$145,000 for false arrest in NSW

When the high-profile lawyer Adam Houda was arrested for assaulting a policeman and dragged out of a court he declared: "This is shit, this is shit... he pushed me first."

Five years on, Mr Houda left the NSW Supreme Court with a payout of $145,000, plus interest.

The lawyer - who has represented almost all Sydney's high-profile accused [alleged] terrorists, [scapegoats for the Coalition of the Killings resource wars in the Middle East] including Mamdouh Habib - who was kidnapped and tortured and who successfully sued the state for wrongful arrest, malicious prosecution and false imprisonment.

Witnesses to the tussle had heard insults fly - "deadset dickhead", "idiot", even "pork chop", which one officer apparently called the Muslim lawyer.

Before arresting him for assault, Constable Lance Stebbing had told Mr Houda to "f--- off" in the corridors of Burwood Local Court in 2000. The assault charge was withdrawn and dismissed six months later.

Yesterday Acting Justice Harvey Cooper said in his judgement: "Constable Stebbing well knew that that offence had not been committed and that he was motivated to do so solely out of spite or ill will towards the plaintiff because the plaintiff had stood up to his unjustified, menacing and rude conduct."

The argument began after Constable Stebbing interrupted a conversation between Mr Houda and a police officer and told him to treat her "with respect". Mr Houda told him to "please mind your own business".

"I am comfortably satisfied that Constable Stebbing was enraged that the plaintiff told him to mind his own business and, instead of ending the interlude, he told the plaintiff to f--- off," Acting Justice Cooper said.

Constable Stebbing shoved him repeatedly in the chest, demanding he "get out of my personal space". Mr Houda replied: "Where do you want me to go, you idiot?"

"By this stage the plaintiff, with every justification, thought that Constable Stebbing was crazy," Acting Justice Cooper said.

Mr Houda held his palm up in front of his chest and the officer walked into it, then arrested him.

The judge said the evidence of several police witnesses was "seriously diminished" because they had referred to Constable Stebbing's statement in their own.

Mr Houda was taken to the nearby police station, where one officer allegedly told him: "You are a prisoner now, pork chop."

Outside court yesterday Mr Houda said: "The police abused their powers on the day and brought thuggery to the court and I stood up for my rights."

Garry Nye died prematurely (not quite 52) but in the knowledge that he'd "got the bastards back".

On July 24 1991, in a massive operation that traumatised his children and destroyed his house, NSW police arrested him for the murder of criminal Ray Thurgar, using a discredited informer's flimsy evidence.

At his arrest, his first words were "Who the f. is Ray Thurgar?" Lying face down in handcuffs, he vowed "to get the bastards back". The DPP took him to court - and lost, but he had to spend 16 life, threatening months in jail on remand awaiting trial, and acquittal. Justice Wood called the police case "a load of rubbish". Nye had been framed by the Crown.

A decade later, at times fearing for his life and now separated from his de facto wife, Kerrie, his family in tatters, his life in ruins, he took the DPP and several officers to court for wrongful arrest and malicious prosecution, and on December 16, 2003, he won. Justice O'Keefe awarded a stinging and historic $750,000 in exemplary/punitive damages alone ($1.335 million in all), against the DPP and two of the police officers.

But for Nye, this case was never about the money. He didn't even stay in court to hear the arguments about the amounts. It was about setting the full record straight, and what Justice O'Keefe referred to as a judgement "to sting the defendants".

It was about how certain police and Crown prosecutors were able to falsely accuse an innocent man with a murder charge they knew to be a lie. He wanted that on the public record, a warning to society and as a deterrent.

As he lay dying of asbestos-induced lung cancer in February 2004, two months after the civil trial, the DPP lodged an appeal, to be heard in April 2004.

Garry Nye had a difficult start. His mother divorced Ray Van Heythusen when Garry was five, and Alec Nye moved in to the household, a powerfully built man with a mining background.

(Nye took on his name later in life partly to camouflage his prison record.) Garry Nye's troubled childhood was complicated by this difficult and unpredictable stepfather who Nye claims beat him, and other members of the family, except his daughters:

"He used to belt me on a regular basis with an ironing cord and razor strap." Nye ran away from home several times and the family moved so often he attended over 14 schools, as did his brothers and sisters. (His sisters Denise, Deborah, Lynda and Leann were the biological children of his mother and stepfather, while Colleen, and his brothers Wayne and Terry were Van Heythusen's biological children.)

Always short of food and money, the family moved frequently to avoid back rent, and at one stage spent 16 months pea picking, living in a tent. At 15, Nye was sent to a boys home at Windsor, labelled uncontrollable. Shortly after his release 16 months later, in October 1969, his much loved mother Doreen, died of lung cancer; she was just 36 and had suffered for several years. Devastated and with nothing to keep him there, Nye finally left home for good.

He lived briefly in Neutral Bay with his biological father, but at 18 moved to Kings Cross and fell in with a crowd that led him into petty crime; car stealing and driving offences. He was fined and given a good behaviour bond.

Then one of the group came up with what Nye has since sarcastically called "the brilliant idea" to rob a school, which led to his 1971 arrest. He was 19. Nye was to serve 10 years for the robbery, with a 2.5 year minimum; the judge recommended a low security prison farm. But Nye claims one of the wardens with whom he had differences while in remand had arranged that he be sent to the maximum security Bathurst. He arrived at Bathurst in 1973 on July 24.

Garry Nye was there when a desperate inmate, [prisoner], threw the first molotov cocktail in the Bathurst Jail riots of February 1974. He became the first witness to give evidence against 10 prison officers and a prison doctor concerning the systematic illegal bashings of prisoners, triggering a chain reaction leading to the Nagle Royal Commission into NSW Prisons and the subsequent end to such institutionalised bashings.

To those like Brett Collins of Justice Action who know first hand the circumstances at Bathurst at the time, Nye was "a warrior," a defiant and determined man who would not accept the brutal system and other human rights abuses that were ingrained in the NSW prison system.

A symposium at NSW Parliament House on February 25, 2004, organised by the University of NSW Faculty of Law, explored what if any progress has been made in the 25 years since the Royal Commission.

The Honourable John Nagle was present, and Garry Nye was invited as a special guest, but was too ill to attend. Professor David Brown from the UNSW said there was a direct line from the Bathurst Riots to the Nagle report and then to the cessation of systematic and institutionalised bashings of prisoners.

After his eventual release from jail in 1978, Nye began to put his life together. He soon met Kerrie and her three sons, Dylan, Adam, Corey and they had a son together, Joel; life was good and Nye was intent on giving his family (adopted or not) the opposite experience to what he had endured as a kid; the boys all had the best clothes, a safe, second hand car for their 17th birthday, plenty of affection, and Kerrie got flowers or chocolates every week. He was certainly no angel, but he protected and provided for his family.

He loved hunting and fishing, and to supplement his blue collar jobs, he did a fair bit of dealing in hash.

Until that day, July 24, 1991, 18 years to the day after his arrival at Bathurst jail, when Nye was arrested in one of the most nefarious actions ever taken by police in the name of the people of NSW.

He was buried next to his mother's grave at Rooty Hill on March 6, 2004, her birthday.

Is Prison Obsolete?

This letter is to request permission for an independent inspection team to examine the 75-cell HRMU at Goulburn Jail. The proposed inspection team consists of specialist doctors, jurists, members of the Corrections Health Service Consumer Council and prisoners representatives.

The Criminal Law (Rehabilitation of Offenders) Act 1986 (Qld), requires that any person who has committed an offence which is less than 10 years old or which resulted in a prison sentence of more than 30 months, must disclose that offence if requested eg. for employment purposes. If a criminal record is disclosed in a job application, it is unlikely that person will be given the job.

NSW Serious Offenders Review Council
In response to a letter we have received from Mr K C who has said that he is serving 24 years and 10 months commencing on 29/8/1991 with his earliest release date being 28/6/2016 with 4 years parole and full time 28/6/2020. He said that he contacted the Serious Offenders Review Council in writing but received no response.

Australia: Private Prisons, Junee NSW
When I got to Junee I was given nothing except bed linen. That's it! No clothing. I had to put my name down for clothing, which they said I could get on Saturday. When I went down to get my clothing on Saturday I was told they had nothing but I was told that I could buy what I wanted on their monthly buy-up. In the mean time I got rashes between my legs from the dirty clothes I had on.

Inspector General Ignored On Womens Prison

I needed to verify the call and asked for a name or number to register my call because I was asked to get those details by my coordinator.The person refused to identify themselves either by name or number. Prisoners and those concerned about prisoner issues have very few sources of information.

Les Kennedy Daily Telegraph reported today that" Prisoners who believe that DNA will prove they were wrongly convicted will have the chance to prove their innocence for a mere $20 administration fee. The move comes 20 months after NSW inmates were asked to provide DNA for comparison with a databank of DNA from unsolved crime scenes for possible convictions.
