Adler faces jail disciplinary charges?

Rodney Adler will face disciplinary charges for allegedly carrying out business activities from jail after the prison authorities illegally scanned his mail in a minimum-security prison in breach of the Federal Postal Act.

After rotten ron woodham the commissioner of Corruptive Services who works for the corrupt injustice minister john hatzistergoose, who incidentally works for the corrupt premier bob carr, the longest serving dictator in NSW history, passed on the alleged contraband mail to the Australian Securities Commission for corrupt 'prospects'.

The Australian Securities and Investments Commission (ASIC) decided there was no breach of the Corporations Act.

So what was all the fuss about really?

PUNISHMENT!

Mr Adler was transferred from the Kirkconnell minimum-security prison in New South Wales to a higher security prison last weekend after allegations he was secretly carrying out business while pretending to help his children with homework.

ASIC says despite being banned from managing a company for 20 years, seeking company reports is allowed.

Double Jeopardy

But NSW injustice minister john hatzistergoose now says Adler will be presented with disciplinary charges shortly and given a chance to plead in front of the governor of Bathurst jail without legal representation.

WHAT A BONUS TOWARDS AN INJUSTICE PACKAGE!

Not a Judge mind you or even a Magistrate he's got to beg the jailer for mercy AFTER HE'S BEEN SET-UP? After he's been victimised and set up on a false and misleading charge. Does someone owe him or what?

Hatzistergoose: "And it does also allow him an opportunity to examine any witnesses the department may call in relation to the issue," he said.

ACTUALLY I'D CALL rOTTEN rON wOODHAM bOB cARR and jOHN hATZIZTERGOOSE!

HOSTILE? MABEE!

He says while there could be withdrawal of privileges any change to his sentence would be up to the Commonwealth.

But only a couple of days ago the daily terror reported it was segregating Adler in a protection wing.

bob carr says the state's prison officers deserve to be congratulated for being on top of Adler's dealings in jail.

But that's rubbish in the highest order and bob carr should hold his head in shame, re-order his prison guards to do their job properly instead of setting upon and setting up prisoners who are disabled by being in custody.

This is a well-planned political attack and at all material times bob carr having complete knowledge that they have Mr Adler in their full control, 24/7.

Therefore bob carr must take full responsibility for his injustice minister. So should his injustice minister stand down, and his cronies in the prison system given better instructions about how to do their job properly - instead of going about bullying and illegally reading other peoples mail to find alleged examples of contraband, just to mess people up, for political pay backs!

bob carr's filibustering to the community about his pre-emptive radical plan should be recognised for what it is, not what he makes it out to be, after all the evidence supplied to (ASIC) was flawed.

To even be tried again by the governor of the prison is an abuse of process and systemic abuse at that. carr says he thought Adler would have learnt his lesson by now and says he is being treated like any other criminal in jail?

Actually I think it's time bob carr learnt his lesson, that you can fool some of the people some of the time but you can't fool all of the people all of the time. And the very reason he comes undone here is that this is a re occurring pattern that his government has used against high profiled prisoners time and time again!

"The message I want to send is that Rodney Adler in the prison system is going to be treated like any street pickpocket," carr said.

"He's not going to get any special attention or privileges, taking account of his previous status as a high flyer in Sydney and I think the system is asserting that."

And that's why the prisoners keep coming back to jail because whilst they are there minding their own business doing their time they are being manipulated to the point of frustration and being negatively reinforced in prison for trying.

Provided Mr Adler is left alone to serve his time he has the skill to get out of the place and never go back. But unlike so many other prisoners who lack those skills they have virtually no chance at all!

Clearly what the evidence 'shows' in this case should set an example, that what the 'system' is asserting is the corrupt power of the State over those held in custody. Whereas the State prison system should at all material times have a duty of care and rehabilitation to prisoners.

Was Rodney Adler Set-up in prison by a person or persons unknown?

NSW: Sydney businessman Rodney Adler has been transferred to a higher-security prison as punishment for allegedly attempting to conduct business activities from jail even though people are sent to prison for punishment not to be punished?

But Rodney Adler is most likely being punished by someone else and this is just an excuse made up by the Department of Corrective Services Commissioner, Rotten Ron Woodham. Possibly for and on behalf of another person or persons unknown [politicians, NSW Parliament House.] Someone who resides outside the prison but who has links with the authorities and or Ron Woodham himself who can pull the strings and make the necessary arrangements.

If you ask me it would most likely be a government minister who's pushing the buttons but only an independent enquiry may discover the real facts.

So unless Rotten Ron can point us to the proof and then make that proof public then I wouldn't rush out to buy the departments story!

High profile prisoners in NSW have been mistreated like this now for some time and there is ample evidence of it in numerous cases including that of Ivan Milat and Phuong Ngo.

Where the Norm is Not the Norm: HARM-U

One case in particular that went before the Supreme Court of NSW R v Georgiou, 70317 of 2001, (1 December 2003).

The triviality of the alleged 3 phones he was suppose t have is only half the story - the Department could not factually verify that Georgiou ever had phones in his cell, had never investigated the matter, and had never charged Georgiou for such an offence.

Further, when examined by James J, John Salway for the Department conceded that he was 'not sure' whether the Commissioner had designated Georgiou because he constituted an extreme danger to other people (cl 25 (2)(a)), or because he constituted an extreme threat to good order and security (cl 25 (2)(b)), or both.

However, the Department and the prosecution were not finished -- there was another reason for the designation: 'Yes your Honour. On the basis of risk, perceived risk of escape, for the good order of the institution.'18

Unfortunately for the Department, or rather unfortunately for Konstantinos Georgiou who has now spent more than 16 months in the HRMU, the Department has never classified Georgiou as an escape risk.

Of course, for an E1 or E2 classification to be made pursuant to cl 24 Crimes (Administration of Sentence) Regulation, evidence would need to be tendered -- an unnecessary obstacle to Commissioner Woodham when designating 'high risk' prisoners.

However, as it became obvious to the court that Georgiou's placement was baseless, Mark Phillip Wilson tendered in affidavit:

The Department of Correctional Services says Adler was at one stage caught in such an attempt while pretending to help his children with their homework.

Adler is serving a two-and-a-half year jail term over the collapse of insurance company HIH and has been banned from acting as a company director for the next 20 years.

He was serving the sentence at the Kirkconnell prison camp but has now been moved to Bathurst Correctional Centre.

The Correctional Services Department say they have forwarded a report on his conduct in prison to the Australian Securities and Investments Commission and the Commonwealth Director of Public Prosecutions for further investigation.

But Similar claims were made by the Department of Corrective Services that police were going to interview Ivan Milat over some allegation but that never happened all that happened was there was a 'media release'?

So these authorities should forward the same report to an independent person or body to verify the claims they're making and if they don't show proof then they must come clean about what this matter is really about. And whether in fact this complaint was initiated by someone outside the prison.

Most prisoners of the Adler class would not get into any trouble in the prison system unless provoked or incited by the system itself or another less educated prisoner.

In memory of the late Bob Jewson

Bathurst Prison

We was sad to hear that Bob Jewson had died recently after a battle with cancer. That is all the details I have; apparently there was no funeral at his request. Others may know more.

Some will remember that Bob was In the Bathurst riot in February 1974 and was a leading member of the Prisoners Action Group now - (JusticeACTION) upon his release.

He wrote Stir, the screenplay upon which the film Stir was based. He played a major role in agitating for a Royal Commission into the events at Bathurst, and when the Nagle Commission commenced hearings Bob was to be found every day sitting in court for the duration, following proceedings for the PAG.

His experience, insight and detailed knowledge of the events at Bathurst and elsewhere were not only utilised to brief PAG lawyers but were regularly fed through to Counsel Assisting the Inquiry and other lawyers enabling them to follow lines of questioning they may have missed and to more effectively unravel the Bathurst cover-up.

In my view Bob Jewson was one of the unsung heroes of the Nagle inquiry, a sort of unofficial (and unpaid) prisoners'/peoples' Commissioner, keeping the bastards honest.

The Nagle Report has Bob's fingerprints all over it, particularly the sections on Bathurst 1970 and 1974.

He was the author of "Bathurst Gaol and the Royal Commission into Prisons - A Summary by the Prisoners' Action Group" which was published by the PAG in the Alternative Criminology Journal vol 2 no 3 feb 1978.George Zdenkowski in the editorial to the issue remarks that:

"This summary has been prepared by PAG member Bob Jewson - the only full-time unofficial observer of the Royal Commission. It will be clear to the reader that the approach has been low-key. Much of the material is drawn from the transcript of the proceedings. Indeed, a good deal of the condemnatory evidence emerges from the Department of Corrective Services' written submissions or from the lips of its representatives.

Bob's rationale is: why condemn the brutality, the intransigence, the rejection of conciliatory initiatives by prisoners and the duplicity when the official words and actions do it all by themselves."

People who knew him will remember an extremely kind, gentle and generous man, angry at injustice and motivated to attempt to reveal and correct it. He had a good eye for detail and a grasp of and love for the
Australian vernacular.

May he rest in peace. Let us raise a glass to Bob and remember him and his contribution to the prison struggle.

He became the first witness to give evidence against 10 prison officers and a prison doctor concerning the systematic illegal bashings of prisoners, triggering a chain reaction leading to the Nagle Royal Commission into NSW Prisons and the subsequent end to such institutionalised bashings. To those like Brett Collins of Justice Action who know first hand the circumstances at Bathurst at the time, Nye was "a warrior," a defiant and determined man who would not accept the brutal system and other human rights abuses that were ingrained in the NSW prison system.

High Risk Management Unit (HRMU) INSPECTION
The Special Care Unit (SCU) at Long Bay Correctional Centre was inspired by Barlinnie. The SCU was opened in 1981 to replace the Observation Unit, which was strongly criticised by the Nagle Report. The SCU was closed in 1997 because of lack of record-keeping which could give a measure of effectiveness. The SCU was replaced by the Four-Stage Violence Prevention Program, which is housed within the Metropolitan Special Programs Centre (MSPC). The former Inspector General for NSW, Lindsay LeCompte commented, "At the Metropolitan Special Programs Centre (MSPC), for example, the Department has achieved considerable success with the programs that are being delivered there, due to the ability of that centre to concentrate its efforts and resources on focused strategies."
