter jets will patrol Melbourne's skies during the Commonwealth Games next March, as part of counter-terror measures outlined today.

"We are planning to deploy to Melbourne, for the period of the Games, a number of resources. There will be an ADF tactical assault group with appropriate support including Black Hawk helicopters," Mr Ruddock said.

"There will be a range of chemical, biological and radiological response assets.

"There'll be a task force of about 1200 personnel, service personnel, to assist Victoria Police with searching venues, operating vehicle checkpoints, responding to bomb threats, if any, and clearing any underwater aspects of venues and events.

"Helicopters, fast jets and ships will be available to counter specific threats, should they arise, including the capability to divert aircraft and intercept vessels at sea."

The Victorian government is set to introduce new counter-liberty laws to give police more powers.

Under the laws police will be able to demand identification, seize goods and obtain closed-circuit TV footage without a warrant.

They will also be given the power to stop and search people and vehicles.

Police Minister Tim Holding says the new powers are needed.

"They are limited in both time and geographic area and they do require the authority of the Premier before they can be used," he said.

He says the powers will only be used for specific events, such as the Commonwealth Games, and for a limited amount of time.

Premier Steve Bracks says the powers are for use in limited circumstances only and strike a balance between civil rights and law enforcement.

He says the increased power for police to "covertly" search properties will require a court order.

"This requires a warrant which I think is a good balance, an acceptable balance, and has a proper check against excessive use of powers and that warrant is not hard to get if the evidence is there that it should occur and I think that is a sensible and reasonable balance," he said.

Liberty Victoria says there is no reason for the Bracks Government to increase police powers to fight terrorism. [ More likke fear-mongering, propaganda.]

The president of Liberty Victoria, Brian Walters SC, says he does not understand why there is a need to rush through the new laws.

"The terrorism level according to the Federal Government's own security assessment remains at the second lowest level and it's been there since September 2001 - what's the sudden urgency?" he said.

The laws are expected to be introduced into Parliament after they are discussed at a summit of state premiers and the Prime Minister in September.

Australia: Copwatch No. 2

Deputy Commissioner Andrew Scipione, said the evacuation planning required police to imagine the worst that could happen.

A round up of the boys and girls in blue

A review of what the boys and girls in blue have been up to shows that their respective juices have been stimulated by their ability to demand greater and greater police powers.

In Sydney, NSW police were the first to ask for extra powers to evacuate the city centre into Hyde Park and other predetermined areas in case of a 'terrorist' incident, according to the August 1 Sydney Morning Herald.

The plans have been described as nonsense by security experts as this is exactly want terrorists want - 100,000 or so people in Hyde Park so that they can be the victim of secondary bombings. The excitement of police at ordering hundreds of thousands of people around obviously got in the way of their better thinking.

A central plank of the proposal was the push for more sniffer dogs, however, they will have to be better trained than the Victoria police dogs who were accidentally trained to sniff out talcum power.

An August 2 AAP report noted that dogs that had been trained to sniff out cocaine were in fact taught to sniff out talcum powder as the original cocaine had been switched. In January, two Victoria Police dog squad members went to the Australian Federal Police headquarters in La Trobe Street to take the cocaine to train the dogs. They took the merchandise, signed the appropriate forms and headed back to the dog squad.

Each of the dogs will now have to be re-trained at an approximate cost of $95,000 per dog.

The original cocaine has not been found.

On less weightier matters, our cops can't even get traffic cameras to work. A Herald and Weekly Times news article reports that many Victorian drivers have been wrongly banned from driving. Graeme Marr, 41, a former camera operator, said that there were problems with reflected radar beams. Radar beams can be reflected off various metal objects and this corrupts the readings.

Mr Marr is appearing as a defence witness for Glenn Hilburn, in the Broadmeadows Magistrates Court, who is being charged with speeding.

Finally, police are good at some things: shooting unarmed and mentally ill people being one of them. An August 4 AAP report quotes a state coroner attacking Victorian Police who shot a mentally ill man in 2002.

Mark Kaufman, 25, died after he was shot by a police officer at his Glen Waverley home in 2002.

The court heard Mr Kaufman, who had schizophrenia, was brandishing two knives and had stabbed his father earlier that day.

The State coroner, Graeme Johnstone, said that he accepted that the officer feared for his life, but that the police should have just waited while trying to confront him. He further found that the police handled the situation badly and that more experienced police officers should have been involved.

Elizabeth Crowther, from the Mental Health Fellowship of Victoria, says police need to learn from the tragedy.

When not shooting unarmed mentally ill people or criminals, there is always the wildlife. A police officer has been summons to appear at Melbourne Magistrates Court with shooting a magpie.

The unnamed constable, from Diamond Creek, has been charged with discharging a firearm in a populous area in a dangerous manner, hunting and destroying a protected species. An autopsy has been conducted on the dead bird as part of the investigation.

The officer had been charged with discharging a firearm in a populous area and in a dangerous manner. He was also charged with hunting and destroying a protected species. The bird has been subject of an official post mortem.

There is always the avenue of complaint, of course, for the public when the police don't do their job properly. Like the woman who wrote to the Office of Police Integrity complaining that a police officer had breached her privacy.

The reply from the Office of Police Integrity plopped into the woman's letterbox, consisting of 500 pages of confidential material on more than 400 people.

According to the August 6 report in the Melbourne Age, the woman who originaly complained said 'I was writing to the [Office of Police Integrity] about breaches of my privacy and they have breached privacy beyond what I could possibly have imagined...I have no faith in returning the documents to them because they are simply going to sweep the issue under the carpet and do it to somebody else at will.'

The files contained full names, private addresses, sexual preferences, 'ethnic appearance' and criminal records.

The OPI said that 'Although mistakes of this nature are regretted, it should be remembered that the office handles thousands of complaints and inquiries every year.'

That's alright then.

Community seeks more power to interrogate ASIO suspects

Greens Senator Bob Brown does not think increased police powers are necessary. "We have enormous powers for surveillance, apprehension or punishment of people who are engaged in or intending to engage in or thinking about being engaged in terrorist acts in this country," he said.

Australian Community leader Mr Lothar from the 2nd Renaissance is calling for more powers for reverse surveillance of the Federal Police.

Mr Lothar is also calling for expanded community powers to combat the HoWARd Governments fascism.

He says, "Dictionaries tell us that fascism involves, "Extreme right-wing, nationalist and authoritarian systems of government and social organisation."

Almost everyone recognises the past regimes of Adolph Hitler and Benito Mussolini as totalitarian. However, few citizens of the US, Britain, or Australia, consider that their governments have yet reached such extremes." He said

"The mainstream media, and the professional propagandists that now influence and shape every event that is reported by such channels, make it difficult for the ordinary citizen to reason clearly, without being led along carefully contrived lines of argument. Many lines of reasoning given for increased surveillance, and for continual intrusions on individual privacy, end in the exhortation, "If you've nothing to hide, you've nothing to worry about." For example, one sequence goes like this:

* Criminals do harm to society,

* Criminals use cell phones to talk to each other,

* All cell phones need unique identifying codes, so that law enforcement officers can track criminals by their phones,

* So, your phone has a unique identification code embedded in its SIM card,

* The police (and anyone else) can track your every movement while you have your phone switched on,

* But don't be concerned, "If you've nothing to hide, you've nothing to worry about."

This all seems reasonable to many citizens, who genuinely feel that they have nothing to hide. They consider that the surveillance is not directed at them, but only at the "bad guys" in society.

However, that's not true. Anyone who thinks it through soon realises that such surveillance is a significant intrusion on citizen's privacy."

Today's line from the war criminal and his cronies Mick Keelty: (AFP): "Police need greater powers to force terror suspects to say who they work with and what they know about planned attacks." "If society really expects law enforcement to prevent and disrupt terrorist activity, then we need to look at other models that are working or that are under development in other parts of the world," he said.

"The AFP's overseas counterparts have a greater ability to force suspects to provide information about planned attacks."

"These include questions such as the person's identity and movements, what the person knows about a recent explosion or another recent incident endangering life and what they know about a person killed or injured in a recent explosion or incident," he said.

Mr Lothar " But don't let officials and propagandists think for you. Think for yourself. Think for your family, think for their security, think for their future, think for their freedom."

Talk Straight About Surveillance

The prevailing debates about surveillance and individual privacy are unidirectional, they all lead towards citizens and away from governments. Nobody ever suggests surveillance of police by citizen groups. Nobody ever argues that, "Since the AFP works for the people, it can have nothing to hide from them. Therefore, let us see the files. Give us the computer passwords.

Let us into the AFP offices, we own them anyway. Don't we?" If Australia was a real democracy, none of these requests would seem strange. But, the fact is that Australia is only a pretend democracy, as are its allies; the US and Great Britain. So, requests of this nature can be expected to be described by authorities of these elected governments as, "outrageous", "impractical", "dangerous", and of course, "not in the national interest."

It is up to ordinary people to raise the level of debate about the undemocratic surveillance practices of the many faceless and unaccountable agents who make daily intrusions on individual privacy, and about the apologists and propagandists for the War on Terror who applaud every new attack on human rights and freedoms as "prudent" or "necessary". If there is no discussion of reverse surveillance in the national media, create it on the streets on a citizen to citizen basis.

If nobody is talking about the outrageous assaults on privacy and human rights embodied in the new anti terrorist acts forced through US, UK and Australian legislatures, start talking about it to your neighbours and friends. If you are apprehended for behaving in a suspicious manner, make sure that the subject of your "disloyal" dialogue comes out in court.

There is nothing inherently wrong with arguing for an overview process covering the files of covert agencies, or other government departments for that matter. Such reverse surveillance could be performed by randomly selected citizens audit teams. That idea won't be popular with the Feds, but discussion of the proposal can't easily be prevented in a society that is declared to be democratic. If such discussions are to be outlawed, secretive states can no longer pretend to be democratic, and they must show their true colours to their citizens, and the world."

Surveillance

HoWARd's Cronies Federal Attorney-General Philip Ruddock says he will look into whether the AFP needs greater powers to fight terrorism?

The Government gave the AFP increased powers earlier this year, but Mr Ruddock says he will consider any request made.

"I have asked my officials to look at what the Commissioner has had to say," he said.

"If I get advice from somebody like the Commissioner of Police that these matters need to be looked at, I'll look at them."

Reality

Greens Senator Bob Brown does not think increased police powers are necessary.

"We have enormous powers for surveillance, apprehension or punishment of people who are engaged in or intending to engage in or thinking about being engaged in terrorist acts in this country," he said.

"The challenge to Mr Keelty is to use those powers properly before claiming he needs even more."

Mr Keelty was speaking to a conference of criminologists in Melbourne last night.

Lothar:

Argue For Reverse Surveillance - It IS Democratic! Code breaking, and subsequent surveillance of military communications transmitted by the German and Japanese forces, played a major part in the victory of the British and US forces in World War II. As a consequence, the old allies continue to maintain major systems of surveillance, under the UKUSA agreement. To this day, the US National Security Agency (NSA) is the largest employer of mathematicians and cryptographers on the planet.

But their surveillance now intrudes on the private lives, commercial confidences, and intellectual property rights of all citizens.

Not only those people living within the territories of countries that are signatories to UKUSA are affected. The secret SIGINT community spies on all or humanity, on a 24/7 basis.

It is possible to argue that this constant, all pervading surveillance is in the "national interest" of the British or US governments and their "owners", (but not the interests of ordinary citizens). However, nobody can soundly argue that such spying is in the wider interests of humanity.

When the surveillance systems of UKUSA are used to steal knowledge, dominate trade, create artificial scarcity, and maintain poverty and economic control, they serve to refute the notion that the governments that deploy them are either free or democratic.

Reverse surveillance, on the other hand, is inherently democratic. The whole basis of democracy is that elected representatives act for their constituents, and that they run accountable and transparent administrations. There is nothing in the democratic contract that permits covert surveillance of citizens by government agencies, nor is there any understanding that it is acceptable for "our" governments to bug "their" technological developments and steal or suppress what they choose, to keep scarcity and poverty going in the world.

All such surveillance activities are out of step with democracy, and it is entirely legitimate for citizens of any nominally democratic state to insist of their right of inspection and elimination of surveillance systems. All agencies of government, both overt and covert, come under this remit of citizens in a free society. And I guess that includes Governments who want more, more, more and even more powers to screw citizens over for political purposes.
