ASIO fishing expedition makes arrests

There have been a series of counter-terrorism raids in New South Wales and Victoria.

New South Wales Police Commissioner Moroney says more than 400 police officers have been involved in raids on 15 homes in south-western Sydney. [Fishing Expeditions.]

He says they have arrested six men alleged to be planning a terrorist attack in Australia. [He means 'scapegoats' to bolster support and to quell dissent for the Coalition of the Killings resource wars in the Middle East.]

Moroney: "They're currently being interviewed by police and my expectation is that they will appear in Sydney courts this morning," he said.

So what is to show for it? Based on what evidence? I know, it's a secret!

Nine arrests have been made in raids in Melbourne.

Commissioner Moroney says a terrorist attack has been foiled. [Rubbish from a liar, that's not what we payed him for!]

[Moron] "I am satisfied that we have disrupted what I would regard as the final stages of a terrorist attack or the launch of a terrorist attack in Australia," he said.

Indonesian Police Set Free After Torturing West Papuan Students to Death

If you thought Schapelle Corby got a raw deal from the Indonesian justice system, spare a thought for the West Papuan students who survived a vicious attack by police as they slept in their dormitories in Abepura, West Papua, in the early hours of 7 December 2000.

After nearly five years of waiting for the case to conclude, the students were in a Makassar court last week to hear judges hand down a "not guilty" verdict to two police officers accused of perpetrating the violence.

One West Papuan student was killed in the raid, two others later died as a result of beatings while in police custody, and over a hundred others were harassed or tortured in the attack. The case is the first to come before the Human Rights Court newly established under Law 26/2000, which, as an initiative was widely viewed as a positive step toward addressing Indonesia's appalling record on human rights.

However, the verdict sends an ominous message not only to West Papuans, but to all Indonesians, that Indonesia's legal system cannot be depended on to deliver justice, and is a reminder of the ongoing impunity of Indonesia's security forces.

Shortly after 1am on 7 December 2000 a group of unidentified persons attacked the Abepura police station. A policeman, Petrus Eppa, was killed in the melee. In a separate attack on the Autonomy Office in Abepura, a security officer, Markus Padama, was killed. Around 2:30am then police chief Daud Sihombing and then police superintendent Johny Wailan Usman ordered that the attackers be "hunted down".

The police launched a retaliatory attack against a group of mainly highland students who, according to subsequent investigations by a number of high profile legal aid and human rights associations, had nothing to do with either the attack on the police station or the attack on the Autonomy Office.

Over the following twenty-four hours, Brimob (Indonesia's mobile paramilitary police brigade) raided a series of nearby West Papuan student dormitories. Ninmin Hostel was the immediate target. The BTN Puskopad Abepura housing complex home to residents from Kotalima, Mamberano and West Wamena the Yapen Waropen hostel, and the Illaga University Students hostel, were also targeted by police.

One student, Elkius Suhuniap (male, 23-years-old) was fatally shot by police during the raids. Over a hundred others, including pregnant women and children, were rounded up by police and taken into police custody where they were systematically beaten, tortured and taunted with racist remarks.

One West Papuan student recalled the police beating him and spitting on him, saying "your mother eats pig and you have the brain of a pig " even with your college degree you won't get a job " You Papuans are stupid; stupid and yet you think you can be independent."

Two students, Ori Ndoronggi (male, 19-years-old) and Johny Karunggu (male, 20), died in police custody as a result of injuries sustained during torture. Another student, Agus Kabak (male, 19) was permanently incapacitated while a fourth student, Arnold Mundo Soklayo (male, 32), was crippled and later died in Jayapura as result of his injuries.

The students were tortured and beaten to death in the presence of Swiss journalist, Oswald Iten who had been arrested and detained previously for photographing an independence demonstration. The police told Iten that such violence was "normal" when a policeman had been killed.

Iten later wrote: "What I saw was unspeakably shocking. About half a dozen policemen were swinging their clubs at bodies lying on the floor and, oddly enough, they did not cry out; at most soft groans issued from them. After a few long seconds a guard saw me looking and struck his club against the bars of the cell block door.

I quickly went back to my usual spot, from where I could still see the clubs, staff and split bamboo whips at their work. Their ends were smeared with blood and blood sprayed the walls all the way up to the ceilings. Sometimes I saw the policemen hopping on the benches, continuing to strike blows from there or jumping back down on the bodies below."

Indonesia's national human rights commission, Komnas HAM, conducted an independent investigation into the attack. Twenty-five suspects were identified by the commission but only two were ultimately ordered to face trial by the Attorney General's Office. The Office gave no explanation why the remainder of suspects escaped prosecution. The two accused, however, were not arrested, and not only were they allowed to remain in their jobs, they were actually promoted. The Attorney General's Office obstructed investigations by the survivors legal team, and delayed the case well beyond the time limit stipulated by Law 26/2000 on Human Rights Courts.

When the court handed down their verdict last week, the survivors and their families broke into hysterics. One woman climbed onto a chair and yelled in disbelief that the judges had been unfair. In contrast, the group of Brimob soldiers who packed the courtroom cheered and started singing the Brimob anthem. Prominent Human rights defender, Todung Mulya Lubis, who is based in Jakarta, says the verdict will only add to Papuans feelings of alienation from the Unitary Republic of Indonesia.

Inside the court, representatives of Peace Brigades International accompanied the survivors, their families and friends, many of whom had received threatening phone calls and text messages or had been intimidated 'by persons unknown' in the lead up to the trial. Indonesian human rights advocates say they have been told by insiders that the judges involved in the case had been pressured by the authorities to deliver a not guilty verdict, and to refuse compensation to the survivors and their families. Also witnessing the proceedings were representatives of the European Union and the New Zealand and Canadian governments. No one from the Australian embassy was present.

Br. Budi Hernawan from the Catholic Office of Justice and Peace in Jaypura says "the Abepura verdict shows that human rights violations in West Papua are not taken seriously by the central government. The verdict demonstrates that there is no political will to deliver justice to the West Papuan people. The state is not even willing to protect the right to life for West Papuans."

The verdict was handed down just weeks after the Centre for Peace and Conflict Studies at Sydney University released a report on the human rights situation in West Papua entitled Genocide in West Papua? The role of the Indonesian Security Services Apparatus.

The report, which took four years to compile, details a systemic policy of human rights violations of West Papuans, including the burning of entire villages, extrajudicial killings, rape, and torture at the hand of the Indonesian security forces. Both the Indonesian and Howard government questioned the veracity of the findings.

Democrats Senator Natasha Stott Despoja spoke to the Genocide in West Papua? Report in parliament, urging the Australian government to pursue a relationship with Indonesia that is based on being honest and open, on having a mutual respect for human rights and on recognising dignity and the importance of human life. Senator Stott Despoja also called on the Australian government to revisit our role in the internationally discredited 1969 Act of Free Choice under which Indonesia seized control of West Papua. Greens Senator Bob Brown then put forward a motion that notes the release of the report and calls on the Australian Government to investigate the claims in the report and report back to the Senate. Senator Brown's motion was opposed by Labor.

In recent years human rights violations in West Papua have steadily worsened. Jakarta's inconsistent policies, military operations,unwillingness to fully implement Special Autonomy legislations for the province, moves to partition the province into two, and lack of political will to address the core causes of the conflict, have all made matters worse. Jakarta now plans to send military forces withdrawn from Aceh to West Papua, where a new military command will be established.

The increase in troop numbers shows the central government's fear of the nonviolent movement that is challenging Jakarta's legitimacy and whose grievances are beginning to capture the attention of a growing transnational moral community.

The brutality of the Abepura case illustrates the gravity of the dire human rights situation in West Papua. Last week's verdict will only fuel West Papuan nationalism and strengthen West Papuans determination to be free from what is widely considered by West Papuans to be an illegal and illegitimate colonial occupation by Indonesia.

It's not hard to understand why. And Jakarta only has itself to blame.

Indonesia: Do you even think of us Papuans as human beings?

Have you seen photos of the bruised and battered faces of my people, kicked and beaten by Indonesian Police in their student hostel in Abepura in December 2000? I didn't just see photos.

I saw some of my brothers and sisters with my own eyes. Their faces were so mangled I could hardly recognise them. I saw their blood mixed with their tears. I also spent time with the families crying for their loved ones murdered by the Police on that horrible day.

Now Indonesia has added yet another injustice and insult to my people. Over the past few days we Papuans have heard that Indonesia's so-called justice system has acquitted the two senior Indonesian police officers responsible for the Abepura massacre because the brutal killing of three unarmed Papuans (two while already in police custody) and the cruel beating of at least 99 other innocent Papuan students do not meet the necessary criteria for "gross human rights violations".

Amnesty International has issued this strong condemnation, which the world's democracies must listen to:

"Today's verdict means that not a single member of Indonesia's security forces has been convicted of these horrific crimes after nearly five years of investigations and legal proceedings. The verdict also denied victims any compensation.

Despite the Indonesian government's overtures of reform and the establishment of Human Rights Courts, this verdict sends an alarming message to the victims of grave human rights abuses.

These failures to deliver justice and combat impunity illustrate both a flawed system and a lack of political will, which sets an extremely worrying precedent for other cases of grave human rights violations currently under investigation.

Today's verdict also risks giving a green light to future human rights violations by the Indonesian security forces."

When the judge announced the verdicts, my people cried with anger. At the same time, Indonesian police in the court room cheered the two criminal policemen and sang marching songs with contempt for the suffering of the Papuan people.

Surely Indonesia can never think that we Papuans will ever want to be part of Indonesia? Indonesia: Do you even think of us Papuans as human beings? We have seen during 42 years of illegal occupation that Papuan lives mean nothing to Indonesia. We know that Indonesia just wants our land, our trees, our gold and our oil but not us human beings.

We Papuans know that full independence is the only sure way to save us from Indonesian colonial greed and the annihilation of the Papuans as a people.

The name 'Abepura' should be known as the site of one of our Papuan universities, training my people for their futures in a Free West Papua, but Indonesia has made Abepura infamous around the world as a place of Indonesian state violence and contempt for the Papuan people. But Indonesia has made another big mistake. By letting these two police criminals go free, Indonesia has put into all our Papuan hearts an even greater yearning for FREEDOM.

God Bless our struggle. Papua Merdeka!

Tasmanian Legal Watchdog

To Her Majesty the Queen and Tasmania's DPP Ellis

A copy of this letter is being forwarded to Her Majesty the Queen in London, UK, via Alastair Goodlad, British High Commission in Canberra.

Copies are also being sent to the individuals and organizations.

This letter deals mainly with your own conduct and statements in the legal proceedings which have been -- and are being -- pursued against me by Tasmania's Director of Public Prosecutions Mr TJ Ellis; ostensibly 'on behalf of Her Majesty the Queen'.

Ellis is a Tasmanian-raised solicitor and former member of the Law Society of Tasmania like yourself.

I am a British subject presently residing in Tasmania. I do not believe that the Queen knows anything of Ellis's activities in Tasmania reputedly in her name; and my intention now is to provide Her Majesty with complete details over the weeks to come.

This first letter focuses upon your own role in extensively assisting Ellis -- whether that be by accident or design.

1) On 1 September 2003, you sentenced me to three months imprisonment for contempt of court, on charges brought by Tasmania's DDP Ellis ' on behalf of Her Majesty the Queen'.

2) You suspended that sentence for three years on the proviso that I ceased making allegations about Ellis and certain of his Law Society cohorts. However you imposed no restriction on Ellis, who continued his campaign of psychopathic harassment.

3) In February this year, Ellis launched three new --and 'separate' -- actions against me within a two week, period; each reputedly 'on behalf of Her Majesty the Queen'.

4) The first action was seeking my imprisonment for alleged breach of your suspended sentence In September 2003 -- with which demand you obliged him ( I was released from Tasmania's infamous maximum-security prison a few days ago).

5. The second action was seeking another trial and imprisonment for what he and or you called 'fresh' allegations (thus before you jailed me for the first breach on 22 March this year, he was already arranging for you to jail me for a 'fresh' breach when I was released!)

6) You appeared - to me - to throw yourself most enthusiastically into meeting Ellis's demands; which may be exemplified by your unconventional comments to be quoted from transcripts, below.

7) Ellis's third plan 'on behalf of Her Majesty the Queen' was to sue me for criminal defamation for Mr William Cox, Tasmania's former Chief Justice - now Governor.

(Another judge, Mr Crawford, explained at an earlier hearing that if Mr Cox sued me himself, in a civil case, he would have to pay. But if Ellis sued me for criminal defamation, the public would have to pay?).

The result of Ellis's blitz on new actions ' on behalf of Her Majesty the Queen' in February this year were that:

a) you jailed me for three months, on 22 March

b) you began quote 'fresh' proceedings against me for contempt of court -- with the presumed intention of jailing me again -- before I got to prison the first time!

c) and in relation to the Governor Cox you said: "Where that goes, how long it takes and where it travels is a matter for the DPP's office and you."

8) To begin the 'fresh' proceedings for Ellis it was necessary -- you decided -- to bring me in handcuffs from jail on two occasions, to expedite the case for your former Law Society colleague.

9) As the transcripts of the three hearings, on 22 March ( the day you jailed me) then 4 May followed by 15 June, total more than 150 pages, this letter does not attempt to do any more than sketch-in the 'flavour' of your comments during those hearings.

10) Example -- in discussing 'convenient dates' for Ellis to have me brought back to court, handcuffed, from prison, you said to him on one occasion (transcript 4 May 2005, page 36, para 40):

Slicer (sniggering): " It gives him a day out".

11) My main concerns regarding my forced appearances in court from jail, were expressed at the hearings as follows:

a) there were NO FACILITIES in Risdon prison (word processors, copiers, etc) for preparing legal documents -- which you told me to, quote "Write them - by hand".

b) The Legal Aid Commission of Tasmania had refused to provide assistance 'unless I pleaded guilty'.

c) You were determined to push ahead with the case for Ellis -- whether I had a lawyer or not..

12) At the hearing on 4 May (transcript page 4 of 38) you said to the Legal Aid representative, Ms Mainwaring:

Slicer: Your answer is that at this stage the Legal Aid commission will not provide assistance to him?"

Mainwaring: "That's correct. At this stage' adding, "unless he pleads guilty."

13) Substantial segments of the first two hearings were devoted to my asking you to clarify whether the proceedings being brought by Ellis were civil or criminal?

Your long and evasive answers mostly created more confusion than clarification e.g (transcript 4 May 2005, page 33 of 38, para 35):

Slicer: 'Well, it sort of IS -- and sort of isn't. You don't get a jury."

14) After further attempts by me to make sense from your replies you told me (transcripts page 33, para 45) referring to Ellis's 'fresh' charges:

"At the end of the line, this one COULD be a gaol sentence. So when I say it's not criminal, it's sort of kind of like it isn't -- but it's sort of kind of like it IS, okay?"

15) During the 4 May 2005 hearing I also said to you (transcript page 13, para 30): "the big question is this, Sir. The documents which Ellis served on me" (prior to my being jailed on 22 March) "were headed Criminal Code?"

Slicer: " I can tell you about that. In terms of the Criminal Code, if I take evidence on oath and you admit that you WROTE them, your answer can be used in civil proceedings."

"But I'm also empowered to give you a CERTIFICATE -- so they can't be used against you in criminal proceedings. We solve the problem here -- and protect you somewhere else."

16) On the basis of your explanation regarding quote 'protection' at the hearing on 4 May 2005, I then told you which documents I had written.

However when I reminded you of your explanation regarding certificates at the following hearing, you replied (transcript 15 June 2005, page 5, para 10)

Slicer: "No -- you said you didn't want them. Didn't need them."

Trustrum: "Well, if I gave that impression I misled you sir. Because I wouldn't have made those admissions without them."

17) In response to your insistence that I defend myself without legal aid or advice, I several times asked, you during the three hearings while I was in prison what was your reason for all the haste -- and one of your typical replies was (transcript 15 June 2005, page 10, para 30).

Slicer: "Okay. Then let me cut to the chase. When are you due out?"

Trustrum: "Next Tuesday."

Slicer: "I don't HAVE to let you out. But what I don't want to happen is that this thing just wanders and meanders along -- and goes here, there and everywhere -- so that we're still having this discussion in six months."

18) Therefore despite your efforts to fog the real nature of the charges and to force me to answer Ellis's allegations without legal representation (while I was still in JAIL) the real situation was:

Slicer: "At the end of the line, this one COULD be a jail sentence". (Transcript 4 May 2005, page 33, para 45)

19) For these reasons I am completely satisfied that Her Majesty the Queen will now wish to know what is being done by judges and officers of the court in distant Tasmania -- 'on her behalf; where there is unlimited money to 'hunt down' critics of its justice system; but no money at all to legally represent them (unless they plead guilty)!

20) I remind you (though you much prefer to forget it) that these entire hostilities began -- and the Legal Watchdog was established -- in 2001, after Tasmania's DPP Ellis had me arrested and committed for trial for allegedly stalking Devonport solicitor Mr Leon Wootton of the law-firm Levis Stace & Cooper.

( I had paid Wootton $26, 000 deposit on a property, but he never completed the conveyance).

21) It was later discovered that the police officer DPP Ellis had used to ransack my home for Levis Stace & Cooper documents and arrest me, was a new detective-constable, Michael Aaron Ashwood.

22) Ashwood had just joined Tasmania Police, after resigning his job as a solicitor and member of the Law Society of Tasmania because the law-firm he had been working for was under investigation for robbing clients of about $4-million.

23) That firm was Levis Stace & Cooper.

24) Ellis's charges against me were obviously fraudulent and he dropped the case some months later, without explanation.

25) I noted that while you sentenced me to three months in Tasmania's Maximum Security jail, the Levis Stace & Cooper partner who robbed clients of $4-Million was relaxing at the 'farm' without bars, at New Norfolk.

That is why Her Majesty the Queen needs to know what Tasmania's DPP has been doing -- ' on her behalf'.

THE AGE: Scutt fires farewell salvo

Barrister and author Dr Jocelynne A Scutt has ended a troubled term as Tasmania's first anti-discrimination commissioner with a sweeping rebuke the state's legal institutions.

Not even the state's Supreme Court escaped the broadside that extended to lawyers, TJ Ellis the Director of Public Prosecutions, the Ombudsman and the Justice department.

Dr Scutt said that attempts were made to destablise her office right from the start and she had been bullied and coerced. Support in the job was denied her, as was natural justice and duty of care.

She had considered instituting proceedings for defamation, false imprisonment, abuse of process, contempt of court and victimisation -- but she said such steps would have required confidence in Tasmania's justice system.

In her dealings with Tasmania's Supreme Court, she said she had been denied procedural fairness. 'In my extensive experience, I have never encountered such an approach, outside Tasmania".

She said that only in Tasmania could DPP Ellis also act as a solicitor in civil matters; meaning he could appear in anti-discrimination cases.

She said a number of Tasmanian lawyers habitually used abusive and unprofessional language when talking to her and her staff. One member of the Law Society of Tasmania sent her correspondence containing pornography and a death threat. She had to obtain police protection.

Nick Papps not guilty but far from innocent?

Nick Papps may be a free man but he's still a superstar molester...

Jermaine Jackson: "We always felt he was 1000 per cent innocent." "It takes one person to tell the truth, but it takes many to concoct a lie."


That was the stunning admission from one of the fans just the next day after Jackson was acquitted yesterday and went home to Neverland for some peace and quiet away from that mongrel want-to-be journalist at the Daily Telegraph. Rough, Ruff.

The journalist wrote an article this morning claiming amongst other things "Michael Jackson was found not guilty, but far from innocent".

Well is he drunk as skunk on alcohol? Drugged up to the max on cocaine? Super bias? Or just plain deluded beyond belief?

There has got to be some reason why Papps is in contempt of the community and still gets paid by the right wing media corporation to do the devils work.

But as he grovelled with the decision, the jurors went on TV to talk about how they came to their decisions.

'And that evidence made us come back to the same thing: it just wasn't enough.'

Jurors in US criminal cases are required to find that a defendant is guilty "beyond a reasonable doubt," a standard that Sundown's team failed to meet despite an exhaustive search of Jackson's sprawling Neverland estate and prosecution victories on every key ruling by the judge

'We had to look at him like any other individual, not a celebrity'".

The jurors made it clear that they did not like or trust the accuser's mother and suspected that she could be behind the charges.

"I disliked it intensely when she snapped her fingers at us," said a 79-year-old grandmother on the jury. "I thought, 'Don't snap your fingers at me, lady.'"

Legal experts say another critical flaw in the prosecution case was the timeline.

The boy said he was molested by Jackson weeks after the broadcast of a documentary about the singer that touched off a worldwide furor over his practice of sleeping with young boys. Jurors found that claim difficult to accept.

The jurors' comments followed a dramatic day in court where Jackson was emphatically found not guilty of 10 charges that could have sent him to jail for 20 years.

Michael Jackson fans said Nick Papps, has been proven "beyond a reasonable doubt" that he's a superstar molester, taking into evidence his article this morning in the Daily Terror.

But the reason he won't be found guilty of contempt of the community is because there is no one policing the corporate media.

"Have police the means to prosecute them?"

"Have you been a victim of newspaper abuse?"


Jackson appeared relieved as the verdicts were announced yesterday, wiping tears from his eyes and hugging his mother.

Moments later a feeble looking, emotionally drained Jackson was whisked from the court after giving a weak wave to the dozens of fans screaming for him outside the court.

"Justice has been done," Jackson's lawyer Tom Mesereau declared just minutes after the verdict was read.

Jackson himself was saying nothing last night, leaving it to his brother Jermaine to declare the Jackson family was "very, very happy".

"We always felt he was 1000 per cent innocent," he said.

As Jackson bunkered down in Neverland, famous friends like Elizabeth Taylor came out in support of the 46-year-old father of three.

"Thank God Michael is vindicated for all time. Now maybe people will leave him alone," Taylor said.

Jackson's former wife and the surrogate mother of two of his children, Debbie Rowe praised the court decision declaring: "I would never have married a paedophile. And the system works."

Super losers

Disappointed prosecutor Tom Sneddon, who tried unsuccessfully to prosecute Jackson but said he would not just move on to other cases.

Disappointed want-to-be journalist Nick Papps from the Daily Terror a fascist, religious pro government right wing tabloid, also tried unsuccessfully to prosecute Jackson, and Jackson's fans believe Papps could possibly be suffering from delusions of grander and they have suggested he see a good therapist.

In the end, for a jury, which had to decide on guilt beyond reasonable doubt, there could only be one verdict -- not guilty.

As another jury member said: "We actually challenged one another in the deliberation room. We challenged the issues, and we came to the decision that pointed to reasonable doubt."

"We were able to deal with it as fairly as we could as with anybody else," a juror said.

Australia owes Habib nothing: Beazley?

Kim Beazley says Habib cannot claim compensation from Australia?

Federal Opposition Leader Kim Beazley says if Mamdouh Habib is entitled to any compensation for his detention and alleged torture it cannot come from the Australian Government.

But why? It is alleged the Australian government was complicit in the harassment, profiling, kidnapping and subsequent torture of Mamdouh Habib?

Mr Beazley says he did not have much sympathy for the former Guantanamo Bay detainee, who ASIO continues to label a security risk.

But why? Why wouldn't you have empathy for a person whose government colluded to torture an Australian citizen?

And for the 'alleged Opposition' to go on and nominate "ASIO" (one of the alleged perpetrators of this horrific crime) to try and justify continued harassment, not pay damages 'compensation ' and to maintain some bona fide and forthright stance when the government was in breach of the UN convention and has committed crimes is outrages.

Attorney-General Philip Ruddock concedes he cannot rule out whether Mr Habib was tortured.

But Mr Beazley has said that Mr Habib cannot claim compensation from Australia?

"Whoever he's entitled to compensation from is not the Australian taxpayer," he said.

And that's why we need as Mr Habib's lawyer Mr Stephen Hopper said on television yesterday a full Senate Inquiry.

The Australian community would like answers in relation to Mr Habib's treatment by the Australian authorities - including the harassment by ADF - profiling by ASIO - kidnapping by the US - torture by the US - complicity by the Australian Government (not to assist Mr Habib, but to confirm and comply with the US for over three years) - and the continued harassment and spin to date allowing the authorities to further pursue contemptuous allegations - in light of what is now known about Mr Habib's treatment by the Australian people.

'Argue for reverse surveillance!'

As well as that, what about the contempt by the Australian pro-Government media who continue to make false and misleading allegations against Mr Habib including training in terrorist camps and by showing film clips of these camps to prove the spin.

Also by running polls indicating Mr Habib's guilt and whether torture should be okay etc etc..

Mr Beasley would not comment on whether the United States might be liable for compensation to Mr Habib if he was tortured?

Mr Habib was kidnapped, detained, tortured and interrogated by the US and 'Australian authorities'.

He did not make any 'appointment' as it states in the English dictionary under the heading 'interview'.
