Ngo loses High Court appeal bid

Mr Phuong Ngo has lost a High Court special leave application to appeal his 2001 conviction for the murder of Cabramatta MP John Newman.

A NSW Supreme Court jury found Ngo guilty in June 2001 of fatally shooting Labor MP Mr Newman outside his Cabramatta home, in south-west Sydney, on September 5, 1994.

He was sentenced to life imprisonment in November 2001.

Two other men, Tu Quang Dao and David Duy Thai Dinh, were found not guilty of the murder.

In April last year Mr Ngo lost his appeal in the NSW Court of Criminal Appeal against the conviction.

The former Fairfield councillor lost his bid in the High Court, sitting in Sydney, to again appeal the decision.

His counsel Tim Game, SC, told the court Mr Ngo should have a second chance to appeal the decision because his two co-accused could have corroborated each other's evidence and the jury was given incorrect directions by the trial judge about the murder weapon.

"We say there was a big problem about corroboration of evidence of the two accomplices and with respect to lies and the gun," Mr Game said.

The High Court dismissed the special leave application.

"There is insufficient prospect of success," Justice Murray Gleeson said.

"Application for leave is dismissed."

Truth
Who is telling the truth? Well I guess Dr. Ed. Chadbourne or Mr. Peter Ryan may have the answer to that. Dr. Chadbourne sacked by Peter Ryan and more specifically in my view because he elected deputy commissioners Dave Madden and Andrew Scipione as the best men in the service in relation to his qualifications to make a recommendation in his capacity as human resources.That is if you believe that a Dr. can be corrupted.

Honesty
What is happening between the Police Service and politics is quite extraordinary at the moment. If stand over tactics don't work tell half the truth honestly and follow the example of sheep. Another word for it is sleaze, yeah. Another word for it is workplace harassment. Another word for it is bribing a Police Officer. Another word for it is misleading Parliament.

No Legal Aid? Milat loses conviction appeal!

Ivan Milat today, without any legal representation, which includes Legal Aid, lost an application in the High Court to appeal against his 1996 convictions.

The 59-year-old had sought special leave to appeal the murder convictions of seven backpackers and one count of detaining a person for advantage.

He is serving a life sentence in Goulburn Jail for the seven backpackers whose bodies were found in the Belanglo State Forrest, in the NSW Southern Highlands, between September 1992 and November 1993.

This is a case that deserves Legal Aid, so that a person who is convicted of the worst crime can take his case to the Highest Court in the land.

The High Court in Sydney today refused Mr Milat special leave to appeal, saying a NSW Court of Criminal Appeal decision to disallow his appeal was correct.

"There is no reason to doubt the correctness of the decision by the NSW Criminal Court of Appeal," Justice William Gummow said.

Justice Gummow said no argument put forward by Mr Milat proved any miscarriage of justice had occurred.

But there was definitely no argument put forward today by a lawyer or barrister who has the legal knowledge and a full understanding of the law.

Mr Milat had argued the trial judge had erred by giving the jury an alternative account of the case which was not put forward by the prosecution. According to Mr Milat, this allowed the jury to find him guilty of detaining for advantage, which was in turn used to convict him of the murder charges.

As I have said perhaps not the best argument or a professional argument and who knows what the outcome could have been, if in fact he was provided with legal assistance, considering he has been convicted of the worst crime in Australia.

Questions arise, do we want the truth? Is it worth finding out what really happened in the case? Is the real killer still out there? Should people convicted of the worst crimes have the opportunity to take the matter to the highest court considering they will suffer the worst consequences and one of the longest sentences?

Not just that but if you read the transcripts of the case the discrepancies that appear are outstanding as well as the venom of the media who made sure he was convicted by the hype not just in Australia but Britain and the world.

SIX YEARS IN HELL! The Sorry Saga of Ivan Robert Milat

This month, May 2003, Ivan Milat will have spent six years in segregation/isolation without any charge, inquiry, or breach of prison rules leveled against him.

He was placed in this situation and now at the High Risk Management Unit at Goulburn Correctional Centre by Bob Carr and his merry men and by George Savvas, serving 34 years.

Savvas an ex-kingpin drug dealer with Labor party close connections who had been employed by state and federal authorities to discredit groups and individuals who were supporting Ivan Milat, in his quest to establish his innocence of the horrendous murders of which he had been convicted.

Savvas, with the collusion of state and federal authorities was allowed to "walk" from Goulburn Gaol to gather intelligence and to act as an agent provocateur against Mr Milat supporters. Savvas had not been fed enough information by his minders against his targets. He was sent to the home of a Milat supporter, (big mistake). The "target" quickly smelt a deceased rodent.

Australia at the time of the discoveries was well advanced in its bid for the Olympic Games to be held here in year 2000.

The murders were headlines overseas. The State government's public relations machine swung into action. An unprecedented $500,000 reward was offered for the heads of the perpetrators. (Commonsense says there was more than one assailant). Head of the International Olympic Committee, Juan Samaranch, was questioning whether Australia was a safe place to visit.

THE JUDGE: This man should never have addressed the court with out a lawyer especially being kept in the conditions at the High Risk Management Unit at Goulburn in solitary confinement described as a "box within a box" with "no fresh air or sunlight".

Mr Milat has self-harmed, due to indefinite prison solitary confinement during his stay at the Supermax and has been denied legal material for his case.

The questions arise, like did he have a choice? What happened to equality before the law? Do you think a person convicted of the most serious crime should be able to take his case to the Highest Court? If not why not?

The one that suppose to be autonomous according to Lord Denning. Where the Parliamentary Secretary can ask the commissioner of police to 'report' then sack him if he is not satisfied with such report.

Truth
Who is telling the truth? Well I guess Dr. Ed. Chadbourne or Mr. Peter Ryan may have the answer to that. Dr. Chadbourne sacked by Peter Ryan and more specifically in my view because he elected deputy commissioners Dave Madden and Andrew Scipione as the best men in the service in relation to his qualifications to make a recommendation in his capacity as human resources.That is if you believe that a Dr. can be corrupted.

Honesty
What is happening between the Police Service and politics is quite extraordinary at the moment. If stand over tactics don't work tell half the truth honestly and follow the example of sheep. Another word for it is sleaze, yeah. Another word for it is workplace harassment. Another word for it is bribing a Police Officer. Another word for it is misleading Parliament.

Australia: Reconciliation dreaming

Aboriginal leader. Born June 30, 1949. Died Nhulunbuy, Northern Territory, May 26, aged 54.

IN his last public address just two weeks ago, the indigenous leader Djerrkura spoke of his disappointment about the present and his hope for the future.

It is the experience of indigenous Australians to always be speaking this way. The former chairman of the soon to be abolished Aboriginal and Torres Strait Islander Commission, who died on Wednesday of a heart attack in the Northern Territory, aged 54, was in Canberra to launch a book by historian Mark McKenna, which grapples with the unresolved hopes for a republic and the difficult journey of reconciliation, This Country: A Reconciled Republic?

McKenna had asked Djerrkura to write the foreword for the book and to launch it on the basis of Djerrkura's role at the 1998 Constitutional Convention. Djerrkura, speaking first in his own language, had asked the convention delegates "to think about the place indigenous Australians have in our past and in our future.

Now is the time to right the wrongs of the past." Djerrkura paid his own way to the book launch, from the Gove Peninsula in the Northern Territory. Even then he was not well, telling McKenna he was booked in for a heart operation in Adelaide and that he might have to bring it forward because he was suffering a shortness of breath. He died of a heart attack at Nhulunbuy hospital, on the Gove Peninsula.

Djerrkura had witnessed the collapse of ATSIC, which he led from 1996 to 1999, with sadness. Despite the peak indigenous organisation's flaws, which he did not deny, its abolition, he said, had been done in "the classic imperial fashion, without negotiation, without understanding and with little empathy". He noted that as early as December 2001 he had called on his successor Geoff Clark to resign for the good of the organisation. But he reserved his harshest words for John Howard.

"Let me be clear," he said. "The Prime Minister has long refused to accept the fundamental difference of Aboriginal people in our community. He was never sympathetic to the principles on which ATSIC was based and founded.

He has always rejected any suggestion of indigenous autonomy and self-determination. Even when the Prime Minister took up my invitation to visit Arnhem Land in 1998, he seemed incapable of understanding indigenous aspirations." This was at the heart of Djerrkura's disappointment.

He invited Howard to his traditional country at Yirrkala in February 1998. But this was to be no ordinary meeting. He had arranged for Howard to witness important secret traditional ceremonies. It was, as one of those close to the indigenous leadership said, "like inviting a Protestant to an audience with the Pope".

Djerrkura's cultural bosses had been reluctant to allow Howard this entry into their culture, but bowed to Djerrkura's reasoning that this would surely change the heart of the Prime Minister.

It did not. Howard called it a "very moving experience" and said: "I have always respected Aboriginal culture, but until today I don't think I had understood the depth of feeling that the indigenous people have in relation to their culture." But it was not, he said, a step on the road to Damascus on land rights.

Two weeks ago, according to McKenna, Djerrkura was still shaking his head. He told McKenna that Howard didn't have it in him to understand what he had seen. As tributes flowed for Djerrkura, Howard said yesterday:

"I liked him enormously and he tried very hard to help his family."

Djerrkura was regarded as a conservative in indigenous politics, although McKenna's view is that "he was conservative in the sense that he was a bridge-builder".

He was a former Country Liberal Party candidate in the territory; a former chairman of the Aboriginal and Torres Strait Islander Commercial Development Corporation; and a former director of the Henry Walker (mining) Group.

He was a complex man, a product of the missionaries at Yirrkala, but also a senior man of the Wangurri people. In 1984 he was awarded the Medal of the Order of Australia, General Division for his services to the Aboriginal community. He was a member of the Council for Aboriginal Reconciliation and the National Australia Day Council.

Australian Democrats senator Aden Ridgeway, the only Aborigine in the federal parliament, yesterday recalled Djerrkura leading the charge for economic development in northeast Arnhem Land through his leadership of Yirrkala Business Enterprises, which operated independently, providing employment and training to local people.

Ridgeway told The Australian: "My favourite memory of him was at Yirrkala - his home country - with the palm trees blowing in the afternoon breeze. The energy from his traditional country just radiated through the man."

While many indigenous people had feared Djerrkura would be a "yes man" for the Howard Government, Ridgeway said, he instead increasingly became "one of many indigenous Australians who have attempted to help the Prime Minister understand the essential role of land and culture to indigenous people, only to have it thrown back in his face". He said although Djerrkura's attempt to engage Howard failed, "it sent a message of pride in his heritage".

The acknowledged father of reconciliation, Pat Dodson, though never close to Djerrkura politically, expressed sadness at his death and reflected that he had died at an age when non-Aboriginal men were in their prime.

In Dodson's biography, Paddy's Road, author Kevin Keeffe described a scene that explains a great deal about both men and the worlds in which they have walked. It was at the Regatta restaurant overlooking Lake Burley Griffin in Canberra in December 1997 and, to farewell a disillusioned Dodson from the Council for Aboriginal Reconciliation, Djerrkura was presenting him with a powerful and beautifully decorated ceremonial pole from his Yolngu people.

This was more than a gift, Djerrkura explained. It was a pledge of unification and commitment between the people of Arnhem Land, the bosses of that country and that law, to Dodson's Yawuru people on the other side of the nation, in Broome. Keeffe writes: "The two big men came together in a rough and close embrace, pulling their bodies in to each other in the way of the ceremonial ground." He said Djerrkura's death was "an example of the cruel injustice inflicted by the substandard indigenous life expectancy that robs us of people with so much to contribute".

Djerrkura was the consumate diplomat. NT commissioner Akarriyuwu Hill described Djerrkura as "a visionary who crossed many bridges". Indigenous Affairs Minister Amanda Vanstone said he "successfully walked in two worlds". NT Chief Minister Clare Martin described Djerrkura as a "great Territorian", who was a strong voice for indigenous people for the past two decades. And Human Rights and Equal Opportunity Commission social justice commissioner Bill Jonas described Djerrkura as one of the pioneers of the reconciliation movement who had fought to preserve indigenous rights and advance their economic position "right up to the end".

At the end of his last public address, at Manning Clark House in Canberra, Djerrkura was looking to the future. He said he dreamed of a reconciled republic. "If we want to break away from the colonial past and begin anew, then we have to walk together - hand in hand and side by side - as a truly reconciled nation," he said. "A republic that does not make the first concrete gesture towards reconciliation is a republic that walks in the footsteps of the crown."

Lawyer for Australian Guantanamo Bay Prisoner calls for Inquiry

Maha Habib, Mamdouh Habib's wife, and Stephen Hopper, Habib's solicitor, arrived on Monday from England where they held talks with Mr Derghoul, who claims to have witnessed Mr Habib being tortured.

Terry Hicks, David Hicks' father, arrives tomorrow in Sydney to talk about similar claims. Mr Hicks, Mrs Habib and Mr Hopper will hold a Press Conference at 2pm, Saturday 29 May, at Breakout, 65 Bellevue St, Glebe.

Mrs Habib and Messrs Hicks and Hopper will be speaking at the Justice for Hicks and Habib public forum to be held at 6pm tomorrow, Saturday 29 May, at the Granville Youth and Community Recreation Centre, 3A Memorial Drive, Granville. Solicitors for the two Australians imprisoned at Guantanamo Bay are greatly concerned for the physical and mental health of their clients. According to Mr Hopper, Mr Habib "was tortured in Egypt. There he was kept for five months, was beaten, given electric shocks, and interrogated at gunpoint."

"The Australian government has aided and abetted the torture of an Australian citizen. It's a disgrace and nothing short of a full, transparent inquiry is required" Mr. Hopper said.

Campaigner for Hicks and Habib, Marlene Obeid, said "I welcome the Opposition's call for an independent medical assessment of Messrs Hicks and Habib. However the Opposition must give heed to Mr. Hopper's call for a full inquiry."

"I also welcome Senator Brown's request to visit David and Mamdouh at Guantanamo Bay on his trip to US next week; this is what the Prime Minister should be doing on his trip to US in June," she added.

Many have endorsed the forum on Hicks and Habib to express outrage at the continued government's lack of moral stand. Are Indigenous legal services in crisis? Is there a more general crisis across the range of organisations and individuals providing services around legal business? Regardless of the ATSILS tendering process, there are issues on the boil right across the country.

The future may be a very different place. The Indigenous Law Centre is hosting a conference that will reveal information, encourage debate and foster networks. We apologise for the short notice but extend a warm invitation to join us here in June.

With this two-day conference we aim to:
consider issues affecting service delivery right now; explore pressing legal issues; share knowledge and innovation; discuss possible futures for service delivery; affect public policy in these areas; and celebrate the work of Indigenous legal services and their partners.

Vic police silent on witness protection breach

Victorian police have been forced to defended the Witness Protection Program again, after an alleged incident involving a police informer. Channel Nine News said two gunmen raided a Victorian informer's hideout in Queensland.

He is said to have escaped without injury.

Victorian police have refused to confirm the claim. Instead, Commander James Hart has released a statement saying it is inappropriate to comment on specific individuals involved in the Witness Protection Program.

He says he has full confidence in the system, and leaked information can only place the welfare of individuals in jeopardy.

Last week, the Assistant Commissioner of Crime defended the system when it was announced the Ombudsman would review its security as part of the investigation into the murder of an informer and his wife at East Kew.

It was also revealed a police detective improperly passed on information to an informer about his acceptance into the program.

Deeds
I am disturbed by Governments 'actions' in relation to shuffling the police service. Clive Small seconded into Parliament like a cocky in a perch. A breach of the fundamental Separation of Powers Doctrine does not in my view allow the thought of intervening, planning, or shuffling to stack the deck of our police service. The one that suppose to be autonomous according to Lord Denning. Where the Parliamentary Secretary can ask the commissioner of police to 'report' then sack him if he is not satisfied with such report.

Truth
Who is telling the truth? Well I guess Dr. Ed. Chadbourne or Mr. Peter Ryan may have the answer to that. Dr. Chadbourne sacked by Peter Ryan and more specifically in my view because he elected deputy commissioners Dave Madden and Andrew Scipione as the best men in the service in relation to his qualifications to make a recommendation in his capacity as human resources.That is if you believe that a Dr. can be corrupted.

Honesty
What is happening between the Police Service and politics is quite extraordinary at the moment. If stand over tactics don't work tell half the truth honestly and follow the example of sheep. Another word for it is sleaze, yeah. Another word for it is workplace harassment. Another word for it is bribing a Police Officer. Another word for it is misleading Parliament.

Most people I know don't buy the Daily Telegraph. Why? Because of the lies and propaganda purported by them.

Lord Denning
Interesting how a member of the Police Board Mr. Tim Priest would hold grave fears for his safety from dangerous senior police but fails to name them or have them sacked. Rather Priest resigns as if he had no powers. Could that mean what he was saying is that the Governments are also corrupt?

Corrosive
Clive Small is Bob Carr's choice for the new Police Commissioner. It could only be the case considering his, Small's special appointment into Parliament House. Small who suffers from the little person syndrome is the ideal bend over boy who gets shuffled through his corrupt actions. Rolling the legal system for him after the fact, just like his predecessor Roger the dodger Rogerson.

The Premier, Bob Carr, relies on a militia. A gang of bikies and our Police Service, to show all of us he is no murderer. He should be taken to the task along with his partners in crime like Clive Small to account for those people who like my self have been maliciously assaulted and who have complained, without any service and those who cannot speak for themselves who were murdered, like Terry Falconer. Terry murdered in custody.
