Review of proposed terrorism laws

The proposed laws are still at the publicity stage, so there are no details. However, this is what has been released so far.

Control orders would allow the police to go before a closed court and ask for restrictions to be placed on someone who poses a terrorist risk.

The restrictions can limit whom they can talk to, where they can go.

They may also require the person to wear a tracking device such as a electronic foot bracelet, or report regularly to a certain place as if they were on bail. These restrictions can last for up to 12 months.

Preventative detention powers would allow people to be detained without charge for up to 14 days. This violates the Australian Constitution so the Federal Government has to ask the States to help them with this part of the law.

This means that if there was suspicion that a terrorist attack would occur, [false flag operation] hundreds of people could be detained on very thin grounds. They would not be able to go to work, or to communicate with anybody, if the existing laws are any guide.

Furthermore, the current ASIO powers would be toughened. Search warrants would be valid for 3 months instead of only 28 days.

Instead of having to get a warrant to gain access to your mail every 3 months, they would only need to do it every 6 months. This means that there is less oversight over these processes, and will open the door for police abuse.

This is important as any student of Australian history knows, police have not always been free from abuse in Australia.

Public statements come under restriction, where it would be a criminal offence for someone to incite violence against the community in support of Australia's enemies [Coalition of the Killing.] So it would be a crime to say 'Iraqis should resist the occupation by the US, UK and Australia.' The maximum penalty that is being proposed for that offence is 7 years imprisonment.

Organisations that 'advocate terrorism' would also be made illegal. The problem with this is that the offence of advocating terrorism is very broad.

For example, Hizb-ut-Tahrir (HT) has consistently denied that it supports terrorism, but because it says Palestinians have the right to attack Israeli targets, this could be interpreted as advocating terrorism.

If HT were to be listed as a terrorist organisation, all the members of HT could go to prison for 10 years, and under current laws it would be an offence to associate with any of its directors, promoters or members.

The new laws would extend police powers to stop, question and search members of the public.

These would give the police the ability to stop anyone in the street, search them (possibly even including strip searches) and ask them questions when police suspect a person might be about to commit a terrorist offence. More oppressive laws are already in place in some states, such as the NSW Terrorism (Police Powers) Act 2002.

Ed: As has been reported this tactic by Howard is also to scare people. Frighten and terrorise the community. The news had to be alarming, so much so, that most people will be more worried about defending their own skin than confronting the governments failures on Telstra etc.

We should be disciplining Howard for his lies and deceit in the Telstra scandal yet we've had to become even more alarmed about our civil liberties in general.

The Telstra scandal should remove Howard from office post haste as a liar and a fraud to the Australian people.

Howard is the scum of the earth and so is his party; he's deceived this country as a leader so many times.

His own medical crony Tony Abbott has laughed and scoffed at the demise and attempted suicide of one of his own party members John Brogden.

Phillip Ruddock is a bad dog who is promoting terrorism and removing civil liberties all at the same time. There have been many instances that report this. Propaganda leaked to pro government media giants. Raids without evidence of any kind. Fishing expeditions to reap ones personal material that would give grounds for further investigation regardless of who belonged to the material, sought by an ASIO expedition into the privacy of any home.

How many alleged terrorists still remain in custody? How long have they been there? How many alleged terrorist remain in the community on bail? How long have they had to endure this? Now most likely with bracelets on so they've no privacy.

Track and chase - the new war on liberty

AUSTRALIA/CUBA: federal police will be able to fit innocent suspects [scapegoats for resource wars in the Middle East] with tracking devices for 12 months, and their state counterparts could be allowed to hold people without charge for two weeks, under federal government plans to remove civil liberties.

The government also plans to make it harder for foreigners to get Australian citizenship and to introduce new offences of inciting violence against community groups and Australian militants overseas, and leaving baggage unattended at airports.

Announcing the new measures, which were met with concern from civil liberty groups, lawyers and some Coalition MPs, war criminal, john hoWARd, said they were "unusual" but were necessary "to cope with an unusual and threatening situation".

But it appears the most unusual and threatening situation is john HoWARd and his war criminal mates. Do I have to name them?

hoWARd: "There is nothing in these measures that can possibly be regarded as creating a quasi-police state," he said.

There was nothing in the measures that advocated torture either but look what happened to Mamdouh Habib.

hoWARd said the planned laws, which are light on detail and have yet to be drafted, would not have a "sunset clause" requiring Parliament to re-enact them. They arose out of a review of counter-terrorism laws ordered by him after the [false flag] London bombings in July.

At their centre is the creation of "control orders" - similar to apprehended violence orders - on people who "pose a terrorist risk to the community". federal police would be able to ask courts - possibly in a closed session - for an order to fit tracking devices on suspects and to restrict their travel and whom they socialise with.

federal police would also be able to detain people in a "terrorism situation" for 48 hours, demand documents and obtain airline passenger information, and have increased powers of "stop, question and search".

In other words interfere with a person.

The federal government will ask the states at a premiers' meeting later this month to give state police powers to detain suspects for up to 14 days. hoWARd said this was needed to give police time to "prevent the destruction of evidence to prevent the trail going cold" after a terrorist attack. [Easier to set people up.]

The Premier, Morris Iemma, said he would consider the proposals before the premiers met on September 27.

That means yes!

The federal government will also ask the premiers to consider more random baggage searches and closed circuit television at transport hubs and places of "mass gatherings".

Existing offences for financing terrorism, providing false or misleading information to asio and threatening aviation security will be strengthened, as will asio's search powers. The government also plans to increase the waiting period for citizenship applications from two years to three, and reserve the right to refuse applications on security grounds.

The president of the Council for Civil Liberties, Terry O'Gorman, said once in place, the laws would never be removed. "The Prime Minister said today this combined package of powers will not mean a police state," he said. "We say it very much holds the potential for that to happen."

[The draconian laws will be removed it just takes a struggle to do it.]

The Australia Defiance Association questioned the government's refusal to use a sunset clause. The association's executive director, Neil James, said it would make the laws more palatable.

Lex Lasry, QC, of the Victorian Criminal Bar Association, accused the Government of frightening the public, and "having frightened them into thinking a terrorist attack is going to happen any day, taking away some pretty fundamental rights".

Waleed Kadous from the Muslim Civil Rights Network said the announcement meant "a radical shift in the civil rights of all Australians... it will push us more towards a police state".

Some Coalition backbenchers, including Petro Georgiou and senators George Brandis and Marise Payne, complained the initiatives, which were outlined to them in a Coalition party room meeting before they were announced publicly, were "imposed" upon them without consultation. They said it was a "rorting" of the parliamentary process.

hoWARd defended the timing of his announcement. He said he wanted to announce it before he left for New York on Sunday for the UN 2005 World Summit, and it was "absurd" to suggest it was designed to deflect attention from the Telstra furore.

The alleged opposition said it would examine the proposals when more details were available. "labor supports measures which will genuinely protect Australians against the threat of terrorist attack," said labor's spokesman on homeland security, Arch Bevis.

But labor protects its cronies said the Monster.

Department of Corrective Services fails to rehabilitate offenders

NSW: Unpopular people will be forced to wear tracking devices at a cost of $5,000 dollars per unit because the NSW Department of Corrective Services failed to rehabilitate those offenders at a cost of $65,000 a year while they were held in custody for many years.

Labelled most unpopular they will wear a tracking device to prevent them from entering 'prohibited zones' while released on parole.

The device uses satellite tracking to monitor 'ex'-offenders and would send a signal to 'police and parole officers' if the 'ex-offenders moved into designated exclusion zones or removed the bracelet.

The 'ex' offenders would be required to wear an electronic strap around their ankle or wrist and carry a box unit about the size of a large mobile phone.

The Fascist State Government is trialling the devices and has bought three units for $5000 each.

'Ex' offenders will wear them as part of their parole conditions - set by the new 'Parole Police Board'.

GKCNN reports: Dictator Bob Carr should have said..

The Parole Police Board would be able to order unpopular people to wear electronic bracelets or anklets and carry so-called STAR Unit!

The satellite technology would be used to track the 'ex'-offenders to within five metres of their location.

Closely tracking the movements of the 'ex'-offender, effectively trapping the - ex-offender in an electronic bubble, Carr should have said... at a press conference today.

It's easy to sell the gadget if they are hated more - they are offenders that need to be tracked but not people who've served their sentence and should have received education and programs.

This is a dictator's device and will be widely used for unpopular people down the track. We must protect all citizens from draconian electronic surveillance at all material times, no matter how unpopular our 'Politicians' regard these people, from all walks of life.

But this is a failure by the NSW Department of Corrective Services to rehabilitate offenders at $65,000 dollars per year.

Why should taxpayers pay an additional $5,000 per 'ex'-offender after their release on security of all things, not housing or a job, all because DCS failed over many years to rehabilitate them? That can only lead them straight back to prison!

An Alarm Should Sound in the Community!

Carr said an alarm would sound if and 'offender' approached an area they are banned from such as a school, child-care centre or victim's home.

Carr the dictator said the alarm would also sound if the offenders did not carry the STAR unit or tried to remove the anklet or bracelet.

But can you imagine being accidentally in the wrong place? And this alarm going off? That's just madness and could cause an alarm and affront, a heart attack or even a serious accident.

Injustice Minister John Hatzistergos would not speculate on how many people might be fitted with the devices? But he should have said it was a matter for the new Parole Police Board.

NSW Opposition spokesman on justice Andrew Tink wanted to say something but Tink you Stink and so does the Neo-Liberals, right around the county, we may as well vote for the Natzi party.

This [technology] encourages the failure of the Department of Corrective Services and hinges on the views of the new Parole Police Board.

Why We Oppose Home Detention

The recidivism rate for sex offenders is about a quarter the general offender recidivism rate.

The majority of sex offenders are never reported, convicted or imprisoned anyway.

So, overall, the best policy might be to do the same with the small proportion of identified sex offenders as we do with the majority of those who aren't identified.

Just leave them alone. Or, you could try restorative justice programs that encourage them to admit the injury, trauma and damage they cause, undertake to identify and change the behaviour that led to the offence (e.g. alcohol use, misogynist attitudes, etc) and negotiate some form of restitution - either directly to their victim (who is probably a partner, [former] friend or family member) or to the community they come from.

But that wouldn't be anywhere near harsh enough for the law and order freaks now would it?

Better to inflict some horrendous punishment and permanent stigma that may turn the offender into a violent sociopath whose next offence will be far worse than the one they were originally convicted of.

The exercise yards in all units in B Block are now closed in with extra cladding to all external surfaces. No direct sunlight ever comes into the exercise yards at any time of the day. Block walling surround more than three-quarters of the yard. A portion of one wall is covered in with compressed steel mesh with small holes, plus another mesh fence being the original fence. No fresh air comes into these yards because of the mesh and the fact that there is no cross ventilation for air to pass through the yard. The roofing of all unit exercise yards in B Block have been covered in stopping any sunlight. In the summer months, heat generated from the tin roofing over the exercise yards makes the yard so hot, normal use is avoided.

After Mr. Cooper was severally embarrassed by the Abbott and Co escape on 4th November 1997, he visited B Block and the surrounding grounds.
