Justices question prison visitation policies

WASHINGTON: In a case that could affect the visitation rights of millions of prisoners, Supreme Court justices on Wednesday struggled with the question of whether inmates have a constitutional right to visits with friends and family.

Specifically, the question before the high court was whether Michigan violated that right when it imposed a restrictive visitation policy.

In Michigan, they put into effect stricter rules in 1995 to better protect visitors and to stop the smuggling of drugs and weapons. Minors who weren't an inmate's child or grandchild were no longer allowed to visit. Nor were former prisoners, unless they were immediate family. Inmates with two substance abuse violations in prison could have visitation privileges taken away altogether.

Deborah LaBelle, an attorney for Michigan prisoners, said the rules violated a constitutional right to intimate association by categorizing the people that inmates could have contact with.

"The question is whether it's reasonable to slice off family members," she said. "It is totally the prison's discretion as to what constitutes a family and who comes in."

Michigan's Solicitor General Thomas Casey argued that the state has the right to make sure prisons are safe and orderly by limiting visits.

Justice Antonin Scalia said Michigan isn't targeting prisoners' intimate association rights. But he suggested that prisons should simply limit the number of visitors and not choose categories if they want to maintain order. "The object is to reduce the number of children in the room, the number of visitors," he said. "Are we going to have to pass on, one by one, nieces, siblings, illegitimate children?"

But other justices seemed troubled by Michigan's policy and the lengths the state could go to. "You're thinking about cases where that's justified. You better think of cases where it's not justified but the prison wins," Justice Stephen Breyer said.

Aust Govt 'embarrassed' by Guantanamo Bay: Terry Hicks

The father of alleged Australian Taliban fighter [scapegoat for the Coalition of the Killing's illegal and degrading resource wars in the Middle East], David Hicks, says he draws hope from British Prime Minister Tony Blair's comments about inmates [prisoners] being held [tortured] at Guantanamo Bay in Cuba.

More than 600 men [scapegoats], captured during the [Coalition of the Killing's illegal and degrading resource wars in Afghanistan,] are being held as prisoners at the US navy base in Guantanamo Bay even though they have not been charged or declared prisoners of war.

Tony Blair has said they cannot be left in limbo indefinitely and he wants the situation to be resolved as quickly as possible.

David Hicks, originally from Adelaide, has been held without charge at the military prison for more than a year. His father Terry Hicks hopes Blair's comments put some pressure on the Australian Government.

"Well to me it doesn't suprise me at all that Australia remains silent," he said.

"I believe at this stage now that the Australian Government is embarrassed by the situation and they don't want to hear about it.

"The longer it's left and people forget, and it's swept under the carpet."

The United States has signalled it is rapidly losing patience with what officials term "very inflammatory" and "very biased" coverage by Arabic-language media of the US-led war in Iraq.

For the second time in as many days, senior officials at the normally staid State Department have complained that many Arab media outlets are distorting the facts and perhaps deliberately misinforming their audiences about US policy, tactics and aims in Iraq.

"I'm afraid many in the Arab press have been misconstruing things and inflaming things," spokesman Richard Boucher said. "All we ask is, frankly, a fair hearing, that they look at the various views, that they look at the facts, that they not jump to conclusions."

But all of that is a bit hard when someone is blowing your country to bits.

Mr Boucher referred specifically to two reports which have received wide coverage in recent days: a deadly explosion at a market in Baghdad which Iraq has blamed on a US missile and an alleged bombing of a mosque by US forces.

He says the mosque bombing never occurred, and the market explosion was still under investigation although the US military says it may have been caused by an errant Iraqi missile.

"There have been people in Arab language media who automatically assume that the United States was responsible for this and they are turning it into some kind of American atrocity," Mr Boucher said.

"We don't think it's fair to jump to that conclusion, we don't think the facts support it.

"It's entirely possible it was an Iraqi missile that came down in that marketplace."

Mr Boucher would not identify the offending media but says they are not limited to broadcasting outlets such as the Qatar-based Al Jazeera which was criticised on Wednesday by Secretary of State Colin Powell. "We got very interested in some print media the other day," Mr Boucher said.

No black-listing

A senior State Department official has told reporters although it is increasingly disturbed by the coverage, Washington has no intention of black-listing Arab media outlets.

The official says that shortly after Mr Boucher made his remarks, the spokesman was to appear on Abu Dhabi television and that Mr Powell, just hours after he criticised Al Jazeera, had given the network a live interview. However, the official says the United States is disappointed not only by "very inflammatory and very biased" coverage but by almost universally negative commentary which immediately follows interviews with US policy makers.

On Wednesday, Mr Powell said Al Jazeera was portraying the invasion of Iraq in a negative light and accused it of exaggerating small military achievements of Saddam Hussein's regime. "Al Jazeera has an editorial line and a way of presenting news that appeals to the Arab public," he said.

"They watch it and they magnify the minor successes of the regime. "And they tend to portray our efforts in a negative light."Mr Powell says he hopes Al Jazeera will report on US efforts to improve the lives of the Iraqi people as the conflict continues and after it is over.

Shoplifting and homelessness

Shoplifting increased by 7.5 per cent last year, making it the only major crime category to register a significant increase in 2002, crime statistics show.

David Johnson, a 19-year old who spent several years on the streets, and in and out of youth refuges, believes there is a direct link between social welfare benefits and crime.

"If they can't have any income, that's what they will do, they'll revert to stealing. As I was saying before, they're cancelling out all the rent assistance. They're cancelling out all the pensioner's payments," he said.

He worries the perception of more crime will result in putting more police on the streets, which will simply result in more harassment of young people while real crimes go un-addressed.

"It's a chain reaction kind of thing. No payments, more crime. More crime, more cops. More cops, more harassment. It goes back to the bloody payments, basically," he said.

He said he has never been imprisoned, but was given a warning over two counts of petty theft when he was younger.

"I just stole a packet of Tim Tams from the bloody corner shop. I didn't realise the camera was looking straight at me," he said.

For Jesse Karauwan, a former homeless youth who served time for 27 drug and theft charges, the solution isn't dole payments, but providing the young with incentives to find work.

"You get nine dollars or something if you're at [McDonald's] or something or anywhere else. I suppose you're young, fair enough, I mean, you shouldn't make that much more than someone who's older. But like if they gave some incentive for them to actually go and look for work.

A breakthrough came after a deal with the Democrats to reduce penalties for first-time offenders and for a taskforce to review the welfare penalty enforcement system.

The new measures will clear the way for a $900 million package of welfare reform, says Community Services Minister Amanda Vanstone.

"We had to make concessions in order to get it through but we wanted to make that investment in welfare," she said.

Greens Senator Kerry Nettle says the penalties are still too harsh and will harm those most at risk, causing "hardship, misery and homelessness".

Labor agrees and has accused the Democrats of thumbing their noses at the unemployed.

Aust militants join front line as Democrats propose anti-war Bill: Pre-emptive strikes?

Australian militants have been given approval to engage in front-line operations with American and British militia.

Federal Defence [War] Minister Robert Hill has revealed about 33 Australian militants are fighting on the front line.

That is in addition to the SAS militia who are already publicly known to be operating in Iraq.

Senator Hill says the soldiers assigned to allied forces are taking part in a normal exchange program. "They are professional military people," said Senator Hill.

"They are a part of these units as an exchange between countries, US and British forces and ours in the Australian Defence [War] Force, and when they go into operations, ours tend to go with them."

Senator Hill says the events overnight which led to the death of 14 Iraqi civilians are a tragedy.

The civilians were killed by explosions in a residential district of Baghdad. US officials say the cause of the incident is still unknown. They deny targeting the residential area in which the civilians were killed.

A Pentagon official is reported to have said he is not sure whether it was a US air strike or Iraq weapons fire that fell back to ground.

Senator Hill says on the whole, the war is proceeding with an unprecedented lack of civilian casualties. "Now that we have the capability to use precision weapons it is possible to significantly reduce civilian deaths and injuries and we're making every effort to do so and I think most objective observers would recognise that."

But if you take into account the deaths we're not told about then Hill ought to be charged and taken to the war crimes tribunal.

The Democrats want laws changed so Australia's involvement in any military conflict in the future requires parliamentary consent.

The Democrats hope to introduce a bill to that affect in the Senate today. The current war is the first time an Australian Government has committed militants without the majority support of the Parliament.

Democrats Senator, Natasha Stott Despoja, says that is not acceptable.

"I believe after this conflict there will be a movement," said Senator Despoja.

"There will be many Australians who expect that right as citizens and there will be parliamentarians who want to ensure that our troops [militants] are never deployed again to a theatre of war without the support of at least one other party."

The New South Wales Premier is yet to convince at least one of his long-standing ministers to stand aside to make way for new blood on the front bench.


These people are filthy, politicians. Eddie Obeid, who should be jailed for lining his pockets at taxpayers expense.

The other, Richard Amery an ex policeman. For, having no regard for his duty of care as minister for prisons towards prisoners in custody.

In fact it is claimed Amery, has at times acted in direct contravention of the human rights of prisoners by impeding their rights in custody, as you would expect, when the fine line between prisoners in custody and police is broken-down. Contamination, sets in between the Force and Retribution?

The row may yet be decided by a ballot in tomorrow's meeting of the ALP caucus. Bob Carr spent yesterday trying to persuade two of his ministers Eddie Obeid and Richard Amery that their time on the front bench is up, and that they should go graciously, allowing a number of new faces to fill their spots.

Carr later said he was pretty close to reaching a consensus position with the resisting ministers after having what he described as "amicable" discussions. I think we're moving towards a consensus," he said.

"I wouldn't go so far as to say no ballot but I'd like to work through and get that consensus."

But the ABC understands that while Mr Obeid has reluctantly agreed to stand aside, Prisons Minister Richard Amery is not about to give in voluntarily. He wants his future decided by a vote of fellow MPs at tomorrow's meeting of the ALP caucus.
