Nazi tones in John Howard's anti-terror laws, says Malcolm Fraser

FORMER Liberal prime minister Malcolm Fraser has suggested parts of the Howard Government's anti-terror package resemble measures taken by Adolf Hitler and says Kim Beazley's handling of opposition to the package should determine his leadership.

Mr Fraser said he hoped a High Court challenge would be mounted to the terror deal, if and when it was enacted, and said both the presumption of innocence and the right to silence were being challenged by what his former treasurer John Howard was proposing.

"Some of this legislation is truly terrible," he said. "Some of the analogies ... one of the first pieces of legislation Hitler's government put into place was something for 'the good order and safety' of the citizens of Germany: preventive detention ...

"Some parts of the legislation sound horribly familiar."

He added preventive detention, under which suspects could not contact their families nor their employers, "seems effectively to be a law to make somebody disappear". "I think that's an odd law for a country like Australia," Mr Fraser said.

He believed the laws as proposed would make Australia more dangerous, diverting police from "what they ought to be doing". (updated (2009) robbery, blowing up bank ATM's)

Mr Fraser said Mr Beazley had done nothing to slow down the Government's package. He said the Labor Leader "ought to get roasted by his own party" and praised the "eloquently" made stance of Caucus dissident Carmen Lawrence.

Of Mr Beazley's stance, of ultimate support of the Government's package passing, Mr Fraser said, "Obviously, as a total outsider, I would have thought this would be a defining moment [deciding] if Kim Beazley's leadership continues to go downhill.

"He did it unilaterally, without discussion, and in a way that would be anathema to a lot of people in his own party, if not the majority."

Mr Fraser said the Premiers had been panicked "by a couple of skilful briefings" by security services to support Mr Howard's position on the contention the new laws would have prevented the [false flag] London bombing in July, a position that was "totally misleading and untrue".

He praised ACT Chief Minister Jon Stanhope for putting a draft of the proposed laws on his web site, allowing public debate.

Worries over DNA and racial profiling

UK: Black men are four times more likely than White men to be on the national DNA database and there is growing concern about racial profiling in criminal investigations.

The police national DNA database (NDNAD), launched in 1995, now contains almost three million profiles. The prospect of everyone providing a DNA profile for the database is unlikely because of concerns put forward by civil liberties groups about such a system undermining the presumption of innocence.

However, recent legislation has made it simpler for the police to input DNA profiles to the database and it is now lawful to retain DNA profiles for the NDNAD from those arrested, even when a person has neither been charged nor convicted.

The over-representation of Black and Minority Ethnic men on the database, which Professor Alec Jeffreys, inventor of the DNA fingerprinting technique, has recently described in the New Scientist as 'highly discriminatory', is increasingly likely to spill over into racialised policing. Currently, 32% of all Black males within the UK are on the database, compared to only 8% of white males. While DNA forensic evidence is often presented as having near-perfect accuracy, in fact there is potential for error and mismatch.

It is common practice for forensic science laboratories to retain samples, although the technology, at present, is limited to a small non-coding portion of the DNA, which does not unveil any information besides the person's identity.

The Forensic Science Service (FSS) claims that it keeps samples to ensure a mistake has not been made in the database. Yet, a researcher at the NDNAD has already confirmed that any retained samples may be subject to full DNA analysis in the future.

This would reveal a person's ethnicity and other personal characteristics. The database is already being used for research projects authorised by the Home Office and the NDNAD; one study is extracting statistical information on ethnicity. The dangers lie not only in using the database as a policing tool but also in its use as a wider ethnicity-profiling tool.

Operation Minstead

Last year, an operation in South London was criticised for its racial bias. According to allegations made to The Voice by Nathaniel Braithwaite, a Black policeman involved in 'Operation Minstead', officers had been ordered by their superiors to stop Black men in South London and ask them to provide DNA samples.

Braithwaite was instructed to stop light-skinned Black men, between the ages of 25 to 40, between 5 foot 8 inches and 6 foot one inch. He was told to ask them to provide a DNA sample to assist with an investigation into a spate of burglaries. This action was taken as part of an ongoing criminal investigation into a series of rapes across south London thought to have all been perpetrated by a Black man, who had come to be nicknamed 'the nightstalker'.

According to Braithwaite, if people objected to giving a voluntary DNA sample, they were to be arrested on suspicion of rape; a compulsory DNA swab could then be taken at the police station. Their DNA would be stored on the national database indefinitely along with those who gave 'voluntary' samples.

An article in the Metropolitan Police's own newspaper, The Job, in December 2003, advised all police officers to support Operation Minstead by taking DNA swabs from even those people arrested who 'may not fit the profile' given in the description of the perpetrator but who still 'give you concern'.

Braithwaite objected to the nature of the DNA swabbing operation and this led to meetings with his superiors. He was subsequently asked to provide a DNA sample himself. After his initial refusal, he consulted the Police Federation, which backed his objection to provide a sample, on the grounds of it being a racially discriminatory policy. However, after discussions with colleagues, Nathaniel Braithwaite reneged and did provide a sample.

In April 2004, investigators decided that all Black officers in the Metropolitan Police should submit DNA samples. Having to provide yet another DNA sample prompted Braithwaite's resignation from the Met. (He is awaiting a tribunal hearing on his case of unfair dismissal and racial discrimination.)

The Braithwaite case drew attention to the discriminatory potential in database creation. But it also revealed the limitations of such large DNA trawls. For Operation Minstead had already provided officers with enough detail about the suspect's physical profile and family origins through ancestral DNA. Yet, after twelve years, no suspect had been discovered.

The fear for individuals, particularly those from Black and Minority Ethnic groups is not just the action of DNA profiling for specific cases, but the misuse of this information when it has been retained. By inputting as many Black and Minority Ethnic people onto the system as possible, the expanding, but unrepresentative, database is poised to form the basis for further ethnicity studies, and remains as a permanent tool for racial profiling.

Bradley Murdoch committal, lawyer calls for fair hearing

The lawyer of the man accused of murdering British backpacker Peter Falconio has spoken to the media in Darwin. Adelaide Barrister Grant Algie is urging the media to respect the judicial process and allow 45-year-old Bradley John Murdoch the right to a fair committal hearing.

In the committal, the Magistrate will determine if there is enough evidence to commit Mr Murdoch to stand trial in the Supreme Court.

Mr Algie says he wants to ensure Mr Murdoch gets a fair hearing and prejudice is limited.

"Brad Murdoch, for whom we act, doesn't have a website," Mr Algie said.

"Brad Murdoch doesn't have a media liaison officer.

"But what Brad Murdoch has - and this is very important - is a presumption of innocence and an absolute right to a fair trial if and when he is put on trial."

Mr Algie says his client will not be called to give evidence.

"I would say that you could be absolutely certain that not only would Mr Murdoch not be cross-examined but he will not be called in the committal," Mr Algie said.

"It's not a trial."

Innocent until proven guilty

Presumption of innocence. A hallowed principle of criminal law to the effect that the government has the burden of proving every element of a crime beyond a reasonable doubt and that the defendant has no burden to prove his innocence. It arises at the first stage of the criminal process but it is not a true presumption because the defendant is not required to come forward with proof of his innocence once evidence of guilt is introduced to avoid a directed verdict of guilty.

Presumption of innocence succinctly conveys the principle that no person may be convicted of a crime unless the government carries the burden of proving his guilt beyond a reasonable doubt but it does not mean that no significance at all may be attached to the indictment. U.S. v. Friday, D.C.Mich., 404 F.Supp. 1343, 1346.

But bail laws in NSW should be rewritten to make hardened criminals prove they are no threat to public safety, the early findings of an internal police working party have revealed. Members of the police group believe present laws are failing and need to be overhauled, with a presumption against bail for re-offending criminals.

But innocent unless proven guilty is simply a legal concept. In real life you are innocent if you are innocent and guilty if you are guilty. Those who are guilty but found "innocent" in court are STILL guilty ... they just won't be punished or held accountable for their crime.

Similar laws in the ACT have resulted in dramatic plunges in certain crimes of up to 80 per cent.

But while police believe similar NSW laws could reduce crime significantly by keeping serial criminals locked up, the proposal is opposed by the Attorney-General's Department.

Members of a separate Attorney-General's working party on bail are concerned the changes may affect basic rights of justice and are attempting to block the plan.

As an interim alternative, the police party has thrown its weight behind "a stay of proceedings" that would keep career criminals in jail while police can appeal against bail decisions they are unhappy with. [?]

The proposal may be backed by the introduction of permanent bail courts which would ensure offenders awaiting bail appeals are kept locked up for a maximum 72 hours.

Police Commissioner Ken Moroney established the internal police bail working party in January after declaring he was fed up with courts continually letting down police and the community.

The party has been tracking bail information and a series of bail judgments to determine the best way to address the issue.

"My colleagues in the ACT have indicated to me where this provision [presumption against bail] exists there have had some remarkable results,"

Moroney "I am told in some crime categories in the ACT, they have seen their crime reduced by up to 80 per cent . . . if that is so, it is a significant result that can't be ignored."

The commissioner said steps had been taken to improve internal police procedures. Moves were being made to have more arresting officers give evidence in court to help police prosecutors and the police COPS computer system was being refined. [Cops needs to be because COPS is updated regularly with false and misleading information. Not proved.]

The State Government recently toughened bail laws from a position of presumption for bail to a neutral position but has stopped short of recommending a presumption against bail, supported by Opposition Leader John Brogden.

Bail judgments continue to confound police and the public. The Daily Telegraph recently exploited the case of Adam Speyer, 22, continually granted bail despite being charged with 34 crimes over the last three years even though it wasn't any of their business? In the Parramatta area, recent figures revealed up to 80 per cent of repeat offenders police recommended be refused bail walked free from courts the following day.

Moroney said he was expecting to receive the working party's final report by mid-May. He said in the meantime he would be communicating one message to his troops. "If we don't believe the determination for bail is appropriate. You will appeal and you will appeal and appeal," he said.

A breach of the fundamental Separation of Powers Doctrine does not in my view allow the thought of intervening, planning, or shuffling to stack the deck of our police service. The one that suppose to be autonomous according to Lord Denning. Where the Parliamentary Secretary can ask the commissioner of police to 'report' then sack him if he is not satisfied with such report.

The promotion of law and order means money to big business. Profits from insurance, security fixtures, patrol services and the like can only continue to grow if the perceived threat of uncontrollable crime wave escalates. In the past few months there have been many examples of the true nature of our blood thirsty politicians and their sinister attempts to spoon-feed a not so gullible public with their repetitious rhetoric.

Who is telling the truth? Well I guess Dr. Ed. Chadbourne or Mr. Peter Ryan may have the answer to that. Dr. Chadbourne sacked by Peter Ryan and more specifically in my view because he elected deputy commissioners Dave Madden and Andrew Scipione as the best men in the service in relation to his qualifications to make a recommendation in his capacity as human resources.That is if you believe that a Dr. can be corrupted.

Honesty
What is happening between the Police Service and politics is quite extraordinary at the moment. If stand over tactics don't work tell half the truth honestly and follow the example of sheep. Another word for it is sleaze, yeah. Another word for it is workplace harassment. Another word for it is bribing a Police Officer. Another word for it is misleading Parliament.

Lord Denning
Interesting how a member of the Police Board Mr. Tim Priest would hold grave fears for his safety from dangerous senior police but fails to name them or have them sacked. Rather Priest resigns as if he had no powers. Could that mean what he was saying is that the Governments are also corrupt?

Clive Small is Bob Carr's choice for the new Police Commissioner. It could only be the case considering his, Small's special appointment into Parliament House. Small who suffers from the little person syndrome is the ideal bend over boy who gets shuffled through his corrupt actions. Rolling the legal system for him after the fact, just like his predecessor Roger the dodger Rogerson.

The Premier, Bob Carr, relies on a militia. A gang of bikies and our Police Service, to show all of us he is no murderer. He should be taken to the task along with his partners in crime like Clive Small to account for those people who like my self have been maliciously assaulted and who have complained, without any service and those who cannot speak for themselves who were murdered, like Terry Falconer. Terry murdered in custody.
