Push to unify Australia's evidence laws

The Australian Law Reform Commission is preparing to begin an inquiry into unifying evidence law across the nation. At present only the Commonwealth, New South Wales, the ACT and Tasmania operate under a modern codified system of evidence law, while other states use a system based on common law.

Law Reform Commission president Professor David Weisbrot says introducing a single set of evidence laws will reduce legal costs for business and the possibility of different results in different jurisdictions.

"Evidence is so fundamental to our justice system," he said.

"It's about how the courts operate, what lawyers can do, what discretions judges have, that we should really, in a country as small as Australian population and in our legal system, we should have a single set of rules that are consistently applied across the country."

Professor Weisbrot says the inquiry should release its findings by the end of next year.

Govt preparing to cut spending: Labor

The Federal Opposition says the Government is preparing to cut Budget programs in areas such as health and education despite projections of strong revenue growth.

Cabinet is meeting in Sydney today for the final time this year, though ministers deny Budget talks are on the agenda.

Opposition treasury spokesman Wayne Swan says it shows the folly of the Government's $66 billion election spending commitments.

"We heard nothing about these cuts during the election campaign," Mr Swan said.

"Yet now there is speculation about cuts to families, health and education.

"One thing you can say about the Howard Government - they give with one hand before the election and they take even more back with the other after the election."

Take Howards oft repeated "interest rates always go up under Labor". Do a web search, you will find any number of places where he said it. Factually completely false, in fact you don't need to look any further than the last Labor government.

Now that the Howard government has control of the Senate, these laws can finally come through, making even less barriers to the big players buying up anything they can get there hands on. Simple enough deal, you help us stay in government, we'll let you write some laws about media ownership. Once these are through it will be even easier for Howard to lie through his teeth, and have the media report it without comment.

Add to this the filters of the media that Chomsky talks about, that they are owned by big business, that the influence of big business opinions filter down through the chain of command, that business advertising is their main revenue stream, that regurgitating PR is so much easier and cheaper than investigative reporting etc etc.

Someone once said that the wars of the future will be fought with information, look at the recent attack on Iraq, the battle was not whether they would beat an impoverished country brutalised for years under our feudal sanction system, it was whether Howard, Bush and Blair and their ideological brethren in the media could convince the people to let them do it.

To digress for a moment, look into the sanctions on Iraq, 500,000 children dead from easily treatable diseases in a country where childhood obesity was once the main health problem, and Australian warships and political support helping make it possible whilst the media kept every one passive.

Perhaps the greatest crimes against humanity we have ever been involved in and absolutely no debate about it in this country, that is a level of control that Stalin would have been proud of. Even if you thought the cause was just, even if you thought that we had no option, 500,000 children, perhaps a million dead overall, and barely a whisper.

I don't see how we can have a functioning democracy with a corrupt media. If peoples information sources are controlled by certain interests, so too are their beliefs. If you asked the average person they will tell you they are critical in their thinking and don't believe everything they read, but reading is passe in our media, these days ads are made by people with degrees in psychology and marketing, they aren't interested in your conscious mind, it's getting into your subconscious mind that they can really use to control you.

I think the answer lies in circumventing the traditional media, as a member of Greenpeace we did a campaign before the election writing letters about climate change to the national newspapers, we even got a few in but, perhaps in total during the whole campaign we got about as much space in the nations media after writing hundreds of letters as the average daily headline. So what are we left with, the Internet, becoming members of local groups of like minded people, protesting, reaching out to our friends, families, work colleagues, making our own independent media, supporting independent media, and any other ways our creative minds can come up with of reaching out to our fellow citizens.

We all need to put into action the realisation that our duty as citizens in a democracy extends beyond our vote. Through history there have always been sections of the community who will seek illegitimate power, and it is only by making stronger connections as people that we can resist them. As Chomsky says they all want us to be isolated atoms of consumption, so lets be the exact opposite. Sure we are fighting against the biggest corporations the world has ever seen, but we have us on our side:-)

Only a bent mind would envisage the possibility or think of the concept that a '2nd Neo-Liberal 'front' promoted by the right and posing as a Church would enter politics under the flag of "Family First Party".

To sing through the night like a lark who is learning to pray. Do you go to Adelaide Hillsongs when your heart is lonely? I know you will hear what you heard before?

But a congregation of 'inspired fellowship' has arisen from hell this time. Made up of rodent types like, scumbo John Howard, Pastor Peter Costello, Alexander Downer, Tony Abbott, John Anderson and you guessed it Robert Hill of the Hill-song Church.

But no matter what way you look into it - all these men don't deserve the credit of being associated with a church based on their past behaviour which is not "Family First" but 'Family Last'.

"So it will be with a Latham Labor government."

Can Howard win an election by terrorising voters? Threatening that they won't be able to pay their mortgage.

After telling so many lies then trust Howard you should not. Mr Latham says Labor has pledged to keep the budget in surplus and has an economic plan which will put downward pressure on interest rates.

"This is mounting as another dishonest tactic by a dishonest Government, a scare campaign that's not relative to the truth but rather to the political interests of the Prime Minister," he said.

After promising to unveil detailed plans addressing the major challenges facing the nation over the next 10 years, Howard could not guarantee he would serve out a full term if the Coalition wins.

But Howard is standing on his record and asking voters to keep their trust in his Government. "This election ladies and gentlemen will be about trust," he said. "Who do you trust to keep the economy strong and protect family living standards? Who do you trust to keep interest rates low?"

Who do you trust to tell you the truth? And how do you trust a liar? Trust him to lie about the truth?

Too many years you have wandered, scared to make a final move, too many days those boys have squandered, you got nothing left to prove......

Mr Latham jumped on Howard's decision to stake his re-election hopes on the issue of trust. "I can agree with the Prime Minister in saying the election is about trust but people don't trust this Government anymore, with good reason.

It's a Government that's been dishonest for too long. It's a Government that has acted deceitfully for too long,"he said. Mr Latham will campaign on his 'ladder of opportunity' and health and education.

The campaign will run for six weeks for the first time since 1984. Labor heads into the campaign in front in the polls but both Mr Latham and Howard claim to be the underdog.

I'm not giving you a chance, so don't take it, I got all you want, you can't make it, standing there in front of me, butt naked. You can't hide a thing; you've got no choice but to get out of politics.
