The police who pursued a Macquarie Fields man until he slammed his motor vehicle into a power pole has appeared in a Burwood Court today facing new and unusual charges.

The high-speed police pursuit in Macquarie Fields ended up killing his two pillion passengers even though police 'had his home bugged and knew where he resided'?

And in the context of the Macquarie Fields riot which followed and the political inference about 'bad policing' that cost taxpayers about a million dollars to catch a thief, who was already in police custody and virtually could have been caught in bed in his pyjamas any time day or night.

Tell me, Whatcha gonna do?

Now Jesse Kelly has appeared again 'briefly' in Burwood Court charged with 'six cases' of aggravated break and enter at homes across Sydney dating from 2003 to the start of this year?

Perhaps if they blacken his name enough even the police will be able to deny culpability themselves and it appears them and their media mates at CH/10 have that in mind. Just like they did with the Bulldogs Gang Rapists who were not even named.

The Court was told DNA evidence 'also linked him' to the hold up of a Casula news agency where a machete was used. According to TEN news.

Uncle Ken whose been proud of getting his front line police to stick their nose in other peoples business lately (when they're not called for)? Breaking down doors and raiding homes at random, rampaging and destroying peoples private property looking for a thief they'd already had bugged and lost?

During a lengthy meeting today concerns were raised about the equipment, deployment and the tactics used in response to the riots.

Union vice-president Scott Webber says some officers are not happy with the decision made by senior police, but not Uncle Ken?

"Police officers want to be given strong direction, strong tasking and actually perform their role," he said.

But the officers have passed a resolution of support for Commissioner Moroney?

Contempt of Court?

They have condemned the actions of Opposition Leader John Brogden, who revealed details of the secret police operation in Parliament undermining the fact that the victim in custody had his house bugged.

Mr Brogden has rejected the criticism, saying it is a predictable response from a union.

But sources say he should be bought before the court for contempt because he breached the court listening devices warrant?

Brogden: "The rhetoric from the Police Association today is pretty predictable," he said?

"I'm stunned that there's no criticism of the Government and absolutely no criticism of senior police.

"Nobody can argue that four days of rioting where front-line police had their lives put at risk because of a bungled operation by senior police was a good outcome."

Actually the community should be stunned that there is no criticism from the court about Brogden's breach, absolutely no accountability from the NSW Police Force and no Parliamentary Inquiry in the brutality and victimisation of residents at Macquarie fields including a breach of the peace, the NSW Police PR Units daring and wild propaganda stunts with the pro-government media, and police pursuits?

The POLICE FORCE were under increasing pressure last night, to arrest (police pursued) death crash suspect and alleged driver, Jesse Kelly, but were they?

Actually they weren't under any pressure at all and this PR stunt shows us just how the calculating Police PR Unit works.

The Government, Police Force and Pro-Government media are all spinning the same web? No!

What about Police bending over backwoods for what they actually want on national television?

"Failing to respond to a vicious assault against a witness."

But who takes the fall really? Jesse Kelly.

Something Dave Madden quickly apologised for but for a good reason because he knows his PR Unit put him out there for the best possible reason.

Not for failing

To promote the police line that, the infamous 'Kelly Gang' have committed another crime. But we must all remember these were terrified young men and if it were true that they participated into trying to silence a witness then all I can say is that is what can happen after the fact of a crime!

But was there a better way?

1. We have a three-day surveillance of the car thieves.

2. Then a police chase, followed by the crash that claimed the two passengers Dylan Rayward, 17, and Matthew Robertson, 19.

3. Then a four day war with Macquarie fields with violence from the rioters and violence from the Police Force on national television.

4. Followed by daily police raids searching for Jesse Kelly and any other rioters with police breaking down doors and rampaging through homes.

5. Then allegedly we have the witness who is bashed for giving up the driver on national television.

6. The PR stunt by Dave Maddon?

Lessons to be leant here?

Today's real message is that police are slimy at the best of times.

Police although they didn't say it were also pitching for more leverage after the police commissioner Ken Moroney failed to win public support in his campaign for respect following police violence.

Ken Moroney wanted more respect by threatening to 'lock up' offenders' but that is not how you eat porridge if you want some respect.

It is my understanding that you don't win respect from the community with power or by using force. If you want some respect you have to earn it, by showing some respect first.

The subsequent bashing of the witness to the crash scene, although the alleged attack was the latest in a series of incidents that have sparked criticism of police handling of the case, it places Jesse Kelly at more of a disadvantage and this is what police wanted! To win the political war and to defend the initial police violence that sparked the riot.

Daily Terror: "Deputy Commissioner Dave Madden apologised to Jasen Greeks, 34, who was attacked by Kelly and nine others wielding pieces of glass in Eucalyptus Drive at Macquarie Fields.

The attack, witnessed by Mr Greeks' three terrified children, occurred two nights after a fatal accident on February 25 in which Kelly was the driver.

It also came the day after Kelly reported to Macquarie Fields police station as part of his bail conditions for another matter before being allowed to walk free.

Mr Greeks suffered a fractured eye socket and head injuries in the attack. He is due to undergo surgery to have a titanium plate inserted in his skull.

NSW Opposition Leader John Brogden said yesterday a leaked police document revealed the victim's 13-year-old son made an emergency call to authorities. In that call he said his father had been attacked for speaking to the media after he witnessed the car accident that killed Kelly's friends, Dylan Rayward, 17, and Matthew Robertson, 19.

The leaked document read in part: "About 6.30pm 27/2/05 it is suspected the POI [person of interest Jesse Kelly] and a group of males seriously assaulted the victim in front of his children as retribution for his comments made on television."

Mr Brogden questioned whether police had missed another opportunity to apprehend Kelly, who was driving the stolen car that crashed during a police chase on February 25, killing his two mates and which sparked riots in Macquarie Fields.

"Is it possible that a day after Jesse Kelly was identified as a person of interest in the car crash and allowed to walk free from Macquarie Fields police station, that senior police did not respond to a report of his whereabouts," Mr Brogden said. "Was a 13-year-old boy pleading for help declined police support by a senior officer?"

The Daily Terror: "Mr Madden said a duty officer decided not to respond to the emergency call because there had been a large number of calls to local police that night, some of which were believed to be hoaxes aimed at ambushing officers?

He apologised to Mr Greeks and his family. "For the victim in the matter, he'll be wondering what sort of support he does get from the police, and I need to make it clear that we now apologise for our failure to attend on that occasion," Mr Madden said.

"At the end of the day I don't know why police resources weren't deployed......it's not appropriate."

New South Wales Opposition Leader John 'Slayer' Brogden has called for an Upper House inquiry into the police handling of the Macquarie Fields riots.

There were four nights of riots in the area after two passengers were killed late last month when the car they were in crashed into a tree during a police chase [pursuits].

It's a natural grace. Of watching young life shape. It's in minor keys solutions and remedies. Enemies becoming friends when bitterness ends. This is my church.

John 'Slayer' Brogden says the inquiry should investigate the level of resources available to police? He also wants to know why police did not take a firm approach to rioters when the violence began?

Give up the chase and Stay Safe

They should also investigate pursuing people to their deaths, the cause of the riot. The community also wants to know why police took a deadly approach to the car thieves before the violence began?

Brogden: "The bottom line is that if the response from the police had been hard and tough at the beginning, then there may not have been four nights of rioting and as a consequence there may not have been the risk to police four nights in a row," he said?

But Mr Speaker!

Premier Bob Carr strongly disagrees with Mr Brogden and says the Opposition Leader should leave police alone to get on with the job?

Funny, Bob Carr wants police to get on with the job and Brogden and the Community want to know what the job entails and whether the war on the community is a 'valid stance' for the Police Force and the Government to take?

Carr: "Oh, come off it - I want our police commanders to be out on the streets in Macquarie Fields, not stuck before a parliamentary committee," Mr Carr said?

Good example anyway

The question is Bob, what are police doing out on the streets? Chasing offenders to their deaths, sticking their nose in other peoples business, when they aren't called for, publicly using corporal punishment unashamedly on national television, including kneeing young girls and breaking down doors and windows of private premises?

Mr Brogden says the problem of violence against police is getting worse, with separate acts of violence overnight.

"It invited the continuation of the riot the following nights and we now see problems in Darling Harbour last night and another part of Sydney," he said.

Large numbers of police and young people have clashed at Sydney's Darling Harbour overnight, with nine people arrested.

Police were called to Darling Harbour in the early hours of the morning to sort out a disturbance.

No Copycat, 'Cop Out'

When they arrived, a crowd of people threw bottles and other objects at them. More police units were rushed to the area for back-up.

Police say at the peak of the confrontation, about 150 officers faced a crowd of about 150 people.

It appears no-one was injured in the violence.

Six people were arrested for breaching the peace and three others are being interviewed over more serious offences.

Police defend fatal high-speed chase?

Victorian police have defended their actions in pursuing a driver who died during a high-speed chase at Phillip Island last night.

Police say they were conducting random breath tests outside a hotel in Cowes when they noticed a car being driven on the wrong side of the road.

Assistant Commissioner for the south-east region, Noel Ashby, says police were very concerned by the driver's behaviour.

"The car was travelling at a fairly significant speed. They took a decision to try and stop the vehicle and ask the driver to undergo a breath test, at that point the driver accelerated away," he said.

Officers then followed the car, which crashed into a block of flats a short time later, near the corner of Chapel and Osbourne streets.

A 25-year-old Leongatha man died at the scene. Police say the death is a tragedy and there are strict protocols in place for such pursuits.

An investigation is under way by the Major Collision Unit and the Ethical Standards Department.

Shauna Cotter says she had just gone to bed when the car crashed into her house.

"I was just dozing off and heard this car almost full accelerating down the hill, which was heading straight towards our house and I thought, there is no way that car is going to stop and within a millisecond after that, all Hell's let loose and [it's] gone straight through the fence [and] hit the side of the house," she said.

Nineteen arrests were made last night, after further confrontations between police and residents.

The violence was triggered by the deaths of two teenagers who were involved in a police car chase last week.

Well, I looked into the crowd the other night and I saw an old familiar face. He said, "How are you doin' Shirl my boy?" He said, "Tell me, are you still playin' the same old place?

I asked him all about himself and he said that he was married with a kid. Showed me a picture of his wife and we talked about all the things we did.

Police war with Macquarie Fields

Police Commissioner Ken Moroney says there will be a meeting today to discuss how police have responded to the situation.

But let me say, police acted like very provocative bullies, very brutal and I saw a cop slam a girl in the leg before hoisting her in the paddy wagon on national television what about that?

Moroney: "Equally as important through the efforts of a lot of good people in the community, not only in Eucalyptus Drive but indeed the broader Macquarie Fields community. I'm hoping beyond the restoration of order by the police that we'll commence our work with the community and other agencies of government that we'll find some lasting and meaningful solutions to this community," he said.

He realises he can't go to war with the whole community!

Nine of the people who were charged last night are expected to face Campbelltown Local Court later today.

Premier Bob Carr has again defended the Government's response to the unrest.

Mr Carr says the violence has been handled appropriately according to the law.

"Police need to have reason to make arrests and that is they need to identify people who've been throwing bricks on video or catch them in the act of doing it, that's the way the criminal law works," he said.

But how does the criminal law work when your Police Force continues to bury people in the ground because they won't stop pursuing people to their death?

Carr: "I've got police on the front line in a difficult circumstance with one understanding from the Government and that is that we want them to arrest the wrong-doers."

The slayer

Opposition leader John Brogden insists the approach is flawed because some of those involved in the riots are escaping police.

"Yes, there was footage taken of the riots, there were some arrests made afterwards but many people remain unidentified and not pursued by the police," he said.

"My concern is the Government is pursuing a softly-softly approach and I frankly don't think that's doing the people of Macquarie Fields or the state of New South Wales any good whatsoever."

Early on the fourth night of trouble in Macquarie Fields, 150 police officers moved into the area.

Dressed in full riot gear they formed lines around a house belonging to the riot's suspected ringleaders.

It's bound to get ya in. Get right under your skin. Hit you right on the chin - oh yeah. It's bound to be a thriller. It's bound to be a chiller. It's bound to be a killer - oh yeah!

Dozens of locals watched on as arrests were made.

Police moved into other areas of the suburb to make further arrests, their movements followed by a barrage of bricks, bottles and molotov cocktails.

The choppers are a-crashin. The cars are a-smashin. The cops are a-bashin - oh yeah. The kids are a-fightin. The fires are a-lightin. The dogs are a-bitin - oh yeah.

A family car with three children in the back seat had its back windscreen smashed by a missile as they attempted to leave the area.

No one was injured but that was just to win you over with emotion that the danger and damage that police caused trying to act tough wasn't worth it after all!

Furthermore it seem clear that two suburbs of angry young men, women and children will give the Police Force more paperwork than they can handle in a year!

So if there happens to be a better way to tell cops to stop pursuing people to death it may even save taxpayer's money as well as lives.

Police under attack in Sydney's south-west

A police officer has been hit by a brick thrown by a community member in the third night of protest in Sydney's southwest.

The protest follows the deaths of two teenagers during a police pursuit on Friday night.

The definition of a 'death in custody' recommended by the Royal Commission into Aboriginal Deaths in Custody includes, 'the death wherever occurring of a person who dies or is fatally injured in the process of police or prison officers attempting to detain that person'.

With deaths resulting from police pursuits, before the occupant or occupants of the vehicle are recorded as a 'death in custody', it would need to be established that there was a pursuit under way and still in progress at the time of death.

It would also need to be established what offence had been committed by the occupant/s of the vehicle and therefore whether only the driver or all occupants had committed an offence?

Late on Friday night, two teenagers were killed when a stolen car crashed at Macquarie Fields in south-western Sydney, after fleeing from a patrolling police car.

Crash investigation officers had rocks thrown at them early on Saturday morning, and on Saturday night police in riot gear were pelted with rocks and house bricks.

Last night's violent incident occurred in the suburb of Macquarie Fields where a group of 30 police officers advanced on 50 or more protesters.

The protesters pelted the police officers, wearing riot gear, with bricks and other projectiles.

Roads in the area have been closed while a helicopter monitored the situation from the sky.

Police announced yesterday that they were forming a task force to investigate two previous attacks.

Crash investigation officers had rocks thrown at them early on Saturday morning, and on Saturday night police in riot gear were also pelted with rocks and house bricks.

Assistant Police Commissioner Denis Clifford says cooperation between police and the local community is needed.

"The behaviour of certain people in the Macquarie Fields area over the last couple of nights has done nothing but hinder the investigation by the coroner and police into the circumstances, surrounding the death of the two young teenagers out there," he said.

"I'm asking the people who have been involved in that type of behaviour to allow police to get on with their job."

Assistant Commissioner Clifford says police are prepared if any further attacks occurred.

"Can I reassure the community out there, that we will have sufficient resources in that area to deal with anything that arises," he said.

"I certainly hope that there won't be a repeat of last night's behaviour. But if there is, we will have sufficient specialist resources in there to support the local police."

But should young adolescence get the death penalty for learning?, trial and error?, and for making a mistake?, in a world where making a mistake is the only certain way of getting anything right during those growing years?

A fatal car accident in New South Wales has prompted a review of the procedures police use during high-speed pursuits.

Police say a man and a young girl were killed when a speeding car crashed head-on into another car at McGrath's Hill in Sydney's north-west.

One of those killed was the 53-year-old driver of the speeding car. The child was in the other car. Her parents and an aunt are all in a critical condition in hospital.

The Deputy Police Commissioner Dave Madden says current procedures will be looked at.

"As a result of last night, we will review all our procedures," he said.

"A critical incident team has been called in. They will investigate what actually occurred, the decisions of the police and what went on, and what went through their minds, as well as our existing procedures."

The counter claim makes it look good for police opposed to addressing serious procedural problems within the NSW Police "Force".

The death of a three-year-old girl during a pursuit on Windsor Road at McGraths Hill in January 2004, is another example of police pursuits.

The Staysafe committee released a report into police pursuits in November 1994.

But The New South Wales Opposition's police spokesman, Peter Debnam, said, "Many recommendations were yet to be implemented."

Four people were taken into custody after anger erupted at the death of 17-year-old Aborigine Thomas Hickey, who was impaled through the neck on a fence on Saturday morning.

Mr Waites says the riot began after the death of Mr Hickey, who was impaled on a fence in the area on Saturday. "

The misinformation was that they were under the belief that the police were actually involved in a pursuit where an Aboriginal youth was killed and that wasn't true," he said.

But why are police so quick to claim misinformation yet there has been no enquiry. Usually police won't say anything when there appears to have been a death in custody why the change?

Obviously there are witnesses who have said that police chased the youngster to his death. Waites says officers who were on patrol drove past the boy, who was riding his bicycle in the opposite direction. "They continued on their patrol," he said.

They weren't aware that after he'd passed them, he accelerated on his pushbike and gone around a corner and lost control of it. It wasn't till they came around the block again and people flagged them down and told them what happened [that they knew], so the suggestion that police have in some way been the cause of the death is fairly questionable."

But not if you're a witness to the police chase!

The teenager's mother, Gail Hickey, yesterday said police caused her son's death.

"I don't believe the police, I don't care what they say, I don't believe them," she said.

"They did chase him at that time. I got a witness to all that. He seen everything that happened. He told me he seen my son riding the bike real fast, next minute he seen cop cars coming, chasing my son to the building there, where it happened."

Local resident Donna says people are grieving. "It all started over the coppers chasing a young boy," she said.

"It happened yesterday afternoon or last night and it's just that everybody has gone off because they believe the coppers are involved in doing away with the young fellow."

Donna says people are angry because they believe police are responsible for the teenager's death. "He was murdered," she said.

"We've been down to look at the spot and everything and there's no sign, they cleaned it up that quick."

Redfern Aboriginal elder Lyall Munro says police harass local young people on a daily basis and have them running scared.

"The community here is very much aware of what happened," Mr Munro said.

"This type of thing is going to happen and our young people are going to die in this way whilst ever the police are allowed to get away with it."

Mr Munro says relations with police are at an all-time low.

"Community programs that we had going here ....all fell through because Aboriginal people saw what the street police done immediately after the meetings," Mr Munro said.

The president of the Indigenous Social Justice Association, Ray Jackson, says police could have managed the situation better.

He is a friend of the Hickey family and says a police car was driving in a street where the teenager's mother was grieving on Sunday afternoon.

"One report that I got was the police were smiling and sniggering and all this sort of thing and it was common knowledge that there was going to be a problem as soon as it got dark and that's exactly what's happened," Mr Jackson said.

The Australian Institute of Criminology has released the National Deaths in Custody Program annual report for 2002 Between January and December 2002, there was a total of 69 deaths in custody in Australia. There were 50 deaths in prison custody and 19 deaths in police custody and custody-related police operations.

Workers from the Campbelltown City Council, which covers the Glenquarrie Estate in Macquarie Fields in Sydney where the weekend riots took place, will spend this morning cleaning up the streets.

The Mayor of Campbelltown Brenton Banfield says his community is disturbed by the violence.

"I'd say very concerned - people that I've have spoken to are just appalled about what's been happening there," he said.

"I can understand that there's a real sense of tragedy I suppose, that two young people have been killed in a car accident but as to their [fleeing] the police I think that it is just inappropriate."?

He says the Glenquarrie Housing Estate, owned by the Department of Housing, is an area that is being looked at the moment by the department to try to change the social mix of that area.

"That part of the broader community is dysfunctional - that's how I'd describe it.

"The most disadvantaged people live there and they've became dysfunctional communities."

But no matter how inappropriate that is, it's not worth dying for? And the fact that it happened in Glenquarrie Housing Estate does not mean that it doesn't happen anywhere else in Australia? And I am sure that does not make that area dysfunctional opposed to other locations.

Brenton Banfield says housing estates are generally in poor condition.

"This was an estate that was developed probably 30 years ago by the Department of Housing and during that time the condition of houses have deteriorated," he said.

"We have in Campbellton a lot of housing estates that need a lot of money and work done on them - they've became degraded because of the passing of time.

"Those houses are now old or either in need of demolition or renewal."

But poor and disadvantaged people with, low socio-economic backgrounds do live in these estates no doubt.

And they may be more likely to take what opportunities they haven't got by taking a joy ride in someone else's car, instead of taking fewer risks and using fewer resources by buying their own car. But until they get caught and learn the difference like I did, it's not worth dying for otherwise I wouldn't able to write this article.

Nor is it worthy to blame the housing estate.

As for 'dysfunctional people' most communities that stand up for human rights opposed to the brute force dished out by police would be in good stead unless you think teaching and learning is all about 'killing' and 'dying'?

Police pursuit death toll rises: 61 killed in 10 years

At least 61 people have died during police pursuits in NSW over the past decade, a higher toll than previously revealed.

A Herald investigation last year found that 54 people had been killed in high-speed police car chases over the 10 years since November 1994, but five more deaths have been exposed through figures obtained under freedom of information laws.
