I firmly believe Ivan was framed

I believe this is a monumental frame-up similar to that of the Hilton Bombers in the 60s and it is politically motivated. There has been political interference at every level of Ivan's various appeals. I believe it is no co-incidence that Ivan lodges yet another appeal and suddenly the negative publicity appears in the media.

- some of my reasons......

1. The Bennetton top allegedly taken from one of the victims was purchased from a Sydney retail outlet. This evidence was known to both the crown and the defence.

2. Property belonging to Simone Schmidl were taken from the home of a Ms Murphy at Guildford.

3. Property belonging to Simone Schmidl was found at Bright, Victoria. Some of these items were later found at the home of Ivan Milat. How they got there should be a matter for the Police Integrity Commission.

4. The blue daypack allegedly belonging to Simone Schmidl discovered at Walter Milat's home could not have belonged to her. A family photo of the backpack at Walter's home was taken prior to Simone's death.

5. Arresting detectives were captured by the television news carrying fully formed cartons into the Milat home.

6. Ivan and Richard Milat explained to police the origin of some items at both their homes. Backpacks held up in court, as 'evidence' appeared to be new and unused. Statements that those brands could only be purchased in Europe were fabrications.

7. Simone Schmidl's mother was not examined nor a statement taken from her regarding certain items that she had earlier identified and were found in Victoria.

8. The incompetent handling of the DNA evidence was detrimental to the defence case. No description was led as to the colour of the hairs found in the hand of one of the victims. Recent re-examination of the DNA evidence has cleared Ivan Milat and all members of his family. This should be making headlines - but still Ivan Milat remains incarcerated.

9. The loss of Paul Onions' original statement coupled with the original Joanne Berry statement raises suspicions. These statements were made at separate police stations. Neither the police nor the witnesses retained a copy of the original statements. This is suggestive that there was hiding or destruction of these documents. In his original statement Paul Onions had described a man around six feet tall with a spare wheel mounted on the back of his car. This does not fit the description of Ivan Milat at all.

10. To depict sightings by credible witnesses as false was designed to undermine and mislead the evidence that supported a different pattern to the police theory.

11. The police failed to video record the search of the Milat residences. This reflects on the integrity of the police searches.

12. If the second statement by Paul Onions was so credible, why was Ivan Milat not arrested sooner?

13. Only one item of evidence was produced with a fingerprint on it. For the police and crown to suggest that Ivan wiped all of the items free of prints or wore latex gloves was ludicrous considering the amount of property concerned.

14. Forensic evidence showed neither the Bowie knife or the blunt sword found at Ivan's mother's place could have been used in the attacks on the victims. Of all the guns seized from Milat family members not on of them was ever fired in Belanglo Forest. Ivan Milat maintains a Ruger rifle part was planted in his home and recent sackings of corrupt police suggest they were indeed capable of such acts.

15. A vital witness, Jock Pittiway, gave Alex Milat a backpack. Pittiway also gave a trailer load of items to Richard Milat. Pittiway should have been investigated by police.

"Ivan Milat was not the only suspect in this case. There were other suspects, in particular one from Wollongong of European origin whose children saw him doing suspicious things. The man from Wollongong had a long history of violence against women and many criminal convictions including convictions for paedophilia. He was obsessed with guns and had been in the armed forces overseas. He looks not unlike Ivan Milat in appearance and is of similar build. This particular suspect's car was seized by Task Force Air and human bloodstains were found in the back. If police really want to reopen the case they could start by comparing his DNA with that found under the victim's fingernails." - JULY 19th, 2005

When the children started to talk to the counsellors, they began to tell more and more of what had been going on. They had confidence that they were safe and were believed. They said that their father had picked up hitch hikers and had killed them by stabbing and mutilating them. He had made the children help him put the body parts in plastic bags and take them to the bush.

The counsellors called Wollongong Detectives and my children were interviewed. I was not present during the interviews. Meanwhile the bodies of the murdered backpackers were found in Belanglo Forest. The bodies were buried east-west and each one had a circle of stone beside it. These are occult symbols. A stone altar was found in the forest but quickly dismantled by police who did not want public panic. An investigative journalist, then of the Illawarra Mercury and now of the Bulletin, confirmed some of these things. I got in touch with him and told him our story.

My children had stated on occasions their father had killed people both by shooting them and by stabbing them over and over, in the presence of many other people, probably in some kind of occult sacrificial ritual. The people found dead in Belanglo had been killed by the same method, and there were occult overtones.

Ed: There is so much nonsense in this case some people believe Bob Carr has over-baked his cake. One wonders whether he'll eat it as well? A good start would be to give Ivan a fair appeal and stop filibustering by not providing him legal aid or assistance, considering this is the worst of the worst cases. The people of this community deserve to know the truth, the whole truth and nothing but the truth so help me God. Only after that process has finished should the Daily Terror continue to bring forward alleged witness who claims otherwise like John Garrihy today and John Marsden last week. Equally if you follow the links there appears to be many other witnesses that the Daily Terror have failed to report?

I am disturbed by Governments 'actions' in relation to shuffling the police service. Clive Small seconded into Parliament like a cocky in a perch. A breach of the fundamental Separation of Powers Doctrine does not in my view allow the thought of intervening, planning, or shuffling to stack the deck of our police service. The one that suppose to be autonomous according to Lord Denning. Where the Parliamentary Secretary can ask the commissioner of police to 'report' then sack him if he is not satisfied with such report.

Truth
Who is telling the truth? Well I guess Dr. Ed. Chadbourne or Mr. Peter Ryan may have the answer to that. Dr. Chadbourne sacked by Peter Ryan and more specifically in my view because he elected deputy commissioners Dave Madden and Andrew Scipione as the best men in the service in relation to his qualifications to make a recommendation in his capacity as human resources.That is if you believe that a Dr. can be corrupted.

Honesty
What is happening between the Police Service and politics is quite extraordinary at the moment. If stand over tactics don't work tell half the truth honestly and follow the example of sheep. Another word for it is sleaze, yeah. Another word for it is workplace harassment. Another word for it is bribing a Police Officer. Another word for it is misleading Parliament.

Lord Denning
Interesting how a member of the Police Board Mr. Tim Priest would hold grave fears for his safety from dangerous senior police but fails to name them or have them sacked. Rather Priest resigns as if he had no powers. Could that mean what he was saying is that the Governments are also corrupt?

Corrosive
Clive Small is Bob Carr's choice for the new Police Commissioner. It could only be the case considering his, Small's special appointment into Parliament House. Small who suffers from the little person syndrome is the ideal bend over boy who gets shuffled through his corrupt actions. Rolling the legal system for him after the fact, just like his predecessor Roger the dodger Rogerson.

The Premier, Bob Carr, relies on a militia. A gang of bikies and our Police Service, to show all of us he is no murderer. He should be taken to the task along with his partners in crime like Clive Small to account for those people who like my self have been maliciously assaulted and who have complained, without any service and those who cannot speak for themselves who were murdered, like Terry Falconer. Miscarriage of Justice: Ivan Milat

I have made it abundantly plain in my 474 review application to the Supreme Court that the issues are a continuation of the effort which I have mounted since my conviction on 27 July 1996.

The 474D adequately lists my issue.

What I am trying to express is that the appeal process has never properly considered my appeal issue, I had before the court of Criminal appeal (The CCA), argued that a number of procedural faults had occurred in my trial that caused a substantial miscarriage of justice. In short the trial judge erred in law when he directed the jury to act upon evidence that had not been established by the crown.

There is repeated authority on that issue: That the crown is obliged to establish the circumstances he relies upon as proof of guilt and to establish that proof to beyond a reasonable doubt.

The CCA instead of addressing the substance of my argument covered up the miscarriage of justice that occurred in my trial.

The CCA instead of addressing the legitimacy of the trial judges decision "in directing the jury to act upon evidence not established by the Crown." (which was the appeal ground I raised).

The CCA evaded the real issue I put before them by introducing factors that were only marginally connected with the appeal issue and the CCA harped on that issue rather than the real point I raised. Actually I am surprised that no one in the legal profession takes any exception to the ground of appeal I raised. I have repeatedly told legal professionals what occurred and I cannot elicit any comment.

Most people appear to think once I got arrested-charged with Belanglo that alone meant I was guilty. The producer of the ABC program 'Australian Story' was awarded a logie for that particular story.

They contacted my friend before hand and he watched the show. They told me that award night the producer said on air, "There is still time Ivan to come clean about it ". Well actually I already had, before the program was aired-during its production.

I wrote a number of letters outlining my case and answers to the questions and in particular I outlined my appeal grounds and the cover up by the CCA and following that the subsequent cover up by the High Court.

In all the appeals I have made to the CCA and to the High Court on the issue I now still continue to pursue, the appeal courts do not refer to authority to address my ground.

The CCA at the hearing and in their judgement come up with a number of reasons to explain why the two crown witnesses Mr Onions ad Mrs Berry were mistaken about seeing the spare wheel.

The CCA came up with approximately six pages of reasons why the witness, Mr Onions and Mrs Berry must have been mistaken, (non of which was evidence at my trial).

But the CCA did not address my appeal ground, "that two witnesses Mr Onions and Mrs Barry gave their evidence in court on oath, that evidence confirmed in cross examination that the crown closed its case in chief and I replied to that crown case and only later after the close of evidence the crown says that witnesses must be mistaken. The trial Judge in turn, "they can correct me on the basis that the two witnesses were mistaken" or alternatively you can convict the accused on 'Possibility Two'.

The Jury were given two directions in law, on the evidence they could consider was proof of my guilt, The rule of law is that evidence has to be established by the crown. Of course the trial judge can express his opinions on the evidence but it still has to be established by the crown.

The Jury are entitled to accept/reject any part of a witnesses evidence (all those reasons the CCA raised to dismiss my ground - was not evidence the crown adduced in the course of the trial).

I was obliged to address the allegations the crown levelled at me in open court, I did that. The defence did not dispute the evidence of the vehicle given by the witnesses. The crown did, but only parts that did not establish my guilt. But that was not the evidence that the witness gave in court.

The crown did not re open its case in chief on this issue to call evidence, to rebut the evidence. It cannot be a case that the trial judge decides that this is the evidence of guilt yet that is what happened.

The CCA knew exactly what I was on about so Gleeson CJ and his Co Judges covered it up.

My appeal to the High Court was against the CCA decision the High Court ruled, "There is no doubting the correctness of the decision of the CCA".

The issue I raised in the 474D is indicative of my innocence. The issues in the 474 raises serious concerns at law. The appeal courts can deal with appeals from unrepresented prisoners affidavits.

I am having difficulty in getting assistance from the government though; I may add there is still no charges at all on issues I first raised when I came to the HRMU. [High Risk Management Unit Goulburn]

Ed. The Daily Terror should leave IVAN Milat's sister Shirley Soire alone. Deliberately using Mr John Marsden solicitor to validate some wild claim - the notion that she helped hunt and execute seven young backpackers in the Belanglo State Forest south of Sydney between 1989 and 1992, is nonsense!

Shirley died two years ago and was cremated at Sydney's Rookwood crematorium, may she rest in peace, God love her.

The entire jury pool is already contaminated, the general public have accepted the verdict of the Northern Territory News and the NT Police State has turned on the cone of silence. Maybe some of the reporters might want to ask Director of Public Prosecutions Rex Wilde QC just how he is going to secure a conviction when a body has not been found. Surely the NT bureaucracy learnt from the Lindy Chamberlain case that it is not a good idea to jail someone for murder when you haven't got a body. Maybe they have the same people working on the case. The NT Police forensic team certainly do.

An elderly man's claim that he retrieved the infant's bloodied body from the jaws of the wild dog has revived the case and - if true - could finally lead to the discovery of Azaria Chamberlain's body.

Even if it were down by half on the previous year they're still greedy self-interested people who care little about the real damage done, not just in Australia but the world. That profit is obviously on top of wages and expenses yet they're still greedy enough to turn the news upside down to suit the Howard government's investment in advertising.

MILAT WAS FRAMED FOR TOURISM $$$$$

AND THE WINNER IS? NOT IVAN MILAT!

The bodies of seven backpackers were discovered at the Belanglo Forest in 1992. The victims were German, British and Australian origin.

Australia at the time of the discoveries was well advanced in its bid for the Olympic Games to be held here in year 2000.


The murders were headlines overseas. The State government's public relations machine swung into action. An unprecedented $500,000 reward was offered for the heads of the perpetrators. (Commonsense says there was more than one assailant). Head of the International Olympic Committee, Juan Samaranch, was questioning whether Australia was a safe place to visit.

During 1989, a British backpacker, Paul Onions was the victim of a botched hold-up on the Hume Highway near the Belanglo Forest. Onions gave a lengthy and detailed description of the robber to Bowral police. The statement Onions gave to police at that time has not been seen since. The description of Onion's attacker, according to some surviving police notes would exonerate Ivan Milat from the crime. Onion's, at Milat's trial, swore that Ivan Milat was the man who attempted to rob him.

Milat was arrested at his home on 24th May, 1994, by a posse called Task Force Ayr from Chatswood Police led by Clive Small.

Among items seized from Milat's home was a part of a Ruger rifle. Some years later, acting on information police dredged up a sway of guns and gun parts from the Hawkesbury River. It is easy to believe that these items had been, or would be used as "throwdowns" in frame-ups. A Ruger rifle had been used to kill the victims at Belanglo.

At Ivan Milat's trial justice was not seen to be done. An old Victorian court was refurbished at a cost of $750,000. There was only space enough for 35 members of the public. The press and other media sources were "duchessed". Representatives of the overseas media were well in attendance. Australia by the time of Milat's trial had won the right to stage the 2000 Olympic games. The show trial needed to show the prospective International punters that Australia was a safe place to visit.

The press and electronic media have not let up on Mr Milat. Nor will they.

The powers cannot have the truth known as to why Ivan Milat was framed.
