US passes 1000 executions in 30 years

December 3, 2005: Double murderer Kenneth Lee Boyd has became the 1,000th prisoner executed in the United States since 1976. Another man was put to death on Friday for the 1994 murder of a store clerk, becoming the 1,001st person executed in the United States since capital punishment was reinstated 28 years ago. The somber moment drew a sizeable crowd to Central Prison in Raleigh, N.C., to protest capital punishment...

Don't Kill For Me!


Kenneth Lee Boyd, 57, of Rockingham, N.C., died by lethal injection for the 1988 shootings of his estranged wife, Julie Curry Boyd, who was 36, and her father, Thomas Dillard Curry, 57. Members of both families had asked to be present.

Shawn Humphries, 34, mouthed "I'm sorry" to his victim's two sisters before fatal chemicals were pumped into his veins. His death came about 16 hours after North Carolina executed Kenneth Lee Boyd.

Humphries' attorney said he had told her "he would rather be 1,000 because if he has to die, No. 1,000 will be remembered. No. 1,001 won't." Boyd told Associated Press in a prison interview that he wanted no part of the infamous numerical distinction of being the 1000th prisoner executed.

"I'd hate to be remembered as that," Boyd said on Wednesday. "I don't like the idea of being picked as a number."

Boyd's attorney, Thomas Maher, had hoped to win a stay for his client, who he said had an I.Q. of 77. The cutoff for mental retardation, a mitigating factor in some capital cases, is 75. Others argue that the death penalty should be reconsidered because it is so arbitrarily applied. He also hoped the U.S. Supreme Court and North Carolina Governor Mike Easley would consider that before these murders, Boyd had no history of violent crime, and that he had volunteered to go to war in Vietnam.

"The vast majority of those sentenced to death for their crimes are impoverished and live in the South," said Stephen B. Bright, director of the Southern Center for Human Rights and a long time advocate for death row inmates.

"Texas has put 355 people to death in the last 30 years, with just one county in Texas, Harris County, accounting for more executions than the entire states of Georgia or Alabama. Where is the justice in that?" questioned Bright.

Boyd's son, Kenneth Smith, 35, who visited his dad every day for the last two weeks, said in an interview on Thursday that he felt the attention paid to the milestone had hurt his father's chances for clemency. Smith also said his dad was deeply troubled that he might only be remembered as a grim hash mark in the history books.

"He didn't want to be 999, and he didn't want to be 1001 if you know what I mean," said Smith. "He wanted to live."

Belinda J. Foster, District Attorney for Rockingham, N.C., who prosecuted Boyd, said she felt confident that the death penalty was warranted in this case.

"There are cases that are so horrendous and the evidence so strong it just warrants a death sentence," Ms. Foster said.

Michael Paranzino, president of the pro-death penalty group Throw Away the Key, agreed.

"You'll never stop crimes of passion, but I do believe the death penalty is a general deterrent, and it expresses society's outrage," Paranzino said. An October 2005 Gallup poll found that 64 percent of all Americans support capital punishment in murder cases.

Boyd never denied his guilt, but said he couldn't remember killing anyone and didn't know why he did it.

"We believe this occasion is the perfect time to reconsider the whole issue of execution," said William F. Schulz, executive director of Amnesty International, a group that has sought to end the practice of using executions as a punishment for crime around the world.

"Since 1976, about one in eight prisoners on death row in the U.S. has been exonerated. That should raise serious questions about ending a person's life," Schulz said.

North Carolina executed two prisoners last month, as well as two others earlier in the year.

Debate over capital punishment

The grim milestone has prompted global outcry from human rights advocates. In a media statement the European Union also condemned the execution, calling for the end of the death penalty worldwide:

"We consider this punishment cruel and inhuman. It does not act as a deterrent and any miscarriage of justice - which is inevitable in any legal system - is irreversible."

Boyd's death rallied death penalty opponents, and about 150 protesters gathered outside the prison. After watching Boyd die, Rockingham County (N.C.) Sheriff Sam Page said the victims should be remembered.

"Tonight, justice has been served for Mr. Kenneth Boyd. What I would ask you to do is not forget the victims of this crime..." Page said. "Pray for them. Pray for them and their healing."

"This is one small step for humankind - backwards," said veteran American campaigner Clive Stafford Smith in an interview with Reuters. "The death penalty makes us all far more barbaric. I have watched a lot of people die, and when you come out from watching someone being executed it certainly isn't a better world."

According to Kenyan National Human Rights Commission Chairman Maina Kiai, "[It is] a great pity that the US can keep on executing people [when much of the developed world had already ended the death penalty]."

"Also, the fact that in the US a lot of death sentences that are carried out invariably affect people of colour and poor people, it's an issue of great concern," Kiai said.

In Singapore, where a 25-year-old Australian was hanged just hours before Boyd's execution, Sinapan Samydorai, president of the think-tank Think Centre, said there was no justice without life.

"The US is supposed to be a champion of human rights and democracy [? since when? total rubbish!], yet they do not recognise the right to life," he said. Singapore has a mandatory death sentence for crimes such as murder, firearms offences and drug trafficking, and has hanged 420 people since 1991, mainly for drug trafficking.

"It is a scandal that the death penalty still exists in a civilised country like the United States of America," said Petra Herrmann, chairwoman of the German group Alive e V.

In Japan, where the death penalty is widely supported, Akiko Takada of anti-capital punishment group Forum 90 said despite frequent use of the death penalty in the United States, "crime there shows no signs of diminishing, so ultimately the death of these people has no effect."

Thirty-eight of the 50 US states and the federal government permit capital punishment.

Only China, Iran and Vietnam had more executions in 2004 than the United States, according to rights group Amnesty International.

During 2004, at least 3,797 people were executed in 25 countries. At least 7,395 people were sentenced to death in 64 countries. These figures are only reported cases - the true figures were certainly much higher - many countries continue to execute people in secret.

How STUPID are the Americans?

How stupid are the Americans? Why are they fooled by their government's energy policy? Many Links to renewable energy web sites.

IS THIS YOUR ENERGY POLICY?

OUR LOVE AFFAIR WITH THE AUTOMOBILE
We've been depending on the internal combustion engine (ICE) for more than 100 years and over all that time the efficiency of the ICE has climbed to just under 15%. The remaining 85% is waste heat, unfired combustibles.

YOUR PERSONAL COST?

For every $10 bill you put in your gas tank, $8.50 is wasted. It's not that 85% of that gasoline didn't produce anything, it means that only 15% was used to turn the wheels. The 85% produced waste heat, unburned chemicals.

THE HIDDEN STICKER COST?
We're addicted. And an addict will do most anything to satisfy their addiction. Money will be found, people might get hurt, and we'll make deals with anyone to get what we want. We depend on foreign imports for over 50% of our oil. If this sounds familiar it's because it's the same scenario that preceded the "Energy Crisis" more than 20 years ago.

THE ENERGY CRISIS WAS A SET UP
Our trusted trading partners (the dealers) flooded the market with cheap gasoline (the drug) and we (the addicts) of course just started using more. Then they cut the supply and raised prices. The cost to the nation was incredible. The cost to Detroit and the Big 3 was even worse. Suddenly, there was a market for smaller, high mileage cars and Japan was there to take that market.

D?J? VU IN 1999? We're importing about the same, still making deals with anyone, the drug is cheaper than it's ever been (adjusted for inflation), we're using more (SUV's), and driving more than ever. It's obvious we don't have a clue.

DON'T GET CAUGHT BETWEEN AN ADDICT AND HIS DRUG!
Saddam Hussien was a dealer. We knew he was unstable and couldn't be trusted, but he was OUR dealer. We depended on him. Things you normally wouldn't even think about doing aren't an obstacle when you're addicted.

When Saddam moved in on Kuwait (another dealer) our supply was threatened. It was war. Our addiction is so strong we are willing to send our own children to war for gasoline.

Most drug addicts wouldn't go that far but for us it's a logical step. We were willing to use up natural resources regardless of the consequences. We were willing to pollute the air, the land and the water. Our kids can see their air.

As kids we dreamed of the day we'd get our drivers license. The fact that we're willing to sacrifice lives for gasoline is unthinkable, but that is our policy and what it says about our values is worse. We pay more for a gallon of coke, than a gallon of gasoline. Or do we?

THE PRICE AT THE PUMP

The cost of gasoline at the pump includes a tax which is meant for infrastructure.

COSTS NOT INCLUDED AT THE PUMP:
Value of clean air?
Value of clean rivers, lakes, ponds, drinking water?
Value of Natural Resources?
Value of quality of life?
Cost of military defense of "our" oil ?

USER PAYS?

The cost of our military defense of our oil is a tangible amount. It's estimated that if that cost were included, the price of oil from the Middle East would be $100 per barrel. The cost at the pump would be at least $3 per gallon. Instead of including that cost in taxes at the pump, it's being paid by every taxpayer regardless of whether they drive or not or how many miles they drive. Instead of a tax policy that promotes efficiency, we build the best highway system in the world but not the best schools. Our tax code allows corporations such as Exxon a tax deduction for the cost to clean up the oil spill from the Valdez.

The CAFE standards were introduced to increase automobile efficiency but due to industry lobbying these standards have been frozen for the past 5 years and Congress just did it again in 1999.

LET THE MARKET DICTATE COST

This can only happen when the true cost of gasoline is levied at the pump. This is also known as a tax shift and in this case we'll pay those taxes at the pump and not from payroll deductions.

The increase in the cost of gas would raise demand for high mileage (energy efficient) automobiles. Manufacturers, using currently available technology can and would build cars whose efficiency would eliminate the need to import oil. This would go a long way toward eliminating our trade imbalance as well as eliminating national security risks due to our dependence on foriegn imports.

In the end, the environment is improved. Although we've grown up believing that it's every American's God given right to drive an automobile, the truth is that everyone has the right to breathe clean air.

NUCLEAR ENERGY

It doesn't make any sense that this issue is even being debated. What was sold to the taxpayer was the promise of "energy so cheap it you couldn't even meter it". What we have instead is the most expensive electricity, without including the cost for decommissioning or the unknown cost of nuclear waste.

OPERATING COSTS
These of course are passed on to you but be aware that you also contributed more than 50 BILLION dollars for it's development.

WASTE COSTS - YOURS

Here's the Nuclear Waste policy: Remove nuclear waste from nuclear plants all over the country and transport it through most every state, within 1/2 mile of more than 50 million citizens and store it anywhere we can regardless of what the locals residents have to say.

The US Congress is moving ahead with the development of a nuclear waste site in Nevada over the objections of not only the citizens of Nevada but their Senators and Representatives as well. The project will also violate EPA regulations.

BENEFIT VERSUS RISK
Sure we take risks all the time just crossing the street. If your crossing the street to get to work your risk of getting hit by a car is low if you're a law abiding pedestrian. You took a small risk and received a large benefit .. you made it to work and won't be fired today.

The problem with nuclear is we get all the risk and no benefit.

By law nuclear waste becomes the property of the US taxpayer. It's your problem now. The nuclear plant will one day be decommissioned, dismantled and also become your property.

Do you want the waste? Do the folks that produced that waste want it? If nobody wants it ? don't make it.

WHY MOVE WASTE?

A nuclear plant is a nuclear waste dump. Why create another and then take the risk of moving it all over the country?

CONCLUSION:

Why be foolish and reckless like the Americans? You can choose an intelligent and responsible energy policy using sustainable technology. Sustainable technology creates long term economic growth with more jobs, a clean environment and healthy people. Are you going to follow the ignorant Americans? Are you stupid?

AN APPEAL FOR ARTICLE 9

On the 60th anniversary of the end of World War II, an appeal for international action for peace through Article 9, the war-renouncing clause of the Constitution of Japan.......

HYOGO, JAPAN -- Today, August 15, marks 60 years since the end of World War II, a war that took millions of lives and changed the course of history. All around the world today, it is a time for quietly reflecting on where the human race has been and where it's bound.

Nowhere is that more true perhaps than here in Japan, which had been both the victimizer and the victim in that war. Sixty years on, Japan has yet to deal as a nation with the magnitude of the killing and suffering it caused in neighboring Asian nations and elsewhere; the same can also be said of the United States and its horrendous atomic bombings of Hiroshima and Nagasaki, and every war that America was waged around the world since then.

But this special day of remembrance marks not only a time of much-needed reflection on the most basic issues of life and death, peace and war. It is also marks a time for much-needed action.

This action, I believe, could be in the form of some concrete steps that can be taken to join together with people from different cultures and nations in a common global cause. I would like to make an appeal here for one of those steps on the road to a common international action: Article 9 of Japan's Constitution.

The two paragraphs of Article 9 of the Constitution of Japan, enacted in 1947 in the ashes of World War II, read in their entirety:

Aspiring sincerely to an international peace based on justice and order, the Japanese people forever renounce war as a sovereign right of the nation and the threat or use of force as means of settling international disputes.

In order to accomplish the aim of the preceding paragraph, land, sea, and air forces, as well as other war potential, will never be maintained. The right of belligerency of the state will not be recognized.

The Importance of Article 9

The question naturally arises: Why is Article 9 important to us all today, more than a half-century after it was written? There are several reasons.

First of all, Article 9 serves to balance the scales of justice in favor of peace and against war. Article 9 gives the world another choice beyond that offered by the Bush regime in its threat of "you are either with us or you are with the terrorists." The world need not choose between two sides of terrorism. Article 9 offers a real and viable alternative for all people by offering the practical alternative of building peaceful societies.

Secondly, Article 9 seeks to break the vicious circle of vengeance that wars and war economies thrive on. For example, for the countries -- especially in Asia -- that were ravaged by the Japanese military's fascist fantasies of global domination, Article 9 has served as a source of postwar political stability in nipping militarism in the bud. The global circle of violence must be broken and replaced in our time with one of peace and understanding among all nations. Article 9 takes us closer to that goal.

Thirdly, Article 9 works to build upon true economic prosperity by discouraging military buildup and encouraging societies to devote their budgets to peacetime development. That has certainly been true in postwar Japan, which owes its economic prosperity in great part to its "Peace Constitution," as it is referred to here. Along with addressing the moral roots of war, we must realistically begin to address the economic roots of war as well. Article 9 allows us to do just that.

Fourthly, Article 9 builds upon the earlier foundations for peace that are already in place. Did you know, for example, that the United States and 61 other nations of the world signed on to the Kellogg-Briand Pact (or Paris Pact), a treaty "providing for the renunciation of war as an instrument of national policy" that went into effect on 24 July 1929? This pact remains a binding treaty today under international law -- and thus technically is still part of the supreme law of the land under Article VI of the U.S. Constitution. Japan's Article 9 can help build upon such legal foundations around the world.

This is all not to say, of course, that Article 9 has been a cure-all for Japan's problems; it hasn't. With great encouragement from the U.S. Pentagon over the decades following World War II, Japan is said to have become the world's fifth-largest military spender. Moreover, the U.S. occupation forces that came into Japan following the atomic bombings of Hiroshima and Nagasaki have essentially never left: An estimated 45,000 U.S. troops are still stationed at American military "camps" around Japan today, mostly in Okinawa to the south. The U.S. military, of course, even now bills the Japanese government for most of those American military expenses in Japan. All this has happened despite the existence of Article 9 in the Japanese Constitution.

But at the same time, it is no exaggeration to say that without Article 9 in place in Japan, the international community would have been much less stable over these past decades and the ambitions of Japan's militarists would have resurfaced much earlier.

Militarism Resurfaces

"Resurface"? Yes, it's true: Sixty years after the end of World War II, Japanese militarism is surfacing once again -- this time in the form of assistance in fighting America's so-called "war on terrorism." Under pressure from the U.S., Japan -- the country that once suffered the atomic genocide of Hiroshima and Nagasaki -- has sent hundreds of young soldiers of its Self-Defense Forces to Samawah, Iraq, to help shore up the American occupation. Samawah is an area of Iraq recently found by former U.S. military scientist Dr. Asaf Durakovic to have high levels of deadly depleted uranium contamination from weapons used by the U.S. in its illegal March 2003 invasion of Iraq. The atomic bombings have come full circle.

Along with that, the arch-conservative Japanese government, using current Prime Minister Junichiro Koizumi as its frontman, is making all-out efforts to change Article 9. The reason? Ostensibly to make it easier for Japan to dispatch its military to any overseas location at any time without any say by the Japanese public. The new U.S. ambassador to Japan, a George W. Bush loyalist named Thomas Schieffer, has been explicit in his expectations that Japan's Self-Defense Forces play an even stronger role in helping America fight its so-called "war on terrorism" in Iraq. And Japanese Prime Minister Koizumi, backed up by the rising neo-conservative forces in Japan's government, are more than ready to bow to the demands of the warlords in Washington.

It is against this backdrop that vibrant citizens' movements have been growing recently in Japan to stand up and protect Article 9 from being changed in any way. People from all walks of life in Japan -- students, teachers, retirees, actors and actresses, labor union members, musicians, scholars, politicians, business owners, NPO volunteers, activists, authors and more -- are standing up together and making their voices heard in Japanese society in favor of protecting Article 9. These are thriving citizens' movements, where the real meaning of democracy can be truly seen and felt at local levels throughout Japan.

But we are far from being in the safe zone. Japan's corporate-dominated mainstream news media, like others elsewhere in the world, have mostly ignored these calls for peace. The Japanese government, under pressure from Bush and his neo-conservative cronies, is steadily chipping away at the war-renouncing clause of Article 9, with many in Japan seeing it as just a matter of time before Article 9 crumbles under the weight of U.S imperialism. The irony is that America was the one that helped give birth to Article 9, and now, nearly 60 years later, America may well be the one to kill it off.

That is why, at this crucial hour, many of us in these pro-Article 9 citizen movements in Japan see an urgent, immediate need to reach out to brothers and sisters around the world for solidarity and support -- not in the form of money but in the form of your voices and organizing efforts.

Let us use Japan's Article 9 for the reason it was originally created: to prevent future wars and stop militarism. Rather than helplessly stand by and watch the Peace Constitution of Japan die a quiet death 60 years after Hiroshima and Nagasaki, let us work together anew to spread the seeds of Article 9-type guarantees throughout the countries of the world. Yes, it can be done.

If your conscience moves you to do so, here are some practical, concrete steps you can take today:

* Find out more about Article 9. It is important as a first step to understand what Article 9 is, how it came about, why it has been an important part of world peace so far, and why it is worth protecting and spreading around the world. A web search will offer you a wealth of other websites providing useful information on Article 9.

* Sign a petition calling for the protection of Article 9 and for the withdrawl of Japanese military forces from Iraq. The petition has gotten off to a good start but the momentum must be kept going. Simply follow the directions in filling in the information (in English or Japanese), including your personal message to Prime Minister Koizumi. The sponsor of the petition, the Japan-based Global Peace Campaign, has pledged to deliver the voices of peace collected here to the office of the prime minister of Japan:

* Pass this appeal around to whoever and wherever you can. Every person who reads this appeal counts as a potential voice in support of Article 9 and for peace.

* Make contact. A few of the Article 9 movement organizations within and outside Japan are listed below. Make contact with them and let them know that you too are standing up in support of Article 9. Some of the Japanese sites don't have English webpages, but they all have e-mail contact listings. Don't let the language barrier deter you!

* Consider creating an Article 9 for your own country. Article 9 stands as a testament to the possibilities of peace for the entire world, not just for Japan. By replacing the words "the Japanese people" with your own nationality, you have the basis of a war-renouncing clause that can be applied to your own country's circumstances. Dare to imagine, if you will, what could happen in many nations of the world (especially the USA) if governments were legally bound to such war-renouncing clauses by their own citizens.

In closing, if the memory of millions of those who needlessly died 60 years ago in the rubble and ashes of a not-so-distant war are to mean anything, then this appeal on behalf of Article 9 must somehow be a beginning, not an end. If the voices of young people and old people today are going to mean something now, then let it be in defense of peace and prosperity for all people instead of war and wealth for the greedy few.

And if the voices for peace and peaceful prosperity everywhere are to ring out loudly in the future, then let it be a vision of tomorrow based on true brotherhood and sisterhood, not on concepts of "divide and conquer" and delirious dreams of global domination. We all live on the same Mother Earth and together we must find ways to keep on living here in harmony.

Consider giving true peace a chance by giving Article 9 a chance in our time.
