US Peace Activist to be Deported

US Peace activist detained as "threat to national security"

Scott Parkin, a Texas based peace activist was detained by Federal police at approximately midday Saturday. He was en route to give a workshop about the progress and success of the peace movement in the US and companies profiting from the Iraq war.

Scott is a community college instructor who teaches history in Houston.

He has been detained by Federal Police at the request of DIMA and was held by Federal Police at Carlton West police station before being moved to Melbourne Custody Centre on Londsdale st. The reason given for his detention is that he poses "a threat to national security." It is understood that he has had his visa revoked at the Minister's discretion.

Scott was contacted by ASIO by phone on Wednesday and asked to attend a voluntary interview to which he declined. Scott participated in a non-violent street theatre action outside US corporation Halliburton's headquarters in Sydney during protests against the Forbes meeting on August 31st.

Liz Thompson from the National Anti-Deportation Alliance (NADA) said "This is a major attack on dissent, free speech and the anti-war movement. Scott's detention prevented him from sharing his experiences of working for peace in the US with other local activists. This appears to be an attempt not just to intimidate Scott, but all those working for social justice and progressive social change more broadly. "

Ms Thompson said "These actions seem to contradict Philip Ruddock's denial that Australia is turning into a police state. The Federal Government already has extraordinary powers to silence dissent. This should be a warning to everyone about the greater powers that ASIO may soon be granted."

On Thursday John Howard announced control orders and preventative detention measures giving the AFP and ASIO powers to control people who have not been convicted of any crime.

Scott Parkin has not charged with any offense.

It is understood Scott will be forcibly deported on Monday.

Bush Expected to Visit Storm-Ravaged Areas

US: WACO, Texas - President Bush is expected to visit storm-ravaged areas of the Gulf Coast later this week, but first he is returning to Washington to oversee the federal response to Hurricane Katrina.

Bush cut short his monthlong vacation, heading back to Washington two days early even though the White House has long contended that his duties are uninterrupted when he spends time at his technologically equipped ranch in Crawford, Texas.

Aides say the president decided he needed to be in the nation's capital given the magnitude of destruction and death caused by Katrina, one of the most severe storms to hit the United States in decades.

"These are trying times for the people of these communities. We know that many are anxious to return to their homes. It's not possible at this moment,'' the president said Tuesday during a speech in Coronado, Calif. "Right now our priority is on saving lives, and we are still in the midst of search and rescue operations.''

Katrina left thousands homeless in Louisiana, Mississippi and Alabama, and many more without electricity or fresh drinking water.

The storm also caused the closure of oil platforms and pipelines in the Gulf Coast, prompting the administration to consider tapping into the nation's emergency petroleum stockpiles. The Energy Department is reviewing a request for a loan from the Strategic Petroleum Reserve.

Bush originally was to return to the White House on Friday, after spending more than four weeks operating from his ranch. But after getting updates on the devastation, he decided to fly back to 1600 Pennsylvania Avenue to personally oversee a massive federal emergency assistance program.

"The president's preference is to manage the response efforts from Washington, and that's why he made the decision to return,'' said White House press secretary Scott McClellan.

Returning to Washington ahead of schedule also could insulate the president from criticism that he was on vacation during the crisis, and the return could be seen as a symbolic gesture to hurricane victims.

"I don't think that's necessarily the way to look at it,'' McClellan told reporters. "The devastation is enormous. The destruction and loss of life is very sobering. Our focus remains on saving lives and making sure that we're prioritizing the relief efforts to get assistance to those who are most in need right now.''

The president, upon his return to Washington, planned to chair a meeting of a White House task force set up to coordinate the federal efforts to assist hurricane victims across more than a dozen agencies.

Bush was expected to visit the ravaged region by week's end, but details on that trip were in flux as the White House worked to make sure a presidential tour would not disrupt the relief and response efforts.

The president was leaving Texas just as anti-war protesters, who had gathered near his ranch for nearly a month, were departing on a bus tour aimed at building momentum to bring home U.S. troops from Iraq. Protesters dogged the president during trips to Arizona and California this week.

On Tuesday, Bush gave his third speech in just over a week defending his Iraq policies as the White House scrambled to counter growing public concern about the war.

Standing against a backdrop of the imposing USS Ronald Reagan at a naval air station near San Diego, the president gave a fresh reason for American troops to continue fighting: protection of the Iraq's vast oil fields, which he said would otherwise fall under the control of terrorists.

Bush said the Iraqi oil industry, already suffering from sabotage and lost revenues, must not fall under the control of Osama bin Laden and al-Qaida forces led in Iraq by Abu Musab al-Zarqawi.

"If Zarqawi and bin Laden gain control of Iraq, they would create a new training ground for future terrorist attacks,'' Bush said. "They'd seize oil fields to fund their ambitions. They could recruit more terrorists by claiming a historic victory over the United States and our coalition.''

A one-time oilman, Bush has rejected charges that the war in Iraq is a struggle to control the nation's vast oil wealth. The president has avoided making links between the war and Iraq's oil reserves, but the soaring cost of gasoline has focused attention on global petroleum sources.

Man Gets Life Under Fetal Protection Law

US: LUFKIN, Texas - A 19-year-old accused of causing his teenage girlfriend to miscarry two fetuses by stepping on her stomach was convicted Monday of two counts of murder.

Gerardo Flores received an automatic life sentence because prosecutors did not seek the death penalty, which was available under the state's 2003 fetus protection law.

Erica Basoria, 17, acknowledged asking Flores to help end her pregnancy; she could not be prosecuted because of her legal right to abortion.

The defense contended that Basoria punched herself while Flores was stepping on her, making it impossible to tell who caused the miscarriage.

Basoria told authorities that, after about four months of pregnancy, she regretted not getting an abortion and started jogging and hitting herself to induce a miscarriage. When her efforts failed, she said she asked her boyfriend to help.

Flores did not testify, but earlier told police that he stepped on Basoria's stomach several times during the week before she miscarried.

Prosecutor Art Bauereiss said most of Basoria's family was pleased with the jury's decision. But Basoria, who sobbed as she left the Angelina County Courthouse, had stood by Flores.

"It's just tragedy all around,'' said Flores' attorney, Ryan Deaton.

Texas law defines an embryo or fetus as an "individual'' and allows criminal prosecution or civil action for a preventable injury or death of a fetus. The law exempts health care providers who perform a legal medical procedure, such as an abortion.

'Who can decide who is the worst of the worst and who dies?'

Sister Helen Prejean and her friend and collaborator, the actor Susan Sarandon, tell Alex Hannaford why they will never give up their mission to abolish the death penalty.

A few months ago, 65-year-old Sister Helen Prejean travelled from her home in New Orleans to the Texas town of Huntsville, an hour north of Houston, to pay her last respects to a man she had only known for a few years. James Allridge, 41, had been sentenced to death in 1987 for the murder of a convenience-store clerk in Fort Worth. He had spent 17 years on death row.

"There is no touching, there are no hugs allowed there," she says. "The thing about this contrived, artificial event is that it's not like visiting someone in hospital. James Allridge was fully alive. The only thing that told me he was about to die was my mind and my watch, ticking away on my wrist."

Prejean first visited Allridge at Huntsville's redbrick prison, known as the Walls on account of its imposing fortress-like surround, on August 6. "He was the most gentle, insightful, loving man, and he really thought that because he had changed so much he could challenge the clemency process. He thought they wouldn't kill him." A film made by Allridge's defence counsel, containing interviews with former prison guards who testified that he was no longer a danger to society, was sent to the Texas Board of Paroles and Pardons. They were unswayed, and voted 6-0 in favour of proceeding with the execution.

Allridge was executed by lethal injection on August 26, and his story now forms part of Prejean's second book, The Death of Innocents, published by Random House next month. At Allridge's request, Prejean returned to Huntsville to witness the execution. Before he died, she says, he spoke to the witnesses gathered in the small room beyond the glass partition. "He sounded like he was making a little speech to friends," Prejean says. "He turned his eyes to his victim's family and said, 'I'm so sorry I have destroyed your life.' Then he turned to Christa, a friend who had come over from Switzerland, and said: 'To the moon and back. I came into this world in love and I leave this world in love.' He was so poised."

Since beginning her ministry work in 1981, Prejean has witnessed six executions. Famously, she became a pen pal to Patrick Sonnier, the convicted killer of two teenagers who was sentenced to die in the electric chair in Louisiana (and who was executed in 1984). This experience, and their relationship, were related in Prejean's 1993 book, Dead Man Walking, subsequently made into a film by Tim Robbins and Susan Sarandon.

For the past 20 years, Prejean has continued to campaign against the death penalty, most recently against the execution of minors. The supreme court is currently hearing a case which will determine whether it is unconstitutional to implement the death penalty against juveniles. If the answer is yes, 75 could be freed from death row. (Between 1990 and 2003, the US executed more juveniles than the rest of the world combined. In the past four years, only four other countries have executed minors - Congo, China, Iran and Pakistan.) Prejean also founded a victims' advocacy group, Survive, based in New Orleans, which counsels death row inmates as well as the families of murder victims.

Prejean remains a close friend of Sarandon's, her collaborator on Dead Man Walking. When the actor first contacted her, more than a decade ago, Prejean had barely heard of her. "I didn't even know what she looked like, and she was suggesting turning my book into a mainstream film. It took her nine months to convince Tim Robbins." Robbins has since adapted the film for the stage, but before it reaches Broadway, Prejean has asked that the script be made available to US schools; the first performance will be at a high school in California.

It was Sarandon who first told Prejean about Allridge's case. "I stay with her and Tim when I'm in New York," says Prejean. "Susan showed me a note from James, and then in April this year she called me, saying he had been given an execution date. She had been writing to him for eight years. You get into the habit of writing to inmates, and when this happens you can't believe the state is actually going to kill them. And then she hit me with the bombshell - James had asked if I could be with him when he died." (Sarandon also visited Allridge shortly before his execution.)

The US occupies an uncomfortable position on the list of countries that still implement the death penalty. In fact, the list reads like a roll call of those nations America views - or once viewed - as hostile: North Korea, Afghanistan, Iraq, Iran, Libya, Lebanon, Syria. Since 1976, when executions resumed in the US after a nine-year moratorium, 69 people have been released from death row after evidence of their innocence emerged.

In 1996 a poll showed that 78% of Americans supported the death penalty. A 2004 Gallup poll found that this figure has now dropped to 64% - the lowest in 20 years. According to the Death Penalty Information Centre, public support for execution drops to below 50% when voters are offered alternative sentences such as life without parole.

"The disturbing thing," says Prejean, "is that although 38 states still have the death penalty on their books, over 80% of executions happen in the southern states where slavery was rife. In practice, the death penalty has always been a southern thing. Overwhelmingly, when a black person kills a white person, they are given the death penalty. There is no consistency. Look at the Green River Killer [Gary Leon Ridgway, who last year confessed to the murder of 48 women]. He didn't get sentenced to death. Who can decide who is the worst of the worst and who dies?"

In the Death of Innocents, Prejean recounts the stories of two death-row inmates she ministered to: Dobie Williams, a black man from Louisiana with an IQ of 65, and Joseph O'Dell, a 54-year-old white man from Virginia.

After witnessing Williams's execution, Prejean wrote an open letter to the Louisiana Coalition to Abolish the Death Penalty. "For the first time, I believe, I befriended a truly innocent man on death row," she wrote. "A 38-year-old indigent black man, I believe, was railroaded to death, for the death of a white victim in a small, racist southern town."

Prejean says that O'Dell asked for one evidentiary hearing and a DNA test so that he could prove his innocence of charges of rape and murder. "This was denied and after his death they destroyed the DNA so we will never know," she says. "After the Pope got involved, the governor's office received 10,000 faxes from the people of Italy. Then when Joseph died, the mayor of Palermo made him an honorary citizen and his body was shipped over to Italy and buried there."

Prejean is hopeful that the supreme court will rule against the continued execution of minors; a judgment is expected next spring. "If you are under 18 in the US you can't buy alcohol or tobacco or serve in the military and, ironically, you can't witness an execution. I think the Supreme Court will rule it unconstitutional for the same reasons it ruled against executing the mentally retarded: these people have no culpability for their actions. The rest of the world is watching. The US and Somalia are now the only countries that have not signed up to the Convention on the Rights of the Child."

Speaking from her home in New York, Sarandon says she believes she will see an end to the death penalty in her lifetime. "I have to believe that. It is a very tough thing to participate in that system - for the guards, the jurors, for everybody - because there are so many people involved. And I think that the jury in James Allridge's case was affected. A number of them asked that his sentence be commuted to life because they had not been given all the information, such as his background, when sentencing him.

"The thing that frightens me about the state of our dear nation and our world is this pre-emptive strike philosophy, and of violence as a means of solving everything, whether it is directed against the individual or a country. It is the elimination of all moderation. The most horrific thing about the death penalty - besides the fact that it is arbitrary and capricious and only affects those who have no money - is what it does to society."

She says she has never seen the death penalty as an effective deterrent. "It is archaic - there is a reason why it is outlawed everywhere else."

Sarandon spoke to Allridge over the phone on the afternoon of his execution. "When his last meal came he was a little shocked. He had really convinced himself there was a chance. I don't think he ate anything but had a cigarette instead. I was terrified for him and felt so useless. One of my kids said to me once, 'People don't die, because energy doesn't die, so you'll always be here with me.' When I'm feeling positive, I agree wholeheartedly. When I'm not, I'm not so sure."

Indymedia a Target: Heavy hand of the law

Last week's seizure of material belonging to anti-globalisation websites could have serious consequences for citizen publishers. It is a story with components that would have most conspiracy theorists running for the nearest tinfoil hat shop: a radical media organisation, the FBI and an apparently anonymous foreign government.

Last week, Rackspace, a hosting company with headquarters in Texas, handed two of its London-based web servers to the FBI after a subpoena for their contents was issued by a US district court. The servers contained material belonging to the Independent Media Centre - better known as Indymedia - a conglomeration of global radical anti-globalisation sites produced by ordinary citizens.

Indymedia claims it was not informed of the decision to seize its content, nor has it been told the reasons, despite the fact that 20 sites and more than 1m pieces of content were affected.

The FBI has said it was acting on behalf of a foreign government, though for the American subpoena to have power in the UK, it would need approval from either the British courts or the home secretary. Such agreements would usually be made over investigations into terrorism, though nobody involved has been able to confirm this.

Rackspace said it is complying with a court order "which establishes procedures for countries to assist each other in investigations such as international terrorism, kidnapping and money laundering". Clearly, such serious allegations against any media organisation - even one produced by amateurs - could be devastating.

"The site crashed last Thursday at 4pm," says one Indymedia UK volunteer who asked to remain anonymous. "Since then, the only official communication we've had was from Rackspace, but they would only say they couldn't tell us what was going on. No one at the FBI has talked to us about this, and we have not been told anything."

With the situation shrouded in a legal fog, the often-controversial grassroots news organisation has struggled to operate its sites across countries including the UK, France, Belgium, Serbia, Portugal, Italy and parts of South America.

"This seizure has grave implications for free speech and privacy," says Kurt Opsahl, staff attorney of Electronic Frontier Foundation, a digital rights campaign group working with Indymedia to uncover the root of the FBI action.

It is not the first time Indymedia has come to blows with law enforcement. During the G8 summit in Genoa three years ago, buildings used by Indymedia journalists were among those raided by Italian police. Computers were destroyed and equipment seized in an action that international press watchdog Reporters Sans Frontieres described as unprecedented and incredibly violent.

Founded as an anti-globalisation news source covering the protests against the World Trade Organisation summit held in Seattle in 1999, Indymedia quickly turned into an international network of citizen journalists. It provides a voice of underground political opinion around the world, though its open door policy has seen the occasional publication of unsavoury and offensive content, including anti-semitism and incitement to violence - though representatives are quick to disown these.

The latest raid is more than just emblematic of the conflict between one radical anti-government organisation and the establishment. It highlights the potential for conflict between law enforcement agencies and citizen publishers and sends a warning to anyone involved in web publishing operations.

"Certainly on face value it looks like an attempt to gag an independent media organisation," says Barry Hugill, a spokesman for civil liberties organisation Liberty. "It is just possible that there is a legitimate reason for this action, but we certainly need more clarification."

At a time when mainstream media is being opened up to the masses, such crackdowns deal a blow to citizen journalism. Threats to the freedom of web publishers could damage the amateur investigators and webloggers who are the lifeblood of independent online journalism. The lack of information given about these seizures raises the potential threat that anyone could see their content removed without warning or explanation. It shows how fragile internet publishing can be - even in the hands of major media organisations.

"It is easy to go after the provider or the hosting company to close down a website," says Yaman Akdeniz, the director of Cyber Rights and Civil Liberties and a lecturer at the University of Leeds cyberlaw research unit. "Unfortunately, arbitrary censorship exists. There are less risky places to publish information and there are more risky places. I do not recommend anybody to rely on a hosting company in the UK, and certainly our cyber-rights.org servers are run outside the UK for a variety of reasons."
