The reckoning of a police whistleblower

A decade after crooked cop Trevor Haken rolled over at the Wood Royal Commission into police corruption, he remains in fear of his life and says he has been left out in the cold by authorities, having reached his used-by date.

"I would have been far better off not going on side with the Royal Commission and holding the line with other members of the New South Wales police force," he said.

"I still feel, and I think I always will feel, that my life is in danger because of the number of people that I implicated at the royal commission.

"I'm basically not a creature of habit anymore. I live life as though I'm being followed all the time. I drive looking out of the rear-view mirror all the time. I don't shop in the same shopping centre twice."

As a former high-ranking detective in the New South Wales police service, Haken was a member of the drug squad at the CIB, led the drug unit at Kings Cross for several years and was a member of the joint task force into drug trafficking. But Haken was on the take.

He and his colleagues protected some organised drug syndicates in return for monetary kickbacks and information. That information was used to investigate and prosecute competing drug syndicates.

Haken says it was an arrangement that allowed the police some measure of control over crime and gave tacit approval for their criminal associates to grow their market share.
Former NSW police minister Paul Whelan says Haken was nothing more than a crook.

"Haken and his mates were the gatekeepers of crime at Kings Cross, 'please pay'. They believed that they had 'noble cause'. In fact, they were just straight crooks," Mr Wheelan said.

Rush to ruin

Haken now says accepting kickbacks was "a rush towards a ruined life".

Still, he did not set out to be crooked. With stars in his eyes, Haken joined the police force after the death of his father. It was the yearning for a "brotherhood" and strong male role models that sealed the deal.

Following the lead of others, he soon became involved with tow-truck rackets that paid kickbacks when notified of accidents. It was a seemingly harmless scheme and Haken says it wasn't long before most things could be "justified".

"When you start off into corrupt practice it doesn't take very much to go up the ladder. And the further you go up the ladder, the more acceptable things become until you reach a point where there's nothing that isn't acceptable," he said.

Haken says it got to the stage where there was no form of improper behaviour that he wasn't involved in.

"I was involved in stealing money, verballing people, giving false evidence, gutting briefs which is removing information from briefs to allow people to be exonerated," he said.

After years of lining his pockets with the proceeds of crime, Haken realised that he was under surveillance.

"In the early 90s I was aware that I was under surveillance by police from some organisation. I wasn't aware who," he said.

"And then on one occasion I went home and found that the tumblers on my front door lock had been interfered with.

I didn't know whether it was a clandestine search had been carried out on my home or whether they'd placed listening devices in the house. But I was aware that I was under surveillance," Haken said.

Pivotal evidence

It was the New South Wales Crime Commission that had been keeping an eye on Haken and in September 1994 senior officers from the Wood Royal Commission into the New South Wales Police Service made contact with Haken and asked him to roll over.

He says he made the choice because inevitably there was no other choice. In exchange for criminal indemnity, Haken spent nine months gathering audio and video evidence.

Some of his infamous targets included crime boss Bill Bayeh and friend and colleague detective inspector Graham Fowler. Haken says it was dangerous work.

"At one meeting with Bayeh, he told me that another police associate had told him he must have balls to be meeting with me because the rumours were all over town that I'd rolled.

"And he said, 'If anyone goes against me, I'll kill them, I'll kill their wife, I'll kill their kids'. And that's not a threat I took idly, not then, not now," Haken said.

Once his cover was blown, his then wife and four children were put in the witness protection program, separated from Haken and sent overseas without any follow-up support.

When his turn as star witness at the Royal Commission came, Haken's evidence proved pivotal.

Mr Wheelan says the evidence sent shockwaves through the force.

"Haken's public acknowledgement as a police informer sent shockwaves to those he'd been working with. It came as a bomb.

"Haken exposed a large number of corrupt police, all the way up to chief superintendent to assistant commissioner," Mr Whelan said.

"I would have to say that it was Haken's evidence that was crucial for the success of the Royal Commission."

[But in reality they didn't go far enough did they Mr Whelan? They never got the headkickers in Parliament House did they? They didn't get the politicians that owned the pub just up the road from Surry Hills Police Centre and who allowed things like the standard police 'noble cause corruption' to go on, did they Mr Wheelan? What about the stealing money? verballing people? giving false evidence? gutting briefs which is removing information from briefs? to allow people to be exonerated. Not to mention out and out police corruption? Laugh!]

Haken continued to give evidence for a further nine years and individuals such as Bayeh and Fowler were charged and jailed for various crimes. On the whole, the Wood Royal Commission was the catalyst for wide-ranging reforms of the New South Wales policing system, but it still rankles with Haken that there were others whom he implicated that were never charged.

Life in hiding

Haken says he has been left high and dry following his experience as a whistleblower and is devastated by a life in hiding.

"I've lost all hope that life can ever be returned to normality," Haken said.

"I believe I haven't been suitably compensated and my security hasn't been taken into consideration properly. Financially I'm in a perilous situation.

"In the eyes of those at the Police Integrity Commission I've reached my used-by date."

In the end he failed the brotherhood and the brotherhood has failed him.

"Even if I had gone to jail, it would have probably only been for a couple of years and not the life sentence that I've got now," he said. [Known Disparity for Police.]

It seems a simple logic in retrospect.

The one that suppose to be autonomous according to Lord Denning. Where the Parliamentary Secretary can ask the commissioner of police to 'report' then sack him if he is not satisfied with such report.

Prison Mind Games-Do they exist?
Directives are given inside the prison system that are not consistent with the law in NSW. And not in the good interests of the health and well being of the prisoners.

What is happening between the Police Service and politics is quite extraordinary at the moment. If stand over tactics don't work tell half the truth honestly and follow the example of sheep. Another word for it is sleaze, yeah. Another word for it is workplace harassment. Another word for it is bribing a Police Officer. Another word for it is misleading Parliament.

The Police Commissioner, Ken Moroney, has said he will recommend to the Police Minister, John Watkins, that Taskforce Gain be given extra resources and made a permanent squad.

The taskforce focuses on gangs in south-western Sydney with links to Middle Eastern organised crime.

The proposed unit would have the same powers as the South-East Asia crime squad. It would include detectives and support staff including translators.

The squad would reverse a decision by the former police commissioner, Peter Ryan, to shelve a proposal for such a unit because of fears it would be seen as racist.

Senior police said the decision was short-sighted, ignoring early warnings that the city was facing a potential crime "time bomb" inside the Lebanese-Australian community.

An alleged report in 2000 was said to have predicted problems that later arose.

[After the killing of John Newman, who was gunned down in front of his home by a person not found and a weapon not found, but by a person who was alleged to have conspired to kill Newman for political purposes, was framed and jailed.]

[Phuong Ngo found guilty of the murder was said to have been politically motivated?]

[But Newman wanted to stop the drugs in Cabramatta and lobbied heavily against the drugs. It was then Newman became the target of more sinister motives from the people who wanted no opposition to the 'slimy mackerel's' (bribes), being hooked and cleaned up at Cabramatta.]

[Ngo was alleged to have a political motivation for the crime, however there was a bigger plot, and that was to stop Newman on the drugs issue in Cabramatta.]

Despite massive pressure on the NSW police to solve the crime, no arrests were made until almost four years later when an inquest was held into Mr Newman's death.

David Hardaker: John Newman drew public attention to the gangs. But his campaign only enhanced their reputation on the streets. And when Newman was killed, Tri Minh Tran and his gang were natural suspects. But according to his sister, the Newman name wasn't mentioned at home.

The assistant commissioner of the New South Wales Police, Clive Small, responded to Detective Sergeant Tim Priest's comments a short time ago.

CLIVE SMALL: Yes I do and I acknowledged that when I appeared before the parliamentary committee.

CLIVE SMALL: It would seem to me that during 1999 and 2000 there were a number of internal problems at the police station and those problems meant that the fights in the police station were bigger than the fights on the street, if I can put it that way, and as a result of that the people of Cabramatta suffered.

CLIVE SMALL: Look I think it was a bit of all of those things. Certainly there were management issues and a lot of those management issues revolved around whether or not the police sufficiently understood the problems on the street.

JOHN STEWART: Do you accept the comment that over the past decade Cabramatta has become a major centre for heroin distribution, and that has impacted on other city and country areas throughout Australia?

CLIVE SMALL: Yes and again publicly I've acknowledged and so has the service acknowledged that Cabramatta has really been the heroin capital of New South Wales and indeed Australia for some years.

[So the drugs moved from Kings Cross out to Cabramatta, after the Wood Royal Commission, and then after the Cabramatta Parliamentary inquiry, the drugs moved to Bankstown, where the Green Light dominated the high part of town, until the rival gangs got out of control again!]

[Clive Small, has now taken over as the hero of the day who gets let off with his Contempt of Parliament in the Cabramatta Parliamentary Inquiry.]

[These gangs were above the law until the community howled with protests as each day Sydneysiders listen to news covering the drive by shooting. Gangs fighting for turf and at times even in broad daylight, because these gangs are more fearless being above the law in the first place.]

[Remember the initial call from police at Cabramatta was,

"It doesn't matter about the turf wars they are only fighting between themselves."]

[Rubbish! Try fighting between themselves, believing they were above the law in the first place. Police who made that statement and I think it was Clive Small ought to be suspended pending an inquiry, not put in Parliament House beside Bob Carr, after being found in contempt of a Parliamentary Inquiry.]

[Pretty good Gadget, if you had a clue about where the Police warlords were going to group together next, all you had to do is shine the ever-loving light on Bankstown, 3 years after you wrecked the place, and blamed it on the ethnic make up of the community.]

[This smart arse chooses new ethnic communities to bluff because he's a racist cop, who thinks he is so clever, he can hang out in Parliament House. Police Commissioner in waiting?]

[I urge all New South Wales citizens not to buy the corrupt NSW Police Force's line, and the reason they need a new squad, based on the corrupt history of police, but instead look for the corrupt elements within the police, and who gave the green light at Bankstown.]

[Please note that the crimes and the criminals were not apprehended when the problem at Bankstown broke out, because police behind the corruption would fear getting done themselves, if they arrested their co-offenders. It takes time to clear them, so police don't get done.]

[The police line on the initial claim about Bankstown drive-by shootings was that,

" It's all over a domestic dispute." Yeah! Why make that statement believing it was wrong!]

Last May the violence spilled into public view, leaving six people dead and 13 injured.

[The report's author was the then head of Crime Agencies, Clive Small, who set up Ivan Milat for the tourist industry.]

[The only witness in the Milat framing was evidence given by Paul Onions who never identified Ivan or the vehicle Ivan was alleged to have been driving. Since being convicted for the Backpacker murders Ivan has been kept in solitary confinement and thwarted from his high court appeal also being denied Legal Aid to prevent the truth from coming out.]

[Once again the Milat case was allegedly solved by Inspector Gadget (Clive Small) years after the crime was committed.]

[Small has been sitting beside Bob Carr (Mr Noble Cause Corruption himself) in the Premiers office, for some two years after he lost the bid to take Ryan's job as Commissioner. For a very good reason too, because bent police are a requirement for a bent premier!]

[Similarly, why Ron Woodam has stayed Commission of Corrective Services after the Rex Jackson affair.]

[Small was alleged to have told Mr Ryan of an urgent need to train more detectives to specialise in Lebanon-Australian crime. He predicted by 2001 such gangs' drug trafficking would cause "increasing economic and social harms".]

[It was alleged instead of creating such a unit, Mr Ryan, put the document in his personal safe.]

Small said yesterday he had presented his report, which drew on information gathered from five years of undercover police work, but would not comment on his conversation with Mr Ryan.

One senior officer, who requested anonymity, said the decision had hurt Mr Ryan because it splintered support among his senior officers.

"The Lebanese criminals have been a growing concern for more than 10 years and now every unit in state crime command is dealing with some form of major crime being committed by someone from the Lebanese community," the officer said.

"It just makes sense to create a squad of specialists who are able to understand their way of crime and the way they do things."

Instead of a permanent squad, there have been taskforces to investigate specific crimes associated with the Middle East-linked gangs. Although effective in small areas, strike forces such as Ranger, Benlow, Mask, Lancer and Operation Gore have been wound up.

Mr Moroney said making Taskforce Gain permanent had always been an option since it was formed in October to target crime in the area bordered by Bankstown, Cabramatta, Fairfield, Flemington, Liverpool, Rose Hill, Ashfield, Burwood, Hurstville and St George. Taskforce Gain, headed by Detective Superintendent Bob Inkster, is also investigating the security industry, gun thefts and illicit gun supply, extortion, car rebirthing and drug crimes. "I'm enormously proud of the results already delivered by Bob Inkster," Mr Moroney said.

The raids took place in the Bankstown, Liverpool and Campsie local area commands.

Warrants were obtained to search the houses for evidence relating to drive-by shootings and murders earlier this year.

The operation was the direct result of [alleged], tip-offs concerning illegal firearms and drugs.

Roger Rogerson, the old hero, who never faced a result in the Warren Lanfranchi, or Sally-Anne Huckstepp murders, was let off in my opinion when the New South Wales Government rolled the legal system (deciding what evidence to give the police prosecutor) to have the jury believe the illusion they (the Government wanted to create).

Why the NSW Police wanted to see me last night

I worked hard all day yesterday as a volunteer at Justice Action and I arrived home at 5pm. At 6pm my mobile phone rang.

It was Kings Cross police.

Police: Hello Mr Kable.

Kable: Yes.

Police: We would like you to come down and pick up the variations to an AVO made by Clover Moore MP 3 years ago.

Kable: That AVO order must be almost finished. Okay I will come down.

Police: Are you coming down now?

Kable: Yes!

Police: If you don't come now we'll keep knocking on your door until we can serve them.

At that time police ringing my phone was enough to slip me into post traumatic stress because of police harassment in the past. We had a conflict of interest that had not been solved.

The Apprehended Violence Orders (AVO) was taken out on me by Clover Moore MP after I complained to her, my local MP in the Bligh electorate, because of police harassment almost three years ago. I continually complained to her because the police harassment never stopped even when I had complained many times.

One day I posted a notice on Clover Moores Paddington office Window about the police harassment because I was sick of getting no support and subsequently I was picked up and taken to Caritas Psychiatric hospital in Darlinghurst down the road from Moore's Paddington office for placing the notice on the wall.

My solicitor Mr Angus Neil Smith explained, "He was given enough drugs to put down an elephant". Three days later I was released by Magistrate Pearce. Mr Angus Neil Smith said, "My client was illegally arrested".

The AVO was made because police convinced Clover that my integrity was not intact? Clover believed them obviously.

Some months later I made arrangements to meet Brett Collins at Parliament house for a demonstration. Before Brett arrived I was picked up out-side Parliament House in Macquarie Street and arrested. Breach of and AVO Clover Moore. Subsequently the orders stated her Paddington Office but were amended when I was hauled in for the alleged breach to extend to Parliament House Macquarie Street Sydney.

I beat the base charge because the orders did not include her office in Parliament House. Nor did I have any reason to see Ms Moore there that day. But I was convicted of resist arrest though and fined $160. I resisted arrest because I was terrified after being drugged by them and felt innocent of any crime.

Subsequently there has been no breach of the orders in relation to Ms. Moore.

Back to last night.

I thought who owns the problem? Why am I going out of my way for their problem?

I rang Kings Cross police back and gave them my solicitor's address and asked the constable to serve my solicitor and I will pick the papers up off them.

Police: Took down the notes.

I hung up.

Police: Ring back 5 minutes later. You have to come down to Kings Cross police station and be served in person.

Kable: No serve my solicitor.

Police: Don't swear at me.

Kable: I didn't swear at you.

He was angry and said.

Police: We will subpoena you if you don't come down now!

I hung up the phone.

I raise this matter today because I am frightened of the police and what they will do now.

They are clearly trying to make orders for another 3 years or so.

But that means I cannot have my constitutional passage with my local member or NSW Parliament that my friends is less than fair. It is my understanding that there is no Legal Aid to defend you against AVO's. You must defend yourself.

Subsequently police never went on to serve my solicitor? Never served me at JA my workplace? So why did they just want me on my own in their parlour? And whilst I was being harassed by police in the whole period there were bikie groups involved and working with them.

Murder charge first for DNA data bank link, but not the same as solving the murder

Mass DNA testing of prisoners has [allegedly] led to the first NSW case of a person being charged with a previously unsolved murder as a result of a controversial gene-matching data bank.

[As long as the the prisoners DNA wasn't planted at the crime scene. It is one thing to force prisoners to hand over their DNA and another thing to exploit it.]

The Herald reported 25 Nov 02 "a DNA saliva swab led to the charging of a former prisoner with the bashing murder of a woman. Police had been unable to find any witnesses or suspects following the murder in Sydney's inner city two years ago. Detectives had admitted they faced a tough job finding the killer."

[But that doesn't mean anyone who has been forced to give a DNA swab should be framed.]

Herald: "But now the man has made criminal history in NSW by becoming the first person to be linked to an unsolved homicide through the prison DNA data bank.

During a brief court appearance last week, police did not release any details as to what type of DNA was recovered at the murder scene [allegedly] linking the man to the homicide. Nor were there any details about the unrelated crime for which he had been in prison at the time he provided his DNA sample. His DNA is among almost 13,000 such samples taken from inmates [prisoners] in NSW's 28 jails since January 2000, when the collection scheme was introduced."

[So now police and the ruling class have 13, thousand people that can have their DNA planted at any crime scene and made to look guilty of the crime if they had the finger pointed in their direction i.e. alleged circumstantial evidence to go along with it.]

"Inmates,' [prisoners], DNA is being compared with more than 20,000 samples from unsolved crimes dating back to the 1960s. The "cold storage" DNA ranges from blood, dandruff, hair, sweat, saliva and even skin tissue scrapings found at crime scenes."

Police confirmed yesterday that since the scheme was introduced, inmates' [prisoners], samples had been linked to DNA found at 1254 so-called "cold hit" cases - crimes where police had no clue as to the perpetrator. [Rubbish!]

Michael Strutt a Justice Action consultant on DNA reported "The linking of a former prisoner to an unsolved murder via the NSW DNA database is not the same as solving the murder."

"There are now about 12,000 prisoner DNA samples on the NSW database and about the same number of crime scene samples. Attempting to link them all to each other will result in a massive 144 million attempted matches."

"Although forensic scientists routinely claim accuracy of better than one billion to one in DNA testing the fact is that they mess up the tests more than once in every 100 attempts - so the actual reliability of such testing is nowhere near sufficient for the uses it is being put to by police.

[Regardless, that still doesn't mean that Noble Cause Corruption won't be an element because DNA can be planted at any crime scene. Of course it will be a match if it was taken from the database and matched with live samples 'off' prisoners held in custody' and planted at the scene of any crime.]

Although UK police were then claiming 37 million to one accuracy for their DNA database system it still resulted in the false arrest of Parkinsons sufferer Raymond Easton for a crime he could not possibly have committed. Even if the match in the case is not an error it does not mean that the ex-prisoner is guilty of murder.

There are many reasons that someone's DNA might be found at a crime scene. For example they may have visited the location before the offence took place or their DNA may have been planted in order to incriminate them - something Nick Lisoff has experienced.

Although teenaged sex worker Rebecca Bernauer had been about to give evidence against Kings Cross police in a heroin dealing case, when she turned up murdered police said that to solve the crime they needed to be able to DNA test all men living nearby.

Sure enough, they soon claimed to have found a DNA match to Uraguayan immigrant Louis Pintos-Chaves.

[One such case where luckily his DNA wasn't planted at the crime scene. Or otherwise what chance would he have had? But corrupt NSW police are not stupid either because they would learn from their mistake here and other guilty verdicts, based on DNA could be subsequently planted at the scene of the crime. Then there would be no escape!]

After 18 months in prison, Mr Pintos-Chaves was cleared of the murder, only to be arrested by immigration officials and immediately deported before he could speak to the media.

His visa had expired while he was in prison awaiting trial.

Responsible forensic scientists insist that people should never be convicted on DNA evidence alone, but responsible forensic scientists very rarely get jobs in government labs such as the Division of Analytical Laboratories - which carry out DNA testing for NSW police.

[And people have been convicted based, not only on 'circumstantial' evidence but 'flawed' circumstantial evidence and that means along side 'planted DNA' evidence taken from the database and off the prisoner and 'trial by corporate media' (now with no double jeopardy laws, because the 800 year old law was repealed, (and that was a crime), which means people can be tried over and over and over, not just by the courts but by the MEDIA, who have been linked to the ruling classes 'Noble Cause Corruption' in the interests of say, the TOURIST DOLLAR.

In other words, if say a backpacker was killed that would scare off the tourists and the billions of dollars for the economy. But if the murder was solved those potential tourists would not be so afraid to visit Australia.]

Last year, former Police Minister Paul Whelan told UTS students that they would be 'shocked' if they knew how many innocent people had been convicted with evidence fabricated by corrupt police.

This arrest on a DNA database match does not show that the ex-prisoner committed the unsolved murder or that the NSW police DNA database is solving serious crimes. What these charges show is that the Carr government is pouring resources into DNA testing of cold cases and having people arrested on insufficient evidence while not a single wrongfully convicted prisoner has yet been able to have his case heard by the Innocence Panel.

In some cases, DNA from a prisoner has been linked to more than one cold hit crime scene; for example, a home burglary and an unrelated vehicle theft some months later.

The police DNA data bank has also had 650 matches to "warm hit" crime scenes, where police had suspicions of a person's involvement [or a noble cause?] but had insufficient evidence at the time to convict or compel them to give DNA.

Police would not say how many inmates [prisoners] whose DNA had been matched to crimes had since been charged, but most DNA matches so far related to property crime. The swabbing program has led to charges being laid against a number of inmates [prisoners] - including some released on parole after giving their saliva - for burglary and a burglary-arson in the western suburbs.

The same data bank has cleared about 300 inmates, [prisoners], of suspected involvement in crimes.Three weeks ago, the Government's long-awaited Innocence Panel, chaired by Judge John Nader, began taking applications from serving and former inmates, [prisoners], who believe they were wrongly convicted of serious crimes, such as rape and murder, and that DNA may exist to prove someone else was the perpetrator.

In November, the then police minister, Paul Whelan, revealed the 1999 rape of a 15-year-old girl was among 300 crimes police had drawn links to in the early stages of the DNA testing of prisoners.

[Because the rape of any child compels more people to believe corrupt politicians and police. If it were the rape of a prisoner people would not pay any attention to that rubbish line from Paul Whelan or the Herald Scum who both have an interest in NOBLE CAUSE CORRUPTION.

Lets say police wanted to commit crime? So they now have a tool to blame innocent exploited prisoners. So the wrong person is found guilty and the cop that could have been raping and murdering people gets off scot-free, to rape and kill again! So is there any evidence of police corruption?

What is happening between the Police Service and politics is quite extraordinary at the moment. If stand over tactics don't work tell half the truth honestly and follow the example of sheep.
