Australia: Right to strike to go

HOWARD MAKES THE 'BLUE' UNLAWFUL

THE RIGHT TO STRIKE GOES DOWN THE WC?

'The right of workers to leave their jobs is a test of freedom. Hitler suppressed strikes. Stalin suppressed strikes. But each also suppressed freedom. There are some things worse than strikes, much worse than strikes - one of them is the loss of freedom.' US President Eisenhower.

'Eisenhower was correct in pointing out that the hallmark of the Police State is the loss of the right to strike. A worker's right to strike is surely a basic human right. The right to withdraw labour is the one thing that distinguishes a free worker from the slave. This is a fundamental freedom.' Clyde Cameron, former Labor Minister.

There are many concerns with WorkChoices, WC. I only deal with how Howard is to (almost) extinguish the limited right to strike for workers.

Howard's WC legislation will be rushed through Parliament to hide repressive changes. One change is to make legitimate union industrial action 'unlawful'. There are new penal powers and sanctions against striking workers legitimately pursuing, as a last resort, their workplace and economic interests.

'Blueing' is to be even more risky. Will the Australian 'blue' with the boss be an endangered species? Workers and their unions in dispute, those 'blueing', will be liable to be ordered back to work, fined, sued and even criminalised, with increased penalties. Employers who love power and authority will benefit.

Australia is going through a low strike era. Howard did not raise these further restrictions on the right to strike during the election. Corporate associations lobbied Minister Andrews to take away the protections necessary for the effective right to strike.

The government ads say: 'We won't take away the right to strike' but this is 'spin'. Here are 8 further limits on the right to strike. The devil will be in the detail.

1. Minister Andrews himself is to have unbelievable government power to intervene in 'essential services' to halt strikes. This is now possible only through the Industrial Commission or Courts; not the Minister! But his version of 'essential services' is not limited to the army or police, but to cover any corporation and he cites car companies, mining companies and electricity companies. Public sector employment, nurses, teachers and public servants are to be covered. No choice here.

2. New provisions severely restrict basic union rights for industrial action for industry or pattern bargaining. No choice here, as there is no right to strike outside of the single enterprise. Nowhere else in the OECD is pattern or industry or national bargaining unlawful.

3. A small amendment, with wide ramifications, allows third persons affected by industrial action (other than the employer and unions in the dispute) to halt protected legal industrial action. By definition industrial action affects third parties in some way. So other businesses affected or other persons, such as students or patients can stop legitimate union protected bargaining.

4. Unions pursue claims that encourage unionism and many employers agree. Now employers and workers are to be banned from reaching agreement on such claims. No choice here. It is to be unlawful to pursue legitimate workplace matters by industrial action.

5. The Australian Industrial Relations Commission, which will be all but gutted of its 100-year-old responsibility to prevent and settle disputes, will only have more powers to halt industrial action 'not protected'. Employers can more easily go to the courts for labour injunctions to halt industrial action. Employers retain their power to easily lock-out workers.

6. Compulsory secret ballots have to be conducted before there is lawful protected action. They are now voluntary. The new compulsory ballot requirements are so prescriptively complex that it will be most difficult to implement a valid ballot. In practice this will severely restrict protected action in enterprise bargaining. No choice here. No requirement for employers to compulsorily ballot shareholders before locking out their workforce.

7. The already limited right to protected action is narrowed. Any industrial action that is not protected will be penalisable. All industrial action is prohibited during the life of an agreement. No choice here.

8. WC repeals the requirement for the AIRC to issue a s166A certificate before employers can take common law action to recover damages for unprotected industrial action. The ancient common law tort, based on master and servant doctrine, makes all industrial action unlawful. At least the current limited protection enables 72 hours of conciliation in the Industrial Relations Commission to settle the grievances. Now there is no choice.

The Howard government has already outlawed the right to strike for building and construction unions in legislation slammed through in August and applying retrospectively to catch unions' campaigns. Little debate was allowed in the Senate.

A new building industry police force is operating to 'investigate' workers involved in so-called 'unlawful industrial action'. They have incredible powers. Building workers basic civil rights to silence and not to incriminate yourself have been removed with threat of jail! (details available).

These labour laws do not meet Australia's ILO obligations for protecting the right of workers to collectively bargaining and exercise, without penalty, the right to strike. (Evatt Foundation website http://evatt.org.au/news/336.html )

Will Howard's attempt to suppress strikes be effective? Historically unions took protest industrial action to defend the right to strike. The right to strike as a human right has been long fought for as an essential freedom of being a unionist, for collective bargaining and to defend and promote the social and economic interests of working people and their families.

Eisenhower defended the right to strike because the abolition of such a right is the loss of a freedom. Freedom for industrial action without penalties.

Australia started as a penal colony with penal powers against workers acting in unions. Now in the 21st century penal powers return. This time in a globalised corporate world and a government on the extreme right wing ready to suppress strikes.

Australians do not want to go to the penal days of masters and servants, or slaves, with forced labour.

No choice, no fair go. Will the long tradition of the Australian 'blue' be suppressed? Or will the 'blue' survive?

Stanhope stands his ground

Stanhope: It is bizarre to think legislation of this significance can be rushed into Parliament without consulting a single Australian.

ACT Chief Minister Jon Stanhope says he will not comply with instructions from the Commonwealth insisting he remove draft counter-terrorism legislation from his website.

He posted the documents on his website yesterday, because he says the public has the right to know about how the far-reaching laws will impact on civil liberties of Australian citizens.

"As far as I'm concerned, any one of the jurisdictions who's participating in the development of this legislation has a right to consult in the way that they feel appropriate," he said.

"It may be that Philip Ruddock and John Howard don't want to consult on this legislation, they don't want the views of many Australians, they want to rush it through, they want to do it in secrecy, but I don't."

Mr Stanhope says he hopes posting draft counter-terrorism laws on his website will open community debate about the issue.

"This is fundamentally important legislation, this goes to the rights of every Australian and I think it is bizarre in the very extreme to think that legislation of this significance can be rushed into Parliament without consulting a single Australian," he said.

'Indecent haste'


The Law Council of Australia says the Government has acted with indecent haste to try to push through anti-terror laws that will affect each and every Australian.

With the bills set to go before Parliament in a fortnight, the Opposition and minor parties are angry a Senate inquiry will be given just one day to consider their content.

The Law Council's president, John North, has said, the laws seem to ignore the fundamental right to remain free unless a person is reasonably suspected of having committed an offence.

"It looks as if the Government is going to be able to lock people up in times of fear such as if they're having a heads of government meeting or an Olympic Games and if they think that there's going to be trouble, well they can pull people off the street and hold them under these orders," he said.

Mr North says the suggestion that under the legislation that police will be able to use lethal force when arresting someone is just one of the proposals the Law Council is concerned about.

"It differs in that police under today's law can only use lethal force if they are directly themselves threatened or they have to save someone," he said.

"Under this, there seems to be enough room to manoeuvre and it seems to be directly pointed at the London situation where the person was shot."

Labor's homeland security spokesman, Arch Bevis, says the inquiry will be unable to scrutinise whether the legislation provides a balance between security and civil rights.

Draft copy 'more extreme'

The Australian Democrats and the Greens say the new laws go much further than previously anticipated.

Queensland Premier Peter Beattie has also raised concerns that the draft copy does not include key provisions that were agreed upon by Prime Minister John Howard and state and territory leaders.

Australian Democrats Leader Lyn Allison says the draft copy of the legislation is more extreme than she expected.

"It's extraordinary, this bill provides a whole lot of extra powers to the police that were previously not contemplated," she said.

Greens Senator Kerry Nettle says the draft copy of the anti-terror legislation proves the need for a longer and more indepth inquiry.

"The state premiers are aware of the need to look over more closely this legislation," she said.

"Agreements that John Howard made to them in their meetings have not been met in the detail of the legislation that we have seen to date, and that's just one more reason why there needs to be proper scrutiny."

The Opposition says Mr Stanhope has performed a community service by posting the details on his website.

Labor's homeland security spokesman Arch Bevis says the website posting shows that what he called the Prime Minister's abuse of the Senate last week was even more serious than originally thought.

"There needs to be a proper inquiry," he said.

"John Howard should take up Labor's offer put on the table in the Senate last Thursday, to ensure that sufficient time is given for these bills to be discussed this year but also to ensure that the Senate has a proper review of the matter.

"There should be a Senate inquiry, it should go for at least a month and it should ensure that all of the people in Australia who have an interest in this can have their say."

Australian government unveils legal framework for police state

In the lead-up to his September 27 "counter-terrorism summit" with the eight Australian state and territory leaders, Prime Minister John Howard last week unveiled a package of legislation that goes well beyond the already deep inroads made into essential civil liberties under the fraudulent banner of the "war on terrorism..."

With the tacit support of the Labor Party--which currently holds office in all the states and territories, and whose leaders instigated the call for the summit--Howard's government is proposing unprecedented measures that directly target fundamental democratic rights: the freedoms of speech, association and movement, and the right not to be detained without trial.

Once again, as happened after the [CIA false flag] September 11, 2001 attacks in the United States and the[CIA false flag] Bali bombings of October 2002, the government is seeking to exploit a terrorist atrocity--in this case the [false flag] July 7 London bombings--as a pretext for sweeping changes to the machinery of rule.

While no legal details have been provided of any of Howard's proposals, the main lines are clear. They go far further than the previous "counter-terrorism" laws. What is being prepared is the legal scaffolding for a police state. In the name of fighting terrorism, broad provisions are being drafted that could be used to stifle political dissent and opposition.

Control orders: In secret court hearings, the Australian Federal Police (AFP) will be able to apply for 12-month control orders imposing draconian conditions on individuals, such as tracking devices, travel bans and association restrictions, simply because the security agencies accuse them of being "terrorist risks".

Howard claimed these orders would be similar to apprehended violence orders (AVOs), taken out by individuals to protect themselves against domestic violence. But an AVO ordering a person to stay away from a place of residence bears no resemblance to an order permitting the police and intelligence services to electronically monitor a person's movements and conversations, and bar them from travelling or meeting with political or religious colleagues.

Preventative detention: The police and the Australian Security Intelligence Organisation (ASIO) will have the power to secretly lock people away for up to 48 hours. This marks a qualitative shift in the power to detain people without trial. Victims will be imprisoned not because they are accused of committing any offence, or even alleged to have "information" relevant to terrorism (as with ASIO's already unprecedented detention power, established in 2003), but because of what they are suspected of intending to do in the future.

At the September 27 summit, Howard will ask the premiers to pass state laws providing for longer periods of such detention, similar to the 14 days recently introduced by Blair's Labour government in Britain. In effect, he is asking them to help bypass the Australian Constitution, which bars the federal government from detaining citizens without trial for periods that would be viewed by the High Court as punitive.

Inciting violence: Howard is proposing to outdo British Labour by outlawing "inciting violence against the community". The British "inciting terrorism" laws can jail people for their political views, such as expressing sympathy for terrorists or calling for an understanding of the social roots of terrorism.

Howard has chosen to go even further by extending the existing sedition offences to make it a crime to write or speak in a way that supports Australia's "enemies," or promotes ill-will or hostility toward any group in the community, including Australian military forces overseas. The maximum penalty for sedition will be increased from 3 to 7 years' imprisonment.

Sedition laws are designed to suppress political and media criticism of Canberra's underlying domestic and foreign policy. People could be jailed for opposing the war on Iraq, for example, if their views could be construed as encouraging attacks on Australian troops. At his media conference, in response to a specific question, Howard refused to rule out the possibility that journalists could be prosecuted for exposing Australian conduct abroad, such as involvement in the US torture at Iraq's Abu Ghraib prison, if their reportage caused reprisals against Australians.

Advocating terrorism: Similarly, the government's unilateral powers to ban organisations without any court hearing--agreed to by Labor late last year--will be extended to include groups that "advocate" terrorism. This is far-reaching, especially given that the Criminal Code definition of terrorism is wide enough to include many traditional forms of political dissent, such as demonstrations where injury or property damage occurs.

Expanded police powers: An array of ASIO and the federal police powers will be boosted, including to use closed circuit television surveillance, secretly enter and search premises, intercept communications and seize material. ASIO's interrogation power will be bolstered by longer jail terms for providing false or misleading information.

The AFP will have new powers to stop, question and search people on the street, seize documents and obtain airline passenger information. Its proposed "notice to produce" powers could severely affect free speech and media scrutiny. They could be used, for instance, to compel journalists to hand over their notes and recordings, including those made during interviews with confidential sources.

Citizenship: Immigrants will have to wait three years--an extra year--before being eligible for citizenship. Applications can be rejected on security grounds and more readily revoked. These changes will make it easier for the government to deport targeted individuals or detain them in immigration detention centres.

How such a vast expansion of the government's powers, which already exist for non-citizens, can be readily used for political purposes has been demonstrated by the current detention and planned deportation of an American anti-war activist Scott Parkin. After three months in Australia, his visa has been revoked on "national security" grounds, when his only "offence" appears to be participating in protests against the war on Iraq and the activities of corporate giants such as Halliburton.

Attorney-General Philip Ruddock has refused to give any reason for Parkin's removal, claiming that he cannot comment on "national security" decisions. If that is the case, then no one can challenge such deportations, no matter how flagrantly they violate freedom of expression.

A range of civil liberties, legal and media organisations have condemned Howard's proposals and pointed to some of their implications. NSW Civil Liberties Council president Cameron Murphy said: "It's very difficult to define when someone is inciting violence. It's an absolute nightmare." Australian Muslim Civil Rights Advocacy Network convenor Waleed Kadous asked: "What about someone who says that the people of Iraq have the right to resist the occupation? That would contravene these laws."

Australian Council for Civil Liberties president Terry O'Gorman told ABC television: "If you grant huge new increases in powers without any checks or any limitations or any oversight, then, by definition, it's a recipe for a police state."

The new laws have nothing to do with protecting ordinary people against terrorism, the threat of which the Howard government has itself heightened through its participation in the invasions of Afghanistan and Iraq. No new powers are needed to fight terrorism--every conceivable terrorist offence, from murder to kidnapping and arson, was already a serious crime before 2001, as was supporting, financing or planning such actions.

Significantly, apart from a vague reference to the July 7 bombings in London, Howard offered no evidence to justify the need for the latest measures. Asked by journalists at his media conference whether there was any increased risk of terrorism in the months ahead, he admitted that the government had no specific information or reason to raise its official terrorist alert level.

Even mainstream journalists, who have generally uncritically backed the government's erosion of basic legal rights since 2001, appeared taken aback by the far-reaching character of Howard's package. One reporter asked Howard: "[H]ow are you going to answer the criticism that these measures will go too far and that Australia is essentially being turned into some sort of quasi police state?" Howard claimed this was an "absurd proposition" but could offer no answer, except to say that court rulings would be required for "control orders".
