Anti-terrorism laws inquiry calls for submissions

Police State

A Senate inquiry into the proposed anti-terrorism laws will start advertising today for submissions.


Public hearings are likely to start in nine days and are expected to be held in Sydney, Melbourne and Canberra.

After lobbying from the Australian Democrats, the Government has agreed to a three-week inquiry.

Democrats leader Lyn Allison is expecting a strong response from the community.

"I think it's going to generate a lot of interest, I think there will be a lot of submissions," Senator Allison said.

But Senator Allison doubts if her party will support the legislation.

"The Democrats have had a good look at the provisions in this bill and we are very, very concerned," she said.

"I doubt we will support any part of it, but we will keep an open mind and it is an opportunity for us to put forward amendments which could improve the Bill."

The state pre-meditators agreed to the counter-terrorism package after a lengthy round of negotiations between themselves and the dictator HoWARd.

The Prime Meanster, hoWARd the coward, wants the federal dictatorship to approve the laws before Christmas so he tried to terrify everyone playing his terrorist card.

But now decent people are being urged to send him their psychiatrist bills for the next twelve months. He should be glad to pay your psychiatrists bills for inciting fear in the community.

Sedition concerns

Liberal Member for Wentworth Malcolm Turnbull said he does not believe the sedition provisions in the proposed anti-terrorism laws are ideally drafted.

"I think they are an attempt and a very good effort but, nonetheless, I don't think the outcome is as effective or as clear as it should be," he said.

"The problem is, the sedition laws ... are very old laws going right back centuries.

"There's been an effort to modernise them, but I still think the language is very cumbersome and hard to follow."

He says the laws have to meet the circumstances of the times.

"I would like to see these offences we're concerned about - people promoting violence, people urging others to assist our enemies - those sort of provisions being expressed very clearly in contemporary language," he said.

"The primary duty of every state, every government and every society is to protect the security of its citizens.

"In doing so, it should endeavour to ensure the laws it enacts impinges on as little as possible on the liberties of the communities."

Christ would have little chance against the new sedition laws, writes David Marr

THE stench that hangs around sedition cases goes way, way back to the greatest trial in our history, the one that has loomed over our world for a couple of millennia. Christ was tried for sedition.

"Anyone who is relaxed and comfortable about the proposed anti-terrorism legislation might care to read Chapter 23 of Luke's Gospel," Canberra's auxiliary Catholic bishop, Pat Power, said this week.

"Jesus is dragged before Pilate accused of sedition. The trumped-up charges are laid but Pilate returns a 'not guilty' verdict. The accusers become more insistent, so the cowardly Pilate orders a review, sending Jesus the Galilean off to be examined by Herod. The new trial simply shows up the shallowness of Herod's character.

"The upshot is Jesus's eventual crucifixion and two old enemies, Pilate and Herod, becoming good friends. It is amazing how anti-terrorism measures bring together unlikely allies!"

Christ's trial had in spades elements that would emerge time and again through the squalid history of sedition: dodgy evidence, lies, duplicity, and a judge who goes with the mob knowing in his heart he's condemning an innocent - but troublesome - man.

The charge was clear. Dr Paul Barnett, the former Anglican bishop of North Sydney and ancient history lecturer at Macquarie University, says: "The gospels all agree, Christ was crucified as King of the Jews. So sedition and treason were the presenting cause for the Romans to crucify Jesus of Nazareth."

Note: the presenting cause. What makes Christ's the prototype of so many trials that followed was the use of sedition as a device for persecution. Christ was arrested and tried by the Sanhedrin on the night of April 6, AD30 (approx) for blasphemy. They wanted him dead, but as they explained to Pilate the next morning: "It is not lawful for us to put any man to death."

That's when they accused Christ of sedition, saying: "We found this fellow perverting the nation, and forbidding to give tribute to Caesar, saying that he himself is Christ, a king."

The accusation played on two Roman fears. The first was the fear of another tax revolt like one that erupted a few years after Christ's birth when Judea first became a Roman province. The second was a fear that this man was trying to displace the local king. As Barnett explains: "It was Roman policy to set up client kings in the provinces they conquered. But the Romans decided who that would be and they took a very dim view of any local individual who made that claim for himself."

Inquiry into West Australia's prison system

The Prison Reform Group welcomes the announcement of the inquiry into West Australia's prison system.

Prison Reform Group WA (PRGWA) notes the broad terms of reference as well as the robust independence of the inquiry. In establishing an inquiry that is motivated to provide a clear and fresh view of a beleaguered system it is hoped that an unbiased, clinical analysis free of the dreadful political mudslinging that has mired this area in the past may now be possible.

WA's prison system needs a new start. It needs a blank page to start from. It also needs some robust recommendations that will revolutionise work practices and the management and operation of prisons.

For the past decade isolation, politics and cosy relationships have led to a system that has seriously underperformed and has continued to slide into entrenched despair.

The inquiry should be left to pursue its investigations unencumbered by political opportunism. It should be allowed to recommend changes that do not try to preserve the pet projects of either the present government or the former one. The needs for this inquiry are complex and the involvement of the Office of the Inspector of Custodial Services is good and supported by PRGWA.

In relative terms, the costs of the inquiry should not become an issue as currently we have more than 3,000 people held in WA prisons at a cost of $80,000 per person per year. In other words the stakes are high.

The Prison Reform Group welcomes the inquiry and looks forward to providing what information and support it can to Mr Mahoney and the inquiry team.

E-mail to coroner an open-ended threat: QC

So this is what happens when coroners *don't* support the preferred government spin*_*_*

ACT Coroner Maria Doogan had failed to distance herself from an e-mail sent by her senior counsel which was described yesterday as an "open-ended threat", possibly against government employees being treated fairly in the 2003 bushfires inquiry, the ACT Supreme Court heard.


Richard Tracey, QC, counsel for the ACT Government, also told the Supreme Court yesterday that one witness to the inquiry, government media officer Marika Harvey, was treated "unduly harshly" by Mrs Doogan when Ms Harvey gave evidence in March last year.

That differential treatment of Ms Harvey could lead a fairminded observer to fear that her evidence would not be dealt with impartially in the inquiry, he said.

Mr Tracey continued throughout yesterday to detail examples which he argued gave cause for Mrs Doogan to be disqualified from the coronial inquiry on the grounds of an apprehension of bias - that is, a perception of bias rather than actual bias.

Jim Glissan, QC, counsel for nine individuals also seeking Mrs Doogan's disqualification, is expected to address the court. Her clients include former chief fire control officer Peter Lucas-Smith and former Emergency Services Bureau executive director Mike Castle.

He will be followed by Julian Burnside, QC, counsel for the Director of Public Prosecutions, which is supporting Mrs Doogan.

Mr Tracey said there were three issues which were enough to justify Mrs Doogan's disqualification. These were: Her field trip to the Bendora fire ignition point which was not revealed until eight months later and from which notes were produced but then withheld from other parties.

The "gratuitous and unwarranted" remarks Mrs Doogan had made against lawyers representing the ACT and individuals when they "properly" requested access to a range of documents including the notes made by expert witness Phil Cheney on the field trip.

Mrs Doogan had accused the lawyers of "seeking to impugn the integrity" of the inquiry. And Mrs Doogan's failure to disavow herself from the infamous "They'll get theirs Phil" e-mail.

The court heard that Mr Cheney in November 2003 sent an e-mail to Lex Lasry, QC, senior counsel assisting Mrs Doogan.

It referred to comments made earlier by Chief Minister Jon Stanhope in the Legislative Assembly about Mr Cheney.

Mr Cheney had written in the e-mail, "I guess it's an indication of what their tactic will be."

Children in crisis: the real diagnosis

Children's clinics at hospitals nationwide are clogged with youngsters whose real problem is their inability to read rather than a medical ailment. This is according to the chairman of the Federal Government's inquiry into reading.

Dr Ken Rowe, the newly appointed head of the national inquiry into the teaching of literacy, said psychology clinics at hospitals were straining to cope with the deluge of children seeking medical attention for problems caused by their failure to learn to read at school.

"Hospitals are complaining that their clinics are being filled with kids who are being referred for things like Attention Deficit/Hyperactivity Disorder (ADHD)," said Dr Rowe, who was last week appointed by the federal Education Minister to run the inquiry. "But once the pediatricians sort out the children's literacy problems, the behaviour problems disappear. What is essentially an education issue has become a health issue."

The Royal Children's Hospital is overhauling its clinical services after an internal audit revealed that one-quarter of all children who attended the emergency department and other outpatient services for medical help, were diagnosed as having non-medical conditions, such as learning difficulties and behaviour problems.

Professor Vicki Anderson, director of the hospital's department of psychology, said she and her colleagues were stunned by the audit's findings. About 500 Victorian children over the past year were treated at the hospital's Learning Difficulties Centre and demand for its services has almost doubled each year for the past five years.

Professor Anderson said many children, sent to the clinic because teachers, families and GPs believed they had ADHD, did not have the condition. Instead the child's inattention or poor behaviour in class was secondary to their primary problem of failing to learn to read.

"ADHD is clearly overdiagnosed," Professor Anderson said. "The appeal of a pill for ADHD is much easier than arranging twice-a-week remedial reading sessions."

Professor Anderson said specialists in charge of child psychology clinics at large hospitals in other states had similar concerns about the growing number of struggling readers attending their clinics. She said families often sought help at the Royal Children's Hospital's learning difficulties clinic because of long waiting periods at schools to have a child's learning problems assessed by Education Department psychologists.

A spokesman for Victoria's Education Department said Professor Anderson's concerns related to up to 250 students at the hospital's clinic whose main problem seemed to be reading failure, out of a statewide population of more than 540,000 students at government schools. He said the department was unaware of lengthy waiting lists for students who needed assessment of learning problems.

SLOW LEARNER:

[Lack of concentration can cause at risk children not to learn, read, or keep up with the class. There are numerous health conditions or even problems at home that tend to defer concentration in children until later on.

So forcing children to concentrate while they're at risk is not the answer either. Children can grow out of learning difficulties but those difficulties must be assessed to find out why there is a problem? So we should not completely dismiss all learning difficulties due to "youngsters whose real problem is their inability to read".

Hives and allergy for instance amongst other things can cause lack of concentration. Once the health or social problem is solved this can change the rate at which a child can concentrate - so that they can learn. Concentration has a lot to do with reading, have you noticed?]

Professor Anderson: "Instead the child's inattention or poor behaviour in class was secondary to their primary problem of failing to learn to read."

[But what is the cause of the primary problem 'failing to read'? This question must be assessed so early intervention can solve the problem, down the track. Those assessed 'at risk children' could do other activities 'now' besides reading that would not need lots of demanding concentration. For instance social skills, life skills, the arts or sport.

The ability to learn to read means more than having brain cells. It also means the child's ability to concentrate which takes into account their status, health, stress, conditions, environment, or even whether their parents can read themselves and help pass it on.]

Professor Anderson said, "Families often sought help at the Royal Children's Hospital's learning difficulties clinic because of 'long waiting periods at schools to have a child's learning problems "assessed" by Education Department psychologists'.

[But why leave it up to the schools to have a child's learning problems assessed by 'Education Department psychologists'?

In my day that was done by parents, outreach clinics, doctors and hospitals. In short it's the communities responsibility to have children assessed for learning difficulties - and not necessarily Education Department psychologists. DO I GET AN "F"?]

Roseanne Catt alert - miscarriage of justice?

Thank you LORD, the gates of hell shall not prevail against the Army of the LORD! Amen! (Sister Mary Court)

I first met Roseanne Catt when I visited Mulawa Women's Prison in 1999 and I have been following her case ever since. This week, her campaign to prove her innocence will finally reach a climax in the NSW Court of Criminal Appeal.

I feel this case has many serious implications for the justice system in NSW and for the way the media and the legal system handles such cases. I intend to deal with some of these in future reports.

If you are interested in her case, watch for further reports in the Sydney Morning Herald and Reportage. Pass them onto others who may be interested. Many people have received little information about this case because much of the media have either failed to report on the defence case or have actively undermined it.

In August 2001, Roseanne Catt who had almost served a twelve years sentence for eight crimes against her ex husband Taree motor mechanic Barry Catt, was released from prison after the NSW Attorney General received fresh evidence which supported her claim of innocence. Now, three years, Acting NSW District Court Judge Thomas Davidson has forwarded his report on the facts of her case to the NSW Court of Criminal Appeal which will now decide whether or not she is guilty.

Witnesses may have conspired, says judge

Criminal charges will be considered against prosecution witnesses who gave evidence at the inquiry into the conviction of Roseanne Catt over a conspiracy to murder her husband.

The judge heading an inquiry into Catt's convictions said he would refer evidence of more than 100 phone conversations between key prosecution witnesses to the NSW Police Commissioner and the NSW Director of Public Prosecutions to determine whether criminal prosecutions should be launched against them.

The acting District Court Judge, Peter Davidson, said at a final hearing on Friday that his inquiry, which began in February last year, was complete and he would forward his findings to the NSW Court of Criminal Appeal early this week for a decision on whether any or all of Catt's 1991 convictions should be overturned.

Catt spent 10 years in prison for possessing a pistol and poisoning, stabbing, assaulting and conspiring to kill her then husband Barry Catt. While the prosecution painted her as an evil and manipulative woman, the defence case has been that she was the victim of a conspiracy between prosecution witnesses.

The case was reopened after an acquaintance of former NSW detective Peter Thomas, who led the police investigation, provided the Attorney General, Bob Debus, with a statement saying Thomas told him he planted a gun on Roseanne Catt. Mr Debus then requested the Court of Criminal Appeal allow a fresh appeal in the case.

In the last days of Judge Davidson's inquiry, defence barrister Tom Molomby, SC, succeeded in tendering phone records of numbers associated with key prosecution witnesses, including Thomas, serving NSW detective Carl Paget, Barry Catt and his daughters.

Mr Molomby's analysis of the records showed phone contact between these people on more than 100 occasions during the hearing despite warnings from the judge they should not discuss the case or speak with anyone likely to be giving evidence in the inquiry.

Judge Davidson said the evidence of contact was so extensive further investigation was needed.

Update on Roseanne Catt case

Judge Davidson called both parties back to Court today to announce that he has finished his part of the Inquiry and to advise that he is sending his findings to the Registrar.

The Registrar will then set a date for the Judge's findings to go before the Court of Criminal Appeal.

Roseanne asked me to convey her thanks and appreciation to everybody for their continued prayer and support. She said she knows she would not be where she is today if it weren't for the tireless support and prayers received over the years from many many people. GOD IS FAITHFUL!

Roseanne was released on bail pending an Inquiry back in August 2001. It has taken 3 years to get to this point. Not long to go now before she is acquitted. Hallelujah!

Please continue to pray protection for Roseanne, particularly at this crucial time. Thank you LORD, the gates of hell shall not prevail against the Army of the LORD! Amen!

SUBJECT: WITHDRAWAL OF LEGAL AID FOR ROSEANNE CATT INQUIRY

It has been brought to our attention that today Legal Aid have formally advised Brock Partners, Roseanne Catt's solicitors, that they will no longer fund the Inquiry - at this most crucial time when her hearing is set for next Monday 3rd February.

What is going on!!

How is it that you, in the first place, instruct the Crown Solicitor to re-open the case due to overwhelming new evidence; 3 Supreme Court Judges agreed there was more than enough merit to go ahead with opening an Inquiry and ruled that a Judge be appointed; Legal Aid agreed to fund the Inquiry and has provided funding for the solicitors to obtain crucial affidavits, subpoena witnesses to appear in Court next Monday etc.

And all Roseanne's supporters have given an enormous amount of time, energy and resources to help prepare documentation - and then here we are 18 months down the track where everything is in place for the hearing next week and Legal Aid decide to pull the plug and refuse to fund the Inquiry!!

There is more than enough evidence to show that there has been a grave miscarriage of justice in the Roseanne Catt matter. Would you please ensure that funding is released by Legal Aid for the Inquiry to go ahead as originally agreed upon so Roseanne is not denied natural justice. The multitudes of the Australian public have a right to know the truth of what is going in this matter.

2,500 crooked detectives? Or a corrupt Government?

How to become corruption resistant in NSW
Don't trust those who cannot prove themselves with the little amounts of trust you give them. Just because they have a letter of perceived trust doesn't mean they can be trusted.

This is not how you eat 'antisocial behaviour'
Process corruption, perjury, planting of evidence, verbals, fabricated confessions, denial of suspects rights, a solicitor to induce confessions, tampering with electronic recording equipment, framing. Generally green lighting crime, and I say Murder, including the kids who overdosed on heroin. No doubt.

Black Knight - Long way to go home
In line with the current climate of police corruption and the demise of the reform unit set up by Wood, these facts ought to have been a good reason to leave Moroney out of the package as Commissioner.

Deeds
I am disturbed by Governments 'actions' in relation to shuffling the police service. Clive Small seconded into Parliament like a cocky in a perch. A breach of the fundamental Separation of Powers Doctrine does not in my view allow the thought of intervening, planning, or shuffling to stack the deck of our police service. The one that suppose to be autonomous according to Lord Denning. Where the Parliamentary Secretary can ask the commissioner of police to 'report' then sack him if he is not satisfied with such report.

Australia's Political Underworld...& their enforcers
The promotion of law and order means money to big business. Profits from insurance, security fixtures, patrol services and the like can only continue to grow if the perceived threat of uncontrollable crime wave escalates. In the past few months there have been many examples of the true nature of our blood thirsty politicians and their sinister attempts to spoon-feed a not so gullible public with their repetitious rhetoric.

Truth
Who is telling the truth? Well I guess Dr. Ed. Chadbourne or Mr. Peter Ryan may have the answer to that. Dr. Chadbourne sacked by Peter Ryan and more specifically in my view because he elected deputy commissioners Dave Madden and Andrew Scipione as the best men in the service in relation to his qualifications to make a recommendation in his capacity as human resources.That is if you believe that a Dr. can be corrupted.

Honesty
What is happening between the Police Service and politics is quite extraordinary at the moment. If stand over tactics don't work tell half the truth honestly and follow the example of sheep. Another word for it is sleaze, yeah. Another word for it is workplace harassment. Another word for it is bribing a Police Officer. Another word for it is misleading Parliament.

Tele Tales
Most people I know don't buy the Daily Telegraph. Why? Because of the lies and propaganda purported by them.

Lord Denning
Interesting how a member of the Police Board Mr. Tim Priest would hold grave fears for his safety from dangerous senior police but fails to name them or have them sacked. Rather Priest resigns as if he had no powers. Could that mean what he was saying is that the Governments are also corrupt?

Corrosive
Clive Small is Bob Carr's choice for the new Police Commissioner. It could only be the case considering his, Small's special appointment into Parliament House. Small who suffers from the little person syndrome is the ideal bend over boy who gets shuffled through his corrupt actions. Rolling the legal system for him after the fact, just like his predecessor Roger the dodger Rogerson.

Black Nexus
The Separation of Powers Doctrine is nowcontaminated witharangeofcolours, now leaving us with a black shirt on a once blue bridge that crossed that thin blue line. The 'Amery and Woodham show'.

Same boat
The Premier, Bob Carr, relies on a militia. A gang of bikies and our Police Service, to show all of us he is no murderer. He should be taken to the task along with his partners in crime like Clive Small to account for those people who like my self have been maliciously assaulted and who have complained, without any service and those who cannot speak for themselves who were murdered, like Terry Falconer. Terry murdered in custody.

Good Cop

Partners in crime - history!
Roger Rogerson, the old hero, who never faced a result in the Warren Lanfranchi, or Sally-Anne Huckstepp murders, was let off in my opinion when the New South Wales Government rolled the legal system (deciding what evidence to give the police prosecutor) to have the jury believe the illusion they (the Government wanted to create).
