Former Australian defence force chief Ruling Class Peter Gration says a secret British report on the war in Iraq is further evidence the conflict was legally and morally unsound.

War criminal and one of the co-offenders Ruling Class British Prime Minister Tony Blair has released previously secret legal advice showing his Attorney-General, Ruling Class Lord Peter Goldsmith, had initial reservations about the war.

Ruling Class General Gration says they were valid concerns.

"There was very eminent British legal opinion before the war started that the war was illegal," he said.

"The grounds on which that opinion were given haven't changed so I'm not at all surprised to hear that.

"The fact that it was unprovoked aggression against another country I think made it morally quite dubious."

The fascist Federal Government has been exposed for the torture of Australian Mamdouh Habib and the US Government's allegations against him (if they were true) would have been made under duress.

Mr Habib insists he confessed to training some September 11 terrorists after being tortured. Ouch!

Fascist Foreign Minister Alexander Downer has conceded that innocent man Mamdouh Habib may have been physically abused in Egypt?

The Foreign Minister's admission came as senior government officials continued to maintain they had no evidence of maltreatment during Mr Habib's three years in US custody?

But the perpetrators of this brutal crime wouldn't concede to the crime, but they let it happen, and it was okay to watch it happen and perhaps to even interrogate Mr Habib themselves.

The War Criminal Downer also said it was possible evidence of torture would be found at the US's Guantanamo Bay facility in Cuba, where Mr Habib was held without charge for almost three years before his release last month.

"For all I know, he may have been badly treated in Egypt, but we don't know because the Egyptians have still not conceded to us that they held him,"?

A parliamentary committee heard almost $500,000 was spent on returning Mr Habib to Australia.

Secretary of the Attorney-General's Department, Robert Cornall, said to a Senate estimates committee hearing today the charter flight for Mr Habib had cost $US354,000 ($451,300).

Under questioning by Labor senators, he said the cost was shared equally between the US and Australian Governments.

Meanwhile Ch/7 Sunrise advocate this morning that a phone poll they had taken asking, "Do you think that under certain circumstances people should be tortured?".

'I think I love you' CH/7 and its viewers reckon 52% said yes. People should be tortured under certain circumstances and 48% said no they should not be tortured under any circumstances.

Meanwhile, the federal opposition Leader Kim Beazley (a well paid loser) chosen to lead the opposition by HoWARd's ABC and the Corporate media has been alleged to have narrowed the gap between the Labor Party and the Government by 10 percentage points since mid-January, an ACNielsen poll showed?

Another flawed plebiscite no doubt, the poll in today's Sydney Morning Herald, shows Labor under Mr Beazley enjoyed 48 per cent support on a two-party preferred vote, compared to the Coalition's 52 per cent.

But I notice strikingly that the same statistics 52% and 48% suggest the same group of people who think it's okay to torture a citizen.

Could this group of people represent human rights in Australia? One does wonder!

It is difficult to comprehend that Australia has gone that far back to the dark ages by lowering the standards of a human being. That means these people advocate that they themselves can be tortured?

Fascist Attorney-General Philip Ruddock does not know the reasons behind the US decision not to lay any charges but says American authorities had told Australian officials they did not have sufficient evidence?

"We were disappointed about that because they'd led us to believe they did," he said.

"They've told us they didn't have sufficient evidence to proceed with the prosecution.

Ruddock "I assume it relates to a range of potential issues that might be involved in that."

Ruddock says he can not exclude the possibility that one of those "issues" was the use of torture to gain Mr Habib's confessions.

So after Ruddock let them torture him he was disappointed that they did not charge Mr Habib?

You mean it was all for nothing?

Labor's Nicola Roxon suggests the evidence against Mr Habib was tainted.

"I think it defies belief that they haven't asked the US the reasons that they released Mr Habib without charge," she said.

"The evidence they had was tainted in some way and couldn't be used, for example it was obtained through torture."

ASIO and federal police officials will be quizzed today about whether any of their officers witnessed Mr Habib being tortured.

But according to the ABC Four Corners program last night there is no question that their officers were complicit in the torture and interrogation of many others.

Stephen Kenny, the lawyer representing the family of Guantanamo Bay detainee David Hicks, has welcomed a US court ruling that military commissions set up to try detainees at Guantanamo Bay are unconstitutional.

A US federal court judge ruled that detainees have a right to challenge their imprisonments in the US civil court system.

She has also suggested that the military tribunals established at Guantanamo to try detainees are illegal.

Stephen Kenny, the lawyer representing David Hicks's family, says the court's decision is quite significant as it backs his argument that the treatment of Hicks without his basic rights is no longer acceptable.

He says the Australian Government will be pressured further.

"They are now being exposed as ignoring the rule of law in the abuse of individuals' basic human rights," he said.

Today's decision conflicts with a ruling in a different but similar case two weeks ago, in which the judge backed the Bush administration.

The US Justice Department is now considering how to respond today's ruling.

The US military defence lawyer for Hicks, Major Michael Mori, the ruling is good news.

"It means that he has constitutional protection down there at Guantanamo Bay, specifically in the combatant status review tribunal, and it means the system that's been set up to deal with this has been set up wrong," he said.

"Now it's him left from Australia and obviously all the Brits were released, which is the US acknowledging that the military commission system doesn't meet international legal standards, and yet he's been left there to go through this unfair process," he said.

Lawyers warn the legal arguments about the military commissions and detentions at Guantanamo Bay could take months to reach a conclusion.

The trial of Hicks is in limbo until the civil court proceedings in the US finish.

Although the other Australian inmate, Mamdouh Habib, was sent home to Australia last week, the Howard Government has ruled out asking for the same treatment for Hicks.

Meanwhile, the Law Council of Australia says recent developments including judicial criticism of the US military commissions and the release of Mr Habib have placed unprecedented pressures on the credibility of the administrative and legal system.

CO-OFFENDERS DO NOT REBUFF UN ON 'ILLEGAL WAR'

The 'coalition of the killing's' complicities - the US, Britain and Australia - have insisted that their countries' military action in Iraq was legal after they have committed war crimes against humanity that include pre-emptive strikes on the sovereign nation, occupation, genocide, maiming and torture of any resistance.

War criminal, US President George Dubya Bush has disputed comments made by United Nations secretary-general Kofi Annan that the war in Iraq was "illegal" under the world body's charter, saying that the UN approved the invasion.

So if the UN made the statement then who is George Dubya Bush to argue in the face of the rest of the world that they somehow had received approval for a pre-emptive strike on a sovereign nation, when that had never been legal in the eyes of the world? After all it wasn't George Duby Bushe's statement it was Kofi Annan's and the UN as well as billions of people around the globe.

Australian Caretaker Prime Minister war criminal John Howard also rejected Mr Annan's comment while on the campaign trail ahead of the October 9 election. "The legal advice that we had, and I tabled it at the time, was that the action was entirely valid in international law terms," he said.

Bullshit! You were told so many times your rodent that you should not lie to the Australian people and you knew that the war was illegal and in fact went to war before your alleged tabled advice in anycase.

His view was echoed by Prime Minister Tony Blair's office, which said the British government's top lawyer - Attorney-General Lord Goldsmith - had reached the same conclusion before the invasion was launched in March last year.

All three governments face elections in the near future.

The US President did not directly address Mr Annan's comments, but he referred to the Security Council's unanimous endorsement in November 2002, of resolution 1441, which warned Saddam Hussein he would face "serious consequences" if he was still seeking weapons of mass destruction.

"The United Nations looked at the same intelligence I looked at," Bush said. "They concluded Saddam Hussein was a threat. They voted by 15-0 in the UN Security Council for Saddam Hussein to disclose, disarm or face serious consequences.

But serious consequences under existing law doesn't mean blowing a country to bits surely? 

It doesn't mean killing tens of thousands of innocent people in order to achieve your goal, surely?

BUSH: "I believe when bodies say something, they better mean it."

The United Nations statement saying Mr Annan's position on the war had long been well-known.

Mr Annan feels it is no different from what he has been saying for more than a year, and that position is very well-known to member governments," UN chief spokesman Fred Eckhard told reporters.

The billions of people around the globe knew it as well. This was a war crime and was illegal and the killing of innocent people and subsequent torture was degrading. 

 Bush suffered an embarrassing blow when the vast caches of Iraqi weapons of mass destruction at the core of his public case for war did not materialise.

The bloody chaos in Iraq and rising death toll among US militants pose a threat to his hopes to win a second term in November's presidential election. After vowing to bring a second resolution before the Security Council, Bush gave up on the effort when it became clear that opposition from France, Russia and other members would lead to a veto.

US State Department spokesman, war criminal, Richard Boucher denied that Washington needed a second resolution after UN Security Council Resolution 1441 and other UN resolutions that preceded it.

"There were, as we've pointed out before, 17 resolutions, including Resolution 1441, that detailed Iraq's obligations, its refusal to disarm and the consequences for non-compliance," he said.

"So we think that was a very solid basis, legal basis, for the war. And that's the basis on which we proceeded."

Bullshit! Once again black is white and lies are truth. Clearly the US was on a mission and invited the Coalition of the Killing and that's what they did and have continued to do. And no matter what anyone said the US and the Coalition of the killing were already killing.

The US ambassador to the United Nations at the time, war criminal, John Negroponte, had said Washington reserved the right to act if the world body did not, but also said that 1441 was not UN authorisation for US military action.

"This resolution contains no hidden triggers and no automaticity with respect to the use of force," he said.
