Singapore: Nguyen Tuong Van, 25, an Australian citizen of Vietnamese origin will be hanged within two weeks in Singapore after various pleas for clemency failed.

This is the end of the processes of appeals for Nguyen. The execution by hanging is expected to be carried out very soon, which is the custom in Singapore.

Nguyen is set to become the fourth Australian sentenced to death by Asian countries on drug charges. Brian Chambers and Kevin Barlow were hanged in Malaysia in 1986. Michael McAuliffe was hanged in Malaysia in 1993.

Nguyen was caught in transit at Singapore's Changi Airport in December 2002 on a flight from Cambodia to Australia. Nguyen said he had the drugs because he was trying to raise money to clear debts incurred by his twin brother in Melbourne Australia.

He was convicted on March 20, 2004 of trafficking 396 grams of heroin and sentenced to death by hanging. An appeal to the High Court on October 20, 2004 failed.

Kim Nguyen fled Vietnam alone in a boat in 1980 and gave birth to her twin sons in a transit camp in Malaysia, before the three were accepted as refugees into Australia four months later.

According to Amnesty International, Singapore executes more people per capita than any other country in the world and has the toughest drug laws. Anyone caught with 15 grams or more of heroin faces a mandatory death sentence.

ACADP is appalled and shocked by the news, and expresses deepest sympathy to Van's mother and twin brother - the innocent victims of the Singapore justice system.

" ... Because it's the law of that country and the law should apply equally to everybody. We don't believe in capital punishment in Australia. But that doesn't mean that we conduct a campaign around the world in every case to stop it occurring.

I will always argue that if an Australian has received the death penalty anywhere in the world, I will make representations to the Government of the country in which the penalty's been handed out that it not be implemented. Beyond that, I don't see it as the role of Australia to run around expending an enormous amount of energy in relation to the death penalty ... "

He now faces execution, possibly within 10 days.

Nguyen's mother fled Vietnam alone in a boat in 1980 and had her twin sons in a transit camp in Malaysia before being accepted into Australia four months later.

Nguyen's Australian lawyers described the decision as "devastating for him, his family and friends".

Lex Lasry QC said Nguyen had always admitted his guilt and given constructive help to authorities including the Australian Federal Police.

"The decision appears to pay no heed to the provisions of the Singapore Constitution that make specific reference and provide for clemency to those who assist the authorities with information which can be used to prosecute others," he said.

Mr Lasry called on the Singapore Government to reverse its decision.

Nguyen was sentenced to death last year after being found guilty by a Singapore court of smuggling almost 400 grams of heroin from Cambodia via Singapore.

Nguyen said he had the drugs because he was trying to raise money to clear debts incurred by his twin brother.

There have always been examples of rulings and interpretations that have supported the saying "The law is an ass". This is increasingly the case, because even the best intentioned judges are now facing an avalanche of new technologies and social change. But, it is no good making excuses for the judiciary and continuing to accept their strange interpretations. We must recognise that not only judges but the whole legal system will struggle more and more. In the end the whole system will become a farce. This is the way empires end.

WHAT HAPPENED TO STEPHEN?

We are not sure what happened to Stephen or how he ended up in Argentina. This is what we do know.

Stephen was working in a factory in Sydney. He met a Peruvian girl who befriended him, we think through his work. A relationship may have developed.

We then discovered that Stephen was in Peru and living with the Peruvian girl and her family. Stephen wrote to us saying that her family were being very kind and treating him well. We don't know if this was a genuine relationship or Stephen was targeted to become a drug mule.

Stephen was arrested in a hotel room, without any drugs. We think this happened in Buenos Aires although DFAT have never told the family the exact details. Stephen has always maintained he knew nothing about carrying any drugs. He says he was asked to deliver some gold.

At this stage, his life and the lives of his family in Australia had been threatened. He was obviously very scared that we were going to be harmed.

We learned Stephen was arrested in Argentina on a drugs charge through a programme on the local news. We still do not know what happened to the Peruvian girl or whether she was involved.

Stephen was convicted of drug smuggling and sentenced to 11 years in prison. There is an appeal in 6 months.

DFAT informed Stephen's family in Australia of the trial just weeks before it began. They spelt the name of the Argentinean lawyer incorrectly and gave no contact details. Because of the incorrect spelling, it took 5 days to trace the attorney. By this time, the trial had started and it was too late for the family to compile evidence for his defence.

In 2003, Stephen was surviving on one meal a day and was malnourished. He was very ill. When his original lawyer visited him, the translator was so horrified at his condition that she called a doctor. Stephen was crippled and bent double in intense pain. This was due to a back injury that had happened prior to incarceration but had been left without treatment in the prison.

6 weeks before the trial, his sister Ann wrote to DFAT to ask how Stephen was. Ann was told 'happy and okay,' but after the trial, she found out he had been hospitalised during that time with a serious chest infection.

Stephen is contactable, though it is very difficult. Contacts are available only only through an Argentinean volunteer who lives a 3 hour bus ride from the prison. She has only managed to visit once because of problems with authorisation from the Australian Consulate in Argentina.

PEACE ACTIVIST AGREES TO BE REMOVED FROM AUSTRALIA BUT CHALLENGES SECURITY REVIEW

American peace activist Scott Parkin has written to DIMIA today requesting his removal from detention and agreeing to leave Australia provided his appeal rights are preserved, according to his lawyers.

Keren Adams, from Maurice Blackburn Cashman, and Erskine Rodan, immigration lawyer, said they had been advised by DIMIA this afternoon that Scott would leave the country on Thursday.

Ms Adams said he would continue to challenge the reasons for the cancellation of his visa.

"In accordance with Scott's wishes, we have asked for Scott to be removed from the country under section 198 (1) of the Migration Act," she said this afternoon.

"At the same time, we have relodged an appeal with the Migration Review Tribunal against the cancellation of his visa. This can continue once he has left the country," she said.

Ms Adams said the letter signed by Scott was handed to a DIMIA representative today, and Scott was advised that he would stay in the Melbourne Custody Centre until his flight on Thursday.

"We are still calling for his transfer to Maribyrnong detention centre and for him to be able to call his family and friends and have visitors which is entitled to under immigration detention," she said.

Ms Adams said under the removal, Scott is liable for a debt to the Government of $125.47 a day for each day in detention, plus the cost of his airfare and the cost of two escorts who will accompany him to the U.S.

"And he won't be able to return to Australia unless the original reasons for his visa cancellation are overturned and he has repaid this debt," she said.

Ms Adams said Scott was still in the dark about the reasons for his visa cancellation, and had no contact with ASIO since his detention on Saturday.

Ms Adams said the lack of information was not acceptable.

"Scott is feeling really depressed and frustrated and has no idea why he is being held there," she said.

Mr Rodan called on the Government to release the reasons for Scott's detention.

"What's happened to young Scott is dreadful. What's happening is that a national security assessment has been made against him and any other country that he wants to visit he will not be able to visit because of this negative national security assessment.

"His opportunity for travel to other countries is no longer available to him if he is deported, and if the cancellation of his visa is not overturned.

"This young man must be transferred to an immigration detention centre. He cannot be kept in this jail, in a place where there is no natural light; he is essentially in solitary confinement. He should not be a prisoner."

"He's a very frightened young man and he should have the opportunity to be transferred immediately to the immigration detention centre at Maribyrnong at least and preferably be released into the community. This young man has done nothing and no-one has said he has done anything. Everyone seems to be hiding behind the assessment made by ASIO and no one knows what is in that assessment, not even Scott," he said.

I have made it abundantly plain in my 474 review application to the Supreme Court that the issues are a continuation of the effort which I have mounted since my conviction on 27 July 1996.

The 474D adequately lists my issue.

What I am trying to express is that the appeal process has never properly considered my appeal issue, I had before the court of Criminal appeal (The CCA), argued that a number of procedural faults had occurred in my trial that caused a substantial miscarriage of justice. In short the trial judge erred in law when he directed the jury to act upon evidence that had not been established by the crown.

There is repeated authority on that issue: That the crown is obliged to establish the circumstances he relies upon as proof of guilt and to establish that proof to beyond a reasonable doubt.

The CCA instead of addressing the substance of my argument covered up the miscarriage of justice that occurred in my trial.

The CCA instead of addressing the legitimacy of the trial judges decision "in directing the jury to act upon evidence not established by the Crown." (which was the appeal ground I raised).

The CCA evaded the real issue I put before them by introducing factors that were only marginally connected with the appeal issue and the CCA harped on that issue rather than the real point I raised. Actually I am surprised that no one in the legal profession takes any exception to the ground of appeal I raised. I have repeatedly told legal professionals what occurred and I cannot elicit any comment.

Most people appear to think once I got arrested-charged with Belanglo that alone meant I was guilty. The producer of the ABC program 'Australian Story' was awarded a logie for that particular story.

They contacted my friend before hand and he watched the show. They told me that award night the producer said on air, "There is still time Ivan to come clean about it ". Well actually I already had, before the program was aired-during its production.

I wrote a number of letters outlining my case and answers to the questions and in particular I outlined my appeal grounds and the cover up by the CCA and following that the subsequent cover up by the High Court.

In all the appeals I have made to the CCA and to the High Court on the issue I now still continue to pursue, the appeal courts do not refer to authority to address my ground.

The CCA at the hearing and in their judgement come up with a number of reasons to explain why the two crown witnesses Mr Onions ad Mrs Berry were mistaken about seeing the spare wheel.

The CCA came up with approximately six pages of reasons why the witness, Mr Onions and Mrs Berry must have been mistaken, (non of which was evidence at my trial).

But the CCA did not address my appeal ground, "that two witnesses Mr Onions and Mrs Barry gave their evidence in court on oath, that evidence confirmed in cross examination that the crown closed its case in chief and I replied to that crown case and only later after the close of evidence the crown says that witnesses must be mistaken. The trial Judge in turn, "they can correct me on the basis that the two witnesses were mistaken" or alternatively you can convict the accused on 'Possibility Two'.

The Jury were given two directions in law, on the evidence they could consider was proof of my guilt, The rule of law is that evidence has to be established by the crown. Of course the trial judge can express his opinions on the evidence but it still has to be established by the crown.

The Jury are entitled to accept/reject any part of a witnesses evidence (all those reasons the CCA raised to dismiss my ground - was not evidence the crown adduced in the course of the trial).

I was obliged to address the allegations the crown levelled at me in open court, I did that. The defence did not dispute the evidence of the vehicle given by the witnesses. The crown did, but only parts that did not establish my guilt. But that was not the evidence that the witness gave in court.

The crown did not re open its case in chief on this issue to call evidence, to rebut the evidence. It cannot be a case that the trial judge decides that this is the evidence of guilt yet that is what happened.

The CCA knew exactly what I was on about so Gleeson CJ and his Co Judges covered it up.

My appeal to the High Court was against the CCA decision the High Court ruled, "There is no doubting the correctness of the decision of the CCA".

The issue I raised in the 474D is indicative of my innocence. The issues in the 474 raises serious concerns at law. The appeal courts can deal with appeals from unrepresented prisoners affidavits.

I am having difficulty in getting assistance from the government though; I may add there is still no charges at all on issues I first raised when I came to the HRMU. [High Risk Management Unit Goulburn]

Ed. The Daily Terror should leave IVAN Milat's sister Shirley Soire alone. Deliberately using Mr John Marsden solicitor to validate some wild claim - the notion that she helped hunt and execute seven young backpackers in the Belanglo State Forest south of Sydney between 1989 and 1992, is nonsense!

Shirley died two years ago and was cremated at Sydney's Rookwood crematorium, may she rest in peace, God love her.

UK: The number of prisoners being sent back to jail after release has nearly trebled in the past five years, according to a report published today.

Most of those people returning to prison have been sent back because they have breached the conditions of their licence - which releases them into the community under the supervision of the probation service - and not because they have committed further criminal offences, the report by the Prison Reform Trust said.

The charity, which campaigns for a more humane and effective penal system, wants the probation service to increase support to prisoners on licence in order that they understand the conditions of their release.

The prison service should also always explain to prisoners why they are back in prison, so that they have time, if appropriate, to appeal the decision, the charity said.

Enver Solomon, the author of the report, Recycling Offenders Through Prison, said today: "This story isn't just about the figures but more about why these figures have gone up, why people are returned to custody and why can't they cope?"

Mr Solomon said he knew of cases where prisoners with learning difficulties had been recalled to prison after failing, as part of their license agreements, to attend probation meetings because they were unable to distinguish between Thursday and Tuesday.

He said: "These prisoners have returned to prison not because they pose a threat to public safety but because they have needs which aren't being met."

Juliet Lyon, director of the trust, said: "The current system for breach of licence and recall sets people up to fail. Arrangements designed to be tough and fair are too often turning out to be punitive and unjust."

The number of prisoners recalled to custody for breaching their licence in 2000-2001 was 2,333, according to official figures from the Home Office. By 2003-4, that figure had soared to 8,103 - an increase of 247%.

The report revealed that in a three-month period at the end of last year, 8% of offenders on parole who had been sentenced to more than four years' imprisonment were sent back to prison for committing another criminal offence.

But for prisoners who had served shorter sentences, between 12 months and four years, the number being recalled for re-offending rose to 40%. However, the report said, reconviction rates for people serving shorter sentences were traditionally higher.

The Home Office said the increase in the number of prisoners released on license being recalled to jail reflected improved performance by the probation service.

A spokeswoman said: "The increase in recall of prisoners reflects our overriding concern to protect the public from further offending and sends a clear signal that we will not tolerate poor behaviour from those offenders serving a sentence in the community."

The report comes as the prison population in England and Wales has reached a record high of 75,877, an increase of 25,000 prisoners over the last decade.

Harry Fletcher, assistant general secretary of the National Association of Probation Officers, said the increase in the number of released prisoners returning to prison was due to Home Office targets introduced five years ago.

He said: "The Home Office set rigorous enforcement targets for prisoners so that anybody who failed to turn up for three appointments with their probation officer while on licence was automatically returned to prison. Our professional discretion was taken away. "The government has to decide whether it wants to continue to go down the path of punishment and enforcement or reintroduce professional discretion, rehabilitation and reform."

AUSTRALIA: QLD: In the Supreme Court in Bundaberg last October, Ian Douglas Previte, 32, was jailed for life after being convicted of the murder and robbery of Caroline Stuttle, 19.

Mr Previte lodged the application in the Court of Appeal in Brisbane on the grounds that the trial judge erred by allowing evidence from a handwriting expert and two other witnesses to be admitted during the trial last year but has had his appeal against conviction dismissed?

The original trial was told she had been thrown from the Burnett Bridge during a struggle for her handbag in Bundaberg, 350km north of Brisbane, on April 10, 2002.

Previte appealed on several grounds, including that Justice Peter Dutney had been wrong to admit evidence of handwriting experts and taped confessions and the convictions were unsafe and unsatisfactory.

But after considering submissions, three Supreme Court justices found the jury verdict was safe and dismissed Previte's appeal?

Mr Previte is serving life in prison.

Experts gave evidence at the trial on whether a confession found on a wooden bench in a Bundaberg park was written by Previte. The confession read: "I Throw The Girl of the Brige I am sorry" (sic)? [Rubbish!]

Some letters written by Previte to his family were used in comparison tests. In one letter, Previte admitted "knowing someone in every jail in Queensland" and in another he vented his anger against a family member? [They had him in custody and chose to exploit his communication to attain some alleged confession planted on a wooden bench.]

Justice Cate Holmes said she had concerns about the letters when there appeared to have been "abundant" other material for tests?

"It may not loom so large here but it is not an attractive approach," she said.

[To exploit any prisoner in custody like that is not justice it is a blatant frame-up by the ruling class.]

Justice Holmes said for her part the letters couldn't be described as anything but prejudicial, however, there did not appear to have been any objections to them going into evidence at the trial?

Mr Hunter said the prejudice of the letters' contents far outweighed their probative value, and a direction should have been given on the use the jury could make of them.

Mr Hunter said there were discrepancies in the evidence which meant Previte's [alleged] confessions to a fellow prisoner, and later police, should not have been admitted into evidence????

Director of Public Prosecutions Leanne Clare said the unsafe and unsatisfactory ground came down to the reliability of Previte's police interview????????

"There is no evidence as to why he would have made a false confession," she said?

[Oh yes there is, try a bent country, corporations, corporate media, the billion dollar tourist industry, bent police and a ruling class that doesn't give a rats arse about its citizenry or the truth, accept for maintaining 'tourism dollars' at the expense of natural justice. And he's not the only one whose been set-up in this way.]
