Lawyers urge open reporting of terrorism cases

As the first allegations against one of Sydney's terrorism suspects [scapegoats to bolster the Coalition of the Killings resource wars in the Middle East] are to be made public this morning, lawyers warn proceedings against those arrested in last week's raids must remain open to keep authorities accountable.[?]

Justice Marcus Einfeld of the Supreme Court 'warned' secret hearings or evidence would result in an unsavoury Guantanamo-style legal system under which there were no checks on the power of authorities.

Michael Slattery, QC, the president of the NSW Bar Association, said terrorism suspects needed to be treated "with exactly the same fairness and openness that our criminal justice system affords to all defendants". [Even more so considering they're being used by the government.]

The comments come after the Commonwealth Director of Public Prosecutions on Friday stopped a local court giving reporters access to a court document outlining the allegations against Bosnian-born Mirsad Mulahalilovic, the first of the suspects to apply for bail.

The DPP was to seek an extension of the suppression, valid until 9.30am today, but has apparently decided not to do so. The magistrate, Allan Moore, denied the bail application.

Justice Einfeld said: "The world must not allow the Guantanamo situation to exist. It's a wholly unhealthy, unnecessary and unsavoury element being brought into the common law in the West."

He warned proposed new laws should "not extend those powers into more hands than necessary and more circumstances than necessary .... It would be wrong if that meant that the media cannot act as a mechanism for checking on administrative and executive power .... The record of security forces and police in this regard is not particularly good."

Mr Slattery said making allegations public allowed media scrutiny and strengthened the confidence of the community, and of those accused, in the court processes. "Only in very exceptional cases some non-publication might be justified on national security grounds or on grounds that publication might cause prejudice to related investigations," he said.

Cameron Murphy, the president of the NSW Council of Civil Liberties, said it was important to balance the issue of open access for the media with the need for a fair trial: "Ministers, police and other authorities have been 'selectively leaking details about the cases', yet there has no been the ability for the people accused to put their side of the story, or for the media to investigate appropriately and report on the proceedings."

Ed: So don't get busted with a lie about a 77 dollar speeding fine unless you toe the governments line? I know judges are normally a protected species however the 300 club of the most wealthiest people in the world don't think so. In other words after making this statement you could be a marked Judge?

Peter Thatcher was called to testify after the court heard his DNA was found on hand restraints that allegedly bound the wrists of Peter Falconio's girlfriend, Joanne Lees.

Dr Thatcher said he did not know how it got there and that, in line with protocol, he believed he was wearing gloves when he handled the ties. [What about monkey business?]

He told the court his DNA could have been transferred by a sneeze or dandruff. [What about a fart?]

The court also heard swabs taken from the back of the couple's Kombi van were not tested for gunshot residue because there was no evidence of a gun being used or a cartridge being found at the crime scene.

Murdoch has pleaded not guilty to killing Mr Falconio and assaulting Joanne Lees in July 2001.

Common Sense: David Hicks is pro-government propaganda fodder for Four Walls and a scapegoat for the illegal and degrading wars in Afghanistan and Iraq. And there is doubt about everything, until he can tell his side of story which incidentally, doesn't even need to be told because people already know the real truth. So what are they trying to say just one month before his Star Chamber? That he's guilty?

Common Sense: Low life Four Walls is just getting in on the sensationalism and adding irrelevant material like, doing drugs, and boning chickens so the inference is that he is no good anyway for little johnny hoWARd the coward before David is tried and convicted.

Common Sense: But who didn't do drugs and who didn't eat or work and what's that got to do with the price of eggs?

Four Corners [Walls]: "This investigation throws new light on Hicks' role as a trainee fighter in Pakistan and Afghanistan - and on his starring role as the only Caucasian scheduled for military trial."

Ed: She also brings up David Hicks's past to make him look worse or at least somehow worthy of his current treatment? And by carefully using words rubs his face right up John Howard's arsehole, to boot. Four Corners is okay when they're doing the community a service by exposing corruption but when they act for John Howard's war agenda propaganda machine they should be culled as any sort of human rights advocates. Shame!
