The Federal Government abolished the Aboriginal and Torres Strait Islander Commission (ATSIC) in June last year. For nearly 15 years, ATSIC had provided a framework and focus for Indigenous representation at all levels of government and in other domestic and international forums.

The Regional Councils established under ATSIC, which provide an important link between Indigenouhttp://www.blogger.com/img/blank.gifs communities and government, will be disbanded on 30 June this year. This forum looks forward to new possibilities -- how should the interests of Australia's First Peoples be represented in the future?

Larissa Behrendt is Professor of Law and Indigenous Studies and Director of the Jumbunna Indigenous House of Learning at the University of Technology, Sydney. She graduated from UNSW Law School in 1992 and has since completed her Master of Laws and Doctorate at Harvard. She is a practising lawyer and lecturer and has worked with the United Nations. She is published on property law, Indigenous rights, dispute resolution and Aboriginal women's issues.

Warren Mundine is Chief Executive Officer of NSW Native Title Services Limited. He is also National Junior Vice President of the Australian Labor Party. Educated in Sydney at Benedict Marist Brothers College at Auburn, Warren later studied at the South Australian Institute of Technology. He is currently a member of the Macquarie Area Health Board, the NSW PCYC Board and the Local Government Association of NSW and Deputy Mayor of Dubbo.

Tanya Hosch has spent most of her working life in Adelaide and mostly in the public sector including women's services. She has worked for the Human Rights and Equal Opportunity Commission, the Council for Aboriginal Reconciliation in Canberra, and with ATSIC. Tanya has been involved in the development and delivery of leadership programs for young people She is a director of Australian Indigenous Leadership Centre and the Foundation for Young Australians.

Senator Aden Ridgeway, from the Gumbayngirr people of Northern New South Wales, is the only Indigenous member of the Federal Parliament and the Australian Democrats Senator for New South Wales. Aden has extensive experience in policy and administration, a long time involvement in national Indigenous politics, a passionate commitment to human rights and an ongoing interest in philanthropic and arts organisations.

A Call to Action: re election of John HoWARd?

I am fed up with the political apathy of the majority of Australians and depressed about the outcome of the election. I need to do something about it. Does anyone want to help me.

My name is Mimi Zilliacus, I am a student studying history and politics at the University of New South Wales in Australia. Today I am very depressed. Yesterday my fellow citizens re-elected, [war criminal], John Howard, a man who has lied to the Australian people on numerous occasions on issues of much more importance than his sex life.

Why you might ask would the Australian people want this man back in Parliament? Well that's a very good question. The reason is the money.

He has claimed to be responsible for the growth in the economy and for lower interest rates, and on top of that he has promised to bring in tax cuts for a select few. What the general public fails to understand is that the growth in the economy and interest rates are also dependent on what is going on in the global market place. They fail to see that a "free trade" agreement with the US is going "F" us over, we will be the underdogs and America will be free to benefit at great costs to us, the Australian people.
I believe in human rights and that Australia should be fulfilling its obligations under international law. I believe that war is never going to create less of a terrorist threat, it creates more. I believe that Australia should not be stealing oil from a country which has risked so much to become democratic and which is struggling to re-build itself.
I believe that there is no justification for locking up children. I believe that these things are more important than the state of the economy.

Prior to the election I went to a rally against the lies of the Howard government. It was fantastic, 7,000 people marched through the streets of Sydney. There was a great atmosphere. I don't know anyone who voted for Howard. And here in lies the point, we need to find a way to educate the masses, those people who didn't go to the rally, and don't go to any rallies.
The cab drivers, labourers, and ordinary Australians who are just trying to make a living and don't really care, or don't have the time to care, about international politics. Those who read only main stream media and believe what they read. We need to be able to communicate to them; to say to them we are not all a bunch of tree hugging hippies and actually what happens in international politics does affect their everyday lives.

That in the broader perspective a tax cut and lower interest rates are not going to help when we no longer have free health care. The cost of medicines triples, our pharmaceutical and agricultural industries cannot compete with America, even in our own backyard. And when only the elite can afford to go to university.  

Actually the cost of mandatory detention is far greater than any other alternative. Even if every one who is currently in a detention centre were in the community and being given welfare, [social services], it would still cost less than detention.
I need to do something, but at the moment I don't know what to do, I feel powerless, but there has to be something that I can do. Got any ideas? I am not sure who I am going to send this to, but to anyone who wants to help me all assistance would be greatly appreciated.

Australia is supposed to be a democracy but democracy doesn't work without a well-informed public. With this in mind I want help to come up with a way to educate the public, and especially those people who see "left" as being a bad thing. Because I cannot live through another three years of Howard without some hope that we can change things, and because I think that this is a similar problem in many other countries.

We need to up the frequency of graffiti, street art, billboard improvements and so on. We need messages where people will see them. that's just one idea.

Reform the Senate
There is no point to a complete over haul of government, but there is change that would make all the difference to how the government behaves. It is time we rearranged the SENATE, or upper house. The elected senators should be independent of all and any political party that inhabits the House of Representatives, or Lower house.

These Senators must plead allegiance to the people who elected them, or sign a contact of service to the people. They need to posses the relevant qualifications to assess, on its merits, each bill presented by the lower house in regard to the public benefit. People, who have been nothing but politicians all their life, are not qualified for this task, as they will vote for a bill to benefit the party, not the people. The Senate then becomes a real house of review, not the rubber stamp it currently is. It would also be able to launch truly independent inquiries into government business when the need arose, rather than the white wash institute it is now. Then the public has a real chance of being informed of the whole story, not the selective government version.

As it stands now, there is no point to these expensive, time consuming PR exercises that produce findings like "We were wrong about the intelligence, but we did the right thing". The people cannot make informed choices when this is what they get for information. The Senate must also be empowered to penalize or to demand dismissal for Ministers who act in breech of the Law, Australian Constitution, International law, the Geneva Conventions or any other Laws or treaties we are signatory to. Our Governments must be accountable to a truly INDEPENDENT Senate, with the powers I have outlined. That is how a real Democracy functions. The only people, who would object and obstruct the transition to a reformed Senate, would be the sitting government.

Pythagoras said, "we are all chained together looking forward." One day when we break free from those chains we will notice that, "what we are looking forward to was actually what was projected from behind us", all the days of our life, that is "unless we break free from our chains". Why do I tell you this?

Because it appears that only after people have been "directly affected" in other words "broken free from their chains" that the political landscape will as well. And it seems the more people who are directly affected the more it will change.

Some people have not had to change because they have not been affected.

A cause worth fighting for
If you want people to transform the world they need to know that their dreams - and not that of some politician - can shape that transformation. "Any revolutionary who is to be counted on can only be in it for himself (sic)...." Disarm Authority, Arm Your Desires!

REPORT: AUSTRALIAN PRISONERS' ELECTION NEWSPAPER

There was high drama as the only state prisons department in Australia to refuse The Australian Prisoners' Election Newspaper, was challenged in an emergency hearing before the NSW Supreme Court.

All legal observers agreed that the state would almost certainly lose the case. Commissioner Woodham pulled out all the stops to keep the judge from making a judgement. He finally avoided it by making all prisoners vote early before the court could decide. We were ready for the battle but he wasn't.

George Williams, Anthony Mason Professor and Director, Gilbert + Tobin Centre of Public Law at the University of New South Wales, and Ben Zipser from Selborne Chambers argued the case on behalf of Stacy Scheff, the newspaper's editor.

Justice Smart heard preliminary arguments regarding the issues and timing of the case. Woodham's lawyers argued that he was on leave and therefore could not consider the matter. Justice Smart said that he would have to come up with a better argument than that.

Their next move was to argue that if constitutional issues were to be raised, all States' and Territories' Attorneys General would have to be notified and consider the matter, and that there was not enough time to do this before the federal election on Saturday, October 9 2004. Justice Smart decided there was enough time, and set the hearing for administrative arguments at 3pm on Friday, and constitutional arguments at 10am on the Saturday of the election.

After the hearing, the solicitors filed the appropriate notices to all States and Territories, and began to prepare for the next day. In anticipation of victory, we began to distribute the newspapers to NSW prisons to be held by the governors until the court order came down.

That afternoon, our lawyers got a call from the Crown Solicitors saying that the mobile polling booths had been rushed forward. Prisoners in Siverwater, Cessnock, Parramatta and Mulawa had already voted but Bathurst jail only was still going to vote on Saturday. We were planning to proceed with the case on that basis. Within one hour, voting at Bathurst had been moved up to Friday. All other NSW prisons voted by postal vote.

Because the constitutional case could not be argued until Saturday, and NSW prisoners would all have voted by then, our lawyers told us the judgement would be futile to the case we were arguing, and therefore the judge was unlikely to make one.

As a direct result of this action, support came from across Australia and around the globe. Top legal minds in Sydney stood up for prisoners' rights on short notice. The media recognised the decision for what it was: a bad mistake and an arrogant abuse of discretionary power. The groups who supported and produced this newspaper will be producing another issue, this time with the constitutional entitlements in mind. With a legal team in place for the full constitutional arguments, it will be put before Commissioner Woodham. As the election won't be imminent, it will be some months before it goes before the court, if necessary.

The Criminal Law (Rehabilitation of Offenders) Act 1986 Qld
The Criminal Law (Rehabilitation of Offenders) Act 1986 (Qld), requires that any person who has committed an offence which is less than 10 years old or which resulted in a prison sentence of more than 30 months, must disclose that offence if requested eg. for employment purposes. If a criminal record is disclosed in a job application, it is unlikely that person will be given the job.

NSW Serious Offenders Review Council
In response to a letter we have received from Mr K C who has said that he is serving 24 years and 10 months commencing on 29/8/1991 with his earliest release date being 28/6/2016 with 4 years parole and full time 28/6/2020. He said that he contacted the Serious Offenders Review Council in writing but received no response.

Australia: Private Prisons, Junee NSW
When I got to Junee I was given nothing except bed linen. That's it! No clothing. I had to put my name down for clothing, which they said I could get on Saturday. When I went down to get my clothing on Saturday I was told they had nothing but I was told that I could buy what I wanted on their monthly buy-up. In the mean time I got rashes between my legs from the dirty clothes I had on.

Justice Action is a community based organisation of criminal justice activists. We are prisoners, academics, victims of crime, ex-prisoners, lawyers and general community members. We believe that meaningful change depends upon free exchange of information and community responsibility.

Community Restorative Centre
NSW spends more than half a billion tax dollars a year on prisons. It costs $60,000 to keep someone in maximum security for a year: more than double the minimum wage. CRC looks for and implements better solutions to the high social and economic costs of crime.

Sisters Inside Inc
Sisters Inside Inc. is an independent community organisation, which exists to advocate for the human rights of women in the criminal justice system, and to address gaps in the services available to them. We work alongside women in prison in determining the best way to fulfil these roles.

Smart Justice
Smart Justice does not support any party but calls for investment in prevention, alternatives to custody and initiatives that tackle the causes of crime. It is important to dispel the myths about 'law and order' and promote real solutions to crime and violence.

Children of Prisoners' Support Group
Children of Prisoner's welcomes Ann Symonds as our first Patron at this years AGM and screening of "The Space in Between" video , and will have a visual display to demonstrate the invisible population of children effected by parental incarceration.
