Rape conviction rate falls to all-time low

UK: Convictions for reported rape cases have reached an all-time low because of a "culture of scepticism" among the police, according to Home Office research published last week.

The study finds that despite long-running efforts by the government to boost the conviction rate, only 5.6% of reported cases end in the rapist being convicted in court.

This represents a record low, with the conviction rate having fallen from 32% in 1977. While the last two decades have seen a continuing and unbroken increase in the reporting of rapes to the police by victims, it has not been matched by a similar rise in prosecutions or convictions.

The official study, A Gap Or a Chasm?, by researchers at the London Metropolitan University child and women abuse unit, says that part of the reason is that police and prosecutors overestimate the scale of false allegations made by victims.

This is feeding a "culture of scepticism", which in turn leads to poor communication and a loss of confidence between those who complain and the police.

The research says the most recent data from the British Crime Survey suggests that as many as one in 20 adult women have suffered at least one incident of rape since they were 16 and there may be as many as 47,000 such attacks every year.

Women are most likely to be raped by men they know and 50% involve repeated assaults by the same man. It is most likely to take place at home, with only 13% happening in a public place.

The Home Office research shows that of 11,766 allegations of rape made in 2002, only 655 resulted in convictions, and that includes those that were overturned on appeal. In only 258 cases did the rapist plead guilty at trial. The 2002 conviction rate - which is lower for rape than any other violent crime - fell from 6% in 2001.

"This year on year increase in attrition represents a justice gap that the government has pledged to address," says the study.

The researchers tracked 3,500 rape cases through the courts and interviewed 228 rape victims. While they conclude there was some evidence of poor investigation and lack of understanding of the law, the main problem was the culture of scepticism among both the police and prosecutors.

They say that rape is unique because in no other crimes were victims subject to such scrutiny in court or was the defendant so likely to claim the victim had consented to the attack. Between half and two-thirds of all cases are dropped before they come to court.

The reseachers suggest that more women police officers and crown prosecutors could help create a "culture of belief, support and respect" as well as a growing network of sexual assault referral centres and rape crisis centres. The development of "courtroom advocacy that does justice to the complainant's account" would also help.

The Home Office researchers also say that there needs to be an increased recognition of the significance of alcohol in rape and sexual assault, including further work on the extent to which men target unknown women who are drinking and the strategies they use to make contact.

THE DRUG-RIDDEN STREETS OF BALI:

Chris Allen, took to the streets of Bali and found it possible to buy a smorgasbord of illegal narcotics from dealers.

On one night with a hidden camera it took just minutes to be offered more illegal drugs than most Aussies could see in a lifetime.

Grams of heroin, ecstacy and more were handed out like pieces of candy. The dealers were even prepared to bargain for their drugs, discounting prices for bulk amounts.

Aussies travelling through this holiday destination confirmed the suggestion that the dealers appeared to target them, with one confirming she was offered 'everything' on the streets. "They practically put it in your hands before you realise what it is," said another.

"We have 'Charlie', speed, marijuana, hashish, what you like, anything you want is black market," spruiked one dealer.

For Schapelle Corby, the reality of the Bali drug trade became her nightmare. She was arrested at Bali airport with four kilograms of marijuana in her luggage.

Now the 27-year-old could be facing the death penalty for drug-smuggling.

While Schapelle Corby sweats it out in a Bali jail, other Aussies were left wondering if they could be targeted by Indonesian authorities keen to make an example of foreigners.

Australian Criminologist Dr Paul Wilson, studied Indonesia's drug scene and said evidence suggested police and dealers do target unsuspecting tourists.

"There's no doubt that the Indonesian Criminal justice system is pretty corrupt," said Dr Wilson. He outlined a chilling scenario.

"One scenario is a Westerner is approached by someone selling drugs, he or she may be stupid enough to accept the deal. Then police arrive and they are told in no certain terms unless money is paid they will be charged with what is a very serious offence that will lead to the death penalty," said Dr Wilson.

Last year, the number of people arrested on drug charges almost doubled and the number of foreigners arrested was up by about 40 per cent. Many of those were what they call 'users' - the kind of Aussies silly enough to buy drugs on the street.

Bilal Khazal, who has been charged with facilitating terrorism, was granted bail and will face a Sydney committal hearing in June? But like all the rest of those people held in "AA" isolation with the worst of the worst convicted Ruddock and his agencies have no concrete evidence unless it has relied on International findings in Military Court's or Third World Countries where evidence simply cannot be relied upon.

A court in Beruit has jailed Saleh Jamal for five years with hard labour for allegedly plotting subversive activity with individuals in Lebanon's Palestinian refugee camps?

He was arrested in Beirut but did Phillip Ruddock's links to Lebanon ensure he was charged there? Could he have influenced the decision made by the authorities? You Bet!

Pro-Government version: "He was arrested in Beirut and initially charged there with having links to Al Qaeda and for involvement in a bombing in Damascus in 2004, but those charges were dropped."?

In Australia, he is accused of involvement in a drive-by shooting at the Lakemba police station in New South Wales in 1998. But that doesn't mean he was guilty! He fled Australia on a false passport while on bail, but wouldn't you if you were a Muslim living in Australian in the context of the vilification and racism in this country? And if he were innocent and thought he was being set-up for a noble cause?

Carr says even though there is not a formal extradition treaty in place, arrangements have been made for Jamal to be returned to Sydney once he has served his sentence in Lebanon.

Perhaps Bob Carr should come clean on his real motive! Like the sensationalism of terror to promote his draconian Terrorism (Police Powers) Act 2002.

Carr: "I've been advised that Interpol has alerted the Lebanese authorities to the outstanding issues in Australia," Mr Carr said. "On his return to Australia, New South Wales police will present evidence to the courts alleging his involvement in the shooting of the Lakemba police station."

So that the feds can then go on and claim that Bilal Khazal is a terrorist even if the evidence linked to him is false and misleading! Right Bob?

Because Ruddock, ASIO, the AFP and Bob Carr are desperate to find some evidence to prove that there is a link to Bilal Khazal, and Terror.

Ruddock says Mr Khazal will not be extradited until he has faced an Australian court.

"There has been a request by Lebanese authorities for his extradition, that's still being processed," he said.

"But obviously, in the meantime, him being the subject of charges here, then he would not be free to be extradited."

Mental Health Tribunal recommendations on forensic inmates

HEALTH-IMPLEMENTING MENTAL HEALTH TRIBUNAL RECOMMENDATIONS


Dr Chesterfield-Evans: asked the Special Minister of State, Minister for Commerce, Minister for Industrial Relations, Assistant Treasurer, and Minister for the Central Coast representing the Minister for Health

(1) How many prisoners have been recommended for parole or release by the Mental Health Tribunal?

(2)

(a) Of those, how many have been released or paroled?

(b) How many are still awaiting Ministerial approval?

(3) What is the average waiting time between the Mental Health Tribunal recommending release and prisoners being released?

Answer:

(1) and (2) (a) The Mental Health Review Tribunal makes recommendations to the Minister for Health about the detention, care and treatment of forensic patients.

(2) The Tribunal may recommend the release of a forensic patient, subject to conditions, or unconditionally, where satisfied that the safety of the patient or of any member of the public will not be seriously endangered by the person's release. Forensic patients fall into three main categories:

- Persons found not guilty by reasons of mental illness;

- Persons found unfit to be tried;

- Correctional centre inmates who become mentally ill and are transferred to hospital for treatment.

The Mental Health Review Tribunal has now been in existence for over eighteen years.

Searches of individual patient records would be required in order to respond to the question in the level of detail sought. To do so would substantially and unjustifiably divert public resources away from the exercise of core functions.

(b) As at 16 November 2004, there were six persons with recommendations for release being considered. These recommendations are at various procedural stages, as required by the Mental Health Act.

(3) The processes leading to a release differ between the categories of forensic patient. However, in all cases, the Minister for Health must first notify the Attorney General and the Director of Public Prosecutions of the receipt of a recommendation for release. Those officers then have a statutory period of 30 days in which to notify of any objection to the release.

Where there are any concerns about supporting a release recommendation, procedural fairness requires that the patient be advised, usually through his/her advocate, and be given the opportunity to make additional submissions. The length of the period over which the release recommendation is considered may be affected by the time taken by the patient and his/her advocate to respond to the invitation to make submissions.

Measures have recently been introduced to reduce the amount of time consumed in consideration of release recommendations

In 1996, Michael Kelly, husband and father of two, shot a stranger on the stairwell in his block of units. Michael was terrified the stranger would harm his wife and children.

He was in the grip of a serious mental psychosis when he pulled the trigger. A court found him not guilty of grievous bodily harm on the grounds of mental illness.

That was six years ago, and Michael is still in gaol.

If he had been found guilty, he would probably have served his sentence and been released by now.

Instead, Michael is still struggling with the frustration of prison routine in the mental ward inside Long Bay Gaol. His wife visits him as often as she can, taking along the kids, who are growing up without him.

Michael is caught up in a particularly cruel version of the game of Cat and Mouse. Because he is classified as a forensic patient under the Mental Heath Act of NSW, the Minister for Health is his master, not the Minister for Corrective Services. And the Minister for health will not let him go.

The Act requires a Mental Health Tribunal to review Michael's case every six months. The legal requirements of the Tribunal under the Mental Health Act is to determine if a forensic patient poses a risk to the community if they don't they should not be held in prison

The Tribunal, who themselves are experts in psychiatry, must call expert witnesses, the treating psychiatrist and psychiatric nurses who have observed him for years, his family and others.

For the past two years the Tribunal has found Michael ready to be placed in the community for treatment and rehabilitation. The expert forensic psychiatric team managing him say he poses no risk to the community. The community psychiatric team has repeatedly reported they are ready to take him into care.

His community placement would be subject to a stringent set of conditions. He would be assessed regularly by a psychiatrist, and case managed by staff expert in forensic case management. He would undergo regular drug/alcohol testing, because he will not be permitted to use mood-changing drugs.

Should he show any signs of mental illness or fail to cooperate with treatment, he can be returned to prison under the restraints of the Mental Health Act. Michael has agreed to all these conditions.

Why then is he still in prison? That is the question we put to Craig Knowles, Minister for Health NSW. The Minister sent us an evasive letter but gave us a clue to his thinking.

"I take very seriously decisions with respect to forensic patients. While the Mental Heath Tribunal is responsible for making recommendations the decision to approve or reject those recommendations rests with me.

I must be certain their mental illness is controlled and they no longer pose a risk."

I point to the Canadian experience of concentration of discretionary powers in the hands of government ministers in the name of the so-called War on Terror.

Knowle's use of power is another example of the same trend. The deliberate undermining of professional psychiatric teams by the Minister's refusal to release mentally ill people under his control must end. Craig Knowles must go and his power to decide these matters must be taken away from him.

ED: How did we give one man, one key, to the roll of abnormality without any qualifications to diagnose one single person's integrity, above specialists in the field of psychiatry?

In addition forensic matters should not be subject to Ministerial Discretion because it is inappropriate use of Parliamentary powers people with positive reports from the (MHRT) Mental Health Review Tribunal for release, conditional release and transfer (for example to allow people with intellectual disability to transfer to jail Disability Units from jail forensic wards) are kept for years unnecessarily in inappropriate accommodation and in jail.

This is a supreme injustice. We also consider, despite legal decisions regarding States, that separation of powers under the Westminster system is a good idea if the current style of democracy exists - the future is unknown but consider Queensland under Joh Bjelke-Petersen.

These situations can be somewhat resolved by following 2003WHO/1991UN principles, and international standards on Human, Civil and other Rights - monthly reviews for involuntary patients and 3 monthly for voluntary; protection of Indigenous ethnic groups and minorities via cultural respect, autonomy, community controlled mental services etc; and removing the Minister's duty and power of sign off on the MHRT decision. As per Q30, less demand (via originally having social/community support and services) for MHRT hearings would increase effectiveness and allow higher frequency.

Rights of review and oversight for patients must not be diminished. The extent of video-conferencing and phone hearings is an injustice (as described in Q30). Accessibility could be increased by employing more members, as there are currently exceedingly few.

Free legal representation must be available by right for hearings before the MHRT for reasons the same as for Magistrates hearings.

We have never heard anyone, from conservative bodies to activists, support the Ministerial Discretion power. It must be discarded.

The prisoners are deprived of all basics and made to earn small things in order to survive. DCS do this until the prisoner's head caves in or self harms. Once the damage is done DCS send them to the Long Bay Mental Health Facility and put them on drugs to control them.

Today, some 283,800 inmates are identified as having a mental illness. This represents 16% of the inmate populations of state and local jails. Jails have effectively become America’s new mental institutions; they house a larger volume of mentally ill people than all other programs combined. However, these inmates rarely receive the treatment that they need and have a right to. The criminal justice system is overpopulated and under equipped to deal with those with psychotic disorders requiring mental health care services.

How many people with mental retardation are in the criminal justice system?

Based on the 1990 census, an estimated 6.2 to 7.5 million people in the United States have mental retardation. Various studies have suggested between 2 percent to 10 percent of the prison population has mental retardation. Denkowski & Denkowski (1985) found that about 2 percent of all inmates in either state or federal prisons have mental retardation (about 14,000 people). Another study conducted by the state of New York found similar results: between 1.8 percent and 2.2 percent of people with mental retardation were imprisoned (Sundram, 1990). Residential programs that house offenders with mental retardation support another 12,500 people who have been convicted, or suspected of, committing a crime (Noble & Conley, 1992).

Firms made bankrupt and workers made unemployed and unemployable by the changes simply will not have the wealth needed to fill the coffers of central taxation agencies.

Substantial requirements for increased funding of welfare support and other adjustment programs are arising at a time when the ability of big governments to raise funds is decreasing exponentially.

Only lean, savvy administrations that are geared to providing value for money services are likely to survive. None of the OECD states fit this description.

Peter Saunders: The Howard Government now wants to stem this increase. Two of the key factors driving the growth of welfare dependency have been the increased numbers claiming Disability Support Pension and Parenting Payments. A cabinet blueprint proposes reforms to both these benefits."

Peter Saunders: "The proportion of the working-age population on DSP has doubled since 1981. Although Australians have been getting healthier, the number of people under 65 defined as incapable of working has swollen to more than 700,000 (much higher than the number of unemployed)."

But some of these people are really "hindered from employment" rather than disabled Peter.

For instance 50,000 people a year go to jail and return back to community completely disabled because when they go to jail they are disabled, whether they were disabled before they went there is another thing.

But those 50,000 people who are unemployed can't get a job because the government has a policy for people who go to jail and that is that 'when they get out they cannot work for the government for the rest of their natural working life'?

Most non government employers won't employ them either because they take the governments lead and even have employment forms asking about previous history in relation to having a criminal record.

Once it's learned that the employee or potential employee has a criminal record they are sacked if they were employed, put on the bottom of the list if they weren't or never given a job at all. And after long periods of being unsuccessful they lose their self esteem and self worth, and become depressed, hence some disabled are long term unemployed.

Peter Saunders: "Half of those entering DSP each year are long-term jobless transferring from unemployment benefits."?

Half Peter, well lets see your figures?

Even if it were that some people transferred because DSP pays more than Newstart according to Peter Saunders? or because as he says, "DSP requires no mutual obligation,"? or that it is more attractive to claimants,? or because it gets hard-to-place clients off its books,? or even that it also suits Job Network providers when claimants switch?

The fact is some long-term unemployment leads to depression. All government benefits including public housing Peter, require mutual obligation and sure you don't know because you're not long term unemployed, and no doubt don't live in public housing or you would understand that these people are driven mindless with paperwork and obligations to be able to sustain the benefit they are on, as well as a thorough medical examination, Peter???

Most of the increase in DSP rates has everything to do with incapacity.

What about empathy Peter?

Peter Saunders: "One-third of claimants cite musculoskeletal complaints that are often quite minor? Another quarter have psychological problems that may or may not be debilitating."?

Peter Saunders: "Many DSP claimants are older men with limited skills who have had difficulty finding work. They should be helped by reforming the labour market laws to generate more jobs, but for the past 30 years they have instead been shunted on to the disability pension and then forgotten. Once on the pension, claimants rarely come off until retirement."

But many claimants are genuinely disabled Peter and a lot are older men and women and some are also ex-prisoners no doubt.Do doctors 'shunt' them on to disability Peter or does the employment agency override the doctor's opinion?

So the very idea that people get shunted on to the disability pension Peter, is blatant lie? If a medical practitioner certified they could not work because of their disability - then the employment agency placed them on a disability support pension Peter, because they provided a medical certificate in terms of their mutual obligation!

For ex-prisoners Peter, even a minor summary offence prevents them getting a job. That experience could give anyone depression and even require medical attention?

Peter Saunders: "The Government wants to tighten the definition of incapacity to put a stop to this slippage from unemployment into disability. It has public backing? A 2003 ACNielsen poll for the Centre for Independent Studies found nearly two-thirds of the public wants tighter rules."?

But Peter, the slippage from unemployment into disability if that is in fact the case is because those people didn't get a job for so long that they 'slipped'....

And your flawed plebiscite statistics don't back you up unless you polled the directly and indirectly affected.

So if two-thirds of the public that don't suffer the consequences as you say, and want tighter rules, then let me tell you all those people not going without can go to hell, and the rest of us can come over to your place for a meal, right Peter?

Peter Saunders: "Groups representing the disabled should also back this reform because limiting DSP to those who genuinely cannot work would release money that could better be spent improving support services for those who really do need help, and for their carers"?

Yes doctor Saunders! As if the medical certificate that says they can't work could be overridden by a loser like you? You're another Andrew Bolt masquerading as a journalist for the Un-Australian Newspaper!

Under the heading mutual obligation Peter, these people have been certified by a doctor who has professional qualifications to certify whether they can work? If you can do a better job why are you just masquerading as a pro-government journalist today?

Peter Saunders: "Much the same arguments apply to reform of the Parenting Payment. Although many lone parents work, half rely on the Parenting Payment as their sole or main source of income. As with DSP, the payment is more generous than the unemployment benefit and there is little mutual obligation required. Under present rules, sole parents are entitled to stay on welfare until their youngest child reaches school-leaving age. Many do just that. The average time sole parents spend on welfare is 12 years, during which time their skills erode and work habits attenuate. When entitlement eventually runs out, many are left unemployable."?

Peter Suaunders: "As with disability, so with the rearing of young children; nobody resents giving help where aid is really needed. Very young children benefit from having a parent at home to look after them and it would be wrong to push sole parents into work while they are still caring for babies and toddlers."

Peter Saunders: "But many parents return to work when their children start school and there is no reason why sole parents on welfare should not do likewise. Australia is one of very few countries where sole parents are not expected to re-enter the workforce once their children start school - the Americans and all the continental European countries insist on it as a fair and reasonable requirement."?

Here we go again with the flawed ACNielsen back up!

Peter Saunders: "Public opinion also sees this as reasonable. The ACNielsen survey found 84 per cent think single parents on welfare should work part-time once their children start school and government research found many sole parents agree with this. With both the DSP and Parenting Payment, therefore, the case for reform is compelling. We can nevertheless anticipate fierce resistance from opponents."

Peter Saunders: "Two years ago, when I suggested single parents with school-age children should work part-time, the chair of Catholic Welfare Australia condemned the idea as "staggering in its harshness" and a leading sole-mothers activist warned of "homelessness and starvation for infants and mothers and more beggars in the street".

Peter Saunders: "We can expect more such hyperbole in the coming months as opponents of reform seek to cloud the issue with emotional fog. We shall hear that the infirm are being forced to work and that sole parents are been driven into poverty.
