Downer won't press US for 'torture' report?

The, [war criminal], Australian Government says it has tried and failed so far to get a copy of a report by the International Red Cross which claims psychological and physical coercion of detainees, [prisoners], at Guantanamo Bay in Cuba?

Leaked details of the report, which accuses the American military of beating some detainees, [prisoners], as well as using physical coercion described as "tantamount to torture".

Foreign Minister, [war criminal], Alexander Downer says the Red Cross has denied Australia's request to see the report, and it is not appropriate to ask the US for a copy. [?]

Downer says he will wait for the results of a US Naval investigation into allegations of mistreatment at the prison. [?]

"If there are any concerns about maltreatment then that's something that we'd vigorously take up with the Americans," he said. [?]

The Red Cross says it cannot release reports because of a confidentiality agreement with the US. [?]

"While the ICRC has felt compelled to make some of its concerns public, notably regarding the legal status of the detainees, the primary channel for addressing issues related to detention remains its direct and confidential dialogue with the US authorities," it says on its website.

"The ICRC's lack of public comment on the conditions of detention and the treatment of detainees must therefore not be interpreted to mean that it has no concerns.

"Confidentiality is an important working tool for the ICRC in order to preserve the exclusively humanitarian and neutral nature of its work."

The lawyer for Mr David Hicks, Stephen Kenny says the Red Cross report alleging torture is consistent with inmate, [prisoners], statements.

"What it does is confirm the treatment and the allegations that have previously been made by not only David to us, but by others who have been released," he said.

The report, which the Red Cross is yet to confirm, says some prison doctors violated medical ethics by helping plan interrogations.

Australia's minor political parties have seized on the report.

Incoming Democrats leader Lyn Allison accuses the Government of not doing enough for Australian detainees, [prisoners], David Hicks and Mamdouh Habib.

"It's been prepared to walk away and say, 'well, we'll just leave it up to the United States' and I think that's an abrogation of responsibility," she said.

Life in jail is an ordeal but it's a much harsher sentence for the child of a prisoner

They have been dubbed the forgotten generation - the innocent casualties of their parents' crimes. New research shows that in 2001 14,500 NSW children had a parent in jail. And 60,000 NSW children under 16 have experienced the incarceration of a parent, more than half enduring the trauma of separation before they turn five.

The statistics were outlined at a Public Health Association of Australia conference in Brisbane. And as the NSW prison population continues to grow, researchers fear this group of children may become particularly vulnerable to psychological, social and other health problems as well as the long-term effects of such an early exposure to prison.

The study's author, Simon Quilty, said children and their remaining parent were often unsupported, increasing their vulnerability to mental health problems.

"This enormous group of children are born into situations they simply have no control over. This also puts them into family environments which, often by loss of a parent to prison, makes them even more marginalised. "This effectively puts them at far greater risk themselves of becoming involved in some form of criminal activity."

Based on information provided by parents to NSW Corrections Health Services, the report used a population model to estimate the number of children in the state who had a parent jailed in 2001.

This model estimated the total number of children under 16 in 2001 who had experienced parental incarceration. The model adjusted for changes in prison population over the past 16 years and attempted to account for recidivism.

Mr Quilty spent a year working on the research for his masters in Public Health at the University of Sydney. Based at the head office of Corrections Health Service at Long Bay Prison Hospital, he was provided with administrative assistance by the service.

His research was supervised by Associate Professor Michael Levy, the Director of Population Health at the service. He said: "Here we have a cohort of children who are themselves from a high-risk background of poverty and socio-demographic disadvantage, who have a parent that probably has poor health and other problems such as employment difficulties and housing problems.

"On top of that, the parent/child bond is disrupted due to incarceration, further exacerbating the problems these children might face in future. "The model predicts that 60 per cent experience their first episode of parental incarceration before the age of five.

This is an age when they are most vulnerable and when the trajectory of their life is being set. That experience is just another of a series of adverse events these children have to overcome or the direction their life goes in." A generation of children whose life experience meant they lived with massive risk factors was often not acknowledged by governing bodies.

This claim was supported by Eileen Baldry, of the University of NSW school of social work, and Ann Symonds, a former state MP, who authored a parliamentary report into the children of imprisoned parents. "These are children who in some ways are said to fall between the gaps and have not even been recognised formally to exist." Ms Symonds said.

Dr Baldry said it was important that the judicial system took into account the effect on children of incarceration. "Their needs are enormous. They already come from a demographic that is high-risk but they have also lost a parent to prison."

Mr Quilty said that while every prisoner's parental status was recorded there was no follow-up: "I heard so many stories from the inside from prisoners about what would happen to their children. A man was brought in who had tuberculosis and had four children and his wife had only recently died ," he said. "The family were bordering on homeless but he just wouldn't comment or tell the department where the children were."

Statistics indicate that at any one time approximately 15,000 students in NSW are directly affected by the imprisonment of a parent, and that 60,000 students under the age of 16 have experienced parental incarceration at some point in their lives. The peer groups of each of these students can also be affected indirectly.

The Criminal Law (Rehabilitation of Offenders) Act 1986 Qld
The Criminal Law (Rehabilitation of Offenders) Act 1986 (Qld), requires that any person who has committed an offence which is less than 10 years old or which resulted in a prison sentence of more than 30 months, must disclose that offence if requested eg. for employment purposes. If a criminal record is disclosed in a job application, it is unlikely that person will be given the job.

NSW Serious Offenders Review Council
In response to a letter we have received from Mr K C who has said that he is serving 24 years and 10 months commencing on 29/8/1991 with his earliest release date being 28/6/2016 with 4 years parole and full time 28/6/2020. He said that he contacted the Serious Offenders Review Council in writing but received no response.

Australia: Private Prisons, Junee NSW
When I got to Junee I was given nothing except bed linen. That's it! No clothing. I had to put my name down for clothing, which they said I could get on Saturday. When I went down to get my clothing on Saturday I was told they had nothing but I was told that I could buy what I wanted on their monthly buy-up. In the mean time I got rashes between my legs from the dirty clothes I had on.

Four months after a report from the Inspector General on Mulawa Correctional Centre, key recommendations involving safety and welfare of prisoners and staff have been ignored. Kathryn Armstrong (former chair of Inmate Development Committee) and Annabel Walsh, released from Mulawa Womens Prison in February, have produced an independent report confirming the findings of the Inspector General.

I needed to verify the call and asked for a name or number to register my call because I was asked to get those details by my coordinator.The person refused to identify themselves either by name or number. Ron Woodham, Commissioner Corrective Services stated "[this Department] does not recognise Justice Action as an advocate on correctional centre issues." He has ordered a ban on all Justice Action material inside the NSW prison system. This resulted from a request for the approval of the latest edition of Framed (the Magazine of Justice Action) to be distributed throughout NSW prisons as has occurred for the past ten years.
