Bone marrow donors risk DNA identity mix-up

IT SOUNDS like an open-and-shut case: a clear DNA match is made between semen from a serious sexual assault and a blood sample from a known criminal. Yet in a recent case from Alaska, the criminal in question was in jail when the assault took place. And forensic scientists had already matched the crime sample to the DNA profile of another person who was their prime suspect. It was only after careful detective work that the mystery was solved: the jailed man had received bone marrow from the suspect many years earlier.

This week, at a meeting of the American Society of Human Genetics in Salt Lake City, Utah, Abirami Chidambaram of the Alaska State Scientific Crime Detection Laboratory in Anchorage described the case to highlight the danger of miscarriages of justice.

Given the retribution that can be doled out to sex offenders by other jail inmates, the consequences could be severe. "If you implicate the wrong person, they can be killed in prison," says Chidambaram.

When Chidambaram discovered the perplexing match, she initially thought there had been a sample mix-up. But there was no mistake. What's more, the jailed man and suspect shared the same surname.

Because medical records are confidential, a detective had to make further enquiries among family and friends of the two men. That revealed that not only were the convict and suspect brothers, but the inmate had received a bone marrow transplant from his brother. As a result, his blood was populated with cells bearing his brother's DNA profile.

It's an instance of life imitating art: in November 2004, US TV channel NBC broadcast an episode of Law and Order: Special victims unit in which a rapist nearly got away with his crimes because of a similar bone-marrow mix-up.

The chances of cases like this arising are very low. But as forensic DNA databases expand, and more people undergo marrow transplants, the risk of a miscarriage of justice will increase. "It makes sense for investigators to be savvy to this," says David Lazer of Harvard University, who studies the policy issues surrounding forensic DNA testing.

Until recently, bone marrow transplants involved destroying the patient's own bone marrow. In such cases their blood will contain the DNA profile of the donor alone. But some treatments in recent years, such as therapies to treat sickle cell disease, retain some of the patient's original bone marrow, so their blood can contain a mixed DNA profile.

Mixed profiles can also occur when DNA is collected from swabs taken from the inside of the cheek, rather than blood samples. This practice is already standard in the UK and is increasingly being used by US police.

Cheek cells of a bone marrow recipient will contain mostly their own DNA, but can become contaminated with the donor's DNA over time. So police may have to check both blood and cheek samples to be sure of spotting a transplant recipient.

Lazer believes it would cost too much to routinely check both types of sample to confirm whether a suspect has received a bone marrow transplant, and Helen Ng, spokeswoman for the US National Marrow Donor Program, based in Minneapolis, stresses that it would happen only very rarely. "I hope it doesn't prevent people giving patients what they need," she says.

But Chidambaram argues that potential marrow donors should be informed of the small risk of their DNA profile turning up in a crime database if the recipient later commits an offence.

Les Kennedy Daily Telegraph reported today that" Prisoners who believe that DNA will prove they were wrongly convicted will have the chance to prove their innocence for a mere $20 administration fee. The move comes 20 months after NSW inmates were asked to provide DNA for comparison with a databank of DNA from unsolved crime scenes for possible convictions.

'Son of Star Wars' flight test delayed again, yippee!

Big bang: Tests have produced all the results in the Universe without that 'SON OF A BITCH'!

The Pentagon has again delayed a flight test of a ground-based missile defence, [war], system, this time until late November, to replace a malfunctioning flight computer, a spokesman for the controversial program has said.

It is the latest in a series of delays that has halted flight testing of the system, known as 'son of Star Wars' also known as that 'Son of a Bitch', since December 2002 and pushed the next test beyond the November 2 US presidential election.

The military still expects to move ahead with deployment of a rudimentary missile defence, [war], system in Alaska by the end of the year, Missile Defence, [war] Agency spokesman Rick Lehner said. "There is no impact because this test isn't tied to beginning operations," said Lehner.

Air Force militant General Henry Obering, the MDA's director, decided to postpone the flight test on Friday because technicians had been unable to determine the root cause of an anomaly in a flight computer used to send back telemetry data during a test, he said.

Replacing the equipment involves sending the missile interceptor, which has been at a test site in the Marshall Islands in the Pacific for months, back to the United States, according to Lehner. Obering decided that since "there is no rush to do the test, it is best to take our time with this".

Flight tests, which involve firing the interceptor missile from Kwajalein island in the Marshall Islands at a target missile launched from California, each cost an estimated $US100 million. The program has a $US10 billion budget this year.

Critics, however, have charged that the Pentagon is fielding the system without adequate testing.

The MDA has so far deployed two interceptor missiles at Fort Greely, Alaska and plans to deploy three more by the end of the year, allowing it to declare "initial operating capability".

Plans call for having up to 20 interceptor missiles at Fort Greely and Vandenberg Air Force Base in California by the end of 2005.

Since the malfunctioning equipment is test equipment, no changes have to made to the already deployed interceptor missiles, Lehner said.

Australia signed up to Washington's controversial "Son of a bitch" last year.

Russia warns on US son of starwars: 'son of a bitch'

Russia says a United States deal with Denmark to upgrade a radar in north-western Greenland has raised fresh security concerns over Washington's planned missile defence shield, known as son of starwars, ['son of a bitch'.]

They've-got-a-sword that looks like-a-flash-light. The-chick-with-the-ear-muffs-and-the-old-decrepit-man-and-the-gold-en-dro-o-oid-ta-a a-alks-too-much and the-blue-one-loo-ooks-like-a-trash-can.

The deal signed on Friday allows Washington to upgrade the Thule radar to use it in a chain of similar US installations stretching from Alaska to Australia designed to avert potential missile attacks against North America.

In 2001, Moscow bowed to a US decision to abandon the bilateral 1972 Anti-Ballistic Missile Treaty and develop a missile defence, [war], system after Washington said it wanted to defend itself against strikes from states like Iran or North Korea.

"The United States has more than once assured us that the future missile defence, [war], system will not be targeted against Russia," the Russian Foreign ministry said in a statement.

"However, the very geography of the radar in Greenland gives us reasons to think that even at this stage the US missile defence, [war], could potentially threaten Russia's national security."

Reports earlier this year that Washington planned to deploy elements of its missile shield on the territories of new NATO members in Eastern and Central Europe alarmed Moscow.

"Russia will carefully analyse the situation from the point of view of its own security and reserves the right to take all appropriate measures to maintain it on an appropriate level," the ministry statement said without giving any details.

The Russian military has said it does not believe the US missile shield will be effective and said it will not be a major security problem for Moscow in the next 25-30 years.

The International Institute for Strategic Studies (IISS) has issued a commentary on the impact of missile defence, [war], in Asia. The Institute says China's strategic nuclear forces are not vulnerable to US military action. Instead, the commentary says China's shrill hostility to the anti-missile program is almost entirely political, based on worries about America's global power.

The IISS says Beijing fears that America could give ballistic missile defences to allies in Asia to contain China.
